ZACC arrests Anglican Bishop over unsanctioned levy fees. Anglican Diocese of Manicaland bishop, Eric Ruwona, members of the church’s standing committee, and four principals were arrested for collecting unsanctioned levies from their schools.  A top Anglican cleric in Manicaland Province was this week arrested by the Zimbabwe Anti-Corruption Commission (ZACC) on corruption allegations.

Bishop Ruwona (51), Walter Majoni (35), Daphine Mudarikwa (45), Danisa Muchichwa (40), and Promise Kunyongana (30), who constitute the church’s standing committee, were on Wednesday jointly hauled before Mutare magistrate, Prisca Manhibi, facing charges of contravening Section 21(1) (a) (b) of the Education Act, Chapter 25:04.

They were each granted $60 000 bail, and ordered to report once every Friday at CID Mutare, and not to interfere with State witnesses.

Mutare District Area public prosecutor, Tirivanhu Mutyasira told the court that the suspects resolved that parents and guardians of pupils were to pay a pre-conditional mission fund of US$500 for Form One, and US$900 for Form Five pupils before they could be enrolled in the Anglican Diocese schools.

He said there was no option of payment plan for the mission funds as it was supposed to be paid once-off. As a result, the court heard, the parents and guardians were forced to pay US$276 250 at the five schools as mission funds. The respective school principals were also dragged to court for demanding and collecting the mission funds.

Meanwhile, St David’s Bonda Girls’ and St Mathias Tsonzo high schools principals, Tafadzwa Matanhire (30) and Loveshaw Mupondi (27), respectively, appeared separately before Mutare provincial magistrate, Mr Langton Mukwengi, facing extortion charges over the mission funds.

They were granted $40 000 bail each with reporting conditions. St Mary’s Magdalene principal, Bazel Matikiti (53), and St Faith’s Daniso Muchichwa (40) appeared before Manhibi over the same case. They were also granted $40 000 bail each.

The cases will go for trial on 4 November, and the State is in possession of receipts that were issued to the parents after paying the unauthorised mission funds. Those who paid the pre-conditional mission funds were duly given offer letters which will be produced in court as well as evidence.

Man hits armed robber with a car and disables him. The suspected armed robber, identified as Obey Mhuru of 3419 Makondo, Chiredzi, is now admitted under police guard at Beitbridge District Hospital after experiencing back, facial and numerous other body injuries.

A would-be victim of armed robbery in Beitbridge hit the AK-47-wielding assailant with a car, disabling him until he was arrested. Nigel Moyo, a resident of the border town, had arrived home when he saw a stranger carrying an AK-47 gun in his yard after midnight last Friday.

Moyo accelerated towards the stranger and hit him with a car, trapping him underneath the vehicle. A police officer who attended the scene told NewsDay that the assailant was rendered immobile until the police arrived. Said the officer:

He was dragged by the car for about 40-50 metres and was dumped outside the gate. My brother then went to get the police and upon their return, they found Mhuru lying outside the gate with his gun next to him.

After rendering him immobile, he drove to the police and Mhuru to the hospital. Mhuru disclosed that he had stolen the gun from a car in Baobab in the town.

Community throws a party for Headmaster who worked at the school for 27 years. The Donkwedonkwe community in Matobo district, Matabeleland South province, held a farewell party for headmaster Maxwell Nyathi, who served its high school for 27 years.

Nyathi was described as a hardworking and committed civil servant who contributed a lot to the development of the school and the community through his sound administration.

Speaking in an interview with Southern Eye, Donkwedonkwe School Development Committee vice-chairperson Lameck Ncube said they decided to give Nyathi a token of appreciation as a community, celebrating his contributions at the school he joined in 1994. Said Ncube:

Many children who are products of the school are now doctors, lecturers, while others are in South Africa occupying high positions at their workplaces. He is a humble man who interacted well with the community.

Former head boy, former school teacher and former director of music group African Stars, which was started at the school, Sehliselwe Khumalo, said Nyathi had a charismatic approach to issues. He said:

Through him, I became a head boy, a former teacher at the same school and former director of the African Stars music group that has become a hit on the radio of late. I am now a practising lawyer and I owe it to his administration.

Nyathi, who grew up in Matobo District, said he was leaving the school a happy man after 27 years of commitment to the learning institution and the community. He said: I am excited and leaving the school a happy man after spending 27 years trying to inspire confidence at the school.

Apostolic sect seeks to join ZANU PF

Apostolic sect seeks to join ZANU PF. The apostolic sect’s leader, Bishop Andby Makururu, held a meeting with the ZANU PF secretary for finance and acting political commissar, Patrick Chinamasa, on 2 September.

The Johane Masowe WechiShanu WeAfrica has applied for official affiliate status with ZANU PF and in return, the sect leaders would rally their followers to vote for the ruling party.

Makururu was accompanied by 37 members drawn from the district and provincial leadership ranks, including members of the 250-large “prophetic counsel”. Chinamasa confirmed the meeting in a series of tweets. He wrote:

The meeting explored modalities for collaboration between the church and ZANU PF, especially in the area of economic empowerment, agriculture, mining, touring etc … They applied for affiliate status with ZANU PF and I briefed them on the requirements.

According to Chinamasa, some of the demands include sharing ZANU PF values, preservation and defence of the national interest, national sovereignty and territorial integrity of Zimbabwe, resolutely opposing tribalism, regionalism, nepotism, corruption, racism, religious fanaticism, among others.

