THREE-WEEK old baby to lose arm after nurses mess up

A THREE-WEEK old baby will have her arm amputated after nurses at Gwanda Provincial Hospital allegedly mutilated it while trying to insert a cannula.

Gangrene has set in on the baby’s arm and it is giving off a bad smell.

Baby Andile’s mother, Miss Patience Chikahamadze (25), said that her family has engaged lawyers to represent them in demanding compensation from the hospital.

Miss Chikahamadze said Andile was born at the health institution on July 22 when she went to visit relatives in Gwanda. The baby, she said, was admitted for routine observation on July 29 after she was said to be dehydrated.

“We’re devastated as a family. Our happiest moment has turned into a horrible nightmare,” she said, holding back tears.

“A PSMAS doctor is carrying out tests on my baby here in Bulawayo. However, we’ve been told the arm is likely to be cut off at the shoulder.”

Miss Chikahamadze said she shed tears as she watched nurses pricking her daughter all over her arm in a vain attempt to insert the cannula as they could not locate a vein to put a drip.

“They pricked my baby on almost 10 parts of her body and she wailed piteously. When they eventually forced it in, two pints of fluid were pumped into her arm before the drip stopped flowing and her arm began to swell.”

“We tried to tell the nurses on duty that something seemed amiss but they cut us short. They said they knew better. My baby’s condition began to deteriorate and she cried a lot indicating she was in pain. Nurses that I won’t mention by name turned a deaf ear and instead concentrated on their phones.”

Miss Chikahamadze said Andile’s body temperature shot up to about 40 degrees.

The cannula was stuck on my baby’s arm for over a week, although we could see that the arm was getting infected. The arm was getting dehydrated and skin on her whole body began to peel off. Still no one was willing to listen to our pleas as they claimed to know better,” she said stifling sobs.

She said baby Andile was eventually transferred to Mpilo Central Hospital on August 8.

“By then she looked like she had been scalded with a hot liquid on the arm.

We could tell the baby was feeling intense pain as she cried ceaselessly. Her fingers have become shrivelled and she can’t move them.”

“We know suing the hospital will not return our angel’s arm but it will be a lesson to other nurses to give full attention and dedication to patients,” she said.

The baby’s grandmother, Ms Evelyne Chikahamadze, said she could not believe hospital staff had watched while the baby’s condition deteriorated to the extent that her arm now has to be removed.

“We want the world to know how some hospital staff can be cruel because this arm rotted and got dehydrated right in front of their eyes.

“When dealing with human life, dedication is required and there is no room for ignorance and negligence,” she said.

Matabeleland South provincial medical director Dr Brian Maponga said he had requested the family to complain in writing to assist investigators.

“I have asked the parents to submit a complaint detailing everything in writing. I will meet them and I have also asked the hospital to give me an update on what transpired. Those two reports will guide us on the next step,” he said.


ZESA hands over defaulters to lawyers to recover $572 million

The Zimbabwe Electricity Transmission and Distribution Company (ZETDC) has handed over some of its defaulting customers owing $572 million to lawyers as it intensifies efforts to recover money owed by users.

A transmission and distribution unit of Zesa Holdings, ZETDC says it is owed $1 billion by its customers.

ZesaZesa spokesperson Fullard Gwasira said that the measures currently underway were in line with its credit control policy and had been necessitated by the need to sustain the prevailing stable power supplies to its valued consumers.

Gwasira added that it was prudent customers appreciated the need to pay for their consumption to maintain security of supply.

Zimbabwe is generating an average of 1 200MW against demand, which sometimes peaks to 2 200MW.

Council worker run over and killed by reversing refuse collection truck

A City of Harare employee, Nahor Mushavi, died on Tuesday after being run over by a reversing refuse collection truck

The city’s acting communications manager Mr Michael Chideme confirmed the incident.

He said the city has lost a hardworking employee whose contributions will be missed.

Bulawayo police arrest 210 ‘robbers’ in two days

POLICE in Bulawayo arrested 210 suspects in just two days this week in connection with a series of theft cases that rocked the city recently.

Detectives recovered stolen property worth thousands of dollars between Monday and Tuesday.

The 210 were arrested following a sting operation to curb theft from vehicles, unlawful entry and plain robberies among other crimes.

The officer commanding crime prevention in Bulawayo, Chief Superintendent Marshal Dube, headed the operation.

Yesterday, acting Bulawayo police spokesperson Assistant Inspector Abednico Ncube said the arrested suspects are linked to the recovered property.

We’ve arrested at least 210 suspects in connection with various offences during an operation to stop unlawful entry and plain robberies.

