Coup underway in Sudan as govt Ministers are taken to custody by the Army. Reports suggest that ministers of Cabinet Affairs, Industry, Information have been taken into custody. The souring ties between the military and civilians in the ruling government threaten Sudan’s fragile transition to democracy since the military’s removal of al-Bashir in April 2019 after nearly three decades of autocratic rule.

Sudan’s security forces have reportedly taken civilian members of the Sudan government into custody amid growing tensions between the generals and the pro-democracy movement that fuelled the uprising against former president Omar al-Bashir.

Al Jazeera reports that these protesters want the military to take over, replace the current cabinet with a new one, inclusive of everyone who took part in the protests that took off in December 2018.

The protests are largely a result of a split within the coalition which led the anti-government protests against al-Bashir.

The current crisis surfaced following last month’s coup attempt.

Officials blamed al-Bashir’s loyalists for the move but the generals lashed out at the civilian part of the government, accusing politicians of seeking government posts rather than helping ease people’s economic suffering.

General Abdel Fattah al-Burhan, the head of the ruling Sudan Sovereign Council, said that dissolving Hamdok’s government could resolve the continuing political crisis.

That suggestion was rejected by hundreds of thousands of pro-democracy protesters who took to the streets across the country on Thursday.

RBZ orders Mobile Network Operators to reduce airtime price vouchers. Mobile Telecommunications and Mobile Phone Service Providers, Measures to curb abuse of physical airtime vouchers for money laundering.

The Reserve Bank of Zimbabwe (RBZ)’s Financial Intelligence Unit has issued measures to curb the abuse of physical airtime vouchers for money laundering. Pindula News presents Chiperesa, the Director-General of the RBZ Financial Intelligence Unit.

1. The Financial Intelligence Unit has noted that bulk airtime recharge vouchers are being abused by airtime dealers to facilitate illegal foreign currency trading and money laundering. 2. Airtime dealers have been purchasing airtime vouchers in bulk from mobile telecommunication service providers using local currency and then disposing same at discounted foreign currency prices. The bulk airtime traders have not been depositing the significant foreign currency proceeds so generated into the banking system but have instead channelled same to fuel trade on the foreign exchange parallel market.

3. In order to curb this abuse, the following measures shall apply in respect of mobile telecommunication and mobile payment service providers:

4. Mobile telecommunication service providers shall —

(a) take steps to decrease the production and sale of bulk physical air time recharge vouchers and promote the increased use of electronic airtime recharge;

(b) reduce sales of physical airtime recharge vouchers to twenty percent (20%)of all airtime sales by 31 January 2022 and to ten percent (10%) by 30 April 2022;

5. Mobile telecommunication service providers shall submit a written plan to the FIU no later than 7 November 2021 detailing the measures to be taken to meet the above targets by the set dates.

6. In addition to the measures referred to above, mobile telecommunications service providers shall issue circulars to their respective airtime distributors to enforce limits on till-point airtime voucher purchasers.

To ensure that customers purchase airtime vouchers for personal use and not for re-sale, a customer shall be allowed to purchase airtime of not more than ZW$10,000 in value in any one transaction. A customer can buy up to five vouchers at a time but not exceeding ZW$10,000 in total.

7. In order to facilitate electronic airtime recharging through customers’ mobile money wallets, individual mobile wallet holders may, with immediate effect, be allowed to conduct cash-in to their mobile money wallets, at designated outlets, up to ZW$5,000 per week. Cash-outs shall not be permissible.

Report: Parallel Market Exchange rates go down

Report: Parallel Market Exchange rates go down.This follows the introduction of a cocktail of measures by the Reserve Bank of Zimbabwe (RBZ) to curb the exchange rate that was rising at a very quick pace.  Exchange rates on the parallel market have reportedly gone down in the last two weeks from US$1:$200 to around US$1:$165.

A snap survey conducted by NewZimbabwe.com in Harare’s Fourth Street, Copacabana area, Central Business District zone as well as Mbare Musika areas confirmed the latest declines. Said one dealer who identified himself as Godwin:

I am now paying $165 per every US$1 and I am actually the highest here since most dealers are paying far much lower than that. Some are even paying as low as $130 per every US$1 and if you take more time moving around you risk getting a much lower rate.

The dealers also complained over their incapacity to push high volume trades which they attributed to stricter procedures on cash movements being implemented by the banks.

At Mbare Musika market, dealers were however paying $140, 00 cash per every US$1 but bank transfers remained at $165, 00.

