ZINWA increases water tariffs

ZINWA increases water tariffs. The Zimbabwe National Water Authority (ZINWA) has applied to the Ministry of Lands, Agriculture, Fisheries, Water and Rural Development for an increase in treated and raw water tariffs.

Consumers will in the interim, pay the proposed new tariffs with effect from November 1. ZINWA said the hike is in response to the sharp increase in the cost of key water resources management inputs such as electricity, fuel, spares, water treatment chemicals and other obligations since the last tariff review in July 2020.

ZINWA’s corporate communications department said: In coming up with the interim tariff, the authority was guided by the need to strike a delicate balance between service provision and affordability of water.

Commercial agriculture A2 farmers, local authorities and industry will now pay $898.35 per megalitre (ML) while communal farmers will pay $134.75/ML for raw water. A1 farmers will now pay $170.69 and commercial agriculture (estates) will pay $1 212.77 and mining sector $8 983. 49 per ML.

For domestic use, ZINWA is now charging $58.47 per cubic meter for a 1-10 cubic metre band, $101.35 per cubic metre for 21-30 cubic metres and $120.85 per cubic metre for a band above 50 cubic metres.

The government will now pay $93.56 per cubic metre for a 1-10 cubic metre band and $124.75 per cubic metre for the band above 50 cubic metres. Parastatals will pay $132, 54 per cubic metre.

Schools, churches and other institutions will pay $85.76 per cubic metre for a 1-26 cubic metre band, $116.95 per cubic metre for 51 -100 cubic metre band and $155 93 per cubic metre band for above 100 cubic metres. Mines will pay $155.93 per cubic metre while businesses will pay $85.76 for a 1-25 cubic metre band and $155.93 for an above 100 cubic metre band.

ProtonBakers truck was on Thursday involved in an accident along Harare-Mutare Highway near Marondera There has been no casulaties reported but the organization suffered a huge loss as most of the items were obsolete stock.

This time around the people around the community showed maturity by not rushing to loot the bread but they rather helped the victims to get up and be assisted.

Manchester City outclassed Manchester United to claim a comfortable Premier League win at Old Trafford.

Revenge costs marriage as angry wife scald hubby’s privates part with hot oil. Moreblessing Muteswa, a mother of one, told H-Metro that she boiled some cooking oil and scalded her husband for physically abusing her.

A 24-year-old Rusape woman scalded her husband’s private parts with cooking oil following a domestic dispute. Muteswa, who is serving an attempted murder sentence at Marondera Female Open Prison, opened up yesterday during a media tour.

Regretting her actions, Muteswa urged married women to consider divorce than committing crimes of passion. “Prison life is not good at all even where we are allowed to take home leave and return to cells,” said Muteswa. “One day in a prison cell is equal to a thousand years and such a life is not good at all.

“My husband used to beat me up nearly every day for no apparent reason. One day I woke up with a spirit of revenging and that led me into boiling cooking that I poured on him targeting his private parts.

“Ndakamudira mafuta anopisa akavarairwa akatsva asi kurwadziwa kwandaitwa nejeri kwandiparadzawo. “I regret it; I do not see it as a solution to my abuse since it was like from the frying pan into the fire. “Kana pane madzimai arikufunga kutsiva murume wake anomushungurudza nenzira yakadaro ngaasvipire pasi pfungwa iyoyo.

“It is better to quit that marriage, report to police or seek advice from church pastors and elders,” said Muteswa. She told H-Metro that she is going to take her time before getting married upon her release.

Muteswa, one of the first inmates to benefit at Marondera Female Open Prison, thanked its patron Amai Auxilia Mnangagwa for considering women’s woes. “I deserved to be incarcerated because what I did was extreme evil,” said Muteswa.

“I accepted my conviction and sentence and complied with prison officers. “I want to believe that opened a way for me to be counted among 22 inmates selected for open prison,” she said.

Chelsea held to a 1-all draw against Burnley. Kai Havertz opened the scoring for Chelsea with a header from Reece James‘ cross, only his second league goal this season.

Premier League leaders Chelsea were made to regret missed chances as Matej Vydra rescued a point for Burnley. That is the seventh Premier League goal that right-back James has been involved in in six starts this season.

The Blues could have scored a hatful with Thiago Silva’s header hitting the post, while Nick Pope saved well from Callum Hudson-Odoi in each half.