“We’ve also recovered a wide range of stolen property which includes electrical gadgets, laptops, cellphones, television sets, refrigerators, vehicle wheels with reams and radios,” said Asst Insp Ncube.

He said police recovered some of the stolen property from informal traders. Ass Insp Ncube warned members of the public against buying goods from informal traders saying those who do so risked being arrested as accessories to theft.

“Some of the arrested culprits failed to account for the property that was found in their possession,” he said. He said two of the people who were arrested were on the police most wanted list for crimes ranging from pickpocketing, assault and theft.

“Members of the public who might have fallen prey to these criminals are being urged to visit the Zimbabwe Republic Police licence inspectorate at Drill Hall to identify their stole property,” he said.

Asst Insp Ncube said those seeking to recover their property should be in a position to produce serial numbers for goods or positively identify their property. Last month police said property worth nearly $2 million was stolen in the city between April and July this year.

Tsvangirai urged to get cancer treatment in Zimbabwe

A newly established cancer management utility has urged opposition Movement for Democratic Change (MDC-T) president, Morgan Tsvangirai, and others to seek treatment locally.

Tsvangirai was recently diagnosed with cancer of the colony and has been receiving treatment in South Africa.

Thokozani Khupe, one of his three deputies, has also revealed that she has cancer.

Many high profile people travel abroad to get specialised medical attention due to numerous challenges burdening the local health sector, but critics say some of the trips are unnecessary as their conditions can be cure locally.

President Robert Mugabe, reportedly dogged by prostate cancer and eye problems,  has for years been receiving treatment in the Far East even though Zimbabwe boasts Dr Solomon Guramatunhu, a world renowned optician.

Oncocare, a new multi-million dollar facility established by local doctors which claims to deal with all forms of cancer, says getting medical attention locally is cost-effective.

It is located on the eastern outskirts of Harare and is the first medical institution in Zimbabwe exclusively treating cancer.

The institution provides cancer research and education, chemotherapy, palliative care and has a retail pharmacy.

Its chief executive officer, Ben Deda, encouraged Tsvangirai and others suffering from cancer to approach his institution for help.

“We have the latest technology and offer the same services that cancer patients get anywhere in the world. We therefore are inviting him (Tsvangirai) and other cancer patients who are going all the way to South Africa and India to come and get treatment here,” he told local journalists.

“One would be cutting costs by getting treated at home. Remember they are losing money on air fares, accommodation and food when they travel outside the country for exactly the same treatment they can get here,” added Deda.

Oncocare staff said they were working on making their services affordable to patients, among them those that have been getting help externally.

Jobless Zimbabwean teachers flock to Namibia

UNEMPLOYED Zimbabwean teachers are reportedly flocking to Namibia after the neighbouring country’s government advertised 2 000 teaching posts which it said are open to Sadc region nationals. There are about 25 000 unemployed teachers in Zimbabwe.

The Zimbabwe Teachers Association (Zimta) president Richard Gundane however urged teachers to treatsuch adverts with caution.

In the advert, the Namibian Ministry of Education, Arts and Culture advised interested candidates to submit their applications by August 29. The posts are for both primary and secondary schools and teachers will be deployed to different provinces.

“All foreign qualifications must be submitted with evaluation reports from Namibia Qualifications Authority (NQA). All qualifications or transcripts not indicating the duration of the qualification must be accompanied with a testimonial testifying the duration e.g. 3 year qualification or student completed/passed 3 year qualification,” read the statement.

“An attractive range of benefits for permanent full time staff members include a housing benefit, transport allowance, pension fund, medical aid scheme, social security and ample vacation and sick leave.”

The ministry said certified copies of educational qualifications and a complete CV including history of employment must accompany application on Form 156043 and 156094 obtainable on all Government Offices and on www.moe.gov.na.

“Interested persons from the designated group are strongly encouraged to apply.” Mr Gundane yesterday said: “I saw the advert online and I am still verifying to check its authenticity. We encourage those willing to apply to make sure they negotiate for good working conditions.”

“They must get fair contracts that will guarantee good labour standards. We do not want a situation where anyone is hooked into crime or fake employers who dupe people of their hard earned cash,” said Mr Gundane.

He said the applicants must be wary of bogus employers who demand payment during the application process. A Namibian official yesterday said interested teachers should approach the Namibian Ministry of Home Affairs office to process their work permits.

“Applicants are required to have work permits. They can submit their applications while working on acquiring the permits,” she said. A Zimbabwean lecturer working in Namibia said the work permit could take up to 60 days to process and costs R2 800.