Even the payment of civil servants’ salaries this week did not manage to escalate the exchange rates as anticipated earlier by a section of market watchers. A prominent economist, Doctor prosper Chitambara, attributed the shifts to the hard clampdown exerted by authorities this week.

He added that long-term stability will, however, depend on the measures put in place by authorities to bridge the gap between foreign currency demand and supply among other factors.

Details emerge on why Chamisa demoted Job Sikhala in his executive restructure. Nelson Chamisa earlier this month made new appointments to key positions in the party with Sesel Zvidzai being appointed Co-Vice-Chairperson, a move viewed by some as a demotion to Sikhala.

Chamisa, leader of opposition MDC Alliance reportedly “demoted” the party’s vice-chairman, Job Sikhala, for his involvement in the formation of a party that was destined to split the MDC Alliance vote.

An unnamed party insider told Bulawayo24 that Sikhala was the brains behind the formation of Patriotic Zimbabweans which is fronted by Charles Mutama, a US-based former MDC Alliance activist. Added the source:

Mutama is very close to Job and he supported him during his trials. They were tortured by the security agents together. President vakabata ndere ndere yekuti Sikhala ndiye muridzi wechinhu cha Mutama (Patriotic Zimbabweans party).

Job wanted Mutama to set up structures and then invite him to lead the structured party. He also wanted Mutama to test the acceptability of the new party on the ground. Unfortunately, it did not get much traction needed to split the party votes and this is the reason why Job remained in the cocoon. Such a person can never be trusted. He is actually in the departure lounge.

The source said Chamisa also blamed Sikhala for being inactive in the wake of the absence of the national chairperson Tabitha Khumalo who has not been feeling well for some time. Meanwhile, there are reports suggesting that the other camp intends to take Chamisa to court over the violation of the party constitution.

Who is Cedric Fourie?

He is a father, son and brother and grandson. He is a businessman, a University of Cape Town graduate, an actor, a network engineer – he is basically a lover of all things good. He is passionate about helping people from underprivileged backgrounds. He is also all about seeing growth in circumstances unimaginable.

How would you best describe your fashion sense?

I dress according to how I feel. I like experimenting. If I feel good and happy, and because I am a storyteller by nature, one can at times tell how I feel based on how I am dressed. No-one really inspires my look, my inspiration comes from what I see all around me.

What is your love language?

Words of affirmation. I believe we need to communicate verbally not just through actions because those can be misinterpreted. I think as people we have to be good at communicating verbally – we need to say what we mean and mean what we say. It’s easier to communicate your true intentions with words. I also love presence. Being present is a love language on its own.

If you could pause any moment in your life, which would it be?

I don’t believe in pausing moments. I believe in living it and outliving a moment and recreating it if you feel like you’re not done with that moment.

But if I were to pause any moment, it would have to be when my name was called as an official University of Cape Town graduate at the virtual graduation ceremony. I went on a baecation in Thailand, it was extremely amazing, I will pause that.

What personal feature are you most insecure about?

My skin tone. I’ve got uneven skin tone. I hate it so much. Like, my body from my head to knees is one skin colour and then my calves are a shade darker as well as my hands. I don’t understand why but I just don’t like it. It’s almost like there are two people in one body.

What’s the one song you are embarrassed with in your playlist?

It would have to be DJ Mujava’s Mugwanti that’s still on my playlist and I need to get rid of it. This song’s bass-used to make us go crazy back in the day but now I can’t be playing those type of songs.

What always makes you laugh?

A lot of things make me laugh. My humour is so broad; I find humour in almost everything. Like I can be in the scariest of situations in life but if there is something I can spot that’s funny, I will burst out laughing and try to find my way back into fear mode. I also enjoy teasing people, especially people I work with. A lot of people think I’m this guy with muscles who’s all serious only to find out that I am all about laughter.

If you weren’t afraid what would you do?

I’d open a scrapyard. I would then start a gas company and start a journalism degree and also do economics. Oh, I also have a fetish which is wanting to have a baby with someone else. My partner and I joke about this a lot but yeah, if I wasn’t afraid, I’d have a baby with someone else and probably get married to my partner.

What secret talent do you have?

I am an amazing cook. I am a poet and writer.

Dr Musa and Liesl Laurie celebrate two months since saying ‘I do

Dr Musa Mthombeni and his wife Liesl celebrated their second month as husband and wife, and as always they celebrated their love boldly for all to see. Musa and Liesl recently revealed they had their dreamy white wedding in August, and they’ve been celebrating each new month as they wait for their first anniversary since saying “I do”.

