Man wants Mugabe portrait removed from courtroom

Richard Mangena from Chitungwiza has filed an urgent application at the Constitutional Court to have President Robert Mugabe’s portrait removed from a courtroom where he appeared on assault charges.

In the application, Mangena cited a magistrate, Witness Mtetwa, the Judicial Services Commission, the Acting Prosecutor General, Ray Goba and the Attorney General, Goba and Attorney-General Prince Machaya as respondents.

He appeared in court on March 7 after being arrested for alleged assault, but insisted that he would not be tried in a courtroom where Mugabe’s portrait hung behind the magistrate.

In his application, Mangena argued that the set-up compromised judicial independence.

“This is an application for stay of the proceedings in the Magistrates’ Court while this honourable court determines my application for access and, should the court grant access, my constitutional challenge,” he said.

The matter is urgent, as I am now at imminent risk of being tried and possibly being sentenced at a time when an application seeking to challenge the constitutionality of the proceedings under which I am being charged is pending in this court,” reads Mangena’s application.

Mangena insists that by maintaining Mugabe’s portrait in the courtroom, his constitutional rights are being undermined, adding that the court might be deemed improper for associating with Mugabe’s picture.

“The appearance of independence is indispensable to maintaining public confidence in the judiciary system.

“For this reason, members of the judiciary are not only prohibited from accepting bequests and gifts which may influence their judicial conduct, but also those that give the appearance of judicial impropriety.

“Therefore, it is my submission that the courts must not only be independent and impartial, but they must be seen to be independent and impartial (by not associating with the portrait,” he said.

$1m vehicles for police to deal with “shameful agents of regime change

The Zimbabwe Republic Police (ZRP) has purchased vehicles worth more about $1 million to deal with threats to law and order, including demonstrators who government views as agents of regime change.

The vehicles include buses, utility trucks and traffic enforcement cars that will be deployed throughout the country.

The fleet includes two buses, 25 Ford Ranger single cab trucks and 28 traffic enforcement Ford Fiesta B-Cars.

Fleet reinforcements come after police were stretched by restless citizens who have been demonstrating against corruption, unpopular policies, a worsening economy, human rights abuses and rising poverty.

Human rights defenders, diplomats and political parties have loudly complained against police heavy-handedness as they reacted to the protests.

Local and international critics recently warned the International Monetary Fund (IMF) and World Bank against resuming direct lending to Harare, fearing President Robert Mugabe’s government could use the money to undermine human rights.

Police chief, Augustine Chihuri said the vehicles were necessary to maintain peace and to deal with civil disobedience.

Peace is just like a balloon, once perforated, no matter how small the puncture may be, it becomes useless and a candidate for the trash-bin.

“This is the reason why we get extremely perturbed when criminally-minded people take peace for granted, juggle with it and putting unnecessary dents on it,” he said at the commissioning of the vehicles.

“We always stand ready to lawfully and decisively deal with criminal malcontents, who quite often, are drenched in sheep skins when in actual fact they are shameful agents of the tired crusade of the illegal regime change agenda in Zimbabwe. The law will indeed be applied squarely, fairly and without fear or favour,” Chihuri said.

“It is no doubt that this new fleet of vehicles will go a long way in enhancing your efforts in maintaining law and order, in particular, enforcing good behaviour by road users,” Ignatius Chombo, the minister of Home Affairs under which the police falls, said at the commissioning of the vehicles in Harare on Tuesday.

Chihuri added that the vehicles would help improve police visibility and deter law breakers.

“Consequently, with these additional vehicles, the government has obviously extended to us the armour and ammunition to swiftly respond to the demands and dictates of policing services,” he said.

Even though he said the police fleet was ageing, the law enforcement agency has every year bought state-of-the-art vehicles, with most of them going to the top cops.

Suspicion is high that the police are using money obtained from roadblocks to buy the vehicles which are then used to deny citizens their right to demonstrate.