But Burnley levelled when Ashley Westwood whipped in a cross which Jay Rodriguez headed across to Vydra to stab home. Chelsea are three points clear of Manchester City at the top of the table, while Burnley remain in the relegation zone.

Norwich registers their first win of the season by beating Brentford 2 – 1. Norwich picked up their first Premier League win of the season at the 11th time of asking by beating Brentford to move off the bottom of the table.

The Canaries made a dream start when Mathias Normann slotted in from the edge of the area after a good run. It was the first time Norwich had been ahead in a league game this season, although only a superb save from Tim Krul to deny Christian Norgaard from point-blank range prevented Brentford from quickly drawing level.

It proved a crucial save because Norwich doubled their lead midway through the first half when Teemu Pukki was brought down inside the box by Charlie Goode. The Finland striker stepped up to score the penalty.

It prompted scenes of jubilation in the away end, with the travelling fans seeing their side score two goals for the first time in 29 Premier League games. But they endured a nervous second half as Brentford put on the pressure. Bryan Mbeumo had a goal ruled out for offside before Rico Henry volleyed home to make it 2-1.

Krul superbly kept out Sergi Canos’ fierce drive as the home side pushed for an equaliser, but the visitors held out for a precious win. The three points moved Norwich above Newcastle – who play Brighton later on Saturday – into 19th place and five points from safety. Brentford, meanwhile, are 14th.

Norwich’s season finally up and running
Celebrating a Premier League victory will have been something of a forgotten feeling for Norwich fans. This was their first top-flight win since they beat Leicester 1-0 on 28 February 2020. And it ended a run 20 games without a victory, during which they lost 18 and drew just two.

Their first-half performance belied that of a team on such a torrid run. Daniel Farke’s side attacked with pace and confidence and fully deserved their two-goal lead at half-time. But poor defending has blighted Norwich this season, and when Henry was left completely unmarked to halve the deficit, the away fans must have feared the worst.

Brentford did respond but to Norwich’s credit, they defended resolutely to protect their slender lead and secure a huge, confidence-boosting win. There will need to be plenty more performances like this if they are to pull off a great escape, but it gives the struggling Canaries something to build on.

Brentford, meanwhile, have now lost four league games in a row for the first time in five years and for the first time under coach Thomas Frank. They will be desperate to turn around their fortunes after a strong start to their maiden Premier League season.

Wilfried Zaha and Conor Gallagher goals helped Crystal Palace overcome Wolves at Selhurst Park and stretch their unbeaten Premier League run to six matches. Gallagher doubled the Eagles’ lead with 12 minutes remaining, his goal-bound effort taking a heavy deflection off Wolves defender Conor Coady on its way past goalkeeper Jose Sa.

Patrick Vieira’s side deserved the three points on the balance of play, with Odsonne Edouard testing Sa on a number of occasions and Christian Benteke going close to opening the scoring prior to Zaha’s strike.

Wolves, who had won four consecutive league matches prior to their visit to south London, went closest through Raul Jimenez in the first half. Palace’s third league victory of the season lifts them up to ninth in the table, one point behind eighth-placed Wolves.

Thomas Mapfumo performing in SA. Mukanya, as he is affectionately known, commands a sizeable fanbase who are expected to throng the two venues. He will travel with some band members from his Oregon base in America as well as some from the United Kingdom.

Chimurenga guru Thomas Tafirenyika Mapfumo jets into Johannesburg Thursday afternoon for two high-profile gigs at Newtown Music Factory on Saturday night and The Pavilion in Sunnyside, Pretoria on Sunday.

They will join the other Blacks Unlimited members who live in South Africa such as mbira player Bezel Makombe who has been with the group for decades.

“We can confidently say all is ready from our side and we urge fans to continue purchasing tickets on Webtickets in order for us to manage the numbers. Mukanya is a legend and this is one of those rare opportunities where has to perform in Africa,” said Ashton Mutuvha of One Love Movement who are sponsoring the show with Diaspora Insurance. It will be a huge test for the 76-year-old Mukanya, also known as The Lion of Zimbabwe, who is now of an advanced age. He boasts a number of albums and a career spanning over 40 years.

The weekend shows will see the return of urban groover Nox and Darlington Mhofela Tanganyika and his Journey Band. The two artists will be the supporting acts at both shows and they have previously never disappointed.