Never one to shy away from loving his wife out loud, Musa took to his Instagram to gush about his wife and the two months they’ve been married. Happy two monthiversary to my lovely wife, Liesl. I couldn’t have prayed for or asked for anything better,” he said. The pair are clearly making “monthiversaries” a thing, in addition to the daily celebrations of love on their social media platforms.

Liesl took to her IG to say Musa is an answer to a prayer she’s prayed all her life. Instead of enjoying the matrimonial bliss and being able to love his wife loudly on social media, like any other couple, Musa is constantly faced with vitriolic attacks from tweeps. Not willing to let trolls have the last word, Musa hit back.

“Surely some of you here practice witchcraft, surely. Me loving someone surely shouldn’t make you this angry and sad. Niyahlanya [are y’all mad?] Please see someone if you’re going through something. Dirt one side. What do they say? Love and light!

UK-trained Zimbabwean-born doctor becomes 1st to return home and practice Pediatric Orthopedics

UK-trained Zimbabwean-born doctor becomes 1st to return home and practice Pediatric Orthopedics. He works at CURE Children’s Hospital of Zimbabwe, the first and only hospital in the country to provide orthopedic care for disabilities such as clubfoot, bowed legs, and knock knees to children regardless of their economic status.

UK-trained Tongai Chitsamatanga has become the first Zimbabwean-born doctor to return to practice pediatric orthopedics in the Sub-Saharan country. The teaching hospital that is located adjacent to United Bulawayo Hospital in Bulawayo was established in April 2021. Speaking on the development, Dr Chitsamatanga said:

It is a personal milestone, as well as a proud professional achievement, for me to be able to return to my beloved Zimbabwe to improve the health of children. Pediatric Orthopedics is my passion. I hope to heal, and maybe even inspire, many children who live in the country where I grew up.

Dr Chitsamatanga grew up in Bulawayo and later moved to Harare for medical school. After an internship, he worked at a mission hospital for six years. It was while he was at the mission hospital that he realized God’s calling was for him to do similar work in the future. He trained in General Orthopedics with the College of Surgeons of East, Central, and Southern Africa (COSECSA), graduating in 2017.

Speaking about Dr Chitsamatanga’s return, CURE International President and CEO Justin Narducci said:

CURE International is honored to make history with the return of Dr. Chitsamatanga to Zimbabwe. Tongai represents a new generation of highly-trained African medical professionals who choose to return to Africa to improve the lives of their countrymen. CURE will continue to invest in the next generation of national surgeons in all countries and regions we serve.

Dr Chitsamatanga undertook a trauma and limb reconstruction fellowship at the University of Oxford NHS in 2019. He also recently became a Clinical Fellow in Pediatric Orthopedics at the University of Derby and Burton NHS Trust, UK. He first attended a pediatric orthopedics course run at Beit-CURE International Hospital in Malawi (Beit-CURE Malawi) in July 2013.

He later completed a nine-month fellowship at Beit-CURE Malawi hospital in partnership with The College of Surgeons of East, Central, and Southern Africa (COSECSA) Oxford Link (COOL).

Faith Nketsi says she holds nothing back in upcoming reality TV season

The countdown to the season 3 premier of Faith Nketsi’s reality show Have Faith is finally over as it’s set to make its debut on MTV Base on Monday, October 25. It’s been a rollercoaster and a taxing process for Faith to allow more and more people into her private life but she finally feels like she’s developed the thick skin necessary to be herself without fear.

“So in season 1, I did not understand what was going on, I was still scared [and] I was shy, season 2 I started loosening up and I was thinking of other people, season three honestly I could not be bothered and I feel like myself and the audience — we’re like sitting in the dining room together.
A lot of drama, shade and raw moments is what people can expect from this season as she goes through life’s challenges with her friends and family.

While Faith had called off her rap career venture late last year, images of her being back in studio saying that it will be better than last time has sparked rumours that she has reignited her musical career. Zanu-PF elections mayhem exposes deadly factions. The Political temperature is boiling up in Zanu-PF’s Mashonaland West province after acting chair Abiel Mujeri at the weekend barred provincial members from Zvimba, Chegutu, Makonde and Kadoma from presiding over district elections in Hurungwe and Kariba in a move rivals say was meant to stifle them.

According to Zanu-PF insiders, Mujeri decreed that the elections be supervised by war veterans and ex-war collaborators.

Mujeri and Zanu-PF Veterans of the Liberation Struggle (ZVLS) wing’s provincial chairman, Happison Muchechetere constituted the management team overseeing polls in Hurungwe and Kariba, which in most instances turned chaotic.

The ZVLS is a new organisation affiliated to the ruling party.

