SA’s Operation Dudula targets foreign national drivers after deadly crash kills 19 school kids

Operation Dudula in KwaZulu-Natal has repeated calls for transport operators to stop hiring foreign national drivers.

This comes after a horrific accident in Pongola, northern KwaZulu-Natal, where a truck collided with a bakkie transporting schoolchildren on Friday, killing 19 pupils, a teacher’s assistant and the bakkie driver.

The organisation, which has its origins in Gauteng, started forcibly closing businesses belonging to foreign nationals and has pockets of support nationally. It is also targeting local companies who employ foreign nationals.

Condemning the incident on Sunday, the provincial task team of Operation Dudula said they would visit the families and seek to help where they can.

“As Operation Dudula in the province we want to get contact details of these families and the company (of the truck in the accident), and follow up on this matter. From there we want to visit the families and see how we can make whatever donation to assist the families of the victims,” said Mfanafuthi Dumakude, provincial chairperson.

Dumakude said they wanted to ensure the truck owner was also held accountable.

“We have to make sure the company responsible for this accident must pay. If there are court cases to attend we will be there in support of the victims. We can’t let this vanish in thin air like other similar incidents that were hot topics for a while then died down later, as happened with people who killed others in Phoenix during the July 2021 unrest,” he said.

The truck driver reportedly fled after the accident before being arrested on Sunday.

Dumakude said according to their information, the driver was an undocumented foreign national, so the company had erred by employing him.

He said they would also engage with companies to only employ South Africans.

Bheki Dzanibe, another KwaZulu-Natal member, said last week’s accident mirrored other truck crashes involving drivers who were foreigners.

“This is not the first time a foreigner caused an accident. There are too many similar incidents. Remember the accident in Pinetown where about 24 people died and the one in Howick around June or July that claimed 15 lives,” he said

Dumakude said the labour department should be challenged on this issue.

“It’s about time we, as an organisation that represents locals, look deeper into this and put pressure on the companies. It’s one of the issues we want to fight, along with our alliance partners All Truck Drivers Forum in KwaZulu-Natal,” he said.

He said the organisation’s mother body was challenging the decision to extend the Zimbabwean Exemption Permit (ZEP) in court. This follows the announcement by home affairs minister Aaron Motsoaledi earlier this month, that the applications for the ZEP due to expire in December would be extended by six months.

African Presidents have been spotted in a bus being conveyed to the funeral of Queen Elizabeth II.

Photos of the Presidents and the bus have raised a huge concern on social media, as some persons tagged it racism, while others revisited the colonisation story.

Social media users exuded anger as US president Joe Biden and other leaders like France’s Emmanuel Macron and Canada’s Justin Trudeau were reportedly conveyed in luxurious bulletproof cars with security.

The segregation between these Presidents has encapsulated mixed feelings on social media.

South African outspoken critic, Ntsiki Mazwai said, “One day can we talk about the day African leaders embarrassed us and went to an event they were not really welcome at and arrived in City to City busses.”

“African Presidents” trends on social media as people poured out their thoughts about the event.

Four female Zimbabwe Revenue Authority (ZIMRA) employees were abducted and held for ransom in Musina, South Africa, on Monday night.

The quartet, who work at Beitbridge border post, had entered South Africa at around 3PM to do some shopping.

A source revealed: “They were all in ZIMRA uniform. The kidnappers must have known who their targets were.”

The four were kidnapped at gunpoint and robbed of all their possessions before ransom demands were made.

“The kidnappers demanded R10,000 to free them, but they didn’t have the money on them,” the source added.

“The ZIMRA officers were made to contact their colleagues at the border and one of them had an FNB account, and a transfer was effected.”

The ZIMRA officers were released at around 12AM on Tuesday.

“The kidnappers were apparently Zimbabwean because they spoke Shona,” the source added.

Limpopo Police spokesperson Brigadier Motlafela Mojapelo had not answered questions left for him on Tuesday.

A ZIMRA spokesman said: “We are still gathering details.”

Twenty-three women were killed while 35 others were injured in a road accident in the early hours of Monday in Nsama District in Zambia’s Northern Province, the country’s road transport and safety agency said Monday.