There will also be a number of DJs on rotation the likes of Charlieban, Mr Gee Warriors, Mytee Dollar and Stramma. Rico Myers will once again be the MC at both events where hundreds are expected if the excitement on social media is anything to go by.

“While the COVID 19 numbers have been on the decline we are urging all those who are coming to bring their masks as per the government regulations. We are also starting early as there is still a curfew in place at midnight,” added Mutuvha.

Victims of police brutality to be paid $500k, court rules. Home Affairs minister Kazembe Kazembe and Zimbabwe Republic Police (ZRP) Commissioner-General Godwin Matanga have been ordered to pay over $500 000 compensation to two Beitbridge residents who were attacked by police dogs last year.

Edmund Zeyazeya and Benson Tawengwa sued Kazembe and Matanga for damages amounting to $3 million and $1 million respectively after they were severely bitten by a police dog on August 1, 2020, at a fuel station in the border town. Police officers enforcing a COVID-19 lockdown arrested the duo to cover up for their negligence in handling the police dog and charged them with disorderly conduct.

Zeyazeya and Tawengwa were fined and released on the same day. Through their lawyer, Patrick Tererai of Zimbabwe Lawyers for Human Rights, they, later on, challenged the conviction that was made based on the fine which they paid and sought an order for the refund of their money.

The order was granted in September 2020. They then filed the summons on December 4, 2020, at Beitbridge Magistrates Court demanding compensation.

Lawyers representing the police recently agreed to pay $425 000 to Zeyazeya and $85 000 to Tawengwa as damages arising from the unlawful conduct by the law enforcement agents. More people have previously successfully sued the state for state security brutality.

In July this year, a Harare magistrate ordered Matanga and Kazembe to pay USD10 000 to Canaan Machando and his wife Sipetangani Machando as compensation for violation of their fundamental rights and their property.

More buses and cars impounded for smuggling goods and people. Zimbabwe police national spokesperson, Assistant Commissioner Paul Nyathi has said police impounded buses, commuter omnibuses and a Toyota Hiace for smuggling people and goods from South Africa. Nyathi said the passengers had no passports. Assistant Commissioner Paul  Nyathi’s statement.

ZRP RESPONSE TO THE ALLEGATIONS OF CORRUPTION AND IMPOUNDING OF BUSES IN BEITBRIDGE

With reference to the recent social media post which went viral on the 3rd of November 2021, on alleged bus crew and passengers who protested alleged corrupt order by members of the Security Services at Chicago area along Harare-Beitbridge Rd.

The Police set the record straight and reports that buses were indeed involved in smuggling acts and were impounded after a tip-off had been received from concerned citizens. The listed buses and vehicles were then handed over to ZIMRA to ensure the appropriate customs and excise laws were applied:

• Munhenzva bus registration number F203BF GPV with Trailer ABB 1317, had suspected smuggled groceries and two (2) passengers without passports who were charged for exit by evasion.

• Lexliner bus registration number HM 04GC GP, had smuggled goods and thirteen (13) passengers without passports.

• Blue Liner bus with registration HM 70DD GP, had suspected smuggled goods and three (3) passengers without passports.

• Sable Class bus with personalized number plates TRUE GOD, had two (2) passengers without passports and smuggled goods.

• Charazim Travel bus registration number ABQ 8745, had suspected smuggled goods.

• Regional Boundary bus with registration number HN 97FL GP, had suspected smuggled goods and five (5) passengers without passports.

• Nissan Caravan registration number AEP 4454 with suspected smuggled goods was picked by a drone and intercepted by Mounted Units.

• Toyota Hiace Registration number AFK 9917, was intercepted at Area 40 with smuggled goods.

• Nissan Caravan AFD 8084, with smuggled goods was intercepted at Pande Minel.

• Nissan Caravan AFD 7102, with smuggled goods was intercepted at Pande Mine 2.

We warn bus operators and crew against smuggling and also raising unsubstantiated allegations in order to get sympathy from the public. Bus Operators are now posing a security risk with the border jumpers whom they are carrying into the country and with no COVID-19 protocols being followed at all.

This militates against the Government’s quest to fight the COVID-19 pandemic. The Police will ensure that the law takes its course without fear or favour. Meanwhile, the Zimbabwe Republic Police and other Security Services will ensure that action is taken on any security services member involved in corruption.

