Protest leaders denied bail-They were remanded in custody to 15 September

A Mbare magistrate on Friday denied bail to three activists who were recently arrested for allegedly inciting violence during protests late last week.

The trio, Pride Mkono, the Rural Teachers Union of Zimbabwe (RTUZ) programme officer, and human rights activists Mehluli Dube and Makomborero Haruzivishe.

The Prosecution is arguing that the three incited violence when they took part in a march organised by political parties to press for electoral reforms on Friday.

They were remanded in custody to 15 September, after the State argued that they could not be freed as they had similar cases pending.

Meanwhile, Linda Masarira continues to languish in prison, more than a month after she was arrested during a protest in Harare.

She was among the activists who started occupying Africa Unity Square in June, pushing for President Robert Mugabe’s exit over leadership failure.

James Jemwa, a freelance photojournalist, was granted bail after being arrested for filming last week’s protests.

He tested freedom together with a 68-year-old man named as Fredman Mbanjeshoma, who got caught in the protests.

Prosecution also said Masarira had a pending case In Mutare in which she had violated her bail conditions.


Mnangagwa must quit Zanu PF to save his integrity

Former Zanu PF Mashonaland West chairperson Temba Mliswa has said Vice President Emmerson Mnangagwa should resign to save his integrity, as he is facing relentless attacks from his juniors.

Mliswa said President Robert Mugabe is failing to respect his VPs, making it difficult for them to work with him.

“… if it were me, I would leave the job because integrity and dignity of an individual is more important . Those VPs have children and grandchildren, what would they say if they hear what is being said?” Mliswa told journalists in Harare this week.

Mnangagwa is facing mounting pressure from Zanu PF members to resign on allegations that he is plotting to stampede Mugabe’s ouster, with some openly attacking him.

In July, Manicaland provincial minister Mandi Chimene attacked him at a war veterans meeting.

She publicly accused Mnangagwa of leading a parallel government and plotting Mugabe’s downfall.

“The Tsholotsho Declaration was being led by Mnangagwa and now Team Lacoste is also being led by Mnangagwa. For how long are we going to keep on pampering one another?” Chimene said at the meeting between Mugabe and war veterans, which Mnangagwa attended.

Early this year, Mnangagwa was also undressed by Sarah Mahoka, at a solidarity rally held for Mugabe at the Zanu PF headquarters in Harare.

Mliswa claimed Mugabe is the one who is directing junior party members to attack Mnangagwa.

“It is sad that the president would sit and allow the VP to be attacked without even abominating them. And you then ask yourself who is the master of this game, it’s him (Mugabe) who is behind this game as he is allowing the VP to be attacked,” he said.

“The president has no respect for the VPs, something which does not only expose the weakness of the party but expose the country as a whole.”

Mliswa said in Mugabe’s absence, no one would listen to any one of the VPs, who would have been left as the acting president.

“If Mugabe goes out of the country, these guys have no powers, the young boy on the streets say we cannot listen to Mnangagwa because Chimene said this.”

The former Hurungwe West MP warned that Mugabe will be dislodged from power by the people he is persecuting.

“My message to the president is that these people are coming to you, you started with me, you then went to Dydmus Mutasa, Rugare Gumbo and Joice Mujuru now you have come to Mnangagwa the only one left is you (Mugabe),” Mliswa said.

Zanu PF is currently divided into two main factions — Team Lacoste that is pushing for Mnangagwa’s ascendancy to the throne and the G40 camp that is viciously opposed to the Midlands godfather.

Zimbabwe endorses the Indian Cultural Festival

The Ministry of Rural Development, Promotion and Preservation of National Culture in Zimbabwe has endorsed the launch of the inaugural 10-day Indian Cultural Festival where Indian artistes will share the stage with the Zimbabwean artistes.

The Indian Cultural Festival will be held under the theme Celebrate India in Zimbabwe and it is set to showcase India’s cultural diversity through music, theatre, dance, food and film.

The line-up of performers at the festival will include the Indian multiple award-winning singer and composer, Sonam Kalra, who is also acclaimed for The Sufi Gospel Project.

“The event will help cement ties between Zimbabwe and India. The relationship between Zimbabwe and India goes a long way and we do resonate with same Indian culture. Culturally, we have a lot of links, that is food and music,” said the Sport, Arts and Culture permanent secretary, Thokozile Chitepo, on behalf of the Rural Development, Promotion and Preservation of National Culture and Heritage minister Abednico Ncube at the launch of the festival on Wednesday

There is a lot to look forward to at this festival, including business exchange and building capacity programmes.”