The accident, which involved a light truck that was carrying 58 women from the United Church of Zambia (UCZ) who was traveling back from a conference, occurred when the truck overturned while descending a hill.

Alinani Msisya, the acting Chief Executive Officer of the Road Transport and Safety Agency (RTSA), said the accident occurred when the diver of the light truck lost control and overturned as it was descending the hill.

“The agency has dispatched a team of officers to investigate the cause of the road traffic crash to ensure that such incidences are mitigated,” he said in a statement.

The full accident investigation report will be made available to the public in due course, he added.

Zambian President Hakainde Hichilema expressed sadness on the death of the accident victims.

“We are saddened to hear the tragic news… We send our message of condolences and prayers to the church and the affected families. We also wish the injured a quick recovery,” he said in a statement.

Deadly road accidents are frequently reported in Zambia, often caused by the poor state of roads, reckless driving, and some instances of overloading.

South African rapper Nasty C will join local artists Holy Ten and Takura as supporting acts at the Rick Ross concert set for November 18, 2022 in Harare.

Veteran entertainment consultant Ms Shally, spokesperson of the ROAR Entertainment Africa, the company behind Rick Ross’s local show, confirmed the development.

“Nasty C will share the same stage with Rick Ross on the 18th of November alongside Holy Ten and Takura,” she said.

The South African musician has become a household name in the region thanks to hits such as Jiggy Jigga, Strings and Bling and Particula.

He has already shared the stage with stars King98, Nigerian star Davido, ExQ, Nadia Nakai, Tammy Moyo, Shashl, Union 5 and DJ Silence Dosh among others.

He will be privileged again to share the stage with the American rapper next month at Harare International Conference Centre on Friday, November 18, 2022.

Recently, Hip Hop fans launched a petition to bar Zimbabwe’s celebrated Zimbabwean artists Winky D and Jah Prazyah from performing as curtain-raisers at the upcoming show citing the two were not Hip Hop artists.

Ms Shally has since said they were going to consider the people’s concerns adding that they would not choose usual curtain-raisers.

“We haven’t really picked up yet on opening acts, it’s something we are still applying our head around. But one thing I can say to you is that we are going to pick artists that Zimbabwe hasn’t used to open for big acts.

“We have heard people’s concerns and we are promising to put on different artists on this show,” she said.

Mphoko’s son granted $50 000 bail

Former Vice-President Phelekezela Mphoko’s son Siqokoqela, who is facing charges of allegedly raping his 12-year-old niece as well as escaping from lawful custody, has been released on $50 000 bail by the High Court.

Mphoko (44) of Hillside suburb in Bulawayo, last week appeared before regional magistrate Mr Mark Dzira facing three counts of rape and escaping from lawful custody. He was remanded to October 18 for trial.

In granting Mphoko bail, Bulawayo High Court judge Justice Martin Makonese Dube ordered the applicant to report once a month at Hillside Police Station and to continue residing at his given address until the matter is finalised.

“It is ordered that the applicant deposit $50 000 with the criminal registrar of the High Court in Bulawayo and to report at Hillside Police Station every last Friday of the month,” ruled the judge.

Mphoko was also ordered to surrender his travel documents and title deeds of his property to the criminal registrar of the High Court in Bulawayo as part of the bail conditions.

The ruling by Justice Makonese followed an application for bail pending trial by Mphoko, through his lawyer Mr Zibusiso Ncube of Ncube and Partners.

In papers before the court, the State which was represented by Mr Thobekani Mathanzima Nyathi, was cited as a respondent.

In his bail statement, Mphoko is denying the charge, arguing that the allegations are a conspiracy by senior family members who want to silence him in his quest to know his biological mother.

“I actually sent the grandfather of the victim to go and ask my father who my biological mother was. The victim’s mother examined her daughter’s panties and she purports to have seen a blood stain on her undies on August 29, which stain was never examined by a specialist,” argued Mphoko.

He said a doctor who examined the minor on August 30 observed that there were no vaginal tears contrary to her mother alleging that she had spotted blood stains on the girl’s panties.

