ZEC defends its stance of suspending all electoral activities. The Zimbabwe Electoral Commission (Zec) yesterday denied any wrongdoing in suspending all electoral activities over COVID-19 after an independent electoral watchdog red-flagged the move as potentially illegal and unconstitutional.

The Zimbabwe Election Support Network (Zesn) said suspending elections to ostensibly “avoid violating lockdown measures currently in place” is unconstitutional. Suspending elections also went against Zec’s strategic plan 2019-2024, which calls for consultations and stake- holder engagements before any such decisions are taken, Zesn added in its analysis titled Zec’s Suspension of Elections Quarantines Democracy.

The Zec strategic plan states that “electoral stakeholders play a key role in creating public confidence in Zec” and urges the commission to “institutionalise stakeholder engagement and to develop an operational culture that makes it responsive to the needs of the stakeholders”.

“In the absence of these consultations, Zec could at least have considered postponing, rather than suspending electoral activities. But even postponement cannot be indefinite. Zesn notes that the suspension of electoral activities was not done in terms of the law,” Zesn argued.

“Section 132 allows Zec to change dates, but does not mandate Zec to change without giving notice of its decision in the Gazette and in the media and beyond 90 days. Zec should note that any postponement beyond 90 days from the date a vacancy arises as provided for in section 158(3) of the Constitution is potentially illegal and unconstitutional.”

Zec chief elections officer Utoile Silaigwana yesterday argued the commission acted within the parameters of an emergency health situation.

“The Zec acted within the parameters of an emergency health crisis, where it had to look at the safety of the voter, election observers and others. Under normal situations, we could have done such (consultations etc),” Silaigwana told NewsDay.

“How do we consult stakeholders without a position? It is for this reason that we are working on a policy that we will take to the stakeholders on how to conduct elections during the COVID-19 period.”

Opposition parties have cast doubt on Zec’s credibility after crying foul of electoral malpractices it argues have resulted in Zanu-PF rigging its way to victory. Zesn said decisions such as suspending elections without consulting stakeholders further dent Zec’s credibility to conduct credible elections.

He is the cutest! Actress Zola Nombona holding her newborn baby Boy – Video

Just days after revealing that her baby boy had made his grand entry into the world, actress Zola Nombona has given fans a glimpse of Cebelihle.

Looking all glammed up, the new mommy shared a cute video on Instagram of herself holding Cebelihle at what seems to be their first photoshoot.

With a caption that read, “Mommy and her cub. I’m so in love it’s ridiculous,” Zola seems to be smitten by her new smile keeper.

Earlier this week, Zola announced the arrival of her son with an adorable snap of her baby’s footprints on Instagram.

In February, Zola confirmed that she was expecting with a cute snap that showed off her baby bump.

In a love letter to her unborn son, Zola wrote at the time, “Here is my love flourishing. My world has changed and created,” on her Instagram post.

“Your voice will be like the song I’ve longed for, and no musician in the world could ever compose. Your eyes will take away the fog that has been shutting down mine. Your smile will wipe away every tear. Your hand will sustain me forever. You gave me strength I never knew I had.”

Thomas let the news slip when he expressed his joy and excitement on social media at the new chapter of his life.

Taking to Instagram, Thomas shared ultrasound pictures of their unborn baby coupled with a heartfelt message. However, it didn’t take long for his followers to notice that the ultrasound pictures had Zola’s name on them.

“I remember clearly the day I found out about you. Your mother looked at me and said, ‘I’m pregnant’ and then proceeded to cry. I understood it was tears of joy, anxiety, excitement, disbelief, love and the small realization that life will never be the same again.

“As I’ve watched you grow from trying to feel for the first kick, to begging you to stop guquluzing and playing soccer in your mother’s tummy now in the third trimester.”

MDC A activists trial in false start. The youths allegedly marched around Mbizo 4 shopping centre on March 23 this year calling on President Mnangagwa to step down over his alleged failure to manage the economy.

