Zanu-PF member dies as rowdy mob burns Mupedzanhamo Market

A Zanu-PF member died following violent clashes that were triggered by alleged opposition CCC space barons at the popular Mupedzanhamo Market in Harare which was also partly burnt by the rioting mob.

Scores of people were left injured during the clashes on Friday sparked by alleged supporters of CCC leader Mr Nelson Chamisa who want to take over the running of Mupedzanhamo in Mbare.

The Zanu-PF member collapsed and died at a city hospital from injuries sustained when he was hit on the head with a wooden stick by suspected CCC supporters.

Police said 13 suspects have been arrested in connection with the skirmishes. When The Herald visited the scene yesterday, armed police with dogs were in the process of quelling the bloody clashes that erupted over control of vending spaces.

Police had to fire teargas to disperse the rogue elements who were burning down stalls and wares of traders.

A fire brigade team was also busy putting out a fire that risked spreading.

Some defiant traders were also observed in cat and mouse chases with the police, in the process disturbing the smooth flow of traffic.

Others had sought refuge in the nearby flats where they were monitoring the situation.

Yet still, other rowdy hooligans were pelting traders and journalists with stones.

National police spokesperson Assistant Commissioner Paul Nyathi yesterday confirmed the mishap.

“One person is said to have died and we are still conducting investigations. 13 suspects have been arrested with investigations also underway,” he said.

Zanu-PF Ward 4 (Mbare) Councillor Martin Matinyanya said the deceased was a Zanu-PF member.

“The deceased was hit in the head with a wooden stick by CCC members. He collapsed at a local hospital where he had gone to seek treatment.

“Several other people were also injured some in the head, arms, and legs,” he said.

Clr Matinyanya alleged that the opposition members turned violent last Friday when they started assaulting traders.

“They were demanding cash from the traders and some refused to pay them that is when they became violent and started burning their stalls. The masterminds are CCC and we know them”.

CCC spokesperson Fadzai Mahere and her deputy Gift Ostallos Siziba did not respond to questions sent to them through WhatsApp and SMSes.Eyewitnesses said the clashes started last Friday night.

“We just woke up on Saturday seeing some of the stalls burnt. They then continued the whole day engaging in running battles with the traders.

“Since then the situation here has been tense. Our plea is for the council to regain control of the market. We just want to work in a peaceful environment,” said Mr Isaac Katsande.

A fast food operator in the area, Mrs Joice Muwirimi, was left counting her losses.

“Since the weekend, I am yet to record any sales. I survive from hand-to-mouth and the situation has been dire here.

“I was just coming every day to check if the situation has normalised, but today it was even scary with riot police chasing away the violent thugs that were burning stalls and wares,” she said.

Another trader, Mrs Emilda Mwanda, was still to come to terms with the situation.

“I am actually still shocked. Some thugs came and burnt stalls leading to the confusion that saw people being pelted with stones.

“Police then came in to restore order, but the clashes were too much that they had to use teargas to disperse the people,” she said.

Mr Anthony Sherede blamed Harare City Council for failing to take control of Mupedzanhamo which has been closed for over a year now forcing traders to seek vending places outside the market and an open area around Rufaro Stadium.

“Mupedzanhamo has been turned into a carpark as space barons fight for control and the local authority appears unable to exert control.

“As the planning authority, it should just instil order once and for all. A soul has been lost, but the city fathers seem to be unfazed,” he said.

Harare City Council spokesperson Mr Innocent Ruwende said the council’s informal sector committee recently made a resolution to regularise some of the unofficial markets, a move that would provide a lasting solution whilst also benefiting the local authority.

“Council is set to construct modern markets for vendors across the city with the planning stages expected to be completed by month end,” Mr Ruwende said.

He said the Small and Medium Enterprises committee recently toured prospective vending sites in Crowborough North, Mufakose, Glen View, and Sunningdale.

“We want to construct proper and modern structures for our people to ensure that when rains come they will be sheltered.

“The planning process must be done starting this month and we hope that by year-end these markets will be finished. We want to do away with the cat-and-mouse games with the vendors,” he said.

Chitungwiza Magistrates’ Court has ordered popular comedienne, Madam Boss to appear before a judge following alleged violence that erupted at her Seke home.

Madam Boss, real name Tarisai Chikocho, allegedly clashed with her husband’s mistress who had been residing at their Seke home without her knowledge.

H-metro revealed that Madam Boss assaulted Evangelista Zhou, took her mobile phone and deleted all photographs of her husband and the lover. As a result Evangelista approached the court seeking a peace order against Madam Boss.