UK approves COVID-19 pill

UK approves COVID-19 pill. Molnupiravir, developed by Ridgeback Biotherapeutics and Merck Sharp and Dohme (MSD), is designed to interfere with the virus and avoid its replication within the body. The United Kingdom has approved an anti-viral pill that can treat asymptomatic Covid-19 patients, becoming the first country in the world to do so.

In a statement, the Medicines and Healthcare products Regulatory Agency (MHRA) said trials had produced pleasing promising results that showed it was safe and effective at reducing the risk of hospital admission and death in people with mild to moderate Covid-19.

In September, at least three companies were developing daily pills that can fight the coronavirus early after diagnosis and conceivably prevent symptoms from developing after exposure. In the case of Molnupiravir, the enzyme that copies the viral genetic material is forced to make so many mistakes that the virus can’t reproduce.

That, in turn, reduces the patient’s viral load, shortening infection time and preventing the kind of dangerous immune response that can cause serious illness or death.

Britain’s Medicines and Healthcare products Regulatory Agency (MHRA) recommended the drug, Molnupiravir, for use in people with mild to moderate COVID-19 and at least one risk factor for developing severe illness, such as obesity, older age diabetes, and heart disease.

It will be administered as soon as possible following a positive COVID-19 test and within five days of the onset of symptoms, the regulator said, citing clinical data.

Police arrest Freeman Ndudzo over armed robbery cases. Police national spokesperson, Assistant Commissioner Paul Nyathi said the arrest occurred on Friday the 5th of November 2021.

The Zimbabwe Republic Police (ZRP) has announced the arrest of Freeman Ndudzo in connection with armed robbery, unlawful entry and theft cases recorded in Beitbridge. Pindula News presents Nyathi’s statement that announced the arrest.

ARREST OF FREEMAN NDUDZO FOR ARMED ROBBERY, UNLAWFUL ENTRY AND THEFT CASES IN BEITBRIDGE

The Zimbabwe Republic Police confirms the arrest of Freeman Ndudzo (32) on 5th November 2021 by detectives who were pursuing a case of unlawful entry and theft. On approaching number 552 Dulibadzimu, Beitbridge, Police Officers found the suspect with a black satchel under the bed.

Searches revealed that the suspect was hiding a star pistol with a magazine of five (5) rounds, three (3) more pistols with magazines of sixteen (16) rounds, seven (7) cellphones and one hunter’s torch.

The suspect confirmed that the weapons were from outside the country and intended for use in robbery cases in Zimbabwe. The suspect is linked to several robbery cases in Beitbridge which include the purported R1,2 million case reported recently.

ZACC splashes ZW$5M to buy 6 top-of-the-range cars for its former managers. The managers, Edwin Mubataripi (general manager prevention and advocacy), Gibson Mangwiro (chief accountant/finance manager) and Christopher Chisango (general manager finance, administration and human resources) were sacked in 2016 over allegations of corruption.

The Zimbabwe Anti-Corruption Commission (ZACC) has been forced to pay ZW$5 million and six top-of-the-range vehicles to its former managers who were wrongfully fired from the anti-graft body in 2016. The trio was accused of underhand dealings involving the purchase of a ZACC property in the capital where the government was allegedly prejudiced of US$435 000.

A former ZACC boss Ngonidzashe Gumbo was arrested over the matter in which he had allegedly connived with the three managers in the transaction. But Chisango, Mangwiro and Mubataripi approached the court to seek relief over unfair dismissal by ZACC.

After a five-year battle with the commission, the trio won the case and was supposed to be reinstated with salaries and benefits dating back to 2016. However, the managers walked away. Said one of the former managers:

We were supposed to be reinstated effective July 1, 2021, but we opted to give them three months’ notice and resigned. We were to be paid all the salary arrears for five years, that is between 2016 and 2021, but we resigned effective September 30, 2021.

A source said the managers were awarded two vehicles each; double cabs Toyota Hilux and Mazda BT50. They also received ZW$5 million each. The commission processed some of the payments to the former managers instead of waiting on the government’s Salary Service Bureau (SSB).

Approached for comment, ZACC spokesperson John Makamure said: These are internal human resources issues that are being settled in accordance with government rules and regulations and Zacc’s own regulation. Any aggrieved parties fully understand the procedures to be followed.