The trial of MDC Alliance Midlands youth chairperson Sekai Marashe and three-party activists from Kwekwe, accused of holding an illegal demonstration against President Emmerson Mnangagwa, failed to take off on Monday as the State requested more time to put its house in order.

Kwekwe ward 5 councillor Melody Chingarande and MDC activist Lovemore Savanhu were picked by Central Intelligence Organisation operatives a day after the flash demo and handed over to Kwekwe Central Police Station’s Law and Order Section, where they were detained.

They appeared in court and Chingarande was freed on $1 000 bail while Savanhu was ordered to deposit $1 500 for his freedom by Kwekwe magistrate Sherly Thembo Marashe together with Kwekwe ward 12 councillor Washington Moyo, MDC activists Leonard Musemwa and Tinashe Mushosho were also granted $1 000 bail each by magistrate Samkhelisiwe Gumbo over the same case.

However, their trial was deferred to June 16. The activists’ lawyer Reginald Chidawanyika told NewsDay yesterday that the defence team would not rush the State into starting the trial when they feel they are ill-prepared.

“We will wait for them to settle down. I am very confident that my clients have no case to answer and they are innocent,” Chidawanyika said. “However, if the State fails to give us a trial date timeously, that is when I will apply for refusal of further remand. At the moment, the ball is in the State’s court.”

Tendai Chitima explains how Cook Off made it onto Netflix despite only having a low budget. The main actress of the movie Tendai Chitima has revealed how their low budget movie went all the way to get a spot on Netflix. She revealed this in an interview with SkyNews.

The 2017 production becomes Zimbabwe’s first local film to be transformed into a world spectacle. Co-produced by Joe Njagu and Thomas Brickhill, the film’s success has turned out to be a homegrown inspiration.

Zimbabwean romantic comedy, Cook Off, is set for its premiere today on American site, Netflix. “We are excited to be custodians of the first Zimbabwean film to feature on Netflix, this is the future and tomorrow (today) is the day everyone has been waiting for,” said Njagu.

Njagu has given credit to his crew for allowing collaborative efforts. “Everyone behind the production is ecstatic and we are seeing this as a way to turn around our local film industry.

“This has also encouraged more collaborations to produce more magic,” he said. Cook off was listed for Netflix streaming earlier last month before the site picked June 1 for the debut. And since then Zimbabweans have watched the movie on the Application and the actors of the drama have become overnight celebrities.

In a Twitter rampage shared today, 9 June 2020, Pearl retweeted an article which claimed that the public was coming for her, after she spoke from a “place of privilege.” The article targeted Pearl’s lifestyle based in the high-end Johannesburg suburb, Sandton, and questioned her opinion on the dense subject matter.

The internationally-acclaimed actress went on to question her followers on their opinions on the current economic state of South Africa. Fitness model and brand influencer Michelle “Moana” Amuli who featured on Jah Prayzah’s Munyaradzi video is ready to take Zimbabwe’s showbiz by a storm.

H-Metro’s Zvikomborero Parafini caught up with Moana in a wide-ranging in an interview on working with Jah Prayzah, family life as well as her goals and aspirations. Q: How did you get the role in the video, did you go through auditions?

A: I did not go through auditions but Jah Prayazah’s crew looked for me, I’m sure it was through my IG video clips whereby I post and showcase my talent.

Q: Did you participate in formulating the script or you just got there and were told what you were supposed to do?

A: The script was already there, they explained it to me and the character I was supposed to portray. It’s the small things that we would help each other with. Q: Was Munyaradzi your first commercial video, how were you treated on set and how did you navigate through the attention?

A: Munyaradzi was my fourth video. I’ve worked with a few other artists before.

The crew was welcoming, respectful, professional and very humble. They really made me feel comfortable.

I have featured in Takura’s Zvemoyo, Enzo-Mwenje, Freeman – Miridzo and other projects yet to be released

Q: How was it like working with Jah Prayzah and his team in general?