“The interest of justice would not be hampered if I were to be admitted to bail. I am a good candidate for bail and to support this argument I will not interfere with witnesses, and the complainant now lives with her maternal grandfather in Old Lobengula,” said Mphoko.

The State opposed the application, arguing that there were compelling reasons warranting Mphoko’s continued detention.

“Compelling reasons for denying bail are encapsulated in Section 117(2) (a) of the Criminal Procedure and Evidence Act and these are the likelihood to disturb public peace or safety of anyone or likelihood to commit an offence,” said Mr Nyathi.

“In casu, the applicant was called by police to come to Hillside Police Station after a report of rape was made against him. He was placed under police custody before he later fled from lawful custody, thus not a good candidate for bail.”

The State also raised fears of Mphoko likely to commit suicide if released on bail.

“His conduct at the police station upon his arrest presented him as someone who is suicidal. We are therefore of the view that if applicant is released on bail, he may commit suicide,” said Mr Nyathi

According to court papers, it is alleged that some time between May and August, Mphoko unlawfully and intentionally had sexual intercourse with his niece aged 12 (name withheld) thrice without her consent.

Mphoko is also charged with escaping from lawful custody. On August 30, at around 4.30PM and at ZRP Hillside Charge Office, Mphoko was arrested and brought to the charge office for a crime of rape by one Assistant Inspector Admire Donha.

While in the charge office he was booked for detention under ZRP Hillside detention book reference number 284/22 and he had signed for his belongings for detention.

Mphoko requested to get his medication from his motor vehicle which was parked outside the charge office, before he could be taken to the police cells for detention.

He was escorted by Constable Chimuka to his motor vehicle. Upon arrival he jumped into his vehicle and sped off to unknown destination.

Arrest of Sikhala’s wife raises security concerns for his family

Citizens Coalition for Change (CCC) Chairperson Job Sikhala’s lawyer has raised concerns over the arrest of the lawmaker’s wife, saying her life could be in danger.

Freddy Masarirevhu said the way the arrest of Ellen Sikhala was effected raises a lot of questions and discomfort.

Ellen was arrested for allegedly violating traffic regulations on her way to Chikurubi prison where her husband is detained.

She was later released and is due to appear in court Thursday.

“They say she was driving recklessly hence they charged her with a traffic offence,” said the attorney.

“There is a lot that happened leading to the arrest. There were some police officers who escalated the matter after disclosing that she was Sikhala’s wife.

“If it was an ordinary person they would not have arrested her. Some people who were arrested for similar offence were let go after being charged and paying a fine but us we will appear in Court. The arrest raises suspicion,” said Masarirevu in an interview.

Zimbabwe Republic Police (ZRP) spokesperson Assistant Commissioner Paul Nyathi rubbished insinuations that the arrest of the legislator’s wife was politically motivated.

“They are politicising a simple traffic offence. Are we saying that because someone is a wife of a Member of Parliament she should not be arrested?” said Nyathi.

The arrest comes barely a day after Sikhala penned a letter from prison expressing concern over the safety of his family.

In the letter, Sikhala and colleague Godfrey Sithole pleaded for security cameras to be installed at their houses saying their families were receiving unusual visits from strangers.

The legislators were arrested in June for inciting public violence following the gruesome murder of CCC activist Moreblessing Ali.

All efforts to secure freedom have been blocked by the courts on grounds that the two were men of means.

A man from Gokwe who murdered a fellow villager in cold blood in 2020 has been caged 22 years by a Chinhoyi High Court judge Justice Philda Muzofa.

Brian Chipadza (27) of Chikova Village under Chief Mukoko committed the offence together with four accomplices.

Two of the suspects Edmore Murindiwa and Paul Mungwena, died before their matter could be finalised.

Murindiwa died in Gokwe after he was attacked by a mob following the incident.

Mungwena died at Chinhoyi Prison as a result of undisclosed causes.

The other accused person, Mugove Nicholas Makiwa, is still on the run.

The deceased was identified as Liston Chikomba (24) of Mungwena village, Chief Mukoka, Gokwe.

