Former ZIFA President Chiyangwa and Kamambo’s court case hits a snag. Kamambo and Machana are being charged with contravening the Telecommunications Act after sending a series of text messages to Cosafa president Philip Chiyangwa.
When they appeared before Harare magistrate Rumbidzayi Mugwagwa yesterday, prosecutor Lancelot Mutsokoti claimed that prosecution had realised that they are relying on screenshots of WhatsApp messages necessitating the need to engage Potraz to authenticate the texts.
Proceedings in Zimbabwe Football Association (Zifa) president Felton Kamambo and his deputy Phillip Machana’s case have been stalled by the absence of a statement from Postal and Telecommunications Regulatory Authority (Potraz).
The duo’s lawyer Nicholas Chikono opposed the application and queried why trial had not kicked off in a simple matter that should have been finalised by now.
“This matter should not have been before this court, but in a trial court and I am failing to understand the reason for this arrangement. The State is aware that they have no case, but are just trying to buy the court’s time while frustrating my clients,” Chikono said.
The ruling will be delivered on March 9. Allegations against Kamambo are that on November 19 last year, he posted “false and annoying” messages to Chiyangwa which read: “Hie President. You are urged to stop your funny and negative interferences with football, meanwhile urgently start accounting for all Zifa money you stole.”
It was further alleged that the previous day Machana had also sent Chiyangwa offensive texts.
“They usually say if you live in a glass house avoid throwing stones even to those who live under brick and mortar. It is sad that for a long time since just before the Africa Cup of Nations (Afcon) you engaged in unprovoked warfare against my person and that of Zifa president F. Kamambo this despite him having won against all odds in contestation with you,” Machana wrote.
“I equally won the same elections despite your spirited efforts to de-campaign me as well as your then deputy O (Oemga) Sibanda who had served you diligently.
“My only crime it would appear is why did I win where you lost and was the only one retained. You probably expected me to be your henchman to cause Kamambo’s reign all sorts of problems. “You wanted me to assist your implanted “boy” to sabotage football so as to make Kamambo look bad…”
