Flags raised over KVG and Jah Prayzah’s new fancy houses. Jah Prayzah and KVG were recently pictured at red carpet ceremonies being handed over keys to their newly acquired properties at Pokugara Estate in the leafy suburb of Borrowdale in Harare.

A red flag has been raised over the deals that got top musician Jah Prayzah, and Star FM Disc Jockey Kudzai Violet Gwara better known as KVG fancy homes in Borrowdale.

However, one Dr Controlla Gabi, questions the type of lease agreements being offered by the Kenneth Raydon Sharpe owned company Pokugara Properties.

Dr Gabi is of the view that Pokugara Properties might be selling its plushy Pokugara Estate houses using an outdated concept which is being phased out in the United Kingdom.

KVG Borrodale

Gabi said Pokugara Properties was using a “Leasehold” arrangement means that when one buys a property, ownership of the land remains in the hands of the seller and attracts monthly rentals.

Leasehold also has a tenure period and once it expires the ownership of the property reverts to the original owner.

In a five threaded Twitter response to West Properties post about KVG acquiring a new home at Pokugara Estate, Gabi said he was worried about the Pokugara Estate leasehold arrangement which he said was an eternal debt trap. He said:

Congratulations KVG. I hope they gave you a fair contract for the property. I have raised the issue of leaseholds @WestPropZim have introduced in Zim whereby the property buyer doesn’t own the land their property is on. Haven’t responded. Star FM hasn’t commented either.

It’s unclear how much legal protection buyers have against the legal jeopardy of leaseholds. You’d think developers would be transparent about this. It’s worrying that, with the brand ambassadorships being issued to celebrities, scrutiny disappears with conflict of interest.

Leaseholds are an eternal debt trap. Homeowners will continue to pay rent on the land their house is built on. It’s been a controversial scheme here in the UK.

Pokugara Jah Prayzah

With a leasehold, you’ll always pay rent on the land on which your home is built. There must be an option to buy the land or just rent to buy the land which shd give ownership of the land at some point. With no legal protection, land rent will go up or change hands. Uncertainty

Although unlikely, it is possible that, in a leasehold agreement, the price of the lease may end up being unaffordable. It’s unclear what will happen in such circumstances. Would you lose your property, for example? Star FM must facilitate this discussion on their programmes.

West Properties which is the company behind Pokugara Estate did not respond to Gabi’s thread in what could be a confirmation of the leasehold agreement fears.

Chipinge whizz-kid appeals for assistance. A Chipinge whizz-kid, Tarisai Mawire of Usanga Suburb has appealed for financial assistance to pursue a Law dream with the University of Zimbabwe.

Mawire (22) said she will miss her chance if she does not get funding in the next few days. Mawire got 15 points at A-Level and has since secured a place to study law at UZ starting August this year and this is just weeks away.

Tarisai’s mother, Nunurai Gatsi is doing menial jobs hence unable to pay the fees. She is appealing to well-wishers to come to her rescue as she is determined to succeed in life. Said Mawire:

I am a determined girl and my results at A-Level are out of sheer hard work because I face a lot of financial problems. I want to become a lawyer but my dreams will be shattered if I don’t get school fees in the next few days. I am kindly appealing to well-wishers to assist me with fees.

#FreeZuma protests: More soldiers deployed to quell chaos. Acting Minister in the Presidency Khumbudzo Ntshavheni’s confirmed that 5 000 soldiers have been deployed to help quell the chaos in KZN and Gauteng provinces.

The chaos erupted Thursday last week following the arrest and imprisonment of former president Jacob Zuma over contempt of court.

Zuma was convicted after refusing to appear before the Zondo Commission of enquiry that is investigating him for corruption allegedly committed during his 9-year tenure as president. The protests degenerated into chaos as demonstrators looted shops, burnt trucks and blocked roads.

At least 72 people have since died in the chaos with over 1,000 people arrested. Khumbudzo Ntshavheni is urging South Africans to work together with law enforcement instead of taking the law into its own hands.

Horror as married man dies at lover’s house. Crema Masiya, a father of three children died after complaining of severe headache and nose bleeding which began while at her mistress Tapiwa Tafirenyika’s, 33, shebeen in Cherima lines in Highfield. A 42-year-old Highfield man reportedly died in his lover’s arms on Sunday.

Tafirenyika confirmed the incident saying the man passed on arrival at Sally Mugabe Hospital after a severe headache and bleeding he underwent in her arms.

Tafirenyika told H-Metro that she clashed with Masiya’s wife Renia Mubayiwa over taking the sick man to the hospital. “Masiya came to my house from work complaining with a severe headache,” said Tafirenyika.

“I engaged my friend when I noticed that he was bleeding from the nose and mouth and we hired a taxi and took him to his first wife around midnight. “I gave him some tablets in an effort to save his life but in vain.

“Mudzimai wake patamunokera tichimuudza zvekurwara kwemurume aramba kubuda zvikanzi pedzeranai nekuti ndimi manga munaye. “She was so arrogant that I was quick to suspect that it was the reason her husband was finding peace and love at my house for the past three years.

