Ecocash loses court case battle against RBZ. High Court of Zimbabwe has thrown out an application by EcoCash for the restoration of thousands of agent lines terminated by the Reserve Bank of Zimbabwe for suspected illegal forex trading.

The court ruled that EcoCash had no standing to litigate on behalf of its agents and RBZ actions lawful adding that it cannot interdict a lawful act as that interdict will prevent the RBZ from performing its functions in terms of the law.

In the chamber application, EcoCash had presented that they were not consulted before the RBZ made its decision and that the RBZ doesn’t have the power to suspend EcoCash agents.

The court application also pointed out that the agents haven’t committed a crime.

Journalists arrested over MDC ladies’ abduction saga freed on bail. The pair were given a ZWL 500 bail each in a case where they are charged with breaking the country’s COVID-19 lockdown regulations.

Zimbabwe Lawyers for Human Rights has secured the release of journalists Frank Chikowore and Samuel Takawira after they appeared at Mbare Magistrates Court.

It is the state’s case that the two journalists broke COVID-19 regulations when they entered a hospital to interview three members of the political opposition who were being treated for injuries sustained after being abducted and tortured by suspected security agents

Last week Paidamoyo Saurombe, of Zimbabwe Lawyers for Human Rights, told VOA that, “It is disturbing. These are journalists who were in the course of what they should do when they were arrested. So, it is quite surprising. Why would you arrest someone who is going to work? You never know. It becomes scary that if you are arrested while going to work, what else will happen?”

Outspoken preacher Apostle Talent Chiwenga said former president of Zimbabwe Robert Mugabe was a murderer but he died so people should not fear death.

“We should not fear death, where is Mugabe today, he is dead everyone knows Mugabe was a murderer but everybody knows Mugabe was a murderer and for those who do not say it are cowards as well,l am not a coward,” he said.

Chiwenga bemoaned lack of unity in Zimbabweans when law enforcement agents abduct people in their eyes. “No Zimbabwean should be vandalized, brutalized or assaulted while another Zimbabwean is watching it is high time Zimbabweans should stand up and say let us die together.”

The population of Zimbabwe is more than the police the army and the CIOs combined there is no amount of gun power that can silence the voice of all Zimbabweans and this is because of the divide and rule that the politicians have been using for all these years our people are not united.”

Multi-award winning artist Sjava has announced his shock departure from his record label Ambitiouz Records. Sjava, real name Jabulani Hadebe, posted on his social media page this evening that he has parted ways with the controversial label.

In a lengthy statement mixed with isiZulu, Sjava said he was grateful to Ambitiouz for all they had done for him and believing in him when no one else did.

“Through them ngikwazile ukwakhela umama umuzi ekhaya” ,which means he has been able to build a house for his mum.

“Angina nkinga namuntu .Angiyena umntu wama beef nokukhuluma.”

Sjava

He said he had taken a break from social media to deal with his decision.

But he added that not seeing eye to eye with a company business-wise does not mean the end of a personal relationship.

He asked his fans to continue supporting him and not attack his now ex-label.

Sjava was the one big artists left at the label following the rocky departures of other big names such as Emtee and Amanda Black who both claimed to have been mismanaged by Ambitiouz financially.

Sjava

Other artists such as Fifi Cooper, A-Reece, and LaSauce also left the label under a dark cloud.

Sjava released two wildly successful albums under Ambitiouz, Isina Muva, and Umqhele.

He won a BET Award and many local awards including big awards for Umqhele at last year’s SA Music Awards.

Sjava disappeared from social media since fellow singer Lady Zamar and his ex-girlfriend accused him of rape earlier this year.

How to get a licensed gun in Zimbabwe. Most people, small businesspersons, are in need of firearms to protect their businesses but they do not know the procedure of getting one. Zimbabwe has, of late, been inundated with reports of criminals as the economy continues on a nosedive and people try to find alternative means of survival.

The purchase, possession, manufacture and sale of firearms and ammunition in Zimbabwe are regulated by the Firearms Act of 1957. This Act states that civilians who wish to legally own firearms are required to submit an application for a firearm certificate.
Below we publish ZRP requirements towards getting a fire a licensed firearm.

The Central Firearms Registry is a national institution situated at Criminal Investigation Department Headquarters situated at corner 9th Avenue and Josiah Chinamano, Harare, at grid reference 311182. The Section was established after the promulgation of the Firearms Act in 1957. The registration of firearms was centralized in March 1979. The section is mandated with the duty to register all firearms in Zimbabwe except those owned by the State.

Types of firearms that can be registered by private individuals:

1.    Rifles: All non-full automatic rifles (semi and non-automatic only)
2.    Shotguns: All types
3.    And guns: All non-full automatic rifles only (semi and non-automatic only)
4.    Air rifles: All above 1.77mm calibre.

Licencing Authority

The Licencing Authority for a firearm is the Zimbabwe Republic Police.