A teacher who lost his job after deserting pupils to look for greener pastures in South Africa in 2008, said he had met many Zimbabweans scrambling to apply. “I hand delivered my application and I met scores of other Zimbabweans doing the same,” said Mr Zenzo Sibanda.

Jailed rapist Munyaradzi Kereke and the National Prosecuting Authority (NPA) were yesterday ordered to share equally 75 percent of legal costs accrued in the former Bikita West legislator’s prosecution.

Private prosecutor Mr Charles Warara is still to calculate the costs. Harare magistrate Mr Noel Mupeiwa subtracted 25 percent from the costs on the basis that Kereke was acquitted on the charge of indecent assault.

“The first count of indecent assault occupied a quarter of proceedings and Kereke was acquitted. “The second charge of rape in which he was convicted took a huge chunk of time — three quarters,” he said. The private prosecutor was entitled to three quarters of the bill of which Kereke would pay 50 percent and the NPA 50 percent.

In his ruling, Mr Mupeiwa said there was no way the court would become functus officio on deciding on legal costs. “The defence argues that this court no longer has jurisdiction to decide on the legal costs issue,” said Mr Mupeiwa.

“There is a statutory provision, which says the court can order costs to be paid. However, the private prosecutor is guilty of prolonging proceedings by posing long questions of little relevance in cross-examination.

The trial was unnecessarily prolonged and took six months instead of three days. On the other hand, the Prosecutor-General refused to prosecute Kereke until an order was granted and there is no explanation to that except that they exercised their discretion.

“Kereke is not innocent too in this matter because he approached the Constitutional Court refusing to be prosecuted. “Although he was exercising his rights, he delayed trial. Making Kereke pay the legal fees is tantamount to punishing him twice.”

Mr Mupeiwa said the Criminal Procedure and Evidence Act only talks of costs and expenses but not on a scale. “This is because the private prosecutor asked for costs on a higher scale,” Kereke was jailed 10 years for raping a 13-year-old relative in 2010 at gunpoint.

Prominent lawyer Mr Jonathan Samukange said it is difficult to determine how much Mr Warara will get in legal costs because there is no rate for criminal cases. “It is solely up to the private prosecutor to decide how much he is owed for the years that he represented the matter,” said Mr Samukange. “Legal costs follow the loser and if Kereke had won the case, he too could have applied for legal costs.”

Another top lawyer who spoke on anonymity said it is commendable that the judicial system is allowing cases of those who feel aggrieved to be taken further regardless of money. “If a people feel that they are still aggrieved they can approach the legal resources and get a Government funded lawyer who can take their case further,” he said.

“Also, Lawyers for Human Rights are assisting people regardless of money. If one has the money they can hire a private prosecutor just like in the case of Kereke. “Cases in which the Prosecutor General decline prosecution although there is case have always been like that in the country and worldwide

When you talk of ice sports or activities we can only relate the subject to far away countries like Island, Iceland, Canada, and others were the atmosphere allows for such fun and sporting activities to happen because the weather patterns in those areas are conducive for such.Being exposed to the icy atmospheres also allows individuals to be skilled in those fields which was never possible for an ordinary citizen of Zimbabwe.

However, that has become a thing of the past as many people have embraced the newly constructed ice skating rink at the Westgate Shopping Mall at the Fountain Court.

People are coming from all over Harare just to get a feel on the ice and spend time with their loved ones at the Westgate recreational facility named “263Chilled Ice skating rink”.

Yes, ice skirting is now in Zimbabwe and many people who have had the news are liking this remarkable development especially the kids and the youths.

The rink is open from 9am to 9pm daily and entry costs $8 for skaters and $4 for non skaters.

A person can skate for one whole hour and the entry free includes skating boots.

“263Chilled ice skating rink” indoor facility comes just in time for the summer season were it gets extremely hot in the country at times and the environment at the facility will do the magic by just cooling you down.

Though skating itself gets you sweating the cool off is instant and worth the slides on ice according to a number of fun lovers who have had the opportunity to take part in the skating activities therein.

This is just cool and entertaining ,when you get into the skating rink you can get all sweating but the ice cools you off instantly which is good for all skaters,” said Amish Chirisa who also had an opportunity to skate.

“I’m excited that at least what we thought wasn’t possible in Zimbabwe has come to our door step. Thanks to technology which has made this development possible,” said Luke Marlon who came all the way from Borrowdale to enjoy skating.

263 Chilled skating rink official Tamuka Muzondo said they want to add more activities within the facility to attract people with different indoor activities needs.