“Voting in Hurungwe failed to kick off at Robert Mugabe district, Hurungwe Central constituency over branch registers after some names were plucked out by factions battling for provincial posts,” a source said.

“In some areas, the elections were characteristed by massive rigging and violence in some administration districts. In Mhondoro-Ngezi elections were postponed indefinitely, while ballot stuffing characterised some elections,” the source said.

A notice circulating on Zanu-PF-affiliated social media groups confirmed the cancellation of polling in Mhondoro-Ngezi district. “Mhondoro-Ngezi district elections have been cancelled till further notice. Whoever defies this order will face disciplinary action,” Mujere said. Throughout Mashonaland West province, polling was aborted in over twenty districts.

Chaotic scenes played out in Mhangura over violence, while in Chinhoyi which falls under Makonde administration district, massive rigging was recorded amid meddling by sitting Members of Parliament (MPs) and councillors.

Five districts in Chinhoyi are yet to vote after the plebiscites were suspended over allegations of voter manipulation.

Insiders also told NewZimbabwe.com elections were called off in Munyapi district near the gold-rich Eldorado Mine situated outside Chinhoyi town after machete-wielding gangs of artisanal miners, numbering nearly 500, threatened to unleash violence.

Skirmishes were witnessed in the mining community of Mutorashanga, Mt Hampden, Norton and Kadoma, the source added.

In Banket, Zvimba South constituency, elections failed to kick-off as scheduled last Tuesday when party members challenged the voters’ lists, accusing senior Zanu-PF ‘shefs’ of manipulation.

Contacted for comment, acting provincial chairman Mujeri played down the chaos engulfing the party.

“There are in-house challenges which cannot stop us from completing the restructuring exercise, we will sort them out. Elections will be held in those places after we finish Hurungwe and Kariba,” he said.

Mujeri is set to contest for chairmanship against Provincial Affairs minister, Mary Mliswa-Chikoka, Information deputy minister Kindness Paradza and Vengai Musengi, the party provincial youth league chairman.

The Zanu-PF Mashonaland West provincial chairman post fell vacant in June following the elevation of Justice minister, Ziyambi Ziyambi to the party’s Politburo, the highest decision-making body outside congress. However, Ziyambi is reportedly keen to retain control over provincial politics through his proxy, Mujeri.

Woman cries for help to find missing 1-year-old daughter. Prisca Dindinga told NewsDay that she went to report at Budiriro 2 Police Station but was asked to make a formal report for a missing person after 24 hours.

A 29-year-old woman is appealing for information about the whereabouts of her one-year-old daughter who went missing yesterday morning in Budiriro 4 high-density suburb.

She said she suspected that Mitchell had been snatched by a woman who was employed as a maid in the neighborhood. “In the morning at around 7am, I was doing my normal household chores indoors and my child went outside as usual to play with her siblings,” Dindinga said.

“When I went outside to check on my children, she was missing. I inquired about her whereabouts from some people who were around and someone told me that they had seen a maid from the neighborhood with my child.”

She said the whereabouts of the maid were unknown. Harare provincial spokesperson Inspector Mwanza said the police were yet to investigate the matter.

When NewsDay contacted Dindinga in the evening yesterday, she said attempts to locate her child had been fruitless and was now “hopeless”. Anyone who might have information about the missing child can contact Dindinga at 0783 711 975 or the local police.

Afro-soul singer Bulelwa Mkutukana, best known by her stage name Zahara could face jail time after a warrant for her arrest was issued on Friday.

The warrant was issued by the Johannesburg Commercial Crimes Court sitting in Palm Ridge Magistrate’s Court after she failed to show up to answer to a charge of failing to submit her personal tax returns.

The Umthwalo Wam hitmaker was charged by the National Prosecuting Authority (NPA) early this year for contravening South African tax laws for failing to submit her personal tax returns for 2017 and 2018 to the South African Revenue Service (Sars).

She appeared in the same court last month and the matter was postponed to Friday last week where she was supposed to plead to the charge and possibly begin the trial.

But the Phendula singer cocked a snook at the court when she failed to appear for apparently no plausible reason and as a result, a warrant for her arrest was immediately issued. But its execution was stayed until Wednesday, October 27.

NPA South Gauteng spokesperson Phindi Mjonondwane confirmed that a warrant of arrest had been issued against the Loliwe crooner.

“We can confirm that a warrant of arrest has been issued for Bulelwa “Zahara” Mtukukana for her failure to appear in the Johannesburg Commercial Crimes Court sitting in Palm Ridge on her charge of failing to submit her personal tax returns. But it was held over until Wednesday October 27,” she said.