Moreover, India’s ambassador to Zimbabwe, Rungsung Masakui, said the festival was not just showcasing India’s rich cultural heritage, but would be a collaborative effort between the organisers and host nation.

“The festival intends to put a patch on the vast cultural and artistic canvas of the city and become a regular feature in its calendar. It is our effort that the festival will add colour to the cultural landscape of the city of Harare through a rich repertoire of music, theatre, Indian cuisine, dance and yoga to the art city of Harare,” he said.

“The festival intends to create a narrative of our shared heritage and accomplishments and all that bind our two countries together.”

Masakui is said to have added that there would be several interactive workshops organised in partnership with Zimbabwe College of Music, the Dance Trust of Zimbabwe, University of Zimbabwe and Reps Teens group that had been planned with local groups to facilitate the exchange of culture between the two countries

After days in bed at home, the Old Man of Zimbabwean politics dragged himself to the Show Grounds to hear the guest speaker open the show and tried to do a short walk about. He was clearly not well. Then to our astonishment he left the country to fly to Kenya for a Japan/Africa summit. There he actually made a speech but still looked dreadful and really should have been at home

At the close of the summit he flew to Swaziland to attend a meeting of SADC Heads of State. For a much younger man this would have been a punishing schedule and on the plane to Swaziland he had some sort of medical collapse. He nevertheless tried to attend the meeting on Tuesday but collapsed in the meeting and was given medical treatment and then taken to his plane to fly home early.

The plane flew to Harare where a medical team and fresh crew and fuel were loaded and then they flew out – we suspect to his usual medical center of Singapore. However, in flight, they diverted to Lusaka and then Dubai on the basis of a medical emergency. What was wrong – as usual we were told nothing but we hear that the Old Man had a stroke.

I do not think he can come back from this and we must now assume that the long awaited transition to a new government and new leadership is at long last about to start. It would have been so much more dignified if he had recognised that his “sell by” date had arrived and he had retired and handed over to a chosen successor.

What now happens is that the Constitutional transition to a new President starts. The Acting President is Emmerson Mnangagwa who will now assume control of all the levers of the State. This phase runs for 90 days and then Zanu PF must hold an elective conference at which a new leader will be elected who then completes the term of office of Mr. Mugabe through to July 2018.

Then in July 2018, unless otherwise decided, the country will go to an election and a new democratic government will emerge and take over. So we are now back in another transition after the failure of the Mbeki transition of 2007 to 2013.

The problems that will confront the new leadership in Zanu PF are daunting. I estimate total national debt now at $30 billion and rising daily, interest on this debt is already in excess of $1 billion a year or a third of total State revenue.

The fiscal deficit is totally out of control and I have never seen such low confidence in every sector. The banks are unable to function normally, tight restrictions on all cash withdrawals, inadequate foreign exchange for imports and shortages are emerging and prices rising.

We are importing 80 per cent of our food needs and some 5 million people need food assistance to meet their basic needs. A million kids go to school hungry and a third of all school children are orphans. Our State wage bill is running at $280 million a month, against revenues of about $250 million.

Civil service salaries, already inadequate, are being delayed and pensions are months behind. Street protests are taking on a new dimension and threaten stability. Treasury bills, usually a secure form of investment are being sold at a massive discount and all other assets, especially property is selling for up to a 90 per cent discount. What a mess

In addition to all these problems the new leadership is going to have to try and maintain the reengagement process started in 2012 with the IMF and the other multilateral financial agencies. Critical to this process is the need to urgently restore credibility to the State as representative of the people of Zimbabwe and as a stable, law abiding player on the global stage of world affairs. Difficult if you are Emmerson Mnangagwa with 36 years of abuse on your shoulders and a tarnished record in the field of the rule of law and human rights abuse.

If that was not enough, the new leadership assumes control of a regime that is corrupt from the top to the bottom of the State. Perhaps a third of all revenues are being siphoned off in the form of “rentals” being demanded in every sphere of activity. Patronage is endemic and is the glue that holds the regime together, without it the State would disintegrate.

Then there is the situation in the Zanu PF Party itself. The Party is not divided, it is fractured and no reconciliation is possible. Tough for the Mugabe and G40 factions because, like the situation in a lion pride, a new dominant male is now in charge and soon he will systematically kill the progeny in the Party of all contesting males.