This is not the first time that Zacc has clashed with workers for unfair dismissals as 19 investigating officers who were suspended over allegations of corruption fought through the courts and some were reinstated while others sought a ZW$1.5 million arbitrary award in 2016.

Mzansi exotic dancer Zodwa Wabantu has spoken on allegations that she attacked another woman during a catfight in Gauteng on Friday night.

She described the incident as a misunderstanding between two drunk women.

This after Naniki Mokoena posted on Instagram that Zodwa hit her and poured bubbly on her in an alcohol-fueled squabble at Recharge Lounge in Midrand after accusing her of leering at her Ben 10 boyfriend.

“I was attacked last night by Zodwa Wabantu, she slapped me and poured champagne on my face because her Ben 10 was looking at me,” read the post.

Mokoena said Zodwa Wabantu’s team did not restrain the exotic dancer when she was assaulting her. “They said they can’t be involved in a fight of 2 ladies n they can’t chase Zodwa Wabantu (away),” read her post.

Zodwa however said it was just a misunderstanding.

She said she was invited to the venue and when she arrived, she went and chilled in the VIP area and later decided to go and dance.

“I’m not a violent person. She wanted me and I did not give myself to her … I didn’t even care what she was doing with my boyfriend. I just paid my bill and left her with those Nigerian men,” she said.

Days after nominations for the SA Hip Hop Awards were open for votes, award-winning rapper Cassper Nyovest has thrown the cat among the pigeons, saying he is the most deserving of the Artist of the Decade gong.

The awards are scheduled to take place next month.

The Artist of the Decade award is a new category introduced this year – the 10th year anniversary of the awards – which will be broadcast live on SABC1 on December 4.

Cassper, real name Refiloe Phoolo, is nominated along archrival AKA, Khuli Chana, KO and Kwesta, Riky Rick, Nasty C, Emtee, and Reason.

“I believe I’ve been consistent, impactful, and achieved all I set out for in the music space more than anyone else has. But awards also don’t define my success. My name is written in books with legends already,” said Cassper.

Cassper, who this week celebrated the time he first filled up The Dome in 2015, a historical moment that he said he had hoped to achieve again before the pandemic struck, believes his big dreams will still be achieved with many new projects in the pipeline.

“What many don’t know is that I also wrote for and directed the music video.”

Cassper will perform at the Hunters #Musicneedsyou concert next Sunday, the first time since the Covid-19 pandemic started last year that he will be performing to an audience of about 1 500 people.

“I was lucky I got to travel overseas and perform but this is the first event at home where the audience is at this scale. It’s not perfect, but every bit helps.

“As artists we had little to no remuneration. I appreciate every gig as it helps put food on the table,” he said.

Zimbabwe, UK in a diplomatic breakthrough. President Mnangagwa last week engaged British Prime Minister Mr Boris Johnson on the margins of the ongoing 2021 United Nations Climate Change Conference (COP26) in Glasgow, Scotland, where the two leaders informally agreed to foster greater understanding.

Diplomatic relations between the United Kingdom and Zimbabwe have been escalated to the highest political level, breaking a two-decade long impasse in a major breakthrough for Harare’s re-engagement drive.

This comes as similar engagements between the President and other Western leaders including United States president Mr Joe Biden in Glasgow helped trigger a new dawn for diplomatic relations between Zimbabwe and the West. The President’s informal engagement with Mr Biden helped lay the foundation for further formalised dialogue.

Briefing The Sunday Mail on the outcome of President Mnangagwa’s historic visit to the UK, Foreign Affairs and International Trade Minister Ambassador Frederick Shava said all sides were in agreement that the land reform question was no longer a stumbling block to mending relations.

“Zimbabwe’s participation at COP26 in Glasgow, Scotland was a demonstration of the British government’s readiness to engage Zimbabwe at the highest level and Zimbabwe will continue on its path of engagement and re-engagement in order to build greater understanding with our erstwhile friends, now that the issue of land is a thing of the past,” he said.

“Since its inception, Zimbabwe’s Second Republic has been invited to participate in major international and regional conferences, an opportunity that the Government has used to enhance its engagement and re-engagement agenda.