The church promised to fulfil ZANU PF’s requirements. When contacted for his comment by NewsDay, Chinamasa said he was in a meeting.

ZANU PF acting spokesperson Mike Bimha and Tafadzwa Mugwadi, the party’s information director, refused to comment, referring the NewsDay to Chinamasa. The ruling party has traditionally drawn massive support from the apostolic sects, especially during elections.

In February 2019, Apostolic Christian Council of Zimbabwe president Johannes Ndanga said President Emmerson Mnangagwa was God-ordained while addressing mourners at the burial of United Apostolic Church Independent Church of God Archbishop Chiutsi Zihowa Motsi in Mt Darwin.

Arsenal beat Aston Villa 3 – 1. Thomas Partey headed in Smith Rowe’s corner for his first goal for the Gunners – having earlier hit the crossbar. Right at the end of the first half, Arsenal were given a penalty after a long video assistant referee review for a Matt Targett foul on Alexandre Lacazette.

Arsenal boss Mikel Arteta has praised Emile Smith Rowe for changing his lifestyle after the 21-year-old midfielder helped the Gunners to a thoroughly deserved victory over Aston Villa as they moved into the top half of the Premier League table.

Pierre-Emerick Aubameyang’s penalty was saved excellently by former Arsenal keeper Emiliano Martinez, but the Gabon striker put home the rebound from close range.

Villa improved on a thoroughly wretched first half, but Smith Rowe scored Arsenal’s third 11 minutes into the second half. He won the ball in his own half and then finished the move via a deflection and the post.

The visitors got a consolation when Jacob Ramsey curled his first Villa goal into the top corner from 20 yards. They put on good pressure and created a few chances in the closing stages but it was too little, too late. Villa saw two bids for England Under-21 international Smith Rowe turned down in the summer, with Arteta insisting he was never worried he would leave the Emirates Stadium.

Smith Rowe now has two goals and two assists this season and Arteta has been pleased with the development of the academy graduate. He said: “When you want to take the game to the next level, when you become a real important player in such a big club, that should be the only priority and every detail is important and relevant.

“You have to make him aware of that, you cannot give percentages away that can make big differences and he has changed that. “There is no complaining, he is just looking forwards, he is really determined, he has changed the way he is living as well a little bit and some of the habits that he had and he’s been superb.”

This did not look like a game between two teams sitting next to each other in the table – but Arsenal were 12th and Villa 13th before kick-off.

Arsenal are capable of good spells – like at the start of Monday’s 2-2 draw with Crystal Palace – and good games – like the 3-1 win over Tottenham. This was one of the good games, well for 80 minutes.

Aston Villa were the opposite of their 3-2 defeat by Wolves. They collapsed there in the final 10 minutes – but this time that was when they had most of their chances.

They did not manage a shot in the first half, the first time since May 2018 that has happened to a team playing against Arsenal in the league. The Gunners should have been out of sight – Partey had hit the woodwork from close range before headed them into the lead. Aubameyang had a goal disallowed for a debatable Lacazette foul and Martinez made several smart saves.

But Arsenal got the second they deserved in first-half injury time. The crowd thought Craig Pawson was whistling for half-time but he was actually stopping play for a VAR consultation.

Targett was about to clear the ball when Lacazette stepped across him and drew a foul instead. The penalty was given and Aubameyang scored at the second attempt.

Villa had more threat when they brought on winger Leon Bailey for defender Axel Tuanzebe at half-time, but after their first couple of chances, Smith Rowe wrapped it up.

Or so it looked until Ramsey scored the best goal of the game. Ollie Watkins, Ramsey and Bailey all had chances to for Villa but could not set up a tense finale.

Smith ‘confused’ about penalty
Aston Villa manager Dean Smith told BBC Sport: “First half we got dominated physically. I can take the second half. I don’t expect us to get dominated physically though. You can’t give teams in the Premier League a head start.

“We knew Arsenal would start quickly but we allowed them to control the first half. “I am confused about the penalty. We spoke at length [before the season] about the lower-contact frivolous penalties. “I have seen it once and can’t work out if he touches ball first or man. If we are looking at a penalty that long maybe they aren’t given.”

Bulawayo-Beitbridge road accident kills 3 and leaves 7 injured. According to a statement from the Zimbabwe Republic Police (ZRP), a Toyota Hilux with nine passengers on board, burst a rear left tyre, veered off the road, overturned and landed on its roof at the 198 km peg along the Bulawayo-Beitbridge road.

Three people were killed while seven others were injured in a horrific road traffic accident that occurred yesterday (Friday) afternoon a few kilometres from Gwanda town.

The victims all died on the spot while the seven who were injured were ferried to Gwanda Provincial Hospital where they were admitted. Police posted on Twitter:

The ZRP confirms a fatal RTA which occurred on 22/10/21 at 1530 hrs at 198 km peg along Bulawayo-Beitbridge Rd, in which three people died on the spot while seven others were injured.

A Toyota Hilux vehicle, with nine passengers on board, burst a rear left tyre resulting in the vehicle veering off the road before it overturned and landed on its roof.

The bodies of the victims were taken to Gwanda Provincial Hospital for post-mortem while the injured were admitted to the same hospital. The police said they will provide more details on the accident in due course.