“We are in the process of adding more activities like pinball which will be on the top deck so that it becomes a hanging place for more people,” Muzondo said.

“People can also book for private functions like birthday celebrations or family fun days as well as others.”

School kids will also get an opportunity to be trained in various skating activities and sports like ice hockey as they will soon introduce skating classes tailored for them.

“The whole idea is to create a favourable atmosphere for anyone who needs indoor fun. We also cannot allow alcohol within the premises because it can be dangerous,” Muzondo said.

The rink will serve many people who cannot be in other countries to witness or take part in ice skating activities.

Jah Prayzah is the Biblical Canaan in Zimbabwe’s showbiz industry today — that land of milk and honey — and naturally no one should want out of the musician’s orbit. Unless it is all a facade.

Gonyeti aka Pamela Zulu has shocked everyone and even angered the closest of family members and friends with her decision to walk out on the most sought-after entertainer in the country at the moment.

Her unexpected move has made her the butt of many jokes, some have even questioned her sanity while others believe there is more to it than meets the eye.

However, a chat with the chubby yet pretty songstress reveals she has no regrets, she is not insane, but carries deep-seated frustration with her former employer and how he has transformed over the last few years.

“Mukomana (Jah Prayzah) hasisina moyo, hasisina rudo. Zvake zvaita hasisina basa nevamwe (the guy no longer has a heart, he has no love anymore. His ducks are in a row now so he does not care about anyone else),” said Gonyeti as she opened up.

But is lack of love in a workplace enough to show her band of three years her back? After all, who needs love when one is well paid, treated fairly and living a comfortable life? Or is this 30-year-old career backing vocalist being a cry-baby, a spoiled brat?

“I know people are laughing at me and calling me names. Harisi shavi rehurombe and handipengi (I don’t have some poverty-loving spirit and I’m not insane). This is like an abusive relationship where one feels not loved or cared for anymore and just wants out. When I met Jah Prayzah he was curtain raising for Jabavu Drive, a band where I was the lead singer, upenyu ivhiri hunotenderera,” said a dejected Gonyeti.

She added: “Of course we had disagreements especially over money. The monies we agreed on when I joined the band, when the band was charging less for shows have gone down instead of up.”

Gonyeti says when she joined Jah Prayzah around the release of the hit album “Tsviriyo”, life was awesome. She says when they went on tour, the monies were great and she also loved the publicity.

“Others got more, of course, but it was still fine,” says Gonyeti, adding, “the departure of Mai Shinda (Mother Filda aka Mama Filo), was the turning point in the welfare of band members.”

“These days certain shows we do we are told it is for charity and we do not get a single penny. Where we had agreed US$60 per show sometimes they give us half or so. It is so disheartening after lifting those boots through four sometimes five shows in three days.”

Gonyeti says when they confront Jah Prayzah, he gets angry and refers their (mostly her) questions to the manager and when they confront the manager, Jah Prayzah tells them the manager works under his instructions and thus he is a no go area.

“We were in a fix. When we go out of town we all get into that Baby Quantum, everyone including the bouncers. Sometimes the marimba set is thrown in there, making things worse.

“But the worst of it is that most of the times there would be no accommodation, no food, no place even just to freshen up and relax before going on stage. They (Jah Prayzah and his closest) travel in comfort and sleep in luxury yet we toil,” said Gonyeti.

Gonyeti says at Third Generation its each man for himself as Jah Prayzah and his management have mastered the art of divide and rule.

“The band is not united, he picks and chooses. He causes divisions. People are angry, most band members and workers, but they are afraid to speak or like I have done, leave. They are afraid of what people might think of them, that people will laugh that they walked out of opulence for poverty. But I came from Binga alone, so I left by myself,” she said.

Gonyeti dismissed the widely believed notion that she walked out of the band because she was protesting being left out of the USA and Canada tour, and that she tried to incite a rebellion of the band members at the album launch.

“I did not even want to speak to the media but that talk is precisely why I have come out to set the record straight. I went to the UK, I went to Australia, and I know how things work with promoters and all.

‘‘Being angry about the tour is completely wrong and out of the question. But for two weeks that they were away on tour we did not get the monies that we had worked for.

“Other band members got their monies yet some of us were left out, so already its clear there can never be such a revolt of all band members. I just asked myself a simple question: Every time I go out people say ‘Gonyeti Gonyeti’ but what exactly am I toiling for besides the fame? Other bands are envious of us, especially when we return from tours but the truth is there is nothing to be envious of.”

Gonyeti says the straw that really broke the camel’s back was when she had an accident on her way to a show and could not make it.