The warrant of arrest was issued a month after the songstress recorded her second criminal record after paying an admission of guilt fine of R2 000 for failing to submit her company Zahara Army’s income tax returns after pleading guilty to the charges.

She paid the fine when she appeared in the same court after the NPA charged her in her capacity as the director of her company, Zahara Army Projects (Pty) Ltd, for failing to submit company tax returns for 2017 and 2018 to Sars.

After paying the fine, the case was removed from the court roll.

Mjonondwana said the NPA welcomed the outcome of the case involving her failure to submit her company’s tax returns as that would send a strong message to would-be tax dodgers that no one was immune from tax compliance and that all people were equal before the law.

Zahara recorded her first criminal record when she paid a R1 500 guilt fine for failing to appear in the same court for the same case in June.

This after the court gave her an option to pay the quantum or spend three months in jail after finding her guilty of contempt of court.

The musician, whose career has taken a nosedive and has been struggling to pay her bills, handed herself over to the police after a warrant of arrest was issued in April against her.

USA: It’s not sanctioned behind Zimbabwe’s economic challenges. This comes as Zimbabwe and all other SADC countries are campaigning for the removal of sanctions on Zimbabwe saying they are hurting the general populace. SADC set 25 October as the Anti-Sanctions day.

The United States Embassy in Harare has reiterated that sanctions imposed on Zimbabwe are not the cause of the Southern African country’s problems. The U.S., however, says the issues in Zimbabwe are mainly a result of bad governance. Said the embassy on Monday:

Return of Castle Lager Premier Soccer League now imminent. Premier football is set to return a week after the Chibuku Super Cup quarter-finals next weekend. Clubs used the Chibuku Super Cup as a preparation for the resumption of the league and after last weekend’s final round of group matches, the quarter-finals take place this week.

The return of the Castle Lager Premier Soccer League (PSL) is imminent after a two-year COVID-19-induced hiatus. The top-flight teams were given until yesterday to submit their ZIFA club licensing forms, with fixtures expected to be released soon after.

In correspondence sent to the 18 clubs on Thursday, PSL chief executive Kennedy Ndebele demanded that the ZIFA club licences be submitted to the league offices by1700hrs Friday, October 22, 2021. Ndebele said:

Kindly note that this form is required to be submitted before the release of the Castle Lager Premier Soccer League Championship 2021/2022 fixtures.

The PSL on Thursday also issued a press statement announcing the dates for the Chibuku Super Cup and the push back on the league kick start. The league had been set to start on October 30, but that has since been changed to a week later.

Meanwhile, Dynamos’ Supporters Chapters for Matabeleland, Sunungurai Bhiza, has implored authorities to consider allowing more supporters into venues.

Police in Budiriro, Harare, are on a manhunt for an alleged r@pist known as Madzibaba Tanya, who s.e.xually abused a 33-year-old woman twice at his shrine in September after she visited him seeking help for her sick son.

Mwanza told NewsDay: S.e.x predators are a menace to society. The public, especially women, should not be deceived into believing in such religious pronouncements by perverts whose acts are simply bent on s.e.xual gratification. People should always be alert and report such people to the police.

We are on the hunt for the alleged r@pist and anyone with information on his whereabouts should report to any nearest police station. It is alleged that on September 20, the complainant, from Budiriro 1, went to the accused person’s shrine seeking assistance for her son.

Madzibaba Tanya reportedly told the complainant that she had spiritual husbands and ordered her to have sexual intercourse with a man in the bush for three consecutive days and then bring semen for cleansing.

Mwanza said the complainant told the Madzibaba Tanya that she had no one to have s.e.xual intercourse with and the accused volunteered to be the man. After two encounters, she did not return for the third time after figuring out that she was being r@ped. She reported the matter to the police.

Fidelity Printers wins repossession of forfeited Gold claim. Fidelity Printers and Refineries has finally repossessed its claim that was forfeited by the Ministry of Mines and Mining Development last year, after the Supreme Court confirmed an interim order granted to it early this year.

Fidelity, a gold buying subsidiary of the Reserve Bank of Zimbabwe, had approached the Supreme Court challenging the forfeiture of its gold claim in Kwekwe by the ministry, without affording Fidelity a chance to be heard. The High Court had in May this year refused to confirm Fidelity’s provisional order to repossess its claim that had been improperly forfeited to the Ministry for allegedly failing to pay the laid down annual fees for more than six years.