No decision yet on Tomana case who is facing six counts of criminal abuse

The prosecution authority has not made a decision on the appropriate court to hear the criminal trial of suspended Prosecutor General Johannes Tomana, who is facing six counts of criminal abuse of office. Reports yesterday indicated the trial has been transferred to the High Court.

Acting Prosecutor General Advocate Ray Goba, yesterday rubbished media reports that the matter has been moved to the higher court.

“No decision has been made on where Tomana will be tried,” said Adv Goba.

“We are currently working on the matter to see which court he is going to be tried.”

Adv Goba said as of now investigations were underway and once the case is ready for trial, a decision will be taken on the appropriate court to conduct the trial.

“If he is going to be tried at the High Court, the accused would be informed and the process for indictment is done by a magistrate,” said Adv Goba.

“It is not true that the matter has been moved to the High Court,” he said.

“It is premature to say the matter has been moved to the High Court when nothing concrete has been done on the case.

“Up until the indictment process has been done by a magistrate, we are unable to comment. We have not yet reached that stage.

The prosecution on Tuesday sought postponement of trial saying there were new developments in the case for the matter to be moved to High Court.

Prosecutor Mr Jonathan Chigwinyiso said: “Your Worship, there has been a change of events, the accused shall be tried at the High Court and if the matter can be remanded to November 16. We will serve him with the indictment papers on that day.”

Following the new developments, Tomana abandoned his application for refusal of further remand and consented to the postponement.

He had placed the State on notice that he would apply for refusal of further remand if his trial failed to commence yesterday at the magistrates’ court.

Tomana is facing trial for criminal abuse of office after he allegedly dropped charges against suspects accused of attempting to bomb Gushungo Dairy.

Allegations in the other cases are that in 2004, Bright Matonga, then chief executive of Zimbabwe United Passengers Company (zupco), was charged with culpable homicide.

It is alleged that the charge arose from a road traffic accident that claimed the life of Chipo Chikowore.

Tomana allegedly called for the docket and instructed that the charges be dropped.

In 2006, Matonga was charged with contravening sections of the Prevention of Corruption Act.

In December 2008, Tomana allegedly instructed Morgan Dube to drop charges after plea against Matonga.

The court heard that in 2006, zupco board chairman Charles Nherera was charged with corruption.

Tomana testified as a defence witness and Nherera was sentenced to three years in prison.

After sentence, Nherera unsuccessfully applied for bail pending appeal at the High Court.

Nherera served his sentence and was released from prison in December 2008.

When Tomana was appointed AG, he declared that Nherera was innocent and wrongfully convicted.

The court heard that former Bindura Hospital acting medical superintendent Beauty Basile was charged with criminal abuse of duty.

She appeared before Harare Regional Magistrates Court.

Tomana ordered the withdrawal of charges after plea on November 24, 2009.

The court heard that in October 2009, Patrick Mavros, a gold dealer, was charged with possession of gold without a licence.

Mavros admitted to the charges but Tomana directed that prosecution be declined, it is alleged.

Jonathan Moyo reburies father who was killed during Gukurahundi

HIGHER Education minister and Zanu PF politburo member, Jonathan Moyo’s family has sought permission from the Tsholotsho district administrator (DA) to allow them to rebury his father, who was allegedly killed during the Gukurahundi massacres.

The family wants to be allowed to exhume the remains of Moyo’s father, Melusi Job Mlevu, so he can be accorded a decent burial at the family shrine in Tsholotsho.

The process is being led by Moyo’s close family members, with the reburial tentatively set for this weekend in his Tsholotsho North constituency.

jonathan-moyoMlevu, who was a PF-Zapu councillor, was reportedly abducted by the Fifth Brigade in 1982 and ordered to dig his own grave before he was killed in cold blood and shoved into the shallow grave.

He became one of the earliest victims of one of the darkest chapters in Zimbabwe’s history.

Moyo’s family recently sought permission to conduct the reburial ceremony from the DA, Gloria Raundi.