“It’s only that I a mother of four children who separated with my husband, I could have sired a child with Masiya zvino mmmm zvimwe unowonawo wekuiita mwana naye. “I went with Masiya to Sally Mugabe Central Hospital where he was pronounced dead upon arriving,” said Tafirenyika.

A number of her neighbours gathered to console as she directed the mourners to New Canaan where Masiya rented house with his family. She vowed to attend the funeral arguing that Masiya’s father accepted her as a second wife.

“Masiya’s father used to visit me here and he told me that mourners will be gathered at his house in Southlands. “I will be accompanied by my big five female body guards to the funeral in case the late’s wife decide to attack me.

“Mudzimai wacho anozviti anoenda kukereke asi asingagone kuchengeta murume saka parufu tinenge tiri tese kusvika aradzikwa,” said Tafirenyika.

Masiya’s neighbours and workmates were gathered at his rented house in New Canaan but Mubayiwa had already left to Southlands where mourners were expected to gather. Mubayiwa said she was yet to accept the mishap and was not in a position to comment.

“I have no comment at the moment and I am at my father-in-law’s house in Southlands right now,” said Mubayiwa. Sources close to Masiya camp said the late had a soft touch with women. “Mumwe wedu taitamba naye asi panoti madzimai apa mmmm ateverwa nemabasa ake.

“Aita mufiro webenzi kunofira kucherima achiita mabasa erima,” said one of his neighbours. “Hanzi kwaTafirenyika aidziisirwa mvura yekugeza neimwe yekudira mujemba achiberekwa achisiya vana vake vaduku vachifa nenzara,” said the neighbour.

Roasted tomato with Mediterranean vegetables

Roasting fish and veg is an easy way to make a healthy meal for four. Add a crunchy cheese and breadcrumb topping for a winning combination.

Each serving provides 374 kcal, 27g protein, 35g carbohydrates (of which 19g sugars), 12g fat (of which 4g saturates), 10g fibre and 0.8g salt.

Ingredients

2 red onions, cut into wedges
1 aubergine, cut into wedges
2 red peppers, seeds removed, cut into chunks
600g/1lb 5oz butternut squash, peeled and cut into 2cm/¾in-thick slices, then wedges
1 tsp dried thyme
2 tbsp olive oil
4 x 100g/3½oz cod (or haddock) fillets
8 tsp tomato purée
1–2 slices stale bread
50g/1¾oz mature Cheddar, finely grated
2 tbsp balsamic vinegar
75g/2½oz spinach, roughly chopped
sea salt and freshly ground black pepper

Method

Preheat the oven to 200C/180C Fan/Gas 6. Put the onions, aubergine, peppers and squash on a large baking tray. Add the thyme and oil and mix until coated, then season. Roast for 35 minutes, or until golden and cooked.

Meanwhile, put the fish on a baking tray and season. Spread 2 teaspoons tomato purée on each fillet.

Pulse the bread in a food processor to make fine breadcrumbs. In a small bowl, mix 4 tablespoons of breadcrumbs with the cheese. Sprinkle the mixture over each fillet and press down lightly. Cover the tray with kitchen foil and seal around the edges, then set aside. (Freeze any leftover breadcrumbs in a sealed bag to use another time)

After the vegetables have been roasting for 20 minutes, move them around the tray to make sure they’re cooking evenly. Put the fish in the oven and roast with the vegetables for 15 minutes.

Remove the foil from the fish and roast for another 5–10 minutes, or until golden and cooked through. Mix the balsamic vinegar and spinach into the hot vegetables, then serve with the fish.

Lionel Messi agrees new Barcelona deal. The announcement is dependent on player departures that will allow Barca to fund the Argentina captain’s wages.  Lionel Messi has agreed to stay at Barcelona on a deal until 2026 that includes reducing his wages to half of his previous salary.

Messi, 34, was a free agent after his contract – that reportedly paid him £123m a season – expired on 30 June.

He is on holiday after winning the Copa America and the finer details of the contract are yet to be finalised. Re-signing Messi was the principal summer target of new chairman Joan Laporta.

Barca are also looking at a swap deal involving forward Antoine Griezmann and Atletico Madrid midfielder Saul Niguez, with the idea of reducing the wage bill.

Fringe players such as Junior Firpo, Jean-Clair Todibo and Carles Alena have already been sold to free up budget but other big-name departures will also need to take place.

Messi had been linked with moves to Paris St-Germain and Manchester City, where he would be reunited with his former boss at Barcelona Pep Guardiola, as well as America’s Major League Soccer, which he has previously considered experiencing.

Messi is Barcelona’s record scorer with 672 goals and has won 10 La Liga titles, four Champions Leagues, seven Copa del Reys as well as claiming the Ballon d’Or on a record six occasions.

Jadon Sancho speaks after racist abuse: Hate will never win. England forward Jadon Sancho says “hate will never win” after he received racist abuse following the Euro 2020 final defeat by Italy on Sunday.