Their case is expected to be heard next Tuesday at Chitungwiza Magistrates’ Court, according to State documents.

Meanwhile Madam Boss reportedly retrieved her Mercedes Benz car that she had gifted her husband Ngoni Munetsiwa.

She is also now selling their Seke home.

Ngoni has, however, promised Evangelista alternative accommodation in WhatsApp messages seen by the local tabloid.

“Ndakutengesa stand iyoyo ndiite zvimwe totsvaga pamwe pekuti ugare panemvura,” reads part of messages sent by Ngoni to Evangelista.

In her reply, Evangelista urged Ngoni to be strong.

“But try to be strong Ngoni ndinoziva wakaremerwa, tese takaremerwa, but iwe ukadaro ndozoita sei?

“Munoita zvakakusunungukirai henyu matowana munhu wacho arikuida here?”

One of Ngoni’s sisters revealed that Ngoni failed to swallow his pride which may have settled the dispute.

“I hope Ngoni will come to his senses and swallow his pride and seek forgiveness.

“Madam Boss is loving and had been a family pillar of strength that we cannot allow the devil to wreck this marriage.

“Ngoni made a mistake of stooping low to bed Evangelista, overlooking Madam Boss’ family position, motherhood and international status.

“We will not tolerate Evangelista at all and that is why we wanted her to be evicted from the house.

“Ngoni failed us as a family.”

Musona certainly lived up to his billing as he broke the deadlock with a well-taken penalty in the 18th minute.

Musona got his second goal of the day eight minutes into the second half. He notched home from a rebound after the keeper parried the ball into his path.

He completed his hat trick on the hour mark after starting and finishing off a brilliant move on the right a clinical fight-footed shot from inside the box which gave the goalkeeper no chance.

Musona has started in all six games played so far for Al Tai to fourth position on the log with 12 points from just matches, six behind log leaders Al-Shabab.

7 Ingredients

* 250g baby potatoes

* 415g can pink or red salmon, drained, flaked

* 125g can corn kernels, drained

* 40g (1/2 cup) grated cheddar

* 2 green shallots, thinly sliced

* 1 egg, lightly whisked

* 35g (3/4 cup) panko breadcrumbs

3 Method / Steps

Step 1

Pierce each potato with a knife then place it in a microwave-safe bowl. Cover and microwave on High for 8 minutes or until tender. Set aside until cool enough to handle then remove the skins. Use a fork to mash the potato in a large bowl.

Step 2

Add the salmon, corn, cheese, shallot, egg and 15g (1/4 cup) breadcrumbs. Season. Stir until combined. Divide the salmon mixture into 8 equal portions (about 1/4 cupful each) and shape each into a patty. FC Copenhagen 0 – 0 Manchester City

Ten-man Manchester City missed a penalty and had a goal ruled out as they were made to wait to reach the last 16 of the Champions League by Copenhagen in a VAR-dominated contest.

A dramatic opening saw two contentious decisions set the tone for the evening.

Rodri’s superb 25-yard effort for City was ruled out after Riyad Mahrez was penalised for handling, while the visitors benefited by being awarded a penalty when the ball struck home defender Nicolai Boilesen on the arm as he competed for a corner with Manuel Akanji.

But Copenhagen goalkeeper Kamil Grabara brilliantly saved Mahrez’s spot-kick to the delight of a raucous Parken Stadium crowd before Pep Guardiola’s side had Sergio Gomez sent-off for a professional foul on 19-year-old forward Hakon Haraldsson five minutes later.

The decision again came after the Portuguese referee Artur Dias was referred to the pitch-side monitor and left the English champions forced to reshape and play the final hour a man down.

City arrived in the Danish capital with the expectation of confirming their progression to the knock-out stages with two games to spare, with Erling Haaland left on the bench against opponents that had suffered a 5-0 thrashing in Manchester just under a week ago.

However, Guardiola’s side will still qualify for the knock-out phase of the competition if Sevilla fail to beat Borussia Dortmund in Tuesday’s other Group G fixture.

While City saw a run of six consecutive victories come to an end with the loss of their 100% record in the competition, Guardiola appeared satisfied by a point in an encounter they dominated early on.

A youthful Copenhagen side featuring six players aged 20 or under initially struggled to deal with the experience and slick passing on show from the visitors, with Julian Alvarez also close to opening the scoring.

And despite the loss of Gomez just before the half-hour mark City still managed almost 70% possession before the break, though the dynamic of the game altered thereafter.