Personally I am delighted as there are some very nasty rogue elements in there today. The signs are there already that this process is under way. Grace has skillfully rolled over in front of the new dominant male lion and pledged allegiance. I wonder where Jonathan Moyo will run to for protection.

For Emmerson, this is the day he has been working towards for many years and he is fully aware of the challenges and the threats. He has two options – retreat into a closed, oppressive North Korea type State, where the international Community, on humanitarian grounds, feed the general population while the elite live wealthy secluded lives, protected by a privileged military. Or he can engage with the local population and the international Community to seek solutions; restore confidence and secure the assistance that is needed to put the country back together again.

His problem with the latter course of action is that all roads lead to a credible election in 2018, preceded by tough economic and political medicine. I have no doubt at all that in such an election, the Zanu PF Party would be totally eliminated from national political life, there is nothing left of Zanu today. But that is the price that must be paid for 36 years of failure and abuse. If he wants to rescue anything from this mess, then he has to negotiate, first with the rest of us who live here and secondly with the people who hold the purse strings.

We know what is needed – a massive, immediate, injection of funds to keep the State stable and to meet immediate needs in all fields. These funds can only come from direct bilateral grant aid by the countries that form the backbone of the G20 Grouping meeting in China this weekend. These are political resources and can only be unlocked once the new regime has done a deal with the major power brokers.

We can all imagine what the deal with the global community might entail – respect for economic fundamentals first, acceptance of the conditions under which the next elections will be held, reforms to restore confidence and respect for basic human and political rights and strict time lines. Because of the past there will be almost no confidence or trust in the undertakings of any local leadership and therefore there would be very strict compliance rules.

If managed properly and based on some sort of consensus, the phase leading up to the next elections could begin to see economic recovery and political stability. Negotiating through this minefield will need good facilitation by regional States and I am sure this will be forthcoming.

But for most of us who have made Zimbabwe our home, the passing of the Mugabe era will simply come as a great relief. It seems to have gone on forever. The majority here have never known any other sort of regime. We simply do not know what it is like to live in a normal democracy with a stable and growing economy.

Court blocks sale of Kangai’s farm

According to court papers, the applicant is Divine Aid Trust Company, which trades as Datco, while the respondent is Kangai’s Luna Estates and the registrar of deeds.

Datco filed the application for the placement of a caveat on Kangai’s land, in a bid to recover the amount of money that it invested in the project.

High Court judge Priscillah Chigumba granted the application in favour of the firm, after Kangai’s company failed to respond to the application.

According to an affidavit filed by Datco’s board of trustees’ chairperson Brighton Manengureni, the application sought to stop the sale of the remainder of Paarl measuring 257,643 hectares.

Kumbirai-KangaiThe company — through its lawyers Kadzere, Hungwe and Mandevere Legal Practitioners — further sought an order directing the registrar of deeds to register a caveat that would stop Kangai’s company from selling the said piece of land without Datco’s consent.

The court heard that Datco and Luna Estates entered into a memorandum of agreement in September 2012 for land development.

According to the agreement, Datco was to subdivide the land in question and develop it into smaller stands for resale upon the completion of the land development.

“It was a term of the . . . agreement that the applicant (Datco) would pay the first respondent (Luna Estates) money towards the intrinsic value of the land to the tune of

$3 000 000 during the currency of the agreement, which is of a five-year duration.”

“To this date, the applicant has paid the total sum of $745 110 to the first respondent through the first respondent’s agents and nominees,” the court heard.

The court further heard that Datco went on to develop the land in question, and used $269 948,25, to have the land surveyed.

Datco further incurred costs for the field work that was conducted and the application for an environment assessment certificate from the Environment Management Agency. The company said it has a substantial interest in the land and would be negatively affected if the property is sold.

It demanded the caveat as security, so that it may be able to recover all the amount that it used in the development of the property.

Luna Estates did not oppose the application, leading to the matter being granted in Datco’s favour on Wednesday

Mugabe returns home amid health rumours

Zimbabwean President Robert Mugabe arrived at the capital’s main airport from abroad on Saturday, according to a Reuters witness, following intense rumours that he was gravely ill and had sought medical help in Dubai.

Mugabe, 92 and Africa’s oldest leader, looked jovial as he disembarked in the company of security aides.

“I had gone on a family matter to Dubai concerning one of my children,” he told reporters in the local Shona language, without giving details.