Minister of Sport Kirsty Coventry: Norman Mapeza understands our football. Coventry said appointing Croatian Zdravko Logarusic as Warriors coach keeping him in the job that long was a mistake. Youth, Sports, Arts and Recreation Minister, Kirsty Coventry believes local coaches are the best for the senior men’s football national team.

She said her office only learnt at a later stage that the Croatian would come into the country when the national team had an assignment and fly out soon after.

Coventry said the appointment of FC Platinum coach Norman Mapeza as Logarusic’s replacement was a step in the right direction. She said: I think the appointment of the new coach is a move in the right direction. We really need someone who understands our game.

I might not have been a team player in my days as an athlete, but I have learnt that for anyone to be a good coach, they need to have a better understanding of the players and environment. That is something that lacked under Logarusic.

In fact, I only came to learn later that he was flying into the country a few days before an assignment, and would fly out soon after. That is not ideal. It was actually a mistake to have allowed that situation to prevail.

Now that we have Norman Mapeza, it is a step in the right direction. I hope going into the future, we will continue embracing some of our former players, and give them roles in our national team technical set-up.

We really need these former players because of their deeper understanding of the environment and style of play. Coventry was speaking in an interview with Manica Post at the Nyanga/Mutasa Community Tournament where she was the guest at DC Mutasa Ground last week on Saturday.

9-year-old student kicks colleague to death whilst playing kicking game Kigida. In a statement, this Saturday, ZRP spokesperson Assistant Commissioner Paul Nyathi implored members of the public to respect the sanctity of life and try to settle differences without resorting to violence.

The Zimbabwe Republic Police (ZRP) has expressed concern over a surge in senseless murders across the country emanating from petty disputes. In one such incident, a nine-year-old Grade One pupil assaulted another Grade One learner aged twelve whilst they were playing a kicking game known as “Kigida” or “Magadu” on Friday last week.

The incident took place at Tokwane Ngundu Primary School in Masvingo and the victim died on Wednesday this week at Dohwai Village, Masvingo. Below is Asst Comm Nyathi’s statement in full:

MURDER CASES IN BEITBRIDGE, MASVINGO, SIAKOBVU, BULAWAYO AND LUPANE

The Zimbabwe Republic Police is concerned with the loss of lives through murder. Most of these cases are emanating from petty disputes which can be easily resolved by engaging third parties such as church and traditional leaders, relatives, and others.

On 22nd October 2021, a male juvenile aged 16 ran amok and fatally struck Sarina Mbedzi (24) with a wooden stick before strangling her two children, Thanganedzo Mbedzi (6) and Phidzuro Mbedzi (5) at Village 27 Fula, Beitbridge.

He dragged their bodies into a kitchen hut which he set on fire, resulting in the three being burnt beyond recognition. Police recovered a Mobicel cellphone and ZAR 72.00 cash from the suspect.

The teenager is on free bail for another case of murder for killing his aunt, Muhlaba Mbedzi (62) in April 2021 in Fula Village, Beitbridge.

In another case of murder, a nine-year-old grade one pupil assaulted another grade one learner aged twelve whilst they were playing a kicking game known as “Kigida” or “Magadu” on 15th October 2021 at Tokwane Ngundu Primary School in Masvingo. The victim died on 20th October 2021 at Dohwai Village, Masvingo.

In a related case which occurred on 20th October 2021 at Siakaloba Village, Siakobvu, Responsible Siazemba (22) was stabbed with a knife on the groin by his brother, Lloyd Siazemba (18) after the victim became violent whilst they were thatching a bedroom hut together with their other brother, Joseph Siazemba (25).

Responsible Siazemba charged towards his brothers whilst armed with an axe after he allegedly felt disrespected by his young brother, Lloyd Siazemba who had assigned him to bring thatching materials.

On 2nd October 2021, Thulisiwe Ndlovu (38) was assaulted with open hands, booted feet and a stone by Thulani Ndlovu (40), Mkokeli Ncube (31) and Nephani Sibanda (31) at a beer drinking spree in Pumula North, Bulawayo after a misunderstanding over beer. The victim was referred to Mpilo Hospital where he died whilst on admission on 21st October 2021.

Meanwhile, on 21st October 2021, Gilbert Ndlovu (33), who is a suspected mental patient, fatally struck Jerot Sibanda (61), with an axe on the head for an unknown reason, at Dheka Village, Lupane. The Police urge members of the public to respect the sanctity of life and try to solve disputes amicably.

Minister of State for Masvingo Province Ezra Chadzamira implicated in Chief Charumbira violence. Village heads and villagers in the area alleged that Chadzamira was responsible for fomenting and organising the violence.

Minister of State for Masvingo Province, Ezra Chadzamira, has been implicated in the politically motivated violence that rocked Chief Charumbira’s home area last week. The violence was meant to stop MDC Alliance leader Nelson Chamisa from visiting the Mutema family where he wanted to pass his condolences.

Speaking to The Mirror in separate interviews, the village heads said the perpetrators of the violence were prostitutes, hooligans and unemployed youths. They said the thugs were hired by Chadzamira and Ward Six Councillor, Wellington Mahwende, from the gold panning town of Mashava.

Also fingered in organising the violence is ZANU PF Ward 10 councillor Sengerai Manyanga. Chamisa’s convoy was stoned and Ward Five councillor, Daniel Mberikunashe was injured in the melee.