“Indeed, in the past, there were challenges associated with invitations and the issuance of visas to members of the former administration mainly for political expedience by Western countries.” Amb Shava said Zimbabwe participated in many sideline meetings during the World Leaders Summit, which helped thaw previously frosty relations.

“His Excellency the President also engaged other Heads of State and Government and expressed Zimbabwe’s readiness to engage their administrations in order to thaw the frosty relations that still exist. “These countries include Canada, the United Kingdom and the US.

“We are encouraged that the aforementioned countries have demonstrated their readiness to continue discussions with Zimbabwe and we hope that these initial discussions will lead to enhanced relations and the removal of sanctions to enable Zimbabwe to effectively participate in the global arena.”

The summit, he said, provided the President with an international platform to call for the removal of sanctions imposed against Zimbabwe by Western countries. “These sanctions are impeding Zimbabwe’s efforts to, among other issues, effectively fight the Covid-19 pandemic, address climate change-related challenges and achieve the Sustainable Development Goals.”

Turning to the conference outcomes, Amb Shava said the United Nations welcomed Zimbabwe’s commitment to reduce its carbon emissions by 40 percent by the year 2030. He said the country’s submission affirmed its commitment to combat climate change.

“Zimbabwe’s conditional 40 percent greenhouse gas emissions reduction target below the projected business as usual scenario by 2030 was welcomed by the international community and the United Nations Framework Convention on Climate Change’s (UNFCCC) Conference of Parties, together with all other submissions received to date.

“The submission affirmed Zimbabwe’s commitment to combat climate change, which threatens socio-economic development in Zimbabwe and the world at large.

“In addition to the emissions reduction pledge in the revised Nationally Determined Contribution (NDC), Zimbabwe also committed to enhance adaptive capacity to climate change through four main interventions namely: early warnings and disaster risk reduction, climate smart agriculture, climate resilient infrastructure development and sustainable water resources development and management.”

Amb Shava said the adaptation commitment resonates well with the priorities of most developing countries, which are vulnerable to the impacts of climate change. Addressing Zanu PF supporters in Lupane, Matabeleland North on Friday, President Mnangagwa said he asked Mr Biden why the US had unjustly imposed sanctions on the country.

“I told him that there is no crime that we committed against America and why are you imposing sanctions on us? “I reminded him that America calls itself the biggest democracy; why imposing sanctions on Zimbabwe. “He said ‘Mr President kindly wait.’

“He then called his staffer and held my hand and said, ‘This is the Zimbabwean President, and I want that when we return home, we revisit this issue. I would like to talk to him.’ That is what Biden said,” said President Mnangagwa.

Govt: Civil servants bonuses this month. While the Government has committed to paying bonuses beginning this month, negotiations over how much will be paid out are still ongoing. Civil servants will begin receiving their annual bonuses later this month following rounds of negotiations between public sector unions and the Government.

Public Service, Labour and Social Welfare Minister Professor Paul Mavima said: “We are definitely going to be paying bonuses this year, but what is left to be decided is the quantum which will be paid out.

“As such, civil servants are set to start receiving their bonuses this month on a date to be announced later because as of now we have not yet completed our own discussions within Government.”

Zimbabwe Confederation of Public Sector Trade Unions secretary-general David Dzatsunga confirmed the development. “Yes, we have been talking and the employer has made a commitment to pay bonuses,” he said.

“However, we are not really sure about how much we are talking about here because a decision is yet to be made on figures. “But we have proposed that the bonus should also include allowances because the salary alone is too little and the bonus will not be much either.”

Finance and Economic Development Minister Prof Mthuli Ncube recently said civil servants should expect their bonuses on time. “There is always a 13th cheque for civil servants, always, so they can expect one, we have not changed that. It will be paid on time,” he said.

This year, the Government has been making regular salary adjustments to its employees’ remuneration to cushion them against the rising cost of living. In July, civil servants received a salary increase of between 45 and 50 percent. That increase came after another 25 percent adjustment in April.

Zanu PF rubbishes Mnangagwa’s Presidency court application. This comes as ZANU PF Harare province acting chairman, Cde Goodwills Masimirembwa, has submitted that Sybeth Musengezi, who applied to the High Court to challenge President Mnangagwa’s ascendency, is not a bona fide member of the party.

President Mnangagwa is not liable to civil or criminal proceedings while he is still in office and the court challenge seeking to annul his ascendency to ZANU PF’s top post in November 2017 is flawed, the party’s Secretary for Administration, Dr Obert Mpofu, has said.