After informing her superiors she got a call the next day thinking she was about to get help but alas, she was threatened.

She says just before the tour, she complained about outstanding salaries, about US$500 per person, and all she got from her bosses was, “you talk too much”.

Confronted with Gonyeti’s allegations, Keen Mushapaidze, Jah Prayzah’s manager had this to say: “We parted ways amicably. If there are any outstanding issues she is free to come to the office to talk to me or Jah and everything will be sorted out.

“We worked well from the very first day I assumed office and there were no problems and if there were any they would be work-related, which is inevitable in any organisation. Apart from that we have always been cool, we wish her well in the endeavours that she wishes to pursue.”

As for outstanding monies or where full pay did not come Keen says, “In the entertainment industry and I’m sure all other businesses, things don’t go well each and every day but we have always done our best to make sure that everyone gets their dues. Whenever there were challenges, these were communicated to everyone and everyone was in the loop and they agreed to everything.

“We have records to that effect. Any arrears that are there are known to everyone and it is not a secret. I’m sure it would have been a problem if we did not acknowledge that we owe our guys monies. In everything that we do we always make sure that the band is in the know.”

Keen says Jah Prayzah has always been fair to everyone from management right down to the lowest member.

“When we travel it even hurts him (Jah Prayzah) that others have to stay behind and I have to explain to him. We have different events that have different requirements and we have to meet them. When such scenarios arise we have to take certain band members and drop others — it is not even the same people or same faces every other time.

“Some are in videos that we are shooting overseas now, everyone has their opportunity to shine and Jah Prayzah has never favoured anyone. We do not know of any favouritism. We have structures. Everyone knows how much everyone gets.

“Those that get more than others it is because they have specific roles they have been given since Third Generation was created and everyone who joins is made aware of such arrangements,” explained Keen.

So, where to now for the Binga-born and Victoria Falls-raised songstress?

“I’m creating a small manageable band and going back to doing cover versions while composing my own music. Ndakashingirira njombo surely I can get by on my own. I’m 30 years old and have two school-going kids, do you really think I would endanger the livelihoods of my kids if I did not have to? One has to be happy on stage because we are entertainers but I was not happy anymore,” said Gonyeti.

The former Summer Breeze and Jabavu lead singer has a message for Jah Prayzah, “Please take care of your people, love them, because they love you and even pray for you. Bring back the love of old when you would talk to your band members, have time to braai with them, have drinks and laugh, they miss those ‘Big Brother’ get-togethers and please pay them what they sweat for on that stage, it is their money, they have earned it.”

Jah Prayzah, who replaced his formative years manager, Mother Filda, with a new younger, degreed manager Keen Mushapaidze, a couple of years back has already said the Third Generation train will not stop because of Gonyeti.

Women Affairs Minister seen at ra_pe accused Magaya’s church

Thousands of followers of the Prophetic Healing and Deliverance Ministries, including a Government minister thronged the church’s Waterfalls base yesterday a day after their leader ‘Prophet’ Walter Magaya was arrested and arraigned before the court on rape charges.

Women Affairs, Gender and Community Development Minister Nyasha Chikwinya was part of the congregation that cheered Prophet Magaya as he walked in the auditorium.

Magaya arrived at around 3PM.

He received a standing ovation from his followers who appeared unmoved by the allegations being levelled against their leader. Magaya took time to go to the overflow to greet his followers who jostled to have him lay his hand on their heads.

In his address, Prophet Magaya avoided making reference to allegations he is facing before the court. He concentrated on sermons and prayers.

Magaya and his followers took time to congratulate his wife, Tendai, who was celebrating her birthday yesterday. The PHD leader was wearing a matching black suit and a waistcoat. He was driving a black Mercedes Benz.

On Saturday, Magaya appeared before provincial magistrate Mr Vakai Chikwekwe over rape allegations that the State is alleging occurred in June 2015.

The state says sometime in June 2015, Magaya invited the 25-year-old complainant to a house in Mount Pleasant, Harare and allegedly showed her around the place before leaving her alone in a room.

A while later, it is alleged, Magaya returned to the room in the nude and raped the complainant once. He thereafter gave her $200. The prosecution says the woman told her lover about the alleged abuse last month and a police report was made.

Lobels Bread sued over $109 000 loan by Grisberg Services

One of the country’s leading bread manufacturers, Lobels Bread (Pvt) Ltd, has been taken to the High Court by Grisberg Services (Pvt) Ltd, which is seeking to recover $109 195,66 advanced to the bakery firm as loan, while the latter was fighting liquidity challenges six years ago

Grisberg Services (Pvt) Ltd, which is cited as the plaintiff in the lawsuit claims sometime in September 2010 the bread manufacturing firm approachedGrisberg Services, seeking a loan in a bid to buy flour from Manyame Milling Company and to pay for bread pans.