A: It was really amazing because I was surrounded by a group of people who are passionate about what they do, very talented ndaisatozivawo kuti Jah Prayzah is a good actor and the man behind the camera Blaqs, he made it easy for me to really get into character, anonyatsoziva basa rake. Q: The video Munyaradzi is like a movie, which role did you enjoy the most, the part where you and the ‘love of your life’ were broke or the part when you were now rich?

A: The broke part, it made me appreciate my life and how most people including myself should be grateful to God nezvatiinazvo.

Q: Working with an international artist like Jah Prayzah can be life changing, what has changed in your life since the release of this video?

A: I’ve been receiving lots of love and receiving gift left, right and centre from fans. I have signed a few contacts with some of Zimbabwe’s big companies the likes of Nash paints. Q: Given the emotions raised in the video, some people who take it as real life may end up viewing you in a negative light, how have you been handling those critics? A: don’t think I’ve bumped into such as of yet, it’s all been love and a few jokes to be honest. My DMs were flooded with positive comments

Q: Can you relate to anything in the video, have you ever gone through anything similar because the emotions you showed were real, or you’re just a good actress?

A: I sure related because some of us takakurira kuGhetto and nhamo yakambonyatso tirova chaizvo,nothing was handed to me on a silver platter but still hazvo the talent is there hahaha. Q: Why did you say yes to star in this particular video and do you see yourself taking up a similar role like this one

A: Is this a trick question (laughs) who would say no to working with the Zimbabwean Giant? And for sure I’ll portray a similar role without hesitation.

Q: Who’s Moana?

A: Moana is actually a nickname. My name is Michelle Amuli, my life revolves around fitness. I’m a fitness & Fashion model, fitness coach, Yogi and brand influencer based in Zim/Harare. I’m a 25 year old mother of one. I am currently single.

Q: What’s a normal day like in Moana’s life?

Producer Forward Mazuruse: Seduction is real in studios. His surprise birthday party was organised by Esteem Communications under the aegis of Takemore Mazuruse. But it was the Music for Development Studios (formerly Revival Studios) boss’ piece of advice set to inspire young producers.

Producer reveals as he celebrates 40th birthday. Music producer Forward Mazuruse says seduction by female artistes in exchange for free studio time is real.

He, however, said he has managed to overcome the temptation by sticking to his principles. Mazuruse opened up over the weekend as he celebrated his 40th birthday and two decades in the game as a session artist and producer.

SEDUCTION
Like any other job, Mazuruse said a lot happens in the studio booth where producers need to be firm and principled. “I have been a producer for years now but a lot happens behind the scenes, especially ladies who want free studio time.

“Some of the ladies offer their bodies for free in exchange for studio time. “This has been happening for ages and one needs to be strong otherwise you risk working for free. “In my case, I always avoid ladies who are loose because I know I will be killing my reputation and working for nothing,” he said.

Mazuruse who started off working from home said his wife Nancy has been supportive to him. “My wife understands the nature of my job and she is the one who gives me strength, especially when I am down.

“I respect her a lot and she is the reason why I am never tempted or seduced by loose women who visit the studio for favours,” he said.

FOCUS
Mazuruse, who has served Fungisai Zvakavapano for past eight years as a session artiste, said focus has made him strong.

“As a session musician, I have always wanted to be a producer to ensure that I nurture young talent after realising that I can’t be working for others for the rest of my life. “I then decided to set up a studio at home and we would borrow equipment from others.

“I used proceeds from show earnings to buy equipment and the sales from albums Guitar Praise Volume 1 recorded in 2008, Guitar Praise Volume 2 (2010). “I started off in Warren Park, moved to Hillside, later Rainbow Towers but now we are operating at No. 95 Baines Avenues in the capital.

“Over the years, I have produced household names like Fungisai, Allan Chimbetu, David Hondoyedzomba, Liberty Ticharwa, the late John Mutoko, Prince Musarurwa (late), Sety Mandivheya, Tongesayi Rusere among others. “I have been working with Tanzanian diva Betty Barongo and the experience was quite amazing. “We are still in touch with a number of projects line-up,” he said.