Sancho, 21, Marcus Rashford, 23, and Bukayo Saka, 19, were targeted on social media after all three missed penalties in the 3-2 shootout loss. England manager Gareth Southgate, Prime Minister Boris Johnson and the Football Association all condemned the abuse.

“As a society we need to do better,” said Sancho in a post on Instagram. “And hold these people accountable.”

So far four people have been arrested as the UK Football Policing Unit is trawling through thousands of social media posts aimed at the three black players. In his first social media post since the defeat, Borussia Dortmund’s Sancho said “sadly it’s nothing new” to see the racist abuse he, Rashford and Saka received.

“To all the young people who have received similar abuse, hold your heads up high and keep chasing the dream,” he added.

“I am proud of this England team. “I want to say a massive thank you for all the positive messages and love and support that far outweighed the negative.

“It’s been an honour as always representing England and wearing the Three Lions shirt, and I have no doubt we’ll be back even stronger.” Sancho said he was “sorry” to his team-mates, coaching staff and the fans who he felt he had “let down” by missing England’s fourth penalty.

“This is by far the worst feeling I’ve felt in my career,” he added. “There were so many positives to take away from this tournament though the defeat will hurt for a long time. “I was ready and confident to take [the penalty], these are the moments you dream of as a kid, it is why I play football.

“These are the pressured situations you want to be under as a footballer. I’ve scored penalties before at club level, I’ve practiced them countless times for both club and country so I picked my corner but it just wasn’t meant to be this time.”

Rashford also apologised for his penalty miss but said he “will never apologise for who I am”. A mural in his hometown of Withington was defaced after his penalty miss, before it was covered in messages of support and repaired.

Rashford said he was “overwhelmed” by the response, with hundreds of people also gathering for an anti-racism demonstration at the mural on Tuesday. Boris Johnson has promised to ban people guilty of sending racist abuse to footballers from attending matches.

But Labour leader Sir Keir Starmer said the PM’s words rang “hollow”, as he had refused condemn fans who booed players for taking the knee. Southgate said the racist abuse was “unforgivable”, while England captain Harry Kane told those who sent it, “you’re not an England fan and we don’t want you”.

Defender Tyrone Mings criticised Home Secretary Priti Patel as having “stoked the fire” by last month describing players taking the knee against racism as “gesture politics”.

Patel said she was “disgusted” by the online abuse directed at the players while Johnson also defended her, saying she had “faced racism and prejudice all her career of a kind that he [Mings] can never imagine”.

Sancho added that the tournament had been “one of the most enjoyable camps I’ve been part of in my career so far, the togetherness of the team has been unmatched, a real family on and off the pitch”.

The former Manchester City youth player has had a medical at Manchester United and is set to complete his £73m move from Dortmund soon. Rashford may not play for United until the end of October after deciding to have surgery on a shoulder injury.

Italy goalkeeper Gianluigi Donnarumma joins PSG on free transfer. The 22-year-old joins PSG after being named the player of the tournament as Italy won Euro 2020 on Sunday. Paris St-Germain have completed the signing of Italy keeper Gianluigi Donnarumma on a free transfer.

He saved two penalties as the Azzurri beat England in a shootout. Donnarumma, who has signed a five-year deal at PSG, announced earlier this week he was leaving AC Milan after his contract expired. “I am very happy to be part of this great club,” he said.

“I feel ready to take on this new challenge, and continue to grow here. “With Paris, I want to win as much as possible and give joy to the supporters.” Donnarumma has 33 caps for Italy and has been their first-choice keeper under head coach Roberto Mancini. He made 251 appearances for Milan in all competitions after earning his debut at the age of 16.

He played in all but one of the club’s Serie A games in 2020-21, helping them finish second and securing a return to the Champions League after a seven-year absence. AC Milan have already signed a replacement for Donnarumma in France’s Mike Maignan, who helped Lille beat PSG to the Ligue 1 title last season.

PSG, managed by former Tottenham boss Mauricio Pochettino, were beaten by Manchester City in the semi-finals of last year’s Champions League, having been runners-up to Bayern Munich the year before.

Donnarumma is PSG’s third free transfer signing this summer, with Netherlands midfielder Georginio Wijnaldum, 30, joining after leaving Liverpool and 35-year-old Spain defender Sergio Ramos, moving after his Real Madrid contract ended. PSG have also signed Morocco right-back Achraf Hakimi, 22, from Inter Milan on a five-year deal.

PSG president Nasser Al-Khelaifi said they are “pleased to welcome” Donnarumma to the club and congratulated him on his Euro 2020 successes. He added: “Gianluigi will receive a warm welcome from everyone at the club, including his team-mates, our staff and all the Parisian supporters.”

Man United’s Marcus Rashford set to miss first 2 months of season. Rashford, 23, had a scan on Tuesday after being hampered by the problem in the latter half of the 2020-21 season. Manchester United striker Marcus Rashford may not play until the end of October after deciding to have surgery on a shoulder injury.