Meanwhile, Mahwende distanced himself from the allegations saying he lives next door to a house where Chamisa intended to have a private executive meeting. The house belongs to an MDC Alliance member and the meeting ended prematurely after it was disrupted by the police. Said Mahwende:

I didn’t have anything to do with what happened in the Charumbira area. I think my name is being dragged in the mud because I live next Wilstaf Stemere’s house. There was no way I was going to leave my house because there was an MDC meeting next door.

No one can speak on behalf of ZANU PF except Patrick Chinamasa, national spokesperson or provincial spokesperson. So, anyone who is claiming to be a ZANU PF member and is saying Mahwende was part of the organisers of political violence is just hallucinating.

Contacted for comment by The Mirror, Chadzamira said he didn’t own any thugs arguing that people who demonstrated wanted to send a message to Chamisa that they didn’t want sanctions.

However, village head Mudawose Govo who admitted to being a strong ZANU PF supporter, said he did not condone violence. He said that the perpetrators of violence were from Mashava and were organised by Chadzamira who is also the MP of Masvingo for Masvingo West. Govo said:

We are ZANU PF supporters and it’s fact. We are even proud of it but we are not violent. We voted Chadzamira, but he is now encroaching on community leadership issues. He is the one fanning fights between Chief Charumbira and Chief Bere that is why he bussed people to commit violent acts in Charumbira’s backyard.

Horror as man lures wife’s lover and kills him. Sources told The Mirror that in the evening before the fateful day, Tafirei clashed with his wife Brenda Ainos (23) over a love message received from Manatsa. A man from Chivi District, Masvingo Province, was last week on Thursday killed in cold blood by the husband of a woman he was having an adulterous affair with.

The victim, Josiah Manatsa (36), was lured to a borehole by the aggrieved husband, Laurey Tafirei (25) of Madungwe Village under headman Watungwa, using phone messages who then stabbed him to death. Masvingo provincial police spokesperson Kudakwashe Dhewa confirmed the incident which took place on 15 October.

Tafirei grabbed his wife’s phone and continued chatting with Manatsa as if he was Ainos. At around 4 am, he armed himself with a knife and a catapult and invited Manatsa for a nice time by the village borehole.

Oblivious of the source of the message, Manatsa obliged and went to the borehole where he was stabbed in the back and chest by the accused. Tafirei left the scene after committing the crime and went and reportedly told his friend Silas Midzi (40) about the incident.

Tafirei and Midzi then went to report the issue to the village head Hikira Madungwe (79) and the three went to the scene where they found Manatsa lying in a pool of blood. Tafirei who was now in a state of panic ran away from the scene but was later apprehended by the police.

George Charamba claims to hold Kompromat on Nelson Chamisa. President Emmerson Mnangagwa’s spokesman George Charamba says he will expose an altercation between MDC Alliance leader Nelson Chamisa and his security detail.

He did not reveal where and when the alleged quarrel took place or what it was about. Chamisa recently toured Masvingo and Manicaland provinces where he was attacked several times by suspected ZANU PF supporters.

Posting on Twitter using his @Jamwanda2 handle, Charamba promised to release recordings of the alleged altercation between Chamisa and his aide. Oga flexing: Flies Lobola cattle from Nigeria to Zimbabwe for his Fiancée. A Nigerian man, who married a Zimbabwean woman, promised his in-laws that he will fly cattle from his home country for the payment of roora/ lobola (bride price).

Adewale Yusuf Olayiwola married his fiancée Nunurai Colleta Mudarikwa, daughter to Uzumba MP Simbaneuta Mudarikwa (ZANU PF) and his wife Verna Muromba Mudarikwa in Mutoko. Adewale, who is from Nigeria’s Osun State Province reportedly paid at least US$10 000 cash.

Mudarikwa’s Nigerian son-in-law is in Real Estate and Logistics entrepreneurship in both Nigeria and South Africa.

He was represented by his father’s brother, Ishmael Olayiwola, two men and a woman all from Nigeria during the marriage rituals. Speaking to H-Metro, the bride, Nunurai, expressed excitement following her marriage to Adewale. She said:

I am excited because today is my birthday and I am getting married to Adewale. We met about five years ago through mutual friends at a friend’s house. In fact, we started off as friends and we eventually started dating.

I do not tolerate cheating and it helped me in my relationship. I do not have the emotional capacity, so I cannot stay with a cheating man, even if I get that my husband is cheating on me, I won’t stand it. She said cultural differences made the marriage a bit of a challenge but they managed to mix the two to come up with a hybrid culture. Said Nunurai:

The only challenge that I faced is that my husband is Nigerian, so cultural differences were kind of a challenge for both families at some point. However, we managed to have a mix of both and we ended up with our own culture.

Joshua King’s hat-trick helped Watford to a stunning first win under Claudio Ranieri as Everton collapsed in a pulsating Premier League game at Goodison Park.

Tom Davies put the hosts ahead early on but Watford equalised before the break-through King from close range. Former Hornets striker Richarlison put Everton ahead again but Juraj Kucka’s header drew Watford level.

King, who didn’t score for Everton during his spell there in the first half of 2021, then struck twice inside six minutes before Emmanuel Dennis put the seal on an incredible comeback. While Watford had never won at Goodison in any competition before this match, Ranieri has happier memories of trips to Everton – this was his fifth consecutive win at the ground.

Crystal Palace, Newcastle play to a 1-all draw. Graeme Jones, Bruce’s former assistant, took charge of the visitors at Selhurst Park following the 60-year-old’s dismissal by the club’s new Saudi-backed owners on Wednesday.