Dr Mpofu made the assertions in his founding affidavit in a notice of opposition filed at the High Court on Friday against Musengezi’s application. In his submissions, Dr Mpofu argued that the High Court has no jurisdiction to try the President as Section 98 of the Constitution guarantees the President immunity.

“The literal import of the Section is very clear. There’s no need for any aids to interpretation of this Section. The import of Section 98 (1) is that whilst in office, the President of Zimbabwe is not liable to any civil or criminal proceedings in any court for things done or omitted to be done in his personal capacity whilst in office. The Section confers immunity to prosecution to a sitting President.”

Dr Mpofu said Musengezi did not seek leave to sue the President as is required by rule 12 (21) of the High Court. He said the application was defective and cannot be allowed to go ahead as it falls away on filing and should be struck off the roll with costs.

Furthermore, Dr Mpofu said Musengezi had not exhausted domestic remedies which are provided for in ZANU PF’s constitution before bringing the application to court.

On October 20 this year, Musengezi, who described himself as a ZANU PF youth member, approached the Bulawayo High Court seeking the nullification of ZANU PF’s November 19, 2017 special session of the Central Committee meeting which elected President Mnangagwa as the party’s First Secretary and President.

According to the court application, Musengezi, through his lawyer Nqobani Sithole, cited ZANU PF as the first respondent and President Mnangagwa as the second respondent. In his submissions, Cde Masimirembwa said Musengezi is not in ZANU PF structures.

“I confirm that the Applicant is not a member of the 1st Respondent in good standing. Firstly, he applied to be a member of the 1st Respondent in 2014 in Hatcliffe yet he did not reside there and was using a local address belonging to one Cde Mutimbanyoka’s mother. It must be noted that for one to qualify as a member, they must belong to a cell within their area of residence. The party contends that Applicant has ‘dirty hands’ in respect of his claims to membership,” he said.

Cde Masimirembwa said investigations by the party had discovered that Musengezi had been illegally planted into ZANU PF’s structures by fugitive former national political commissar Saviour Kasukuwere.

“It has currently been discovered that the Applicant is the branch deputy secretary to which no elections were held for branch officials other than the Chairman.

‘‘This means that anything else has not been verified and its origins and authenticity questionable. It’s believed, on investigation by the DCC security that reports to me as Chairman of DCC 4 Harare and also Acting Chairman of the Harare Province, that Applicant was “planted “into the relevant district, without the relevant credentials for political and other reasons by the former Secretary for the Commissariat, Saviour Kasukuwere, to whom he is allegedly related.”

According to Cde Masimirembwa, Musengezi belongs to another political party known as Front for Economic Emancipation in Zimbabwe (FEEZ).

“In June of the same year, he was seen to be a member of another political front by participating in their first press conference. He uploaded a video on his Facebook page wearing FEEZ regalia and denounced and disrespected the 1st Respondent and its First Secretary, the 2nd Respondent in the matter. The video footages are attached . . .” he said.

Horror as doctor’s handwriting almost costs a life. It was during this time, three years ago, that he cheated death after a pharmacist dispensed to him wrong medication after misreading a doctor’s prescription. For Ruramai Dzeka (45), who has a long-standing condition known as cardiac arrhythmia that causes irregular heartbeat, the month of October always evokes bad memories.

Dzeka was served with Metformin Hydrochloride instead of his usual prescription of Rythmol, an anti-arrhythmic medication, which he had used for five years to manage his condition. Metformin Hydrochloride is a drug used to treat diabetes mellitus, a condition in which the body cannot control the level of sugar in the blood.

“Shortly after taking the medication, I began to feel weak, with nausea, sweating and increased irregular heartbeat,” he said. “These symptoms persisted for weeks and the last thing I remember was an ambulance taking me to hospital after the situation worsened.

“When the doctor saw the medication I was taking, he was shocked and immediately revealed that it was the wrong prescription.” When the doctor confronted the pharmacist who had dispensed the prescription, it became apparent that a medical gaffe had occurred.

The pharmacist had failed to decipher the doctor’s handwriting on the original prescription. “I was at my wits’ end. To this day, there are occasions when I feel the effects and symptoms I felt when I took the wrong medication.” For many, including some trained medical professionals, deciphering the scribbles on some doctors’ prescription note pads often proves a Herculean task. Many have concluded that doctors are generally flawed writers.