It was decided the damage was so severe that rest alone would not repair it and United hoped the England striker could have the operation immediately. However, the surgeon is not available until the end of July.

It is anticipated Rashford will be out for 12 weeks, which will be a blow to United boss Ole Gunnar Solskjaer’s plans for the start of the new campaign. The news emerged on the day Rashford’s England team-mate Jadon Sancho had a medical as his £73m move to United from Borussia Dortmund edged closer.

Rashford scored 11 goals in 37 Premier League appearances last season but did not make a significant impact for England at Euro 2020. He made five appearances for his country in the tournament but was only on the pitch for a total of 84 minutes then missed a penalty in the shootout as Italy beat Gareth Southgate’s side on penalties in the final.

Rashford – together with Sancho and Bukayo Saka, who also missed their spot-kicks – received racial abuse on social media after the game.

A mural of Rashford in Withington, Manchester, was also defaced. The damage has since been repaired and on Tuesday hundreds of people gathered for an anti-racism demonstration there. People have left hundreds of messages of support and solidarity at the mural.

On Monday, Rashford issued a statement apologising for his penalty miss but said he “will never apologise for who I am”. The statement added: “I’ve had a difficult season, I think that’s been clear for everyone to see and I probably went into that final with a lack of confidence.”

ConCourt judges to decide on Chief Justice Malaba’s fate

ConCourt judges to decide on Chief Justice Malaba’s fate. While the full reasons for the decision will be given later, the Constitutional Court agreed with the legal argument that it cannot abdicate its role set out in the Constitution and that every order on a constitutional matter by a lower court needs to be interrogated and confirmed by the Constitutional Court.

The Constitutional Court will now decide the validity of the High Court order blocking Chief Justice Luke Malaba from opting under the Constitution to stay in office for an additional five years after retirement age.

The full bench of the Constitutional Court, with only Chief Justice Malaba absent as he is at the centre of the case, dismissed an application by NGO Forum executive director Mr Musa Kika seeking the recusal of the entire bench from the case on the grounds that the judges were cited in the High Court case.

The court hearing was presided over by Deputy Chief Justice Elizabeth Gwaunza sitting with the other five judges.

Mr Kika had rushed to block the Constitutional Court judges from hearing Bulawayo man Mr Marx Mupungu who had approached the Constitutional Court for an order nullifying the High Court order. Mr Mupungu, represented by Professor Lovemore Madhuku, wants the Constitutional Court to rule that the High Court order is invalid unless confirmed by the Constitutional Court, and then he has asked for it not to be confirmed.

Mr Kika brought the original application to the High Court to have an order declaring that the recent constitutional amendment did not grant the sitting Chief Justice the right to opt to extend his term.

He then lost a second High Court application when he tried to block the Chief Justice resuming his office pending the outcome of an appeal.

Professor Madhuku and Advocate Thembinkosi Magwaliba, who was acting for the Ministry of Justice, Legal and Parliamentary Affairs, opposed Mr Kika’s application for recusal.

Prof Madhuku argued that the Constitution did not permit the recusal of all the judges of the Constitutional Court since there was no constitutional mechanism for constituting the court in the event of all judges recusing themselves. For that reason it was not competent to seek a recusal of all the judges.

“The Constitution does not permit the appointment of judges for a specific matter or the creation of a court for one case,” he said citing Section 164 of the Constitution which requires the courts to be independent at all times.

The constitutional law expert also argued that even if mass recusal was permitted, Mr Kika had not met the test for recusal. There was a presumption of judicial impartiality for all judges and a presumption that senior judges have a higher level of impartiality. The threshold for a successful challenge of impartiality was therefore high.

Adv Magwaliba by and large subscribed to Prof Madhuku’s submissions, but added that Mr Kika joining all the Constitutional Court judges in his original High Court proceedings was malafide and intended not only to embarrass the judges but to render it impossible for the Constitutional Court to hear any appeal or matter relating to the same issue.

Adv Magwaliba described this as a deliberate attempt to make the High Court order final. Mr Addington Chinake, who argued for the Judicial Service Commission, was in agreement with the two.

In his argument on behalf of Mr Kika’s application, Adv Eric Matinenga stressed the need to uphold the integrity of the court emphasising on the constitutional requirement of impartiality and independence of an adjudicating body given the circumstances surrounding a matter.

He said that because the judges were cited in the lower court, they were in an invidious position, so they should step down.

In the middle of his submission, Deputy Chief Justice Gwaunza asked Adv Matinenga if it was reasonable for all the judges to be recused, suggesting that it looked like there were cited specifically to disable all the judges from hearing this case, after the order of the High Court.

The court also benefited from the legal knowledge of Adv Tawanda Zhuwarara who was invited as a friend of the court. He clarified the law and made it clear that the court could not accept a position that would disable all the judges from hearing the matter.