“Plaintiff (Grisberg Services) undertook to loan defendant (Lobels Bread) money for the defendant, which was facing liquidity challenges and collapse to achieve the following with the loan: – payment for unlocking flour from Manyame Milling Company, payment to unlock the outstanding supply of bread pans, which the defendant required to run its plant number 9, and payment for or supply of diesel, which defendant required to start production,” Grisberg Services (Pvt) Ltd said.

Consequent to the agreement, the plaintiff accordingly proceeded to make the following payments to the defendant; $40 000 on September 16, 2010, $9 000 September 17, 2010, $20 000 on the September 21, 2010 and delivery of 904 litres of diesel, equivalent to $9 041.”

Grisberg Services further said in terms of the loan agreement, Lobels Bread, undertook to pay $15 per tonne for every flour supplied from the funds loaned, which amount would compensate Grisberg Services for loss of business and all in all the latter paid a total amount of $78 000.

“The defendant consequent to the agreement proceeded to repay the plaintiff a total of $96 400 between October 10, 2010 and June 7, 2011. However, the amount paid did not cater for all the interest of 10% per month that had accrued,” Grisberg Services said.

“Therefore, due to the interest of 10% per month accruing on amounts loaned the plaintiff as at August 31, 2012 was owed a total amount of $109 195,66 arising from the parties loan agreement.”

However, Grisberg Services said in May 2012, Lobels Bread entered into a scheme of arrangement with its creditors and, Grisberg Services, proceeded to submit its claim, but was rejected.

“The defendant had no legal justification for having rejected the claim arising from a lawfully entered loan agreement,” Grisberg Services said.

Lobels Bread has since entered an appearance to defend notice.

PROPHETIC Healing and Deliverance Ministries (PHD) leader, Walter Magaya, told his followers during a church service, shortly before his arrest, that some top politicians and government officials were plotting to silence him through trumped up charges.

Soon after the service held at the church headquarters in Waterfalls, Harare, Magaya was picked up by police officers from the Law and Order section and charged for allegedly raping a 25-year-old married woman in July last year.

He was only released the following day on $2 000 bail coupled with stringent reporting conditions.

Magaya said his detractors were not amused by his ambitious housing projects and property acquisitions, hence, the plot to blackmail him.

He made the remarks shortly after he unveiled a housing project in Bulawayo, where he plans to build 5 000 housing units for church members, which he said would go a long way in reducing the country’s housing backlog.

The youthful and charismatic church leader is also constructing a soccer stadium and hotel in the city.

“So today, I want to inform you this, that after the unveiling of Bulawayo, after I spoke about stands, after I built the hotel, they are very big senior people in government, who are upset with me and they want me arrested,” he told his congregants.

But, Magaya told congregants that he has about 16 audio recordings of conversations of people, who had approached three of his female congregants offering them cash in exchange for framing the rape charges against him.

Two of the three girls, he claimed, had allegedly testified during a church service, confirming the plot, saying they had been offered $100 000.

Magaya is accused of taking his victim to his Mt Pleasant home, where after showing her the house, left her inside, only to come back stark naked and forcing himself on her and later offered $200 to buy her silence .
The complainant alleges he did not use protection.

As part of his bail conditions, Magaya was ordered to report three times a week at the Law and Order section and was also ordered to surrender his passport to the clerk of court’s office. He is expected back in court on September 15.

He was represented by Everson Chatambudza and Oliver Marwa.

More Beitbridge police officers transferred from border town

THE Zimbabwe Republic Police has transferred more cops from Beitbridge District with those in the Police Protection Unit and Criminal Investigations Department becoming the latest victims.

There was a massive redeployment of police in Beitbridge District last week.

There are indications 500 police officers were transferred.

Initially when the redeployments were effected, the PPU and CID Law and Order section were spared.

However, there was a change of mind at the Police General Headquarters’ human resource department.

Sources within the ZRP yesterday said those in PPU and CID Law and Order were ordered to report for duty today at their new police stations.

 

police in ZimThe redeployment of police from Beitbridge followed demonstrations that left property worth thousands of dollars destroyed after cross border traders rioted against Statutory Instrument 64 restricting importation of some goods on July 1.

The police are accused of failing to handle the illegal demonstrations.