SOCIAL RESPONSIBILITY
As a way of giving back to the community, Mazuruse has been empowering less privileged artistes under the Music for Development Studios banner. “I have been empowering artistes under my stable as a way of giving back to the community.

“I have since identified a piece of land in Zaka where I come from which has been earmarked for the setting up of an arts centre. “I have realised that there is no need for talented artistes to travel to Harare in search of studios.

“In fact, I have realised that we can produce stars from ekhaya as long as we provide facilities where they can record. “This is part of my vision to set up the arts centre in Zaka as I celebrate my 40th birthday,” he said.

Besides the arts centre, Mazuruse has been donating mbiras to less privileged children countrywide. “I have been moving around donating equipment like mbiras to marginalised artists. “I was recently in Chegutu and soon I am travelling to Zaka where we are set to donate to six schools.

“As a producer, this is the only way I can empower others, especially those who have an interest in music,” he said. The versatile instrumentalist said he was also touched by the plight of some children who cannot raise money to buy shows.

“I have been working with Fagio Marova on the #Donate A Shoe campaign where we managed to assist school pupils. “In this era that we are in, we don’t expect children to be attending class on barefoot.  “As a nation, we need to practice the culture of giving sharing.”

FALLBACK PLAN
As a fallback plan, Mazuruse is also into farming. “Firstly, I have invested in the right people who can always come to my rescue when I fall on hard times.

“I’m also into farming and recently I enrolled for a Music degree with MSU and I see myself becoming a lecturer soon. “Of course I can play music well but now I can brag a lot since I can read and understand music well. “Education is another instrument I am doing because I know I will fully utilise it,” he said.

BRIEF BIO
Mazuruse was born on June 6, 1980, in Zaka, Masvingo. He attended Dabwa Primary School before he enrolled at St Anthon’s for secondary education.

He completed his Advanced Level at Mufakose High 2. After school, he studied CIS Part B but he dropped along the way so that he could pursue music. Like most artists, he learnt to play musical instruments in church when he came to Harare.

In Harare, he established himself as a producer and session musicians who continue to wean off stars. However, exploitation is also rife in his profession some artistes (names withheld) don’t want to pay for service rendered.

There are also some artists who promise to settle their debts after launching their projects but hard come back afterwards. As a producer with vast experience, Mazuruse reckons focus, professionalism and creativity remain key for one’ success in the game.

socialite Mahwindo bails out the woman with triplets. Philanthropist and socialite Wanisayi “Mahwindo” Mutandwa yesterday came to the rescue of Eastview triplets when she handed over groceries, clothes and blankets sourced through her foundation.

This follows the publication of their plight in last Friday’s H-Metro. Named Mahwindo Foundation, the organisation has been bailing out the vulnerable during the Covid-19 lockdown who lost their source of income. These comprised the elderly, musicians and the poor.

And yesterday Mahwindo brought smiles to the triplets’ mother Rumbidzai Tsvangirai who was deserted by her husband, Davison Nzou. The story went viral on social media after H-Metro broke the news with well-wishers pledging donations.

Rumbidzai was at a loss for words after she received goods worth over US$800. “I am at a loss for words after receiving these goods from Mahwindo Foundation.

“When we went public about the issue, we were didn’t expect to get these stuff. “These guys are heaven-sent and I pray that God bless them. “I have seen the power of God and newspaper (H-Metro), “she said.

Speaking at the same event, Mahwindo pledged to continue assisting the triplets through her foundation.

“As Mahwindo Foundation, we will continue assisting such vulnerable people who need our assistance through our foundation. “In our case, we are sourcing this stuff through our firends and they are due ones who sent me with this stuff,” she said.

Meanwhile, musician Peter Moyo accompanied Mahwindo to Eastview where he also bought some groceries for the triplets.