“As the Mlevu family, we, therefore, seek your approval for the reburial of our late relative and former councillor for Tsholotsho, Melusi Job Mlevu, who passed away in 1982,” read a letter to the DA dated September 28 and signed by Headman Mlevu, which was gleaned by NewsDay.

“His remains were buried between Kapanyana and Ziga. As a family, we want to properly rebury the remains where we have other family graves according to our cultural practices.
“The reburial will be open to members of the public and, if permission is granted, we will notify your respectable office of the time and date.”

Moyo yesterday confirmed Mlevu was his father, but professed ignorance over the family’s letter to the DA.

“I don’t know what you are talking about regarding the letter you are referring to, since I am neither its author nor its addressee,” he said in emailed responses.

“I don’t even know whether there’s such a letter and if there is, whether it’s authentic. But what I can say is that Melusi Mlevu, whom you mention, is not just a close relative, but my late father.”

Asked if the move was not likely to open old wounds, Moyo said: “I’m, therefore, insulted by the suggestion that finally giving him a decent resting place at his homestead would open any wound. To the contrary, the shallow grave in which his soul has failed to rest in peace all these years after he was tortured and made to dig it in the bush, before he was brutally murdered, is an open wound that needs to be closed.”

Moyo has repeatedly refused to be silenced over the thorny Gukurahundi issue, despite efforts by his Zanu PF colleagues to close the chapter without addressing the issues.

Thousands of affected people have failed to properly rebury their relatives for decades, with President Robert Mugabe describing the period as “a moment of madness”, but is yet to publicly apologise for unleashing the army on innocent civilians.

Remains of the Gukurahundi victims continue to be uncovered in some parts of Matabeleland, particularly in Lupane, an area that bore the brunt of the mass killings.

According to the Catholic Commission for Justice and Peace, Mugabe unleashed the North Korean-trained militia to crack down on alleged dissidents against his rule in Midlands and Matabeleland, resulting in the death of about 20 000 civilians.

In August, Vice-President Emmerson Mnangagwa urged families, whose relatives died during the atrocities, to approach the Home Affairs ministry for permission to conduct reburials of their loved ones.

Habakkuk Trust director, Dumisani Nkomo yesterday said the move by Moyo’s family vindicates the quest by many affected families who want to rebury their relatives.

“There are a number of organisations that wanted to do the reburials, a few of the graves were done, but most of them were unsuccessful because the genocide has not been properly acknowledged,” he said.

“Moyo’s case shows that a lot of people in government and outside government are all victims of the massacre.

“There is need to have proper truth-telling instead of doing the process in instalments. Families have a right to rebury their loved ones and I think individual families should be allowed to do that.”

The reburial of Moyo’s father also comes following a nasty exchange of words between the Higher Education minister and former War Veterans minister Christopher Mutsvangwa, who claimed the late Zanu leader, Ndabaningi Sithole was the minister’s father.

The two were fighting at the height of serious factional wars in Zanu PF between war veterans and the G40 faction.

Mutsvangwa alleged Moyo was a “traitor” like his father, Sithole, a rant that prompted the former to threaten legal action against the expelled Zanu PF minister, whom he accused of defaming his mother.

On Monday Prof Jonathan Moyo said the 4th of October last year was the last day he spoke to his late daughter Zanele who died 10 days later.

At the time of her death Zanele was a second year Political Science, International Relations and Gender Studies student at the University of Cape Town.

She was found dead in her apartment on the 14th of October 2015.

Prof Moyo yesterday said “I last spoke to my dear Angel daughter Zanele 12 months ago on this October day last year before she departed into eternity 10 days later.

Police moves in quickly and restored order at Beitbridge Border Post

RIOT police moved in quickly and restored order at the Beitbridge Border Post on Tuesday after disgruntled truckers and travellers threatened violence in protest against a new revenue collection requirement that caused delays.

Under the new arrangement, all government departments are now obliged to surrender revenue collection duties to the customs and excise department of the Zimbabwe Revenue Authority (Zimra).