Prosecutor, Herekiya Maromo, proved that on November 10, 2020 Chikomba was seated on a bench under a tree at Gwanzura compound, Battlefield, Kadoma.

The now-deceased was watching a game of snooker and there were about seven people at the place including Tinamambo Kunamatira, Gift Magaya and Tinashe Jack.

Court heard that, during that time, the five accused persons namely arrived at the place driving in a Toyota Allion, reg AFA7516.

The car was being driven by Nathan Makiwa.

Their car was parked about six meters from where Chikomba was seated.

Mugove Makiwa and Nathan Makiwa disembarked in a rush.

The two brothers confronted Chikomba.

One of them demanded to know why Chikomba betrayed and caused his nephew, Courage Mudambo, to be severely assaulted by some soldiers.

Chikomba was not given a chance to answer as he was hit by a bottle of beer in the face by Mugove while Nathan stabbed him with a Colombian knife on his thighs several times.

The now-deceased Chikomba tried to free himself by running away, but the other accused who were in the car ran after him and tripped him to the ground.

They all started attacking with beer bottles, knives and booted feet.

Upon realising that Chikomba was unconscious, they rushed to their vehicle and sped off.

Chikomba’s fellow villagers watched the ordeal from a distance, as they feared being attacked.

After the gang had gone, his wife Zororai Kamudyariwa and her neighbour Kunamatira, attended to him as he bled profusely and struggled to speak.

He was rushed to Kadoma where he was pronounced dead upon arrival at Shalom Private Hospital.

On November 15, 2020, ZRP Gokwe police details received information from an informer that the five were roving in their area of policing, leading to their arrest.

Nathan Makiwa escaped with their gang’s get away car and is still at large.

President Mnangagwa taken to Con Court over judicial capture

$

Friends of Shabani Mashava Mines Trust member Tichaona Mupasiri has filed a Constitutional Court (ConCourt) application alleging President Emmerson Mnangagwa has captured the Judiciary.

Mupasiri filed the court challenge after his application to be joined in the Shabani and Mashava Mines court proceedings were dismissed before the summons were served on the President.

Mupasiri had filed a ConCourt application seeking to be joined in the court proceedings citing Mutumwa Mawere, SMM Holdings Limited, Africa Resources, TAP Building Products and Mnangagwa as respondents.

The background of the matter is that on December 17, 2021, Mupasiri launched an application to have him joined to the ConCourt proceedings over Shabani Mashava Mines Holdings.

On December 24, Mupasiri received opposing papers through DMH legal firm whose managing partner was implicated in the case. This was despite his application having been served on the President as a public office bearer under Section 167 of the Constitution.

Mupasiri then wrote to Edwin Manikai, one of the DMH managing partners on December 27 challenging the authority of DMH to represent Mnangagwa in his official capacity as the President when the law says it should be the Attorney-General (AG).

Mupasiri then filed an interlocutory application on January 25 this year which was dismissed, and the matter was allegedly “swept under the carpet”.

Mupasiri was slapped with costs order in a constitutional matter which involved the President who was never served with the copy of his application because his office, including the AG’s office, refused to accept service.

On May 27, Mupasiri filed an appeal against the cost order, but Chief Justice Luke Malaba dismissed the appeal saying even wrong decisions by the Constitutional Court are not appealable and or reviewable.

“To date the 6th Respondent (President of Zimbabwe) has failed, refused and neglected to bring this Court into his confidence on the facts and circumstances that permitted him to know that an application that I launched was in existence,” Mupasiri submitted.

“What happened following this discovery of my application’s existence? Who made the decision to engage the services of DMH? When was this decision made? When did the Attorney-General know of the existence of the application? How did he know of this application? What were the terms and conditions related to the engagement of DMH to act on this matter?.”

He averred that the above questions have not been dealt with by the court in an open and transparent manner and in the interests of justice

He said his application is to test the rule of law and constitutionalism in the country.

“It is trite that in a constitutional democracy, no person is above the law including members of this court and as such the power granted to this court by the Constitution to hold public officers accountable to the Constitution and the consequential jurisprudence that ought to arise from this compels me to make this application after the promise made by this court to deal with the authority challenge that I made against the President opposition to my application without satisfying the Court that he was authorised in terms of the limitations imposed by S114 of the Constitution to do so,” he submitted.