To date, Mahwindo Foundation has donated to the elderly in Seke communal lands and Chitungwiza, Banket, CAPS United and recently partnered Twabam Foundation and donated to musicians and actors.

200 returnees to be released

200 returnees to be released. Over 200 returnees in Harare’s different quarantine facilities will be released today after testing negative to COVID 19 while those who tested positive have since been isolated at Beatrice Road, Wilkins and Parirenyatwa Hospital’s isolation facility as Government moves to decongest all it’s quarantine facilities across the country.

Over 100 others from Harare are still waiting for their results which are expected by end of day tomorrow.

Making the announcement in Harare this morning, Health and Child Care Minister Dr Obadiah Moyo said this exercise will be cascaded to all other quarantine facilities across the country as a matter of urgency.

“We want to make sure that we test all incoming returnees from day one as they arrive but firstly we have to clear the quarantine facilities,” said Dr Moyo.

Ex-Minister of Health Parirenyatwa trial hits a snag. Prosecutor Mr Brian Vito sought a postponement of the matter before Harare regional magistrate Mr Trynos Utahwashe.

The trial of former Health and Child Care Minister David Parirenyatwa on charges of criminal abuse of office yesterday hit a brick wall after presiding magistrate Mr Elijah Makomo failed to report for duty.

Mr Utahwashe deferred the matter to July 17 for trial continuation. Allegations are that Parirenyatwa abused his position as a public officer and directed National Pharmaceutical Company of Zimbabwe (NatPharm) board chairperson Dr George Washaya to terminate the contract of Ms Flora Sifeku as managing director, allegedly showing favour to Mr Newman Madzikwa, who had once been sacked from the company for selling donated drugs. At the time he was fired in September 2009, Mr Madzikwa was NatPharm’s Masvingo branch manager.

The indictment revealed that Parirenyatwa had indicated that he required Ms Sifeku’s services at the ministry’s head office for an indefinite period.

The board, it is alleged, complied with Parirenyatwa’s directive and gave Ms Sifeku and Mr Madzikwa six months’ contracts each as managing directors. It is alleged that Parirenyatwa’s conduct created double-dipping on NatPharm funds as the company was paying two salaries towards the managing director’s position thereby prejudicing it of a total of $30 006.

The State further alleges that Parirenyatwa’s actions were prejudicial to the good administration of NatPharm and the Ministry of Health and Child Care.

The company that was linked to ED’s son Drax Investment contracts cancelled. In a letter dated 5 June 2020, addressed to NatPharm managing director Mrs Flora Sifeku, acting Permanent Secretary in the Ministry of Health and Child Care, Dr Gibson Mhlanga advised that the cancellation must be done with immediate effect.

Government has ordered the National Pharmaceutical Company (NatPharm) to cancel all contracts for the supply and delivery of medicines and surgical sundries by Drax Consulting SAGL.

He said NatPharm must, by this Friday, be able to prove that the cancellation had been effected accordingly. “You are being directed to cancel all contracts that you had with Drax SAGL with immediate effect. Please be advised that this process needs to be completed by latest Friday 12th June 2020 and all documentation showing cancellation of the same to be submitted in my office by then. Please treat this issue with the urgency that it requires,” wrote Dr Mhlanga. Contacted for comment, Dr Mhlanga confirmed the latest position adding that he was following instructions from Treasury.

He could, however, not be drawn into providing more details. Mrs Sifeku also confirmed having received the letter, but could not comment. Represented by Mr Delish Nguwaya in Zimbabwe, Drax Sagl entered into an agreement with Government for the supply and delivery of medicines and consumables worth US$20 million.

The drugs started coming into the country at the beginning of the year in batches.  Sometime this year, Drax Sagl was also awarded a tender to provide Covid-19 medicines and was subsequently given preferential treatment for the release of its Covid-19 emergency medical supplies that were stuck at Robert Gabriel Mugabe International Airport.

There was a public outcry after it emerged that the company was overpricing its Covid-19 supplies.