Callum Wilson’s magnificent overhead kick canceled out Christian Benteke’s opener as Newcastle held Crystal Palace to a draw in the Magpies’ first game since the departure of manager Steve Bruce.

The Magpies were second best for the majority of the game but earned a share of the spoils when Wilson sent an acrobatic volley into the top corner after Palace had failed to clear a Newcastle corner.

Eagles striker Benteke had opened the scoring 11 minutes into the second half, powering a header into the bottom corner from Tyrick Mitchell’s deep cross.

Benteke also struck the woodwork in both halves, heading Michael Oliseh’s teasing delivery against the foot of the post in the first before sending a looping header onto the top of the crossbar in the second.

In an eventful afternoon for the Belgian striker, he spurned a glorious opportunity to restore Palace’s advantage when he fired into the side-netting from James McArthur’s through ball, before having a late goal ruled out by VAR for a foul against Marc Guehi.

Palace’s sixth draw of the season leaves them in 15th place – five points above Newcastle, who remain second bottom on four points and without a win this season.

Newcastle’s new owners have said the appointment of a new manager “will be announced in due course” after relieving Bruce of his duties just 13 days after the Saudi Arabian-backed £305m takeover of the club.

Bruce’s exit was met with relief bordering on jubilation by the vast majority of Newcastle supporters – but there was little for the travelling Toon Army to get excited about in the early stages on Saturday as Palace dominated possession.

The closest the visitors came to a first-half breakthrough was when Wilson fired into the side-netting from a tight angle after Emil Krafth’s goal-bound effort was cleared by Guehi.

It seemed only a matter of time before Palace doubled their advantage once Benteke had nodded the hosts into a thoroughly deserved lead, but Wilson sent the away fans wild with a magnificent strike into the top corner from Krafth’s flick-on.

The former Bournemouth striker has now scored six goals in his last six Premier League appearances for the club.

The Magpies rode their luck late on as Benteke’s strike was disallowed, but interim manager Jones will have appreciated his team’s resilience in his first of two games at the helm before a new manager is due to be appointed.

Leeds, Wolves play an exciting 1-all draw. Wolves looked to be heading for a fourth successive top-flight win for the first time since 1972 after Hwang Hee-chan gave them a first-half lead. Rodrigo kept his nerve to convert an injury-time penalty as Leeds snatched a draw from their Premier League clash with Wolves at Elland Road.

But the introduction of 19-year-old Joe Gelhardt by Leeds just after the hour proved an inspired move by Marcelo Bielsa. The former Wigan forward brought a superb save out of Jose Sa and then, as Leeds piled forward at the end, weaved his way into the box, where he was brought down by Nelson Semedo.

The result keeps Leeds outside the relegation zone but seems to have come at a price as playmaker Raphinha needed to be helped down the tunnel after being caught by Romain Saiss’ sliding tackle.

Gelhardt saves the day for Leeds

It was perhaps no surprise Rodrigo snapped the corner flag in delight as he ran away to celebrate after sending Sa the wrong way. As with his team as a whole, it was a frustrating afternoon for Leeds.

The rapturous reception Kalvin Phillips received as he emerged for his first warm-up of the day after being named on the bench by Bielsa after recovering from a calf strain was an indication of how key the England midfielder is to the West Yorkshire side.

With Patrick Bamford sidelined as well since the middle of September, it is little wonder Leeds have lacked the decisive edge that earned them so many plaudits last season.

The sight of Raphinha sprinting back 40 yards into a Leeds half empty other than goalkeeper Illan Meslier to retrieve the ball after it had been hacked clear by the Wolves defence was not really the way the hosts needed him to be in possession.

Chances were few and far between for Rodrigo and, until Gelhardt was introduced, the best Leeds could manage were efforts from Jack Harrison and Tyler Roberts, neither of which threatened the Wolves goal.

The fear for Leeds now will be the length of Raphinha’s absence, although at least Phillips should be available for a very important trip to bottom club Norwich next weekend.

Four in six for loan star Hwang
Wolves inserted an option to buy into the loan deal that brought Hwang to Molineux from RB Leipzig at the end of August. Given the forward’s impact already, it might be worth triggering it.

With the exception of Jimenez, Wolves have found goals hard to come by since they returned to the top flight in 2018 and when the Mexican suffered a fractured skull in November that ruled him out for the rest of last season, the failing almost landed them in trouble.

There was nothing pretty about Hwang’s latest effort. Fast reactions meant he was able to get a shot off after Jimenez’s effort hit him. Questions should be asked of Harrison though after the former England Under-21 international opted to move in for a tackle on Semedo by the touchline, when the Portuguese wing-back was going nowhere.

Harrison’s error allowed Semedo to skip into a danger-area, after which Leeds were always in trouble. Wolves were largely content to sit on what they had after that, earning the ire of the home fans for the number of times they went down following tackles.

It also appeared objects were thrown towards the visiting players by fans behind the goal Wolves defended in the second-half, although referee Robert Jones did not seem to get involved.

Southampton beat Burnley 3 – 2 . Burnley are yet to win this season but Cornet smashed in an impressive equaliser to share the spoils. Cornet had given the visitors the lead before the impressive Tino Livramento equalised for Saints. Maxwel Cornet scored twice as Burnley claimed a point in an entertaining draw with Southampton at St Mary’s.