Yes, I was dead, it’s true I was dead. I resurrected as I always do. Once I get back to my country I am real,” Mugabe added tongue-in-cheek in English, referring to speculation on some online news websites that he had succumbed to illness.

Reports that Mugabe’s health is declining have become common but he has often referred to himself as “fit as a fiddle.”

Mugabe rejects accusations by his political opponents that he has brought one of Africa’s most promising economies to its knees since coming to power at independence from Britain in 1980.

Married woman packs her bags every Friday to become another man’s weekend special. THEIR 30 YEARS of marriage have, unfortunately, included years of shame and anger.

The man claims he has been stabbed twice — by his wife and her boyfriend!

And every Friday she packs her bags and becomes another man’s weekend special.

But mdala Lesenyeho Letsooa (65) from L Section, Botshabelo in Free State says he will never leave his wife, Matumelo Letshoara (60).

“I am a man with feelings. I have done everything I could to stop her from running around,” he said.

He said it hurts to see her packing her bag, but there is nothing he can do about it.

“Even though she beats me and cheats on me, I will not leave her. We made holy marriage vows.”

Lesenyeho claimed his terror started years ago when his wife’s boyfriend stabbed him. He said she also stabbed him with a knife in February when they were arguing, but because of his love he kept on forgiving her and never opened a case.

“I forgave her and she promised she would stop her bad behaviour, but the situation is getting worse,” he said.

“I think my love for her has never been enough.”

Lesenyeho claims his wife does not look after the family.

“Matumelo does not have time to look after me and our two grandchildren,” he said.

The grandchildren are aged 10 and 14.

“When I try to talk some sense into her she loses control and starts swearing at me, calling me names,” he claimed.

“She said I do not know how to do a good job in bed.”

The devastated mdala said he wants his family to be strong and united and he pleads that people should pray for them.

“I do not always go to church, but I believe a strong prayer is the only way to save my family,” said Lesenyeho.

When Daily Sun spoke to Matumelo she admitted that she cheats on her husband and that she is another man’s weekend special — but she would not say anything else.

“Ask the mdala. He knows the reason for all our problems. I am not willing to discuss this matter with you,” said Matumelo, who also refused to be photographed.

Pastor Motseki Ramodula of Mission of Faith from Section W, Botshabelo said the family needs to get counselling.

“The devil is tearing the family apart, but mdala is strong and the devil is not winning the battle,” he said.

He will visit the couple and try to help them to solve their problems. — Daily Sun

Minister’s daughter Belinda Mutinhiri killed in car crash

Socialite Belinda Tafadzwa Mutinhiri, the eldest daughter of the Minister of State for Mashonaland East Province retired Brigadier-General Ambrose Mutinhiri and former Zanu PF MP Tracy Mutinhiri, has died in a car crash.

Belinda who worked at the Zimbabwe Tourism Authority is reported to have been killed in the accident which occurred along the Borrowdale Road in Harare, Saturday morning.

Her last update Friday evening on Facebook was a check-in saying:

“Belinda Mutinhiri was drinking cocktails at News Cafe Fife Ave Harare with Glo Diamond, Farayi Madzime and Nyasha Yvette Chitambo

Tendai Biti’s PDP to hold its first anniversary on 11 of September

The People’s Democratic Party (PDP) led by Tendai Biti will hold its first anniversary on 11 September in Bulawayo with a theme calling for a political coalition.

The anniversary will be held under the theme, #TogetherAnotherZimbabweIs Possible, which Solomon Madzore, the PDP national organising secretary, said is “based on the realisation that all political parties need to form a united front to resoundingly defeat the Zanu PF regime”.

In a statement, Madzore said various political parties, civic society and foreign embassies would give solidarity messages.

PDP was formed in September 2015 after Biti led a split from the Movement for Democratic Change (MDC-T) led by Tsvangirai who the breakaway team accused of failed leadership and had called for the expulsion of numerous legislators aligned to the former secretary general.

“(The) PDP has managed to grow significantly, its membership base across the country as evidenced by the high turnout at its activities held in all provinces.

There are increasing calls for the opposition to form a united front to challenge President Robert and Zanu PF at the 2018 elections as parties have in the past split votes.

The parties are currently engaging under the National Electoral Reform Agenda (NERA) and the Coalition of Democrats (CODE) to pool efforts.

The leading opposition parties, MDC-T and newly formed Zimbabwe People First (ZimPF) led by Joice Mujuru, have shown their keenness to join a grand coalition that has in the past failed because of political egos

President Robert Mugabe on Saturday described as reckless and negligent judges who make rulings in favour of anti-government protests, who he accused of causing violence.