A three-judge panel of Justice Susan Mavangira, George Chiweshe and Felistus Chatukuta unanimously allowed the appeal by Fidelity. Writing the judgment for the court Justice Chiweshe found merit in the appeal and set aside the order by the lower court.

“The provisional order issued by this court in HC85/21 on 17 February is hereby confirmed,’ he said. “The forfeiture of the applicant’s claim Mirage 3 Mine registered under certificate Number 18132 purportedly done on 5 June 2020 is hereby set aside.”

In addition, the court declared invalid any act done by the Minister of Mines and the provincial mining director for Midlands to alienate the area under Mirage 3. The ruling means the Ministry of Mines and Mining Development cannot forfeit a mining claim in terms of Section 1260 of the Mines and Mineral Act, without first notifying the affected party and allowing them to make representation.

In the recent past, the ministry has been forfeiting mining claims all over the country by simply posting the notice of forfeiture on their notice boards.

The Supreme Court agreed with Fidelity’s lawyer Advocate Tawanda Zhuwarara that for the forfeiture of the mining location to be deemed reasonable or fair, the Minister was obliged to issue notice to Fidelity concerning the proposed action and give an opportunity to make representations in compliance with the provisions of the Administrative Justice Act.

He said failure to follow the dictates of natural justice before the exercise of this administrative discretion was manifestly arbitrary and an abrogation of the provisions of the Administrative Justice Act.

“Notice must be given before any adverse decision is made because it is through that notice that a party can then elect to use the various protections available such as the obtainment of a protection certificate,” argued Adv Zhuwarara.

He convinced the court that the finding of the High Court that the provincial mining director acted within her powers to forfeit or that Fidelity had no right to be notified of impending decision was unsustainable, warranting interference by the superior court.

A proper understanding of section 260 of the Mines and Minerals Act leads to an immutable conclusion that Fidelity should have been notified of the impending forfeiture and that the adoption of such process was not automatic.

During the hearing at the High Court, the provincial mining director admitted that she proceeded to declare the forfeiture of Fidelity’s mining claim, without giving any warning or opportunity for the appellant to be heard or giving it an opportunity to rectify non-payment.

And Justice Chiweshe in his judgment found the forfeiture notice produced in the lower court to be ample evidence that Fidelity’s administrative right to be heard was never acknowledged. The High Court in May this year ruled that the forfeiture and subsequent re-allocation of Mirage 3 Mine gold mining claim held by Fidelity Printers and Refiners to new beneficiary Mr Jona Nyevera was lawful.

Fidelity, which had sold the gold mining claim to former Herald Editor Caesar Zvayi, was suing the Minister of Mines and Mining Development, the provincial mining director for Midlands and Mr Nyevera. Fidelity’s essential argument was that it received no prior notice of the intention to declare the claim forfeit and that there had been an understanding between the Ministry and itself that no statutory mining fees payment would be necessary.

So it came as a shock, to be informed for the first time that its mine had been forfeited for not honouring statutory obligations for six years.

But the Ministry, in its submissions, argued that Fidelity’s argument was flawed because there was no obligation upon the provincial mining director to issue personal notices to individual miners who might be in default regarding the renewal of their mining fees.

Through his lawyer, Adv Garikai Sithole, Mr Nyevera argued that the law does not provide that personal notice should be given before forfeiture of mining blocks in terms of certain provisions of the Mines and Minerals Act.

He said notice is posted on the notice board and that is what the law provides in the Mines and Minerals Act. This, he said, was acceptable in terms of subsection 3 of section 3 of the Administrative Justice Act, which allows relaxation of the right to be heard where there is a self-contained domestic remedy mechanism in a statute.

All set for the Zanu PF annual conference

All set for the Zanu PF annual conference. The National People’s Conference that will be held in a hybrid format owing to the Covid-19 pandemic, will see provinces following the main proceedings in Bindura, Mashonaland Central province, virtually.

All is set for the Zanu PF 19th National People’s Conference in Bindura with the President expected to chair a Politburo meeting on Wednesday where the Central Committee report will also be tabled.

Last year, due to Covid-19, the ruling party postponed the National Annual People’s Conference but this year the event will proceed albeit with provinces congregating at 10 different venues in their regions while the party’s Politburo will be at the main venue in Bindura, with everyone following proceedings virtually.

The conference will be held from October 25 to 31, 2021, with all delegates expected to produce their valid Covid-19 vaccination certificates before accreditation. Service providers and other stakeholders will also be accredited at provincial centres.

Running under the theme “Growing and Modernising the Economy towards Vision 2030”, the Conference will discuss among other things, the state of the party, state of the economy, food security and nutrition, social services and poverty eradication, macro-economic stability and reengagement, infrastructure development and utilities as well as value addition and beneficiation.