The hosts grew into the game and went in front when Armando Broja scored his second goal in as many games to capitalise on James Tarkowski’s mistake. Cornet’s third Premier League goal in as many starts was not enough to lift the Clarets out of the relegation zone and they remain 18th. Saint drop to 16th after Watford’s win at Everton, four points above Burnley.

New signings shine on the south coast
October may be too early for games to be dubbed six-pointers, but this one was a ‘must not lose’ rather than a ‘must win’. Both Southampton and winless Burnley have had disappointing starts to the season, although the former ended their run of seven matches without victory with three points against Leeds in their last outing.

With just four points separating the sides at the wrong end of the table, Burnley started well as Cornet, the club’s £15m record summer signing from Lyon, headed them into the lead from a Matthew Lowton cross.

Saints were sloppy but their main threat came down the right through teenage full-back Livramento, who joined from Chelsea in the summer. He delivered several testing crosses into the Burnley box before cutting in on his left and hitting the post with a curling effort.

His reward finally came as he rose highest to head Nathan Redmond’s corner into the roof of the net, before Chelsea loanee Broja drove at goal and fired his side in front, after Tarkowski played the ball straight to Ibrahima Diallo.

Livramento, 18, and Broja, 20, have played together in the Chelsea academy since the age of nine but Saints are the beneficiaries of the Cobham production machine. Ivory Coast international Cornet showed his class again as he span his defender to smash in the equaliser, and all three players will be key to their side’s chances of moving away from danger this season.

Phil Foden scored a brace as Man City thump Brighton Hove 4 – 1. Pep Guardiola’s side scored three goals in the opening half-hour as Brighton, who could have gone above City with a win, simply could not cope with the away side’s sweeping attacks. Phil Foden scored twice as Manchester City produced a devastating first-half display to beat Brighton and move up to second in the Premier League.

A brilliant hooked clearance off the line by Lewis Dunk from Gabriel Jesus’ shot in the 10th minute was only a brief reprieve for the hosts as City took the lead three minutes later.

Seagulls goalkeeper Robert Sanchez dropped a routine save from a deflected shot at the feet of Bernardo Silva, who quickly found Ilkay Gundogan to score from close range.

The visitors made it 2-0 after a devastatingly quick break from a Brighton attack, charging up the pitch before Jack Grealish flicked the ball into Foden’s path and the forward made no mistake for his third goal of the season.

Foden got his fourth of the campaign just moments later as Jesus’ shot deflected off him after Sanchez could only stab away Grealish’s low effort at the near post.

The England international almost got his hat-trick just before half-time but Sanchez made a fine save to keep out a curling effort. Brighton were better after the break and Ederson had to be alert to keep out decent efforts from Pascal Gross and Leandro Trossard.

Ederson was finally beaten in the closing stages when Enock Mwepu was brought down inside the box and Alexis Mac Allister just managed to get the ball past the City goalkeeper’s dive.

Brighton came from two goals down to beat Guardiola’s side last season but there was to be no fightback this time as City wrapped up the win when an unmarked Riyad Mahrez rifled home in stoppage time as the visitors moved back to within two points of leaders Chelsea.

Slick City firmly in their groove
City started this season with a 1-0 defeat by Tottenham but if that produced any concerns about their ability to mount a strong title defence they have long since been eradicated.

They have not lost a Premier League game since and the past seven days have seen them at their attacking best, with 11 goals scored in their past three games and just two conceded.

Brighton had come into this game having conceded just two goals in open play in the Premier League after an excellent start to the season, but City got three against them in just 31 minutes as the hosts punished almost every slight mistake the Seagulls made.

City had nine shots on target in the first half – the most by any side in the Premier League this season – and while they were far below that level after the break, the damage had already been done.

Brighton will take heart from a second-half performance that showed their early season form is not a blip, although City did come to life after Mac Allister’s late goal.

City have now taken 20 points from the past 24 on offer in the Premier League and show no signs of slowing down in their pursuit of back-to-back league titles.

President Mnangagwa cornered

President Mnangagwa cornered. In the explosive lawsuit, party member Sybeth Musengezi is demanding that the court follow the precedent set by the opposition MDC-T case in the Supreme Court and force Mnangagwa to step down.

President Emmerson Mnangagwa is cornered in a high-stakes internal power struggle manoeuvre over his dubious legitimacy as Zanu-PF leader in the aftermath of a devastating High Court application by a party member – which reflects factional strife and his faltering grip.

This comes as The NewsHawks has received huge feedback from various political sections, including Zanu-PF bigwigs and ordinary members, showing that the court case has set the cat among the pigeons ahead of the party’s annual conference at the end of this month.

The shifts and changes within Zanu-PF structures amid a state of flux are also being fuelled by the political brinkmanship fixated on the party’s delayed elective congress before the 2023 general elections.

This is over and above the main contention in the application, widely shared in the party, that Mnangagwa should relinquish the leadership, as he was installed illegally through a kangaroo Zanu-PF central committee meeting on 19 November 2017 at party headquarters in Harare. The meeting was unlawfully convened, constituted and conducted, the High Court application by Zanu-PF member Musengezi demanding Mnangagwa’s removal says.

The court challenge against Mnangagwa’s ascendancy by Musengezi has echoes of the messy MDC-T infighting that erupted following the death of founding leader Morgan Tsvangirai in February 2018. Mnangagwa’s unconstitutional and unlawful rise to power is thus now entangled in the MDC-T case precedent. Courts usually work through precedents.