These include road access fees, road coupons, port health, veterinary, transit fees for foreign vehicles, and agricultural permits for goods previously paid for in other departments.

The move is part of efforts to migrate to the envisaged one-stop-border post system to reduce time spent clearing travellers and goods.

Tempers flared when the two customs and excise clerks, tasked to collect revenue, were overwhelmed, as their e-system was slow, resulting in long queues.

Restless travellers and truck drivers burst into song and dance, as they protested against the delays, before riot police moved into to calm the situation to avoid a repeat of the violent clashes that occurred on July 1, when cross-border traders violently demonstrated against the introduction of Statutory Instrument 64/2016.

Zimra regional manager in charge of Beitbridge, Batsirayi Chadzingwa yesterday accused touts of fuelling Tuesday’s chaos.

“After police dispersed the touts, normalcy prevailed,” he said.

Some transporters claimed that the changes had inconvenienced them, as they had paid upfront to various departments at the border post.

“We are not in charge of those accounts, they should liaise with those departments,” Chadzingwa said

Security “hitman” threatens opposition MPs with death ahead of Parliament opening

Several opposition Movement for Democratic Change (MDC-T) lawmakers on Wednesday received deaths threats from an unknown sender ahead of the official opening of parliament today (Thursday).

Nelson Chamisa, the MDC-T co-vice president and Member of Parliament for Kuwadzana East, confirmed he was among the legislators who were threatened by a spooky short message sender signing off as Hitman or Certa.

The Hitman warned the legislators against booing President Robert Mugabe during the official opening.

Opposition legislators have in the past heckled Mugabe who they accuse of dictatorial rule and running down the country.

“You may have a false immunity (sic) as a group, but remember after that you will be alone again. You will be remembered for a few day (sic), after that you are history.

Be responsible as you think of what you intend to do in the August House. Your family is better of (sic) around you. Be severely warned!!!” wrote the Hitman to Chamisa and other MDC-T MPs.

He added: “Don’t be used by those planning to demonstrate (in parliament) for their selfish ends, for they won’t be with you when the dark cloud of death engulfs you. We are trailing,” said the Hitman.

Chamisa shrugged off the threats, saying they were meant to intimidate them.

“This sender is claiming to be speaking on behalf of Mr Mugabe, so that might tell a lot about his or their identity. But we say no to a government of fear, violence and abductions. We will not be intimidated,” Chamisa said.

“These messages have become the norm whenever Mr Mugabe is opening parliament. It makes us wonder what these terrorists are trying to achieve,” added Chamisa.

He added that service providers like Econet Wireless, NetOne and Telecel, together with the Postal and Telecommunications Regulatory Authority (POTRAZ), knew who was sending the messages but required a court order to reveal the identity of the spooky sender.

He said they were considering what action to take against the sender.

Bedridden Lynda Masarira issued with warrant of arrest for failing to appear in court as she was hospitalised.

The Mbare magistrates’ court has reportedly issued Lynda Masarira with a warrant of arrest for failing to appear in court as she was hospitalised.

Masarira, who is being tried for alleged public violence for taking part in a demonstration in July and spent some two months in remand prison, fell ill on Tuesday and was admitted at the Avenues Clinic in Harare.

Colleagues reported that she had a fever and also suffered from a chest infection and excessive vomiting, with some suspecting that her long stay in prison was taking its toll on the mother of five.

She is the chairperson of the Zimbabwe Women in Politics (ZWIPA) outfit and has since June been demonstrating against President Robert Mugabe’s government.

However, reports indicated that the Mbare magistrates’ court where she has repeatedly appeared for trial issued a warrant of arrest when Masarira failed to appear in court.

This is the second time Masarira has been issued with a warrant of arrest while seriously ill.

In the first case, a Mutare magistrate ordered her arrest when she could not appear as scheduled due to poor health.

The courts have given that as a reason why she has endured a lengthy stay at the Chikurubi Maximum Prison.