On several occasions, protesters have had to apply to the High Court to have their demonstrations cleared after police refusal.

Police recently torched violence on demonstrations by using excessive forced to disperse protesters in spite of High Court orders.

Mugabe, though, said judges must not clear the protests because they have turned violent in the recent past.

Mugabe made the remarks as he addressed the Zanu PF youth wing in Harare, hailing the ruling party assembly for “restraining” itself against what he said was provocation by the protesters.

The protesters, however, have been calling on government to institute electoral reforms, reverse the current economic crisis and end a new wave of human rights abuses.

“Our courts, our justice system, our judges should be the ones who understand even better than the ordinary citizens. They dare not be negligent in their decisions when requests are made by people who want to demonstrate, to hold these demonstrations.

In light of the violence that we had earlier on, surely they should have taken note to the fact that when permission was given four days ago, there was violence; when it was given two days ago, there was violence.

“To give permission again when they (judges) are to the full knowledge that it is going to be violent or (there is a) probability that there is going to be violence is to pay reckless disregard to the peace of this country. We hope now they have learnt a lesson (the judges),” said Mugabe.

There is fear that the judges, who Mugabe appoints, will stop making fair judgments on protest applications in the wake of the president’s statements and as government has already banned protests in Harare till 16 September.

Citizens, under the constitution, have a right to demonstrate peacefully or make petitions.

But the Mugabe establishment has been shaken by a wave of restless protests since July as citizens demonstrated against unpopular policies that include a ban on imports, State-sponsored persecution of human rights activists, corruption and an ailing economy.

Government has branded as terrorists, protest leaders using social media to mobilise demonstrations and is railroading a Cyber Crime and Computer Crime bill to rein in perceived dissidents.

Mugabe, while addressing the party youths who have been conscripted to support his continued stay in power, hailed the bill.

“Social media should never be used negatively… That is rubbish, get out of it. We should not be part of it. We should remain clean, clean, clean. I am happy that the Ministry of ICT, Postal and Courier Services is crafting a law to guide the proper use of social media,” said Mugabe

A man from Triangle in Chiredzi raped his stepdaughter (16) after he discovered that she kept po_rnographic material in her phone which the two then watched together.

Masimba Zhowanota (44) of Mpapa in Triangle appeared before Chiredzi Resident Magistrate Constance Mutandwa at Triangle Circuit Court last Tuesday.

The State led by Doubt Phiri said that sometime in January 2015 Zhowanota found po_rnographic videos in the minor’s phone and he took advantage of the situation to propose love to her as well as obtain her consent for se_xual intercourse.

From February 2015 onwards the two had se_xual intercourse on several occasions at his house.

The complainant’s mother later returned from the rural home and was told by neighbours that they suspected that the minor was pregnant. After interrogations from her mother, the minor confirmed that she was impregnated by Zhowanota.

A decision was reached to send her to her mother`s sister and on August 15, 2016 she made a Police report at Triangle Police Station that Zhowanota had se_xual intercourse with her.

Zhowanota was sentenced to 24 months in prison with six months suspended for five years on condition of good behaviour leaving him with an 18 months effective jail term.

 


Jonathan Moyo vows that government will never introduce Electoral reforms-because doing so would be handing over power to the opposition.

HIGHER education minister and Zanu PF politburo member, Jonathan Moyo, has vowed that the Zanu PF government will never enact any electoral reforms because doing so would be tantamount to handing over power to the opposition.

Addressing journalists at the Bulawayo Press Club last Friday, Moyo rubbished calls for electoral reforms by opposition parties, saying reforms were concluded during the erstwhile government of national unity.

jonathan Moyo“They have been quiet for three years and suddenly they now want electoral reforms and give themselves a funny name, a parastatal name like NERA. Let us be clear, for a long time since 1999, the opposition was saying the most important reform that must happen in the country is a new constitution. The current Electoral Act as it is now is a product of the Global Political Agreement parties,” said Moyo.

He added: “Opposition parties are literally saying put in place electoral reforms that will ensure that you lose and we win. That will never happen anywhere in a modern constitutional democracy that a political party that has come into government on the back of negotiated electoral reforms to then come up with reforms intended to reform itself out of power.”

Moyo also denied the existence of a faction called Generation 40 within the ruling party, insisting the phrase was a creation of the media.