Boterekwa road collapses due to illegal mining: Pics. The damage threatens motorists and haulage trucks travelling between Zvishavane and Gweru. A section of Shurugwi-Zvishavane Road at the famous Boterekwa escarpment last Friday caved in and formed a huge crater owing to tunnels dug over the years underneath by small-scale gold miners.

The Transport and Infrastructure Development Ministry has moved on to the site and is filling the crater to avert accidents. Since 2014, environmentalists have warned that illegal gold mining and panning in gorges along the scenic route, the Fernie Creek Pass, popularly known as Boterekwa, were posing a risk to motorists as the road faced collapse.

The beautiful freshwater streams and diverse plant and bird species along the route have been affected by water pollution and land degradation as trees and vegetation in the valley are now covered by heaps of soil.

In 2014, Ministry of Transport engineers patched what was suspected to be an opening to a tunnel in the middle of the highway. Now, a section of the road collapsed after illegal gold panners in the area dug a 15m-deep and 7m-wide cross-cut tunnel under the road.

Shurugwi district administrator, Mr Langton Mupeta, said the area where the road has collapsed is called “danger zone” by locals.

The point of collapse is at the end of the 8km section as one heads out of the Boterekwa escarpment going towards Zvishavane.

“Activities of gold panners over the years have contributed to the collapse of a section of the road. There are tunnels running underneath the road and they need to be filled with concrete. I am happy to note that the Ministry of Transport and Infrastructure Development and JR Goddard employees are working on the section now,” said Mr Mupeta.

He said the illegal miners who dug the tunnel had abandoned the tunnels “They have vanished because they know what they have been doing is wrong. They have been destroying our infrastructure over the years and Boterekwa is now a pale shadow of its former self,” he said.

Shurugwi residents said the illegal miners have for a long time been a threat to their livelihoods as they were digging all over the place without any regard to the environment.

Mr Jameson Gumbo said: “All they care about is gold and violence. Now our road is collapsing.”

Midlands Minister of State for Provincial Affairs and Devolution, Larry Mavima said he was shocked that gold panning was threatening to destroy a section of the busy road, which will affect socio-economic activities.

“As Government we are very concerned by the activities of the artisanal and illegal miners who continue to wantonly destroy critical infrastructure for a few pennies of gold.

“We are going to embark on an aggressive operation to flush out these malcontents and we also plead with members of the community to help us stop this infrastructure destruction by informing the authorities as and when they see illegal and dangerous activities such as this,” said Minister Mavima.

Tunnels can be seen under the road. The artisanal miners seem to have deserted the area following an increase in traffic from Government officials from different ministries who are assessing the damage.

Supreme court Judge Justice Bere misconduct hearing starts. Suspended Supreme Court judge Justice Francis Bere is today expected to appear before a tribunal to answer to the charges of misconduct after his last-minute bid to stop the hearing failed yesterday when the High Court found that the latest attempt to delay the hearing was not an urgent matter.

A three-member tribunal led by retired Justice Simbi Mubako will inquire into the judge’s fitness to hold office, after a lawyer accused him of interference in a civil case.

He is denying the allegations made against him. Lawyer Mr Itai Ndudzo complained about the interference. Yesterday, the High Court rejected as urgent his latest application in which he was seeking an order allowing him to file his papers within the time he wished, while at the same time staying the tribunal process.

Justice Jesta Charewa agreed that Justice Bere had the right to request an expedited hearing of his matter and to challenge the propriety of the process that led to setting up of the tribunal to investigate him,

But the question before her was whether he could come to court at the eleventh hour to assert rights as a matter of urgency that had accrued to him long before now. She did not think so and removed the matter from the roll of urgent matters.

Having lost his two previous urgent applications, Justice Charewa said, the suspended judge was trying to achieve what he failed to obtain when he sought an interdict to stop lawful process in his previous urgent applications.