Patson Dzamara, a civil rights activist whose brother, Itai, a journalist, was abducted by suspected State security agents in March 2015 for leading protests against President Robert Mugabe through his Occupy Africa Unity Square campaign, visited Masarira in hospital on Tuesday.

He said in a message that he had asked the doctor who attended her to write a letter confirming that Masarira was admitted at the Avenues Clinic, but it could not be immediately established if that happened

A man identified as Toni Jax Ncube from Bindura has been arrested for the murder of a s#x worker whose body was discovered on road in Nyamakura Farm, Bindura.

Police have confirmed that on the 4th of October 2016 at around 02:00 am, while at Chipadze business Centre, Bindura, the accused hired the now deceased s#x worker Faith Arimandi, aged 22, also from Bindura.

Ncube then reportedly hired a taxi and took Arimandi to his house where they spent the night together.

The following morning Ncube apparently discovered that his money, amounting to US$60, was missing and accused Arimandi resulting in a misunderstanding

It is reported that the misunderstanding resulted in Ncube strangling (throttling) Arimandi until she died.

He is then said to have taken the body of the deceased to Nyamakura Farm, Bindura where he dumped the body along a dusty road.

Information was received by detectives who made a follow up leading to Ncube’s arrest who confessed to committed the offence.

He also led to the recovery of the deceased Sumsung cellphone which he had already sold to 18-year-old Brendon Dickson of Chipindura park Bindura.

Late Vice President Joshua Nkomo’s businesses in Bulawayo are reportedly on the verge of collapse owing to the prevailing harsh economic conditions in the country, something that has seen the companies fail to service their debts

According to the latest council minutes, Nkomo’s daughter Thandiwe Nkomo-Ebrahim approached Bulawayo City Council (BCC) seeking exemption from paying rates for two family run business, Blue Lagoon and Anzac Investments, a property developer.

However, her request was turned down by BCC arguing it will set the wrong precedent for other companies in the city.

The Chamber Secretary said that rates exemptions were governed by the Urban Councils Act in particular Section 270.

As such, the request should not be acceded to because the properties were not within the list of those that qualified for exemption.

“The temporary reprieve sought would set a wrong precedent. The economy was generally not performing well and the situation was affecting every one,” reads part of the minutes.

The Acting Director of Health Services said that payment of rates was meant to ensure that council continued to provide quality service to all residents.

Therefore exemption from paying rates would adversely affect the already precarious council financial position.

BCC director of engineering services, Simela Dube, said the family could sell all the undeveloped land to avoid a heavy and unsustainable rates burden.

“The Blue Lagoon account was poorly managed by the applicant. Payments had not been consistent over the years resulting in the ballooning of the debt,” he said.

“In view of the comments by the Heads of Department and in particular the City Valuer`s efforts in reducing the rates for the project and the Blue Lagoon it was recommended that the request to exempt the project and the Blue Lagoon from paying rates be not acceded to,” he said.

Thandiwe had indicated that the Blue Lagoon was a sole proprietorship business and the building was leased to three tenants who were operating a restaurant, butchery and a bakery.

She said due to the prevailing poor economic conditions, the tenants had been increasingly failing to meet their rentals which had in turn led to rates payment arrears.

She stated that it had become apparent that it was no longer possible to raise funds from the business and as such she was seeking a grace period from paying the full rates.

Nkomo’s daughter was also seeking the reversal of interest that had accrued to the account. In the meantime, she was putting up the property for sale and she had also started negotiating with service station companies to either purchase the property or to enter into a joint venture.

In terms of Anzac Investments, Thandiwe had pointed out that the company had a development project located within the jurisdiction of City of Bulawayo. The development was of two upmarket suburbs of Mqabuko Heights and Whitestone comprising of residential stands, open spaces, a commercial centre, primary and secondary school sites.

The company was yet to complete the servicing of the area as surveys were 70% complete, roads are 20% complete and the challenge was to raise a quoted figure of $4, 96 million to complete the exercise.