In his address to the Politburo last week, the President said the conference offers the ruling party a chance to reflect on progress made thus far in fulfilling the party’s electoral promises.

“The forthcoming 19th National People’s Conference must allow us to demonstrate the extent to which we have achieved that which we envisioned in the previous Congress and Conference resolutions as well as the 2018 People’s Manifesto,” said the President. Zanu PF acting spokesperson Cde Mike Bimha said it is all systems go for the conference.

“We have been putting final touches even during the weekend we were at work to ensure that all the provinces are ready. “Tomorrow (today) we will have a meeting to assess the progress made but we are happy with the work that has been put in preparation for the conference.

“We are happy that after a long time we are meeting again. Of course we won’t be meeting in large numbers because of Covid-19 but we are glad that we will be meeting.

“This is a time for us to take stock of the year. We will look at the work that the party has been doing as we prepare to ensure that we deliver five million votes for the President. Indeed, this is a good time for us to strategise,” said Cde Bimha.

The conference is also coming on the backdrop of rapid modernisation, industrialisation and economic growth, with development that leaves no one behind as the country under Zanu PF rule marches towards Vision 2030 to become an upper middle class economy by 2030.

Harare Einstein Tuition Centre violent teacher back in court. Talent Chingwaru was at the Harare Magistrates Court asking to be transferred from Parirenyatwa Group of Hospitals where he was performing the unpaid work, saying he had changed his place of residence.

The mathematics teacher who was ordered to perform 630 hours of community service for brutally assaulting one of his students in full view of other learners at a Harare college, was on Friday back in court.

The 29-year-old told Harare magistrate Mrs Judith Taruvinga that he was no longer staying in Mt Pleasant and was now in Epworth, and requested to be transferred to any nearest Government institution in Epworth.

He told the court that it would be difficult for him to travel from Epworth to Parirenyatwa every day to perform the community service. Mrs Taruvinga granted his application and ordered him to complete his punishment at Epworth Police Station.

Chingwaru, who claims to be a Wits University-trained engineer, was initially jailed for 36 months before 18 months were set aside for five years on condition of good behaviour. The remaining 18 months were suspended on condition that he performs 630 hours of community service at Parirenyatwa.

In sentencing Chingwaru, who was filmed assaulting the student at Einstein Tuition Centre, Mrs Taruvinga said although he should be given another chance to reform, he should control his anger.

“It is fortunate that the complaint did not suffer any permanent injuries,” she said. “You could have lost your job and potential employers might not want to accept you because of publicity that was involved.

“Accused, you need to be given another chance to reform and you need to control your anger.” Mrs Taruvinga said she noted that corporal punishment had been outlawed in 2014 after the upper courts noted it was inhumane.

Rights-protected students now having s.e.x in classrooms. Some are even practicing s.e.x orgies in classrooms and turning up for lessons drunken. Now immune to corporal punishment and pampered with an array of rights, school children are turning classrooms into s.e.x nests, developments that have left teachers bemused.

While rights activists are celebrating the introduction of an array of child rights in schools, hapless teachers are crying foul, saying the schools have become ungovernable due to rampant indiscipline.

Teachers say the high levels of indiscipline among school children follow a raft of changes to the Education Amendment Act, which gave learners an array of rights and outlawed corporal punishment.

The country adopted the Education Amendment Act, 2020, to align its Education Act to the country’s constitution. Among other things, amendment bars schools from sending away pupils who would have fallen pregnant and allows them to continue with classes.

Invariably section 68 of the Act requires every school to have a disciplinary policy that deals with issues of learner discipline within schools. Human Rights Watch Southern Africa Director Dehw Mavhinga said amended Education Act is a step in the right direction.

“Zimbabwe’s amended Education Act is a significant step forward for children across the country. Among other things, the amendment prohibits corporal punishment and the exclusion of pregnant girls from school in accordance with the Zimbabwe Constitution which guarantees the right to education,” Mavhinga said.

“The new law provides that children are not subject to any form of physical, or psychological torture or degrading treatment in school, and prohibit teachers from beating students. An overwhelming number of students are affected by corporal punishment in Zimbabwe’s schools,” he said. However, teachers believe the outlawing of corporal punishment has had adverse effects in terms of discipline in learning institutions.

“While we recognise the need for the recognition of the learners’ rights it is important to highlight that our schools are now degenerating into havens of criminality. Leaners are coming to school drunk; others are carrying dangerous weapons; others are having sex at schools. Generally, discipline has hit rock bottom in our schools and its quite a sad scenario. We don’t know what is going to happen to this generation,” a teacher from a public school told this publication in an interview.