With Bernardo Silva and Phil Foden also rested for City’s impending trip to Anfield to face Liverpool in the Premier League on Sunday (16:30 BST), the visitors were limited to long-range efforts from Joao Cancelo and Kevin de Bruyne, which Grabara dealt with efficiently.

AC Milan 0 – 2 Chelsea

Chelsea enjoyed a comfortable victory at AC Milan after former Blues defender Fikayo Tomori received an early red card.

Tomori was sent off for pulling back Mason Mount in the area, with Jorginho converting the penalty.

Pierre-Emerick Aubameyang doubled the lead with a confident strike against his former club.

But Chelsea and England suffered a blow in the second half when right-back Reece James limped off.

The win continues Graham Potter’s unbeaten start as Chelsea manager, with four wins in his first five games.

It moves Chelsea top of Group E with seven points from four matches, but it remains extremely tight with Red Bull Salzburg on six points and both Milan and Dinamo Zagreb on four.

Tomori has not enjoyed his reunion with his boyhood club over the past couple of games – after Milan was beaten comprehensively at Stamford Bridge last week, the Chelsea youth product lasted just 18 minutes of Tuesday’s game at the San Siro.

What looked like being a tight game was blown open when Tomori put his arm on the shoulder of England team-mate Mount, putting the midfielder off balance enough to send him tumbling to the floor.

Referee Daniel Siebert, who was central to the drama throughout to the ire of the home support, deemed it enough contact to be a penalty and that Tomori had not attempted to play the ball, thus overriding the double jeopardy rule and causing him to show the red card.

The decision was debated long and hard by Tomori and Milan’s players, but eventually, he had to leave the field and after a lengthy delay Jorginho calmly slotted the penalty away.

Mount was excellent for the first 45 minutes before being substituted for Conor Gallagher at half-time, having picked up a booking for arguing with Olivier Giroud in the aftermath of the penalty.

Potter decided to remove Mount from the firing line of both the irate home fans and the card-happy Siebert – but not before the England midfielder caused Milan endless problems and showed why he is so admired by his managers for club and country.

While his form is a boost for Gareth Southgate, the sight of James hobbling off minutes after jarring his knee in the turf while making a challenge is worrying, with the World Cup less than six weeks away.

Having been so well stocked at right-back previously, Southgate is now sweating on the fitness of James as well as Kyle Walker and Trent Alexander-Arnold, who have all suffered injuries in recent weeks.

Only two players have started all five of Potter’s games in charge of Chelsea so far – goalkeeper Kepa Arrizabalaga and Mount.

The latter was central to the second goal too. He was played the ball on the edge of the Milan area by Jorginho, and cleverly laid it off the first time. Both Raheem Sterling and Aubameyang were running on, and the former smartly moved out of the way for the latter to plant the ball beyond Ciprian Tatarusanu at his near post.

From then on it was fairly straightforward for Chelsea to earn only their second competitive win on Italian soil from 15 attempts, the last being a 4-0 victory for Claudio Ranieri’s side at Roberto Mancini’s Lazio in November 2003.

They came the closer of the two sides to scoring in the second half, with Gallagher hitting the side-netting after rounding Tatarusanu.

It is a fourth successive win for Potter, with Chelsea continuing an impressive turnaround by rising to the top of Group E after four games, having been bottom after matchday two.

Paris Saint Germain 1 – 1 Benfica

Paris St-Germain missed a chance to secure qualification for the Champions League last 16 as they drew at home with Benfica.

Kylian Mbappe, amid uncertainty over his PSG future, put the hosts ahead in the first half, converting a penalty after Rafa Silva fouled Juan Bernat.

PSG would have qualified with a win but Joao Mario’s spot-kick, following Marco Verratti’s foul on Silva, made it 1-1.

Mbappe thought he had scored a winner but his acrobatic volley was offside.

Earlier on Tuesday, French football expert Julien Laurens told BBC Radio 5 Live that the 23-year-old World Cup winner felt “betrayed” by the club and wants to leave in January.

Mbappe, who has now scored 12 goals in all competitions for PSG this season, signed a new three-year deal in May but now feels he made a “mistake” and would prefer a move to Real Madrid.

However, PSG’s sporting director Luis Campos says the 23-year-old has “never talked about leaving” the club in January.

Argentina forward Lionel Messi watched on from the stands at the Parc des Princes after a calf injury ruled him out of the match.

PSG are top of Group H with Benfica, also on eight points, second, with two matches left for both sides in this phase of the competition.

In the other match in the group, Israeli side Maccabi Haifa secured a shock 2-0 home win against Juventus.