Precedent refers to a court judgment that is considered as authority for deciding subsequent cases involving identical or similar facts, or similar legal issues. The similarities between the Zanu-PF and the MDC-T cases are close. Musengezi is alive to that reality in his application.

“I am fortified in my quest for a remedy to my grievance against the respondents (Zanu-PF, Mnangagwa, Obert Mpofu, Zanu-PF secretary for administration, Patrick Chinamasa, Zanu-PF secretary for finance and acting national commissar, Phelekezela Mphoko, former vice-president, and Ignatius Chombo, ex-secretary for administration) by a recent judgment of the Supreme Court of Zimbabwe handed down on the 31st of March 2020 in the matter of the Movement for Democratic Change & Others v Mashavira & Others Sc 56/20, wherein the Supreme Court of Zimbabwe made a corrective intervention in the internal affairs of the Movement for Democratic Change party and made an order for the regularisation of the election of the leadership of that political party in the interests of justice despite the passage of time and the mootness of the case,” Musengezi says.

“The Supreme Court in the said judgment held that it is a matter of public importance as regards the governance of political parties generally that the leadership of the political party is constitutionally and lawfully ensconced.” Musengezi said the political stakes were much higher in the current Zanu-PF case than in the MDC-T one.

“The stakes in the present matter are much higher and cry out for the corrective intervention of this honourable court as the beneficiary of the chain of events which commenced with the unlawful special session of the central committee convened on the 19th of November 2017, the 2nd respondent (Mnangagwa), now occupies the positions of both president and first secretary of the party and President and head of state of the country. His ascension to both those positions is tainted by blatant illegalities in violation of the constitution of the 1st respondent (Zanu-PF). He cannot derive any legitimacy at all from the catalogue of illegalities which were committed in furtherance of his ambition to occupy the two offices of the party and the country.

“My fear is that once one assumes a position of political power illegally, they are prone to engaging in further illegal conduct to retain and consolidate that power. If such illegalities as were committed in propelling the 2nd respondent to the political positions he currently occupies in the party and under the country’s constitution go unchecked, it will become the norm in the party which is contrary to its aims and objectives as enshrined in the party constitution.”

Mnangagwa is locked in a cut-throat battle with Vice-President Constantino Chiwenga over the party’s unresolved leadership issue following the toppling of the late former president Robert Mugabe.

The infighting between Mnangagwa and Chiwenga – just like Mugabe and Mnangagwa before that – is manifesting itself through different events in the party and government, as well as business and civil society. Musengezi, a Zanu-PF member of good standing for 20 years, says Mnangagwa was unconstitutionally and unlawfully elected by the central committee meeting of 19 November 2017 – five days after the military coup that ousted Mugabe.

As a result, Musengezi is seeking a declaratur against Mnangagwa that the special session of the central committee after the coup at party headquarters in Harare from 10am to 4pm was ultra vires the Zanu-PF constitution, unlawful and thus null and void ab initio.

He also wants the court to rule that all the resolutions of the central committee meeting passed during its unlawful gathering to install Mnangagwa as party leader were “unlawful, invalid and are accordingly set aside”.

Further, Musengezi says Mphoko should temporarily take over the Zanu-PF leadership and preside over an extraordinary Zanu-PF congress to be called within 90 days of the granting of the order to regularise the leadership positions to ensure Mugabe’s successor is installed constitutionally and legally.

As things stand, Mnangagwa has no mandate to be the leader of Zanu-PF and President of Zimbabwe, the application suggests. He came in through a string of illegalities which have not been cured, meaning he is an illegal President of the republic.

Besides the coup and his 2018 disputed election, Zanu-PF did not elect him as the application contends.

Legal experts say Mnangagwa is a product of a slew of illegalities and here is why:

– first, he came in through a coup, which means unconstitutional seizure of power;

– secondly, he did not follow the national constitution on how he should have come in; Mphoko did not act as required;

– Thirdly, he was installed as Zanu-PF leader by an illegal central committee meeting;

– Fourth, he was elected through a disputed election with a wafer-thin margin in 2018; and

– Fifth, he did not hold the 2019 Zanu-PF congress which was due, as he feared defeat amid raging battles of unsettled leadership question.

Sybeth Musengezi, a Zanu-PF member of good standing for 20 years, says Mnangagwa was not constitutionally and lawfully elected by the party’s central committee meeting of 19 November 2017 – five days after the military coup that ousted former president Robert Mugabe.

The Zimbabwean judiciary faces a new credibility test as it comes under fresh scrutiny following a High Court application by Zanu-PF member Sybeth Musengezi challenging President Emmerson Mnangagwa’s legitimacy as leader of the ruling party, hence head of state.

He says the meeting which installed him party leader was not legally convened, constituted and conducted. As a result, Musengezi is seeking a declaratur against Mnangagwa that the special session of the central committee after the coup at party headquarters in Harare from 10am to 4pm was ultra vires the party constitution, unlawful and thus null and void ab initio.

He also wants the court to rule that all the resolutions of the central committee meeting passed during its unlawful gathering to install Mnangagwa as party leader were “unlawful, invalid and are accordingly set aside”.

Further, Musengezi says former vice-president Phelekezela Mphoko should temporarily take over the Zanu-PF leadership and preside over an extraordinary Zanu-PF congress to be called within 90 days of the granting of the order to regularise the leadership positions to ensure Mugabe’s successor is installed constitutionally and legally.