Controller of Firearms

Controller of Firearms is a Police Officer appointed in terms of Section thirty-eight (38) of the Firearms Act Chapter 10:09 by the Commissioner-General of Police. The current situation is that the Director Criminal Investigation Department is the Controller but he has delegated this to the Deputy Director Criminal Intelligence Unit, Records and Technical Services who an Assistant Commissioner.

The requirement for registration of firearms

Section 5(2) of the Firearms Act Chapter 10:09 states that “the firearm certificate shall be granted by the controller if he is satisfied that the applicant has a good reason for purchasing, acquiring or having in his possession the firearm or ammunition in respect of which the application is made and can be permitted to have in his possession that firearm or ammunition without danger to public safety or to the peace”.   This, therefore, means the Controller can discretionally change these requirements from time to time.

Major issues that are considered are:-

a.    The character of applicant: This is done through fingerprint vetting and support from local police.
b.    Security of the weapon: Before submitting the application, police have to visit the applicant’s place of residence and physically inspect his/her gun cabinet, strong room, armoury or safe. Other requirements depend on the intended purpose as stipulated below: Crop/livestock protection

1.    Support letter from local police
2.    Support letter from either AREX/ Dept of Parks and Wildlife/Local Authority
3.    Proof of land ownership i.e. land offer letter/title deeds or letter from local councillor/headman.

Target shooting/gun club sport

1.    Support letter from an official from the gun club.
2.    Support letter from local police

Hunting

i.    A letter by the person on whose land applicant is authorized to hunt
ii.    Support letter from a Senior National Parks Officer

Protection of cash in transit (Individual)

i.    Current Bank Statement.
ii.    Support letter from the Bank Manager
iii.    Supporting letter from Officer In Charge /Officer Commanding District and Officer Commanding Province
iv.    Source of funds.

Protection of cash in transit (companies)

i.    Current bank statement and support letter from Bank Manager
ii.    Certificate of Incorporation
iii.    CR 14
iv.    Letter of appointment from the company director authorizing applicant to stand in for the company.

Home Protection

i.    Letter of support from Officer In Charge /Officer Commanding District and Officer
ii.    Title deeds for the house/lease agreement

These requirements are also a necessity when applying for the importation of firearms and when renewing expired licenses. A firearm certificate is valid for three (3) years calculated from the first day on the month in which it was issued, thereafter renewals will be done.

Somizi is worried about the sale of alcohol

Following the news that alcohol will be sold for home consumption during level 3 of the country’s lockdown, media personality Somizi Mhlongo-Motaung has expressed his concerns.

“I thought that when they finally lift the ban I was going to be excited and today I woke up feeling really worried. Like I am really worried and I am sure I’m not the only person who is feeling this way. It’s really scary”, he said in the video on Instagram.
He went on to say that the government needed to specify how people would get access to alcohol.

Somizi

“If we are going to buy alcohol like we buy food and stuff (in stores), that is worrying for me. One of the reasons why I am worried is because I am worried about people who will now prioritise alcohol versus everything else, their food, bread on the table and their health. I am worried about crowds going to buy alcohol with the fear that the ban might be brought back again”, he added.

The “Idols SA” judge and radio personality said that he felt the people who would suffer the most were those at the lower end of the economy and that the upper class would be fine.

“I am in the upper-class rank and it would be selfish of me to not speak the truth because I have family members who are in the lower class. They live in the townships, they live in numbers, some of them abuse alcohol and some of them are not working but because they have deprived for so long they are going to prioritise alcohol and also open to the possibilities of getting infected”.

Chamisa’s MP confronts police over Bulawayo man fatal shooting

Chamisa’s MP confronts police over Bulawayo man fatal shooting. Paul Munakopa (34) was shot and killed by police in Bulawayo Saturday night following a high-speed vehicle chase. Munakopa, who was in the company of his girlfriend, Tracy Mufudzi died a few minutes after he was admitted at the United Bulawayo Hospitals (UBH).

An MDC-Alliance legislator has called on the Zimbabwe Human Rights Commission (ZHRC) and the National Peace and Reconciliation Commission (NPRC) to speedily institute investigations into the fatal shooting of a Bulawayo man by police.

The pair, according to reports, had been parked at a spot in a city suburb when police and members of the neighbourhood watch committee driving an unmarked Prado, confronted it.

Ilos Nyoni, the MDC-Alliance MP for Bulawayo East where the fatal shooting took place, said the incident has left residents in the constituency shocked and uncertain about their personal security in the hands of law enforcement agents.

Said Nyoni, “The unfortunate shooting by the Zimbabwe Republic Police (ZRP) of a vehicle resulting in the untimely death of the driver, Paul Munakopa (34) of Matshamhlope on Saturday night of 23 May, 2020 at Hillside suburb was sad and uncalled for.