“One would have expected at the very least this Court to live up to the promise of acting as a guardian of the rule of law. My application represented a precedent that this court was enjoined to determine in the interests of justice and accountability. I had no idea that allegations of judicial capture had some validity until I became a beneficiary of a judgment that was determined without any regard to the facts and the law,” he further argued.

According to Cuban publication Aleynes Palacios Hurtado, Mnangagwa is expected in Havana on Friday for official talks with local authorities.

ZANU PF salutes SA President Cyril Ramaphosa

Zanu PF party has saluted South African President Cyril Ramaphosa for boldly engaging Unites States President Joe Biden on the need to unconditionally remove the illegal economic sanctions imposed on Zimbabwe.

President Ramaphosa recently engaged American President Biden on the negative impact of the illegal sanctions imposed through ZIDERA, telling Biden that the illegal embargo has affected not only Zimbabwe, but the entire SADC region.

Briefing journalists at the party headquarters in Harare this Tuesday, ZANU PF Secretary for Information and Publicity, Ambassador Christopher Mutsvangwa applauded the stance taken by President Ramaphosa.

“We applaud the bold stance by SA President Cyril Ramaphosa when he met Joe Biden (US President). It was good to hear it from our powerful regional neighbour. Sanctions against Zimbabwe are damaging growth prospects. Sanctions on Zimbabwe have negatively affected the region as they were meant for regime change, which they see is no longer possible,” he said.

Ambassador Mutsvangwa noted that the Americans, who have failed to effect regime change in Zimbabwe, are now focusing on the 2023 harmonised elections.

“After realising that their prospects of having their candidate win in Kenya, Americans sneaked into the country but they were chucked out via Zambia,” he said.

He commended the Second Republic for transforming the economy in the last four years.

“We hail what the President has done in the economy, introducing the primacy of the RBZ, young men on the streets have disappeared. The Ministry of Finance and Economic Development is doing a good job dealing with contractors who were at the core of creating fictitious figures on the market,” he said.

Zimbabwe has scored huge successes in infrastructure development and food security despite carrying the burden of the illegal economic sanctions for the past 22 years.

“My mother never loved me. She cared about everyone else except me. She would buy my siblings clothes and not me… not even a box of pads. So I took advantage of her and my stepfather’s marital and sexual problems to get everything I want.”

After all the mistreatment from her biological mother, she decided to deal with her mom. Paballo’s mom used to work at a retail store, and while she was at work, Paballo would wear skimpy clothes to seduce her unsuspecting stepfather.

As a man of the cloth, the stepdad tried to resist this temptation, but the flesh unfortunately prevailed, and he chowed his wife’s daughter.

After that, Pastor bae would give Paballo money for clothes, a phone, nails, hairdos, school trips and sneakers.

The lady immensely enjoyed the escapades, and she divulged to a former friend from Church. She told someone else, and the rumour soon spread in the Church.

Paballo’s pastor stepdad was removed as the leader, although he denied it and accused her of having demons. She was then banished from the Church.

Her mother threw her out of the house, and she promised to give her stepdad the cookie for free.

Despite all the embarrassment and shame, Paballo and her stepdad continued their romps. They broke up three years ago, and the Pastor is still bitter.

The story shook Twitter users.

And despite the bad news, it seems Nyovest’s spirit hasn’t been dampened, he told his fans “instead of tossing and turning for hours”, he went for a run instead. As things stand, the only people who are going to see the fight are the people who have bought tickets to see it live. No TV or streaming,” he added in another post.

In the build-up to the show, Mufasa revealed that he would quit boxing should he lose to his latest rival, Priddy Ugly.

“I’m fighting Priddy Ugly on the 1st of Oct, that’s in 2 weeks at Sun Arena. If I lose I will quit boxing forever. If I win I wanna fight Big Zulu next. Nobody wants to fight Zulu so i’ll step up. But first, Priddy Ugly Oct 1st, Sun Arena,” tweeted the star.