As things stand, Mnangagwa has no mandate to be the leader of Zanu-PF and President of Zimbabwe, the application suggests. He came in through a string of illegalities which have not been cured, meaning he is an illegal President of the republic. Besides the coup and his 2018 disputed election, Zanu-PF did not elect him as the application contends.

Legal experts say Mnangagwa is a product of a slew of illegalities and here is why: – First, he came in through a coup, which means unconstitutional seizure of power; – Secondly, he did not follow the national constitution on how he should have come in; former last acting vice-president Phelekezela Mphoko did not act as required;

– Thirdly, he was installed as Zanu-PF leader by an illegal or simply kangaroo central committee meeting; – Fourth, he was elected through a disputed election with a wafer-thin margin in 2018; and l Fifth, he did not hold the 2019 Zanu-PF congress which was due as he feared defeat amid raging battles over an unsettled leadership question.

These issues form a compelling backdrop to the case that judges, already damaged by Chief Justice Luke Malaba’s tenure extension saga, have to grapple with on how Mnangagwa came to power.

Constitutional judges recently violated one of the key rules of natural justice – that no one can be a judge in their own cause – to rescue Malaba whose tenure extension had been blocked by the High Court.

Judges are also yet to hear challenges to two constitutional amendments designed to keep Malaba in office, while helping Mnangagwa in his power consolidation and retention agenda. In the Musengezi challenge against Mnangagwa’s leadership legitimacy, judges would have to navigate a political and legal minefield: maintain their implicit bargain to keep their positions – posts and trappings of office – and serve the ends of justice to retain their credibility at the same time. Legal analysts say the Musengezi case is critical in terms of the way the national constitution frames and deals with how to replace a head state, out through death, incapacitation or removal by different means.

The ruling party of the day is vested, under Schedule Six of transitional mechanisms valid from 2013 to 2023, with powers to nominate a successor through its own constitution and party structures.

“The 2013 state constitution imposes a constitutional mandate and duty to the ruling party of the day to use its internal processes to constitutionally and legally nominate a candidate to takeover from the incumbent removed on any of the stated grounds in the constitution,” an analyst said.

“This elevates the constitutional burden to choose who will be a successor for the remainder of the outgoing leader’s term to a party internal mechanism instead of state electoral processes.

“As a result of that, this means the party process should be democratic, credible, free and fair, and verifiable to meet the national democratic election demands and benchmarks. The rationale is that if a party is to nominate someone to lead a nation through an internal process without being subjected to national elections, its process has got to be constitutional, legal and transparent.

“If the party process is flawed, subverted or hijacked by vested political interests and other forces, then the constitutional foundation and good governance of the republic is imperiled. That erodes the constitutional framework and democratic fabric of the state.

“So the courts and judges have an important responsibility and duty to protect the constitution, the democratic order and constitutionalism of the state against internal party processes which might be compromised, manipulated and subverted to serve narrow political factional or clique interests at the expense of the national or common good, the public interest.”

Another analyst added: “The Musengezi application is very important. The process of nominating or electing a successor to a head of state must not be afflicted with such a string of illegalities or glaring violations of the constitution and democratic process as highlighted in this momentous court application.”

Implicit bargain

There is a rich history of case law within the Commonwealth, where there have been legal challenges to the unconstitutional overthrow of elected governments.

These cases and incisive commentary on them are set out in an interesting book by Professor John Hatchard and Dr Tunde Ogowewo titled Tackling Unconstitutional Overthrow of Democracies: Emerging Trends in the Commonwealth. Hatchard and Ogowewo develop a new theoretical construct – “the implicit bargain theory” – to explain the existing jurisprudence on coups.

Their study critically examines the evolution of judicial decisions on the subject. In doing so, it also evaluates jurisprudential theories underpinning these judgements. The position of the Commonwealth, especially given its strong stance against unconstitutional overthrow of governments, is clearly articulated. Ironically, the Commonwealth’s Harare Declaration of 1991 and the subsequent Millbrook Commonwealth Action Programme on the Harare Declaration (1995), cite coups as particularly grave violations of their principles.

Zimbabwe is currently fighting to go back to the Commonwealth after pulling out over a decade ago. After the 2017 Zimbabwean coup, judges were on the frontline of events and debate. Hatchard and Ogowewo explain why.

“To understand the nature of the existing jurisprudence on coups it is important to understand what in fact produced it,” Hatchard and Ogowewo write.

“For this, a new theoretical construct – “the implicit bargain theory” – is introduced to tell the story. “Judges are important players when there is a coup. The immediate effect of a coup is to eliminate two branches of government – the executive and the legislature. The judiciary is left intact.

“The judiciary is left intact for two reasons.

First, because judicial affirmation of the regime of usurpers confers legitimacy on the usurpers. Second, because even usurpers need to govern in a system characterised by law and order, and an existing judicial system – even if tweaked – is indispensable.” Already, top judges have made their implicit bargain.

The then High Court Judge President George Chiweshe on 26 November 2017 ruled that the military’s actions “in intervening to stop the takeover” of Mugabe’s constitutional functions “by those around him are constitutionally and lawful”.

Malaba also issued a judgment, saying Mugabe had resigned voluntarily, in a bid to give constitutional and political legitimacy to the coup. Now the new High Court application challenging Mnangagwa’s legitimacy will further test the credibility of judges that is already badly damaged due to the coup legitimation process and the Malaba tenure saga.