He alluded to Section 175 (1) of the Constitution which he said institutionalises the court’s supervisory role by limiting every other court’s ability to issue effectual orders “concerning the constitutional invalidity of any law or any conduct of the President or Parliament.

“Put more sharply, no court can issue an order concerning the constitutional invalidity of any law or any conduct of the President or Parliament, unless such order is probed and confirmed by this court,” he said.

“It is from this vantage point that this court should conclude that it can neither abdicate nor avoid confirmation proceedings once initiated and are properly before it. Put differently, it is in cognisance of this court’s supervisory role that the present matter cannot be avoided and must be determined.”

Adv Zhuwarara added that once it is established that the declaratory order in Mr Kika’s case is one described in Section 175 (1) of the Constitution then the Constitutional Court must interrogate such decision in terms of the Constitution.

“Lest it be forgotten that our Constitution is designed in such a way that this court must have the final word in all questions constitutional,” he said. To this end, the court found favour in the arguments by the legal counsel opposing the application for recusal

“The application for recusal is dismissed. Full reasons of the court will be contained in the main judgment,” said Deputy Chief Justice Gwaunza.

She adjourned the hearing to tomorrow. However, Adv Matinenga indicated that he was not instructed to argue the matter and would not be available.

This comes as international financial institutions, such as the International Monetary Fund (IMF), have heaped praise on the country’s economic recovery trajectory much to the consternation of some in the opposition who are now working with the Western-funded NGOs to push the anti-Zimbabwe agenda.

Machanisations by the country’s detractors to derail the country’s development either clothed as non-governmental organisations (NGOs) or blunt opposition forces that do not wish the country any good must be exposed and consigned to history in 2023, President Mnangagwa said.

In his address to the Zanu PF Politburo yesterday, President Mnangagwa said the governing party will not hesitate to deregister meddling NGOs which are increasing their anti-Zimbabwe agenda as 2023 elections draw closer.

“Let us remain alive to the machinations by hostile forces and their allies to derail our programmes and projects. We know their form, agenda, strategies and nature. Detractors, sell-outs and their appendages must forever be silenced at the 2023 Harmonised General Elections,” the President said.

Zimbabwe goes to the polls in less than two years time, with pollsters projecting a Zanu PF landslide victory owing to the economic recovery and policies that resonate with the people.

“As the election season unfolds, we are observing a notable number of NGOs diverting from their operational mandates to delve into political matters, that amounts to interference in the internal affairs of our sovereign country.

“My Government will not brook any such disregard for our laws and will proceed to de-register all organisations found in the wrong. Party structures must be vigilant and expose such elements.

“Party structures, particularly the District Coordinating Committees office bearers in the Business Liaisons, Youth and Women League secretariats from the cell, branch, right up to provincial level in urban areas and growth points are called upon to implement robust mobilisation programmes to bring every urbanite to ZANU PF, the home of the people’s revolution,” the President added.

Under the Second Republic, and despite setbacks caused by Covid-19, the country’s economy is this year alone expected to grow by 7 percent with a multiplier effect on job creation and food security.

Underpinned by the National Development Strategy 1 (NDS1), the country’s inevitable march to becoming an upper middle-class economy by 2030 remains well on course buoyed by increased capacity utilisation, a bumper harvest and prudent fiscal and monetary policies that have seen inflation dropping while prices in shops have stabilised.

“It is noteworthy that the modernisation of both the party and Government has resulted in unprecedented economic successes. These are riding on the rebound of our agriculture, mining and manufacturing sectors. The tourism sector has equally seen increased investments while many airlines are indicating an interest to fly into Zimbabwe.

“The overall rebound of our economy has been acknowledged and received good reviews from the IMF and World Bank. A glowing light can never be hidden under a table; it shall eventually shine forth.

“Unfortunately, there are those lone voices and perennially pessimistic individuals who always wish gloom and doom on our economy and country. These personalities must be ignored with the hope that one day, they too will see the light, acknowledge the truth and speak well of their mother country,” he said.

Party structures, the President said must therefore take the success stories to all levels so that the population is aware of the achievements of the Second Republic.

“The evident progress and successes in the implementation of development projects and programmes under the National Development Strategy 1 must inspire us to do more for the people of our great country.

“Sustainable socio-economic and political development programmes within our party, involving farmers, students, professionals, the academia, women and the youth, must be rolled out more enthusiastically. “The centre of every programme must be the people and the betterment of their quality of life.

“Over and above this, our party must continue to reinvent itself, sustain its revolutionary legacy and grow from strength to strength. The revolutionary and Pan African ethos of emancipating and liberating the masses must always be kept alive.

“On the broader development agenda, the party must actively participate in the devolution programmes right from the ward level up to the provinces. It is these programmes that have far reaching impacts on the quality of the lives of our people.

“Hence, as we continue to prepare for the 2023 elections the party must equally use all available media platforms and its structures to continuously publicise party successes and ongoing projects at the grassroots levels,” he said.

MDC-Allisance trio’s trial postponed. She said their trial cannot commence before the High Court makes a definite conclusion on issues they took to the upper court.