Speeding kombi knocks toddler dead in Harare CBD

A vendor from Harare, Patricia Dengezi whose one-year-old son was fatally crushed by a commuter omnibus in 2017, is seeking US$510,000 compensation from the vehicle owner, his insurer, and the police.

Dengezi was also knocked down, left unconscious and seriously injured by kombi, which was being driven by Munyaradzi Nyamaruru on April 17, 2017.

Cited as respondents in the application are Nyamaruru and his employer, Xolisani Moyo, Champions Insurance Company Limited, Zimbabwe Republic Police (ZRP) Commissioner General, Godwin Matanga, and Home Affairs Minister, Kazembe Kazembe.

Agreed facts are that on the fateful day, Dengezi was at her vending site with her toddler son when they were both hit by a commuter minibus, which left her unconscious.

Unfortunately, her son was crushed and died on the spot.

It is common cause that Nyamaruru was driving against on-coming traffic while fleeing from police officers enforcing traffic regulations.

The vehicle was insured by Champions Insurance in terms of third party insurance cover.

Parties proceeded on the basis of a statement of agreed facts, but Kazembe and Matanga have disputed that police officers acted illegally contributing to the accident.

Dengeza instituted court proceedings a year after the incident on April 9, 2018 seeking US$510,000 compensation for her injuries and death of her son.

After filing the summons, the police bosses retaliated in terms of section 70 of the Police Act and a tender for payment of ZW$2 000 by Champions Insurance, which was the amount provided for by s 23 (b) and (c) of the Road Traffic Act (RTA).

The section sets the prescription period of eight months for any person to institute civil proceedings against the police was ultra vires ss 56 (I) and 69 (3) of the Constitution and, therefore, unconstitutional.

Faced with the predicament, Dengeza then decided to have her case heard by the Constitutional Court.

She then filed an application seeking referral of her concerns to the apex court.

Dengeza wants to know whether the said sections of the RTA, which limit the statutory amount that can be paid by a third party insurer (currently at US$2 000 and at ZW$2000 at a time of application) for injury or death.

She seeks to know if injury or death resulting from a road traffic accident infringes her right to equal protection and benefit of the law guaranteed in section 56 (I) of the Constitution and right to life as provided for in section 48 (I) of the Constitution.

She also wants to know whether section 70 of the Police Act, which sets the prescription period of eight months for any person to institute civil proceedings against the police is ultra vires section 56 (I) and 69 (3) of the Constitution and therefore unconstitutional.

High Court Judge, Justice Elijah Makomo partly upheld her request.

“I fall short of associating myself with and adopting those considerations because my jurisdiction ends with merely considering the frivolity or vexatiousness of the request.

“Suffice to state that I hold that the facts of this case as agreed by the parties indeed raise a constitutional issue of whether s 70 of the Police Act is constitutional in light of Dengezi’s right of access to the courts.

“It is a question that the applicant may expect relief from and the determination of which will enable this court to in turn determine the matter before it.

“In the final analysis, I hold that the request to refer the constitutional question on the constitutionality of section 70 of the Police Act is not frivolous or vexatious,” said the judge.

Zim government recalls South African baby powder products causing cancer

Zimbabwe government has urged health officials to urgently facilitate the recall of Tiger Brands products after recent discovery of excess asbestos, which has significant risk of causing cancer.

The alert aims to amplify an earlier recall by Tiger Brands, which is commonly known for manufacturing Purity Essentials Baby Powder products, after discovering trace levels of asbestos in test samples.

The test samples were from a batch of pharmaceutical-grade talc powder used as raw material in the production of finished powder products.

The batch of raw material with the detected trace levels of asbestos does not meet the company’s strict quality and safety standards.

In a communication dated October 10, 2022 signed by the Health Ministry’s Permanent Secretary, Air Commodore, Doctor Jasper Chimedza, all provincial medical directors, directors’ health services and chief environmental health officers were urged to expedite the recalls.

“The above matter refers. Tiger Brands of South Africa is recalling the Purity Essential Baby Powder from shops. The products contain unacceptable levels of asbestos which causes rare cancer called mesothelioma,” he said.

Products forming part of the recall include the 100g, 200g and 400g pack sizes of Purity Essentials Baby Powder.

“Given that a significant number of products in our supermarkets are sourced from South Africa, there is a possibility that some batches of the baby powder in question are already in Zimbabwe.

“These products should be removed from the shelves or intercepted at points of entry. Let’s inform the public of this harmful product to stop further distribution within the country due to its negative health effects,” added Chimedza.

As opposed to South Africa, where a similar recall was made with customers immediately being reimbursed of their money, in the case of Zimbabwe, details on the reimbursement to customers have not been divulged.