The company had hoped to sell the remaining stands to raise the required capital, to engage a company to complete the project in exchange for land, going into a joint venture with council to complete the development and finally to approach stand holders to make contributions together with the developer to come up with the required funding to complete the project.

While languishing in prison over rape, Gumbura has been slapped with a $74 000 lawsuit over an unpaid debt to Idem Trading Private Limited.

Gumbura is serving a 40-year prison term for raping three congregants and illegally possessing pornographic material. He was convicted of four counts of rape involving three women and possessing pornographic material.

VMG Zvinavashe Trust, which operates a private primary and high school in Tynwald, last week issued summons at the High Court claiming outstanding school fees for the prisoner’s several children.

The incarcerated polygamist’s several children attended school at an institution run by VMG Zvinavashe Trust over the years, but they have not been paying.

In a claim filed at the High Court recently, VMG Zvinavashe Trust wants the jailed polygamist pay an outstanding amount of $49 404 for his children in high school and $50 459 for the children in primary school.

 

 

gumburaThe Trust also wants Gumbura to pay interest calculated at an agreed rate of 10 percent per annum from the date of issuance of summons to the date of payment in full. VMG Zvinavashe Trust seeks an order compelling Gumbura to pay costs of the suit on a higher scale.

According to the plaintiff’s declaration, Gumbura entered an agreement with the Trust for the provision of education to the children for a fee. In terms of the said agreement, Gumbura was required to pay tuition fees for the children at the beginning of each school term.

“In breach of the said agreement, defendant (Gumbura) has failed, refused and or neglected to pay the agreed school fees since 2013.

As a result, the plaintiff was impoverished by $99 863,90 being arrears in school fees plus interest owed by the defendant to the plaintiff,” reads the declaration.

Gumbura is yet to respond to the summons.

Meanwhile, Idem Trading (Private) Limited, trading as Eurotex has filed a separate claim against Gumbura of $74 700 plus interest.

According to the summons, Gumbura held a credit account with Eurotex where he would buy household furniture and other goods for his family.

It is stated in the papers that Gumbura bought kitchenware, lounge and dinning suites, fish tanks, gym bikes, quad bikes, snooker table, electric generator and office furniture worth $74 700.

Gumbura allegedly defaulted payment in October 2013.

Despite spirited assurances by Gumbura and his wives on various occasions, Eurotex has failed to recover the money.

The company was left with no other option, but to turn to the High Court for recourse.

When the summons was served at Gumbura’s Marlborough house in Harare, his wives refused to accept service referring the agent to Chikurubi. They wrote to the court stating their position.

“The writers are mature female adults who are not party to any of the alleged contracts and attending obligations between the stated parties in the summons and may not be cited as respondents in the matter in the light of the above facts.

“The writers are acquainted with and are known to the defendant whose current address of service, for purposes of litigation and suit, is Chikurubi Maximum Prison, situated off Arcturus Road.

“Writers do request and pray that all communications to defendant be directed to him at the address stated above or where plaintiff’s claims may be understood or known,” reads part of the letter to the High Court.

A SOLDIER is nursing scalding injuries after he was allegedly caught red-handed bedding a married woman.

Paddington Mkototsi, 24, is alleged to have accommodated his married lover Nyasha Madziro, 32, at his matrimonial bedroom while his wife Polite Cheura was on night duty but all hell broke loose after the two love birds were caught by Polite last week.

Following a tip off, Polite returned home, boiled water at their neighbour’s house, sneaked into the bedroom and caught the two between the sheets

Paddington and Polite are both soldiers and the two are on separation following the incident.

Polite confirmed scalding her husband with water saying she had been tipped that Paddington had been accommodating Nyasha whenever she was at work.

“My husband is the one who takes over my shift so he took advantage of that to accommodate Nyasha in my matrimonial bedroom,” said Polite.

“Nyasha is an agent of a law firm and she hooked up with my husband after she convinced him to join a legal policy.

“I was not informed of the policy and the two started seeing each other behind my back to the extent of having se_x in my bedroom.