G40 is widely believed to be a group of young Zanu PF politicians working to stop vice president Emerson Mnangagwa from succeeding President Robert Mugabe. The group, which is said to be fronted by First Lady Grace Mugabe, is said to include Moyo, Saviour Kasukuwere and Mugabe’s nephew, Patrick Zhuwao.

“They say there is G40 and you say who is in G40? They say Kasukuwere, Jonathan Moyo and Patrick Zhuwao. A faction with three people!…. I think our country deserves better than that,” said Moyo.

A polygamous farm manager was humiliated and fined after his attempt to bed his father’s second wife for ritual purpose was foiled. Fortune Joe Katurunga, 48, appeared before headman Dununu (real name Matare) and was fined two beasts for demanding se_x from his father’s second wife Brandalina Soko, 58.

Fortune’s desire to get rich quickly prompted him to visit a sangoma and there are claims that the sangoma asked him to bring semen collected after se_x with a relative in order to receive charms that would enrich him.

Narrating her ordeal, Brandalina said she felt her time to die was near after Fortune approached her for se_x.

“I sweated and nearly fainted after my step- son approached me asking to have se_x with me so as to get rich,” said Brandalina.

“He visited my house during the day and asked my grandchildren to excuse him saying he had a secret that needed us to be alone. He brought beer saying the issue he wanted to discuss with me needed him to be drunk.

“He returned to his home and came back after some minutes. He asked the grandchildren to excuse us for the second time and that was the time he told me the rubbish.

“After my grandchildren left, he revealed that he had visited a sangoma but could not disclose where the sangoma resides claiming that he would become rich. He promised me wealth if I agreed to have se_x with him.

I felt embarrassed but as a grown up person I controlled myself and sought ways to trap him and have witnesses. I informed his first wife and begged her to behave herself so as to trap him since he had told me that he was coming in the evening to tell me where the love nest was.

“He came around 7pm and I sent my grandchild to inform his first wife and she was on time and heard the entire conversation as he was standing near a window. “It was all lust and drunkenness that I failed to realize that Brandalina was my ‘mother’, my father is still alive and staying somewhere. There is no sangoma who asked me to have se_x with my mother, its only lust my dear, I am prepared to give the beasts demanded since I am to blame by acting foolishly because of drunkenness,” said Fortune.

Efforts to get a comment from Fortune’s first wife, Mai Memory was not successful since she was not at home.

According to Masvingo Beef Farmers’ Association (MBFA),  Robert Makado,  all seven districts in Masvingo province have run out of pastures.

“About 45 000 cattle are under threat in the province due to the non-availability of pastures. Most rivers and weirs have dried up and most dams like Lake Mutirikwi are less than 15 percent in water level,” said  Makado.

He added, “The price of stock survival feed is not affordable to many farmers. The $10 charged per 50kg of stockfeed is too high.”

The price should be reduced to half or even $3, he said.

Scores of staunch United Family International Church (UFIC) leader Emmanuel Makandiwa followers besieged Alpha Media Holdings (AMH) offices in Harare on Sunday after they were incensed by The Standard newspaper.

The Standard had published a picture of Makandiwa’s wife, Ruth but erroneously said she was the rape accused Prophet Walter Magaya’s wife.

That alone was enough for Makandiwa followers to storm the publication’s offices ‘demanding editor’s head’.

High Court postpones demo application after Mugabe remarks to Wednesday

A High Court hearing in which opposition political parties and human rights defenders are seeking a reversal of a recent ban on demonstrations has been postponed to Wednesday.

Tendai Biti, who is representing the applicants, told the media that the matter was postponed after the State sought more time to prepare its case.

“The state lawyers are yet to file their opposing papers and have asked to be given more time to file their papers,” said Biti.

Government last week invoked Statutory Instrument 101A to ban demonstrations in central Harare.

This follows a recent wave of protests that turned violent when police tried to stop demonstrators demanding electoral reform and President Robert Mugabe’s exit following his government’s failure to solve the current economic problems.

Mugabe last Saturday issued a veiled threat to the judiciary which has in recent weeks approved demonstrations after initial police opposition.

The applicants are seeking an order to suspend the statutory instrument and to interdict the police from unlawfully interfering with the rights of citizens to demonstrate or petition as provided under Section 59 of the constitution.

Biti, a constitutional lawyer and head of the People’s Democratic Party (PDP), is representing the applicants who also want the police to continue processing applications to demonstrate