In a recent interview, State Security Minister Kembo Mohadi said the police failed to react on time even though they had information on the planned demo.

The force has an estimated staff complement of close to 500 officers in the district.

Police chief national spokesperson Senior Assistant Commissioner Charity Charamba recently dismissed allegations that the police officers had been redeployed for their poor handling of the July demonstrations.

“This is a Government programme, where all departments were directed to redeploy everyone from Beitbridge to other districts. The directive does not apply to the police alone.

“As police, we are the first to take up the initiative. This has nothing to do with poor performance and all these sinister reports we are getting,” she said.

Harsh conditions force Zimbabweans in South Africa to beg in search of a better life

Having fled economic turmoil in Zimbabwe in 2008, Merlyn Ndou sought refuge in neighbouring South Africa; anticipating a change of fortunes, but the place of gold or Egoli, as South Africa is popularly known, has reduced her to a beggar.

Ndou, a qualified teacher, was recruited into a group of beggars – a Johannesburg-based syndicate created by a South African national, who provides shelter and food to desperate Zimbabweans fleeing their homeland in search of a better life having endured years of misrule back home. In return the South African demands from them a portion of whatever they get from begging.

As remuneration for her services, the South African benefactor – only identified as Bra Sol – provides Ndou with food and shelter in Shanty Town, a rundown squatter camp near Johannesburg’s Alexander Township.

The shadowy South African national has hundreds of Zimbabweans eating out from his palm, exploiting their desperation.

Every Zimbabwean beggar in the consortium has a target of 50 rand every day.

Bra Sol collects proceeds from the “beggars” at the end of each working day, and Ndou and others are left counting their losses after a day of hustling.

Zim in sa“Ngiyacela uncedo (Please help me),” Ndou says in a corky voice as she patiently waits for a good Samaritan to drop into her cup a few coins that would help guarantee her next meal and a roof over her head for the night.

“I should have stayed home and continued as a teacher, because life here is not easy. I hear teachers are getting a decent salary these days,” Ndou lamented.

Ndou’s benefactor cashes in all the proceeds at around 17:00 hours, provides supper and transport to her abode.

A pale-looking Ndou is suffering from a rare skin disease which needs attention and the South African benefactor is using her health condition to draw public sympathy and boost alms.

She carries a fake doctor’s report that explains her condition, which most people ignore as they go about their business.

“Bra Sol provides me with the medicine for my skin disease which started late last year. I think it is caused by our living conditions, which are terrible,” Ndou told the Financial Gazette during a recent visit to the neighbouring country.

Ndou was fired a week after getting a job as a domestic worker because her employer feared that she could spread the skin disease to her children.

The 35-year-old was left with no choice but to beg on the streets of Johannesburg.

Ndou and some of her Zimbabwean colleagues have tried to fend for themselves, but prohibitive accommodation and food costs keep them in the beggars’ world.

Another Zimbabwean, Pascal Mbedzi (24), from Beitbridge, who is stationed in Braamfontein, is a high school dropout who also left for neighbouring South Africa at the height of the country’s economic turmoil in 2008. He has since then found the going tough, forcing him to join Bra Sol’s army of beggars.

Speaking in broken English, Mbedzi targets rich white South Africans.

He sometimes offers to guard parked vehicles, receiving coke money of up to 100 rand per day and he is somewhat a favourite with the white folk.

But the vicious dependency on the benefactor has caused Mbedzi to stick with the pack.

“I am a young man whose dreams were stolen away by poverty back home. Things were not well so I decided to come here. At least I can get food and a place to stay – it’s not enough though,” Mbedzi said.

“I am looking for capital to start my own business; I know I can make it one day,” said Mbedzi, who, along with other beggars, are each morning dropped off at strategic points to begin their daily chores of begging for a living.

Speaking to the Financial Gazette, a Zimbabwean freelance journalist based in South Africa, Guide Muringai, said there were many untold stories of the suffering Zimbabweans are going through in the Rainbow nation, as South Africa is fondly known.

“Most of our people, due to desperation are used to commit things like crime, drug peddling, sex and begging which is degrading us as a nation. This is how our government has reduced thousands of its citizens to paupers,” Muringai said.

Zimbabwean women have been recruited into drug syndicates where some Nigerian nationals allegedly use drugs to lure them into the sex trade.

Desperate young girls are kept in houses situated in Sunnyside, Rosettenville, Windsor, Benoni, Newlands, Newclare and Eldorado Park, among other areas, in a situation that most probably dwarfs the Kuwait human trafficking saga that received much publicity recently.