“I wanted to scald him on his private parts and face and see if Nyasha was going to continue loving him; he is my husband who deflowered me and we have a child together so I cannot let him be seduced by lustful married women like Nyasha.

“Nyasha ran out and I took her panties, akaenda kumba kwavo asina bhurugwa

I took the matter to Nyasha’s bosses and Paddington collected his belongings and left the house. Maybe he is planning to snatch Nyasha from her husband,” said Polite.

Nyasha denied the allegations and said the story  was only her client not a lover.

“I am married with two kids and I am expecting a third child and this issue has caused me headache that I am afraid this will reach my husband’s attention,” said Polite.

“I am aware that Paddington was scalded with hot water but this did not happen in Dzivaresekwa where they live.

“It happened in Kwekwe where they had visited Polite’s aunt for counselling over my issue but honestly speaking I never fell in love with Paddington; he is my client only.

“Paddington had issues with his wife and they are using me as their fighting ground because of my contact number she discovered in his mobile phone,” said Nyasha.

Paddington showed H-Metro his wounds on his back and neck saying Polite wanted to scald his privates and face over Nyasha.

“I was not in love with Nyasha but my wife got her contact number and this became a big issue that we had to visit her aunt for counselling.

“The message I sent to Nyasha read; ‘Imbomira kusenda message mukadzi wangu aripo’ after seeing this message she saved Nyasha’s contact number.

“It was during counselling when she became violent, slapped me and poured boiling water on me.

“Our misunderstanding with my wife started after I confronted her over seeing one of our bosses behind my back,” said Paddington.

Kereke’s bail application dismissed

Former Bikita West MP Munyaradzi Kereke’s bid to secure temporary freedom while executing his appeal against both conviction and sentence over a rape matter, went up in smoke after his application was dismissed by High Court judge Justice Happias Zhou.

The advisor to former Reserve Bank of Zimbabwe governor Gideon Gono was in July this year slapped with an effective 10-year jail term after being convicted of sexually abusing his 11-year-old-niece at gunpoint.

Following his conviction, Kereke, through his lawyers Advocates Thabani Mpofu and Sylvester Hashiti, filed a bail pending appeal application arguing he had prospects of success on appeal.

However, in dismissing the application, Justice Zhou said while it was accepted that there were some inconsistencies in the girl’s evidence, that would not warrant justification in releasing Kereke on bail.

“The learned magistrate considered inconsistencies in the complainant’s evidence and attributed them to the fact that she was a child….”Justice Zhou said.

“The court has no difficulty in accepting as justified some of the criticisms by the applicant of the evidence of the complainant. If the question of the prospects of success on appeal were to be considered by reference to the complainant’s statements alone or were the only consideration in this matter, the court would have readily granted the application in this matter.”

The judge added: “However, the evidence of the complainant has to be considered in its totality and not piecemeal or in isolation from the rest of the evidence including that of the accused person. That was the approach that was taken by the learned magistrate. Also the prospect of success of the appeal is only one of the other factors and it is not decisive on its own, but has to be weighed against the other factors.”

The judge also said the offence for which Kereke was convicted was a very serious one and the sentence imposed quite long.

“The length of the sentence coupled with the fact that the applicant has already been subjected to the inconveniences of prison life are factors which could induce the applicant to abscond,” he said.

“His conduct, which was found by the learned magistrate to have been disruptive of investigations and in some instances seeking to manipulate the evidence of potential State witnesses, makes his assurances that he will avail himself to complete his sentence if the appeal fails difficult to believe.

“The applicant was also not forthcoming as to the immovable properties which he has to be availed as security….the evidence from the record shows that he did not have one residential place…” the court said.

The girl’s guardian, Francis Maramwidze, hailed the court’s decision, but vowed to fight Kereke even more, adding if he continued challenging the court’s judgment he would appeal and seek a lengthy jail sentence for the convict.

“If he continues to challenge the sentence, which I feel was very lenient, I will be forced to also appeal and make sure the court adds more years since this was not an ordinary rape, but a gun was used,” he said.