“What the applicant seeks to achieve is to have multiple bites of the cherry when he failed to harness all his claims on the day of reckoning,” she said. Justice Bere was serving on both the Constitutional and Supreme Court benches when he was suspended in March this year, pending a probe into potential misconduct

Since his suspension Justice Bere has approached the High Court three times, including yesterday’s hearing, seeking as a matter of urgency an order staying the inquiry into his alleged misconduct.

The other two members of the tribunal to probe Justice Bere are Harare lawyer Mrs Rekayi Maphosa and Advocate Takawira Nzombe.

Last month, High Court judge Justice Alfas Chitakunye declined Justice Bere’s request for an urgent hearing of his application challenging the Judicial Service Commission’s the decision to refer his case to President Mnangagwa, recommending an inquiry into his alleged misconduct.

The finding of non-urgency paved the way for the tribunal to sit and make the inquiry into the judge’s misconduct allegations.

Justice Bere is accused of meddling in a civil case involving the Zimbabwe National Road Administration and his relatives. Justice Bere allegedly telephoned Mr Ndudzo, who was representing Zinara, asking him to consider settling a civil dispute pitting Zinara and Fremus Enterprises.

Complaints against him were raised before Deputy Chief Justice Elizabeth Gwaunza during a court hearing and Mr Ndudzo was asked to make the complaint in writing.

Justice Bere denied the allegations. In a response to the JSC, the judge, said he only contacted Mr Ndudzo in the context of their personal relationship dating back to the days when they were both members of the Zimbabwe Football Association Ethics Committee. He described the complaint as a falsehood meant to taint his clean record.

In January last year, a panel of four judges appointed by Chief Justice Luke Malaba looked into Justice Bere’s conduct after Mr Moxon filed a complaint alleging conflict of interest in a case the judge had presided over.

The four-member Judicial Ethics Advisory Committee chaired by then Constitutional and Supreme Court judge Justice Rita Makarau cleared Justice Bere of any wrongdoing.

Nelson Chamisa drags army to court. In an application for spoliation, five MDC Alliance employees — Washington Gaga, Chancellor Kudakwashe Matibiri, Edith Sana Munyaka and David Zvavamwe Shambare — alleged that soldiers and police assisted Friday Muleya, Paul Gorekore and Tendai Muchekahanzu to forcibly and violently take over the Morgan Richard Tsvangirai (MRT) House on Thursday night, while one of them was severely assaulted and injured during the fracas.

Workers employed by Nelson Chamisa’s MDC Alliance have taken Zimbabwe Defence Forces commander Philip Valerio Sibanda and Police Commissioner-General Godwin Matanga to court over their subordinates’ involvement in the “violent” seizure of the party’s headquarters by a rival faction led by Thokozani Khupe.

“This application is for a spoliation order, being an interdict against the respondents and anyone working under their instruction from forcibly and unlawfully deposing applicants of their peaceful and undisturbed use and employment of MRT House, 44 Nelson Mandela Avenue,” the application read. Army boss, Sibanda, cited as second respondent, stands accused of having deployed armed soldiers who assisted and aided Muchekahanzu, Muleya and Gorekore. MDC Alliance chief security officer Gaga, in a sworn affidavit, said police and soldiers together with the MDC-T youth forcefully gained entry into MRT House.

“On June 4 at about 8:30pm, I was advised in my capacity as a chief security officer, about the violent and unlawful takeover occupation of the MRT House. The report that I received, whose details I have confirmed to be true, was to the effect that those acting on behalf of Matanga and Sibanda, together with the other 18 working in cahoots in the acts of violence, forcefully and violently gained entry into the building and they have refused to vacate therefrom,” Gaga swore.

Gaga said those who took over MRT House did so in the belief that a Supreme Court ruling gave them such powers, although in his contention, he says it does not.

“The illegitimate occupation was ostensibly based on the invaders’ belief that they had been authorised at the Supreme Court to occupy the building, but to this day, I have not seen the court order authorising them to deny me and my co-applicants, as well as all other regular inhabitants from continued use of the premises,” Gaga wrote.