Regional magistrate Mrs Vongai Guwuriro yesterday postponed to next month the matter in which MDC-Alliance members, Joana Mamombe, Netsai Marova and Cecilia Chimbiri, are alleged to have faked their abduction sometime in May last year.

Mrs Guwuriro postponed the matter to August 11 for routine remand saying she cannot supersede a High Court pronouncement. Mamombe, Marova and Chimbiri, who have been playing games aimed at delaying their trial, had opposed the commencement of their trial saying there was a High Court order that had stayed their trials.

The State led by Mr Michael Reza wanted the trial to commence saying he had agreed with the Prosecutor General to settle all the issues that Mamombe, Chimbiri and Marova were complaining of before the trial kicked-off.

“This is a long drawn matter. In April, the matter commenced before Mrs Makwande and they pleaded not guilty and were remanded to another date. In the interim, the accused made an application for review where they requested that the proceedings of April 28 be set aside and quashed,” said Mr Reza.

“They made a specific request that the matter be given to another magistrate and that myself Michael Reza be recused from the matter. Justice Chitapi quashed the proceedings and referred that the issue of Mrs Makwande be heard by another judge.

“Justice Chitapi dismissed their request that the prosecutor recuse himself. Justice Chitapi then referred the issue of Mrs Makwande to Justice Chinamhora to decide on that since he was seized with their other matters. The Prosecutor-General instructed me that the matter be taken to another magistrate and that one that has been done all will be settled.”

Lawyers Mr Alec Muchadehama, representing the trio, told the court that they have since placed the State on notice that they will make an application requesting further particulars, an application for exception to the charge and another application for referral of the matter to the Constitutional Court.

Zim receives 25 000 more Sputnik V doses. The managing director of Alrosa Zimbabwe Mr Sergey Loshkarev handed over the vaccines to Deputy Minister of Health and Child Care Dr John Mangwiro.

Zimbabwe has received 25 000 more doses of the Russian Covid-19 vaccine, Sputnik V, donated by diamond miner Alrosa Group. Last week, Zimbabwe received two million Sinovac vaccines and another 3.5 million jabs are expected before the end of the month in two batches of 1.5 million and two million.

The country is mainly using the Chinese-made Sinopharm and Sinovac vaccines which were granted Emergency Use Authorisation by the World Health Organisation (WHO).  Accordig to research, Sputnik V Covid-19 vaccine has 97.6 per cent efficacy.

After receiving the second batch of doses from Alrosa yesterday, Mangwiro implored those with unusual symptoms not to wait until it was too late. He said:

I want to urge fellow Zimbabweans that Covid-19 disease is real. Once you feel unusual symptoms like headache, vomiting, difficulty in breathing, or anything else, please go to the hospital as early as you can.

This disease gets worse over hours and or days people will be in bad shape. I want to emphasise that people should go to hospitals and other registered formal places where they can be helped.

At times people present late at health facilities and we end up losing them. Most of the cases that succumb would have delayed in seeking professional healthcare.

These 25 000 doses are the second doses of the 25 000 vaccines we received about three weeks ago and those vaccinated will now be able to be vaccinated in time for their second doses so that they are fully vaccinated.

He also thanked Alrosa Zimbabwe for the donation saying it showed a strong relationship between Russia and Zimbabwe. Zimbabwe has as of 14 July 2021 vaccinated at least 988 746 (first dose) and 624 894 (second dose).

4 police officers assaulted by soldier enforcing lockdown regulations. The cops allegedly got a thorough beating after they tried to get Nicolus Chinoza to close his facility in line with the ongoing lockdown restrictions.

A soldier running a bottle store in Chivi district, Masvingo, assaulted four police officers who were enforcing lockdown regulations after they found him selling alcohol way past the stipulated operational hours.

Chinoza, a Zimbabwe National Army (ZNA) sergeant based at Inkomo Barracks outside Harare appeared before Chivi magistrate Rutendo Jakati facing assault and resisting lawful arrest charges.

Magistrate Jakati remanded Chinoza out of custody to 30 July for trial. It is alleged that on 10 July in the evening, police constables only identified as Chidzura, Denya, Velapi, and Muguti were on patrol at Mhandamabwe Business Centre.

They noticed that Chinoza’s bottle store was still operating, in contravention of Covid-19 restrictions which imposed a curfew between 18:30 to 06:00 hours the next morning.

Bottle stores and most businesses are required to close at 15:00 hours. The court heard the police officers proceeded to the bottle store and found Chinoza in the company of his wife and other patrons.

Chidzura then alerted the military man he was under arrest for breaching the Covid-19 induced lockdown restrictions, but Chinoza became violent. Chinoza stated that he was a serving member of the ZNA, therefore, he can operate beyond prescribed business hours.

He allegedly charged towards Chidzura and pushed him on the floor ordering him to vacate his premises.

The other three police officers intervened but Chinoza became more violent and used chairs to assault the cops. The four cops eventually managed to arrest him before detaining him at Mashava Police Station.