Questions have been asked about whether doctors deliberately write unintelligibly as a means of discouraging patients from prescribing their own medication. Others have concluded that bad handwriting is an innate gift peculiar to doctors.

Whatever the reasons, the dangers posed by illegible prescriptions can mean the difference between life and death. A study by Medscape, an India-based organisation spearheading a global campaign to reduce fatalities caused by illegible prescriptions, concluded that this phenomenon is on the rise.

A 2006 National Academies of Science’s Institute of Medicine Study in the United States of America found that 20 percent of prescriptions were unreadable or readable only with effort. “Doctors write about 3,2 billion prescriptions annually, but poor handwriting on such notes leads to over 7 000 deaths and 1,5 million medical errors,” reads part of the research.

The study noted that many such errors result from unclear abbreviations and dosage indications. A standard prescription should show three basic things: the prescribed medication; dispensing instructions and the patient instructions.

Harare-based general practitioner, Dr Norman Njobvu, said millions of lives are potentially in harm’s way on account of illegible prescriptions. “Illegible handwriting can delay treatment and lead to unnecessary tests and inappropriate drug doses, which, in turn, can result in discomfort or death,” he said.

“When a patient is referred to my hospital and the accompanying notes are unclear, I usually place a call to the doctor for verbal clarification.” Dr Njobvu said the situation was rampant in public hospitals. “In private practice, it is not common because it would do more harm than good to the hospital’s reputation,” he said.

“In some cases, when an illegible doctor’s prescription is taken to a pharmacy, the pharmacist could just give drugs based on the symptoms presented by the customer. This is totally wrong.” Dr Njobvu said after being presented with a prescription, a pharmacist is expected to dispense, advise, recommend and even ask questions where necessary.

Unhealthy rivalry

However, he said the problem is compounded by the souring of relations between doctors and pharmacists characterised by an unhealthy rivalry that has developed over the years.

“Pharmacists now refer to themselves as ‘PharmD’ (a combination of a pharmacist and a medical doctor). They now see themselves as doctors and even prescribe drugs,” said Dr Njobvu. “Even laboratory technicians are now prescribing medication.

“In an organised setup, you can only buy over-the-counter drugs without a prescription and all prescription drugs are can only be bought after presentation of a genuine signed and stamped doctor’s note.” Data on patients who have been dispensed the wrong medication in Zimbabwe is unavailable.

Medical and Dental Private Practitioners Association (MDPPZA) president Dr Johannes Marisa said prescribing the wrong medication can lead to death, or financial liability for the doctor and possibly the hospital. “Although this has been rampant for so many years, it does not constitute malpractice on the part of the doctor, but they should be extra cautious,” he said.

“A pharmacist should not dispense something that they cannot read.” Dr Marisa added that a pharmacist who dispenses wrong medication on account of unclear handwriting can be charged with malpractice.

Pharmacists not culpable

Community Pharmacists Association secretary Mr Luckmore Bunu said a pharmacist must be satisfied with the handwriting on a prescription before dispensing medication. “If he/she is not able to read a prescription, he/she can request the prescriber to rewrite the prescription legibly,” said Mr Bunu.

“Notwithstanding a patient’s right to health as enshrined in Section 76 of the Constitution of Zimbabwe, a pharmacist is allowed at law to refuse to dispense a prescription if he/she cannot read what the prescriber has written.” He added: “We are not aware of studies that have been done in Zimbabwe to ascertain the frequency of dispensing errors due to illegible prescriptions.

“However, in a study done in South Africa by Brits et. al. (2017), pharmacists read the (handwritten) prescriptions worst among other healthcare workers. “In a similar study in Switzerland, 2,52 percent of the prescriptions were rated as having bad handwriting and 4 percent as unreadable.”

He said pharmacists are competent professionals who take necessary measures to ensure that patients receive correct medication. “As such, it is highly unlikely that patients will be given wrong medications.

“In the event that it so happens, there are checks and balances that have been put in place to avoid unnecessary loss of lives.” Pharmacist, Mr Enock Mukweva, said: “A pharmacist does not just assume. No trained, qualified pharmacist would dispense a prescription that is not comprehensible.”