Reports say the girls are tied to their beds during the day so that they don’t escape. They are then released at night to engage in illicit sexual activities.

Department of Home Affairs spokesperson, Mayihlome Tshwete blamed human trafficking on South Africa’s liberal travel regulations with most citizens from countries such as Zimbabwe freely entering the country.

“It is easy for people to engage in trafficking because South Africa has many ports of entry, hence easy access. So we are pushing for tough immigration regulations,” Tshwete said.

South African non-governmental organisations have been engaging in campaigns against drug abuse as part of efforts meant to stamp out the drug and sex trade problem, which has rocked most parts of Johannesburg.

Police constantly blamed the victims for not reporting such incidences.

An estimated three million Zimbabweans are believed to be residing in South Africa, with the largest percentage of the population living without permits and well paying jobs.

Despite these hardships, many Zimbabweans living in South Africa have chosen to stay put in the neighbouring country until normalcy returns to their motherland.

Recently, #ThisFlag campaign founder, Pastor Evan Mawarire, who has also sought refuge in that country after infuriating President Robert Mugabe for organising a hugely successful stayaway in July, told the Zimbabwean story to technocrats at Wits and Rhodes universities as he sought to mobilise support for change in Zimbabwe.

General sentiments by Zimbabweans in South Africa are that the government should admit failure, paving way for early elections in order to effect change in the country.

Lumumba to stand trial for insulting Mugabe

Former Zanu PF youth leader William Mutumanje  — popularly known as Acie Lumumba — will stand trial for insulting President Robert Mugabe after his application for referral of the matter to Constitutional Court was dismissed.

Mutumanje, who appeared before Harare provincial magistrate Vakayi Chikwekwe, is being charged with undermining authority of or insulting the president as defined in Section 33 (2) (b) of the Criminal Law and.

Chikwekwe ruled that is was justified for Mutumanje to go through trial because his utterances did not amount to criticism but were demeaning on the president’s dignity.

The trial was subsequently set for August 29.

“The president, as a fellow human being, has rights not to be demeaned or abused in any manner. This is premised in the principles of our Constitution and has nothing to do with the station held by the human being in question,” Chikwekwe said.

“In his speech the accused person uttered the words f**k you to Mugabe and the question which follows is whether it amounts to insulting and whether it would be a violation of one’s rights. An insult ought to be distinguished from criticism.”

Acie-Lumumba“While one is entitled to freedom of expression it should not go beyond the scope of mere criticism. The accused person has to answer the allegations in a criminal trial. His application is not bona fide and consequently dismissed.”

Prosecutor Oscar Madhume echoed the same sentiments with Chikwekwe and told the court that although Lumumba’s main argument was that the Constitution guaranteed him freedom of expression, that same law also protected Mugabe’s right to human dignity.

“…those words were abusive and derogatory to the president. Do you appreciate the difference between insulting and criticising because the section you are charged under does not criminalise criticism?” Madhume said.

“Do you appreciate that it is an absolute right that has to be exercised reasonably

What then was the meaning of f**k you? From the build-up of that statement the words used meant to express an action against Mugabe. The accused person even accepted in his submissions that he had used ‘strong’ words,” Mudhume said.

However, Lumumba maintained that his utterances were a dramatic way of expressing his displeasure at how Mugabe has run down the country.

“When I attributed the words to be strong I referred to how I had used political dramatisation to express myself. The issue here refers to children of this country who have now been prejudiced of a bright future because of Mugabe’s actions,” Mutumanje said.

Last week, Mutumanje said Mugabe must develop shock absorbers to contain political scrutiny.

He gave reference to a 1979 interview in which Mugabe and his late wife Sally defended their political expressions.

“In 1979, Mugabe was in an interview with Angley Cutter and sitting next to him was his late wife Sally. The journalist asked his wife if she did not feel that people were sometimes too harsh in the way they expressed themselves against her husband, at that moment Mugabe interjected and said it was just politics and one ought to develop a set of shock absorbers,” Mutumanje said.

He told the court that Mugabe’s sentiments on political expressions came after he had said ‘the only good imperialist was a dead imperialist’ a statement which was taken to possibly provoke anger.

“He must do the same too now as he knows the game we are playing here and needs to stop whining,” added Mutumanje.

“May a day come when Mugabe also accounts for his words and actions and may this law also be applied on the president.”

According to State papers, charges against Lumumba arose on June 30, this year when he was launching his political outfit at a local hotel in Harare.

It was alleged that Lumumba addressed the people who attended the launch and referring to Mugabe, he reportedly said, “you have not been insulted, you are only insulted by protesters”