In his application, Gaga said this amounted to self-help led by the police and army and that their actions were and remain unlawful. He is seeking an order from the courts to ensure that he is allowed continued use of the building where he is employed.

He said that since the police and soldiers were part of the violent and illegal takeover of the building, he had no other remedy except approaching the courts.

“No other effective remedy. Applicants have to effect the restoration of the status quo ante obtaining prior to June 2020 in order to protect their interests. Efforts to solicit assistance from law enforcement agencies have proved futile,” Gaga submitted.

Shadowy organization Chapter 2 Movement invites Khupe and Mwonzora to Friday’s mass protest. The organization has released an open letter calling for the three leaders to wear black on Friday and post social media messages calling for an end to woes bedevilling the country.

Shadowy organization Chapter 2 Movement has invited MDC-T leaders Thokozani Khupe, Douglas Mwonzora, and Morgan Komichi to participate on a mass protest to be held on Friday.

Other leaders invited include Nelson Chamisa’s MDC, Pastor Shingi Munyeza, award-winning journalist Hopewell Chin’ono, ZAPU officials, and South African politicians and Trade Unionists.

The Law Society of Zimbabwe (LSZ) has expressed concern over the arrest of another lawyer Advocate Slyvester Hashiti. We are still gathering information but we have learnt that…

The brief report received thus far indicates that Advocate Hashiti is being charged with criminal insult arising from proceedings that occurred in court sometime last year. Again the Society is concerned that the lawyer is being charged for carrying out his lawful duties.

Court proceedings are generally controlled and directed by the courts. In any event, the case in point is still pending in court.

ZACC gives an update on Prisca Mupfumira’s court case

ZACC gives an update on Prisca Mupfumira’s court case. In a statement on Wednesday, ZACC said, “The Defense Counsel has been making one application after the other and this has delayed the trial from taking off. Our docket is complete and State is ready.” In December last year, Mupfumira indicated that she was mentally ill and unfit to stand trial.

The Zimbabwe Anti-Corruption Commission says the court matter involving former Minister Prisca Mupfumira has been set down for trial on 19 June 2020. Mupfumira’s lawyer Charles Chinyama told the Deputy Chief magistrate Chrispen Mberewere that she was mentally ill and had been instructed by a renowned psychiatrist to take any trial or court proceedings after a maximum of three months.

The State alleged that sometime in 2013 Metbank defaulted in payment of US$25, 3 million investment loan maturity to NSSA that was secured with properties worth around US$32 million.

NSSA then took over Metbank properties they held as surety to a value of US$25, 3 million on a purchase/sale agreement as a result NSSA remained to hold onto Metbank properties worth around US$7 million after sealing the US$25.3 million investment loan.

As a result of the default, NSSA classified Metbak as a high-risk client that was not worth trading with and in December 2014 Mupfumira was appointed minister of Public Service and on December 15, five days after her appointment she held a meeting with Metbank officials Ozias

Bvute, Enoch Kamushinda and Belmont Ndebele at the ministry offices where no minutes were recorded. On December 16, 2014 Mupfumira and Masoka held another meeting with then Nssa general manager James Matiza and the Metbank officials at the ministry offices.

Mupfumira instructed Nssa to financially bail out Metbank to the tune of US$15 million as it was facing liquidity challenges. Nssa declined the proposal since Metbank had previously defaulted in a US$25, 3 million loan advance. Mupfumira disregarded all that and went to give James Matiza instruction to seriously consider.

Metbank’s loan request and process a loan of US$15million to settle the bank’s US$5 million depositors credit and US$10 million for use in housing projects and bring feedback the following day. However, no minutes on the meeting were recorded.

Nssa resolved to decline the US$15 million loan request after considering Metbank’s risk status however Mupfumira and Masoka forced Nssa to purchase Metbank properties worth US$4 908 050 that they had not intended to purchase.