Sivio: President Mnangagwa fulfilled only 2% Of 2018 Pledges. Statistics released yesterday by the Sivio Institute on the performance of government in 2021 show that out of the 237 pledges made in various sectors of governance, only five had been fulfilled.

Sivio Institute, an independent research body has said President Emmerson Mnangagwa’s Zanu PF government has fulfilled only 2% of its 2018 election pledges.

The report further claims that Mnangagwa managed to fulfil four promises on various issues around the economy and only one on governance, politics and civil rights. His government has, however, already started working on 27 of the promises, according to the report.

Among other things, the government pledged to enhance foreign currency retention thresholds for exporting firms, promote an export-oriented strategy and ensure that the country’s roads in both rural and urban areas are rehabilitated and maintained, projects which are all in progress.

Sivio Institute said on projects which are underway: Zimbabwe’s central bank, RBZ, on January 8, 2021, reversed a decision to force exporters, including mining companies, to sell a large portion of their United States dollar earnings if they were not used after 60 days.

Zimbabwe’s balance of payments position continues to strengthen, after surging 4,25% in 2020 compared to the same period last year on account of strong growth in exports.

Meanwhile, Mnangagwa recently boasted of having made “huge” progress in constitutional changes, where he has already signed 20 Bills into law since his ascension to power in November 2017.

According to his party’s parliamentary reform tracker, Mnangagwa’s government has drafted 44 constitutional changes and 27 are already in Parliament.

He added that there was no time for complacency urging his party to “continue to reform our economy, our infrastructure, and our country for the benefit of all!”

Sivio observed that while the government had also pledged to eradicate corruption in communities through promoting sound governance, inclusivity, transparency and accountability, “none of the promises have so far been fulfilled.”

There are concerns over continued financial losses to corruption every year, despite the existence of anti-corruption institutions.

Rhythm City comes to an end after 14 years

E.tv’s Rhythm City is promising viewers a happy ending. The soapie is coming to an end on Friday, 16 July, after 14 successful years. The channel said people will be surprised to see how the show will end.

“Rhythm City says goodbye to its loyal fans with an ending South Africa never expected. The show, which started on 9 July 2007, will have aired a total number of 3660 episodes by the 16th,” said e.tv.

It said people such as Fats (Mpho Molepo), Jafta (Sandile Dlamini), Sabelo (Ishmael Songo) and Sindiswa (Mbali Zakwe) will get their happily every after.

However, a different fate awaits Khulekani (Mncedisi Shabangu).

“This week will showcase a tale with beautiful endings, from Jafta and Fats finally finding the love of their lives, to Sabelo and Sindiswa moving into their own home, and Suffocate ending up sharing a prison cell with Khulekani.”

It also thanked viewers for a great 14 years.

Another doctor busted for conducting fake medical tests. Harare-based medical doctor, Michael Mandaza has been arrested for conducting fake medical tests at his private surgery at Pacific 24hr Hospital, located at Kamunhu Shopping Centre in the Mabvuku suburb.

The Zimbabwe Anti-Corruption Commission (ZACC) raided his offices and also ransacked his home in Zimre Park and confiscated cash. ZACC said in a statement following the raid on Monday:

Mandaza conducted fake laboratory tests to patients at his hospital, charging them US$60 per test when in fact, he does not own any laboratory and instead, was generating fake laboratory reports.

Investigators from ZACC discovered a date stamp for the alleged fake laboratory, medical records of patients subjected to the fake tests, laptops and other digital devices used to generate the fake laboratory reports at the hospital.

Further searches at Dr. Mandaza’s residence in Zimre Park also resulted in the confiscation of USD$15,000 and R2,000.

Several medical practitioners have in the recent past been found guilty of unethical conduct while scores have also been arrested for masquerading as medical practitioners when they are actually not.

Some have been operating surgeries without proper requirements, treating patients without proper training thereby putting the lives of members of the public at risk.

Former Mugabe loyalist Chipanga readmitted into ZANU PF. ZANU PF has readmitted its former Youth League leader Kudzanayi Chipanga, former Sports minister Makhosini Hlongwane, and several others at the party’s 353rd ordinary session of the Politburo. SPECIAL BRIEF FROM THE 353rd ORDINARY SESSION OF THE POLITBURO
The Party’s Politburo endorsed President ED Mnangagwa a’s call for NGOs and Civil Society Organisations to stick to their mandate or risk deregistration. The Politburo has reiterated the President’s clarion call for all the Party Structures at every level to remain vigilant and alert to the machinations of the enemies of the People’s Revolution.

On the South African Disturbances,
The Politburo received a report on the Diplomatic front from the Minister of Foreign Affairs and International Trade Honourable Dr Frederick Shave. A report on the disturbances obtaining in South Africa was tabled for deliberations. The Politburo resolved that although the rest of the region will be affected directly or indirectly economically, the situation in South Africa was still within the capacity of our fraternal friends, the ANC and its Government to resolve and hopefully, the chaos will come to an end sooner.