Recently, a Harare teacher Talent Chingwaru was slapped with a three-month jail term after he was convicted of assaulting student at his school.

It is said the student who is in Lower Six was found in the Ordinary Level class watching some movies during lesson time, Chingwaru ordered him to go back to his class. Instead, the student went to a biology classroom and coincidentally met Chingwaru who confronted him.

The confrontation resulted in a heated exchange of words leading to Chingwaru assaulting the student. President of the Progressive Teachers Union of Zimbabwe (Ptuz) Takavafira Zhou said the situation in education institutions is very sad.

“There is growing indiscipline in schools emanating largely from premature granting our students too many rights so that teachers have become virtually powerless to guide and counsel pupils. Worse still with the miserable salaries that teachers are getting they have lost their leadership role, lustre, dignity and role model so much that pupils are not listening to advice from teachers,” Zhou said.

“Whilst giving rights to learners is crucial, we must have done that gradually rather than copy and paste rights from Western worlds with long intercourse for rights from an early age. Our abrupt granting of rights gave pupils a wrong impression of freedom to do anything including arranging s.e.x orgy parties where students would be naked drinking, smoking and taking drugs before making love,” Zhou said.

Government has said it is looking into the issue of learner discipline. Ministry of Primary and Secondary Education spokesperson Taungana Ndoro said: “We have since assigned our Learner Welfare, Psychological Services and Special Needs department to provide the necessary support to our schools.”

Health Minister VP Chiwenga speaks on Beer and Cigarettes price hie proposal. Health Minister Chiwenga, who is also the country’s vice president, said this will help avoid overtaxing every citizen. He was speaking during a pre-budget seminar for parliamentarians in Victoria Falls where he was the guest of honour.

Health and Child Care Minister Costantino Chiwenga say the government should introduce taxes on beer and cigarettes to raise money for medical services.

“The ministry is proposing that a certain percentage of the Zinara funds be ring-fenced to finance health services such as purchasing of ambulances required in cases of road traffic accidents and the treatment of victims of accidents requiring hospitalisation,” Chiwenga said.

“It is also proposed that a certain number of cigarettes be reserved for financing health, for example, for every five packets sold one goes to the national health services. With regards to alcohol, a certain number of bottles should contribute to financing healthcare services,” Chiwenga said.

Chiwenga said the taxes shall be collected from the source, were manufacturers will be asked to furnish the government with details of quantities made. “I am saying we cannot collect a two percent tax from non-users of these things. So let’s have a cent from alcohol, cigarettes and Zinara fees, to fund national health services,” said Chiwenga.

He challenged Finance and Economic Development minister Mthuli Ncube to honour the Abuja Declaration where African states agreed to commit at least 15 percent of the national budget for health services. The ministry was allocated 13 percent in the 2021 budget.

Chiwenga made the proposal in response to parliamentarians who had proposed that treasury should introduce a 1,5 percent cancer levy across all sectors of the economy to fund cancer-related medical needs.

Cancer has become a threat to humanity with numerous cases, especially of cervical and prostate cancer. Legislators were also concerned that the country’s health system has been dependent largely on donor funding.

Chiwenga said while it is true that health relied on donor funding, the government had increased funding of the sector from US$287 in 2014 to US$949,3 million in 2020. Chiwenga said the government is constructing hospitals and other health facilities countrywide to reduce the distance travelled to the nearest health facility.

Police in Midlands have arrested a 43-year-old man in Shurugwi suspected to be behind a carjacking incident and theft of property worth USD$517 790.

“After travelling for a distance, Panganai produced a Pistol and grabbed the driver demanding cash. Joshua escaped from the vehicle and ran away. The suspect took over the vehicle and drove away towards Shurugwi. A report was made to the police. On 20 October 2021 a tip-off was received to the effect that the suspected stolen vehicle had been sighted in Shurugwi communal area,” Mahoko said.

“Police acted on the information and recovered the vehicle which had been painted with different colour and its number plates removed. Further investigations were carried out leading to the arrest of the accused Pangani Sithole at his hideout in Masvingo,” said Mahoko.

Police recovered electrical gadgets a laptop, 64 gig memory stick, ipad tablet cellphone, Huawei tablet, car keys, vehicle number plates and a silver spray gun.

“Police are appealing to members of the public to avoid giving transport to strangers whenever they are travelling and we would like to thank members of the public for cooperating with the police when investigating serious crimes,” said Mahoko.