“The incident has left residents shocked and uncertain about their security. “I call upon ZHRC and the NPRC to speedily institute investigations on the conduct of the police operatives in question. Offenders must be brought to book.”

The MP pointed out that Section 48 (1) of the Constitution of Zimbabwe guaranteed every citizen the right to life and it was unfortunate Munakopa lost his life in the hands of those who were supposed to protect it.

“Section 219 (1)(c) of the Constitution out of which the Police Service Charter is derived further defines the functions of the police as protecting and securing the lives and property of the people.

“Thus, the murder of Munakopa by police operatives is a clear violation of the right to life and a failure to do one’s duties,” the parliamentarian said.

Nyoni also questioned the logic behind police only identifying themselves when they had already shot Munakopa. “The men blocking the deceased vehicle only identified themselves as police officers after the shooting.

“Is it now a policy that police shoot first and ask questions later? “It is crystal clear that the couple had not committed any offence that deserved such heavy-handed treatment from the police,” said the MP.

Paul and his girlfriend Tracy
Paul and his girlfriend Tracy

The MP said he and fellow legislator, Jasmine Toffa Tuesday visited Hillside police station with the intention of raising residents’ concerns over the issue but the officers were uncooperative.

“A visit today by myself and Hon J. Toffa to Hillside police station for a meeting with the Officer-in-Charge (OIC) did not yield any results. “The OIC denied us audience on the pretext that she needed to get authorisation from her superiors in order to talk to us on the issue,” he said.

National police spokesperson Assistant Commissioner Paul Nyathi Monday described the incident as unfortunate but claimed that Munakopa’s Honda Fit was suspiciously parked in one of the suburbs, prompting a reaction from police and the neighbourhood watch team on patrol.

Gospel Singer and TV host Khaya Mthethwa might be a pastor too but, he does not believe that opening places of worship is a great idea. The singer took to Twitter to vent on this heated debate, which has since been on everyone’s lips on whether churches must be allowed to operate since the President addressed the nation last night.

President Cyril Ramaphosa said places of worship may re-open under strict restrictions in alert level 3 of lock-down, which will start next week Monday. The President declared places of worship as an essential service because prayer will comfort and strengthen the country as it continues to confront this pandemic.

This left many people divided on Twitter with some saying those who want to pray must pray at home, and opening churches will cause more fatalities and Covid-19 cases. Some said churches are an essential service and but protecting ourselves and others will be all in our hands.

Khaya weighed in on the matter and said to the President, opening churches is irresponsible, he wrote “I’m a church boy but this is irresponsible. #cyrilramaphosa” Khaya said he is not attacking the President but he is just expressing his own views in a democratic country.

Warriors Captain Musona to end Anderlecht nightmare

Warriors Captain Musona to end Anderlecht nightmare. Reports from Belgium yesterday suggested that KAS Eupen were keen to retain Musona’s services on a permanent basis after an impressive performance since securing a loan switch from Anderlecht in the January transfer window. The breakthrough came after he had struggled for game time.

Zimbabwe senior national football team captain Knowledge Musona is set to end his nightmarish stint with Belgian Pro league giants Anderlecht amid reports that he will soon seal a permanent transfer deal to KAS Eupen where he was on loan in the just-ended season.

Since his move to the record 34-time Belgian league champions in July 2018, the 29-year-old endured a frustrating spell, making only eight appearances and scoring just one goal.

This season, Musona was restricted to one reserve team appearance for the side, culminating in a loan switch to KAS Eupen during the January transfer window as the Zimbabwean international sought game time.

By the time world sport was halted because of the coronavirus pandemic, he had already flourished at KAS Eupen – scoring two goals in six starts which appear to have convinced the Belgian side to consider a permanent deal for him.

The Warriors forward is contracted to Anderlecht until July 2022 but has been reportedly transfer-listed with the club making clear their plan to trim playing staff, KAS Eupen – who firmly believe the Zimbabwean could be the torchbearer of their attack – are expecting a positive response.

The former Hoffenheim and Augsburg attacker had also been previously loaned to Lokeren, having been at Oostende where he had made his name in the Belgian league after a move from the Absa Premiership where he starred for Kaizer Chiefs.

He has been a reported target for Mamelodi Sundowns in recent months, but that now seems unlikely as he appears set to stay in Europe. Musona was Absa Premiership’s top goalscorer in 2011, leading to a lucrative move to the Bundesliga. But he failed to get game time at TSG Hoffenheim and spent time on loan at FC Augsburg and then at Chiefs.

However, the recent development where The Smiling Assassin, as he is affectionately known in football circles, will secure a permanent move to KAS Eupen, should excite Zimbabwean fans as he has been the face of the Warriors – the team he has led to two successive African Cup of Nations finals.

He has been linked with a move back to Chiefs but it was recently reported that his huge wage demand could scupper the deal. Musona was reported to be one of the best-paid players at Anderlecht, yet since his arrival, his talent has not been appreciated by the club.