On Swaziland,
The Politburo received a Report on the disturbances in Eswatini by Minister Shava, which centred on the causes of the disturbances and clandestine activities of NGOs and other Civil Society Organisations as well as opposition groups calling for an elected executive arm of Government. Since the matter is under SADC currently, ZANU PF calls for calm and peace in Eswatini and encourages dialogue as a means to find a way forward.

On Mozambique
Minister Shava gave a report on Mozambique’s Cabo Delgado to the Politburo, where the Rwandese deployment to Mozambique was clarified. The President Cde ED Mnangagwa and the entirety of the Politburo agreed that Mozambique was a sovereign republic, capable of entering into bilateral agreements with other republics for her security interest. As such. there is no concern from Zimbabwe on that deployment. Zimbabwe on its part will be participating fully to help our brothers and sisters in Mozambique to deal with the Cabo Delgado unrest.

Annual People’s Conference Report
The final Report was on preparations for the Annual People’s Conference was done by the national Chairman. Cde O. C. Z Muchinguri. The Party is ready to hold the event physically or virtually depending on Covid-19 situation then.

State of Agriculture Report
The politburo received a report on the State of Agriculture by Minister of Agriculture. Lands, Fisheries, Water and Rural Settlement, Dr Anxious Masuka. The Report which was largely quantitative illustrated how the 2020/2021 Agriculture season comparatively had surpassed previous outputs. The Report also highlighted on deliveries to the GMB, Cottco, Tobacco Auctions, Barley etc and now our farmers were being paid. The Report also gave insights on the preparations that were being done ahead of the 2021-2022 Agricultural Season.

On Covid-9 Pandemic
The Party’s National Chairman who is also the Chairperson of the National Covidl9 task force gave a report to the Politburo on the dire situation in the country due to the third wave virus. The death rate in the country was declared worrying compared to the previous variants.

The Politburo applauded the President and First Secretary Cde ED Mnangagwa and our Government for declaring a Level 4 lockdown in the country to contain the spread of the pandemic, minimising deaths but at the same time, allowing the economic players to function in line with the W110 Protocols. Politburo also applauded people for heeding the call to be vaccinated.

Disciplinary Report As Adjudicated by the National Disciplinary Committee
1. Cde Dorothy Mhangami — The Cde expelled herself automatically in 2018 after contesting elections as an Independent having lost primary elections. The Politburo re-admitted her as a card-carrying and will only be eligible to contest an elected position

2. Makhosini Hlongwane — The Province recommended that he be readmitted into the Party because since his dismissal in 2017 over G40 cabal issues, he has shown remorse. The Disciplinary Committee and Politburo accepted his re-admission as an ordinary card-carrying member and can only be eligible to contest for elections after 3years.

3. Tapiwa Matangaidze – He was readmitted into the Party on condition that he will be an ordinary card-carrying member of the Party and will not contest for any election for 4years.

4. Cde Malinga Mpehlabayo – Was recommended for readmission by the Bulawayo Province. The Politburo after recommendations from the NDC he was readmitted as an ordinary card-carrying member on condition that he shall not contest for any election for 3years.

5. On Manicaland Province’s recommendation that Kudzanayi Chipanga be readmitted. the Politburo after serious deliberations, Cdc Chipanga was readmitted into the Party on condition that he does not contest elections for 3years. He is readmitted as an ordinary card-carrying member.

6. Cde James Kaunyc was readmitted into the Party from People first on condition that he be an ordinary card-carrying member who should not contest elections for 3years.

7. Cdc Taura Chiripambcri a former ZANU PF Councillor was also readmitted into the Party as an ordinary card-carrying member. Not to contest elections for 2ycars.

8. Cde Shepherd Makaha – Was readmitted as an ordinary card-carrying member for 2ycars on condition he does not contest for any election for 2 years.

9. Cde Nesbert Chasara – Was readmitted as an ordinary card-carrying member. Not to contest elections for 2 years.

10. Cde Talent Kadzima – Was readmitted into the Party as an ordinary card-carrying member. Not allowed to contest elections for 2ycars.

11. Cde Makanyanga – He defected to national People’s Party but the Politburo has readmitted him on condition he does not contest for elections for 3 years. He will be an ordinary card-carrying member.

12. Cde Ngonidzashe Mudekunye – readmitted to the Party on condition he will not contest elections for 2 years. He will be an ordinary card-carrying member.

13. Cde Fay Chung a decorated liberation stalwart was recommended for readmission unconditionally into the party. The decision was upheld unanimously.

14. Cde M. Mbowa – His application was referred to the Women’s League to be dealt with internally.

Commissariat Report by Cde Mpofu on behalf of the Acting Commissar The Commissariat has commenced receiving CVs for prospective primary election candidates for the pending by-elections.

Youth League Report
The Politburo received a report from Cde Chirau on the programs which the Youth League is holding nationwide focusing more on agriculture, small scale businesses and entertainment as they intensify their youth mobilisation.
