Human rights watchdog condemns Mugabe attack on judiciary – its a threat to the independence of the judiciary in particular and the constitutional order

The Zimbabwe Human Rights Association (ZimRights) has expressed concern over President Robert Mugabe’s weekend attack on the judiciary for clearing anti-government protests.

Zimrights, in a statement on Monday, said it was worried that the attack poses “a clear threat to the independence of the judiciary in particular and the constitutional order at large”.

Addressing the ruling Zanu PF youth wing last Saturday, Mugabe said the judiciary acted recklessly by ordering popular demonstrations to go ahead despite police resistance.

“The statements are unfortunate coming from the head of State and government, whose primary duty and oath of office commits him to defending the constitution of Zimbabwe.

“The constitution…commits the president to protecting the inalienable rights that the Bill of Rights in Chapter 4 allots to Zimbabwean citizens regardless of their political affiliations, including the freedom to peacefully demonstrate and petition,” said ZimRights.

The watchdog said Mugabe must not put his personal interests ahead of the constitution.

“Neither should considerations of the interests of his political party override the duties of his public office through utterances that constitute an ill-advised executive interference with the democratic independence of the judiciary,” it added.

The freedom to peacefully demonstrate and petition is granted under Section 59 of the constitution.

“The judiciary justifiably performed its functions when it upheld this inalienable constitutional right by reasonably and legitimately granting court orders for protests to go ahead,” added ZimRights.

Recent protests turned violent when the police sought to stop them, but ZimRights said where violence occurs, police must investigate instead of shifting the blame to the judiciary.

“It is unfortunate that for reasons known to the head of state, he has also turned a blind eye to the reported cases of police provocation of protestors, and excessive and indiscriminate use of physical violence, teargas and water cannons against innocent civilians in the recent protests.

“The utterances by the President are clearly aimed at subduing the judiciary to the control and political puppetry of partisan interests of the ruling party, which is an abrogation of the principle of non-interference with the independence of the judiciary,” said the watchdog.

This is just a short note to follow my letter entitled “A New Beginning” in which I detailed the flight from Swaziland to Dubai, via Harare and Lusaka of Robert Mugabe. In that letter I said he was not going to be able to come back and was probably the victim of a stroke.

He left the SADC Summit on Tuesday evening and his aircraft returned Saturday morning after a 11 hour flight from Dubai. That meant he was in Dubai for two nights and three days. That is not enough time for anything to be done to him and the State media here are going to great lengths to ridicule talk of his health and possible incapacity.

However our sources are impeccable and there is no doubt that he is very ill and frail. There is also talk that he needs an operation but that his chances of survival are limited and that Singapore – his traditional choice for frequent medical treatments has said that they are reluctant to allow further visits on the basis that his survival his in doubt.

Pictures of the man at the Agricultural Show in Harare last week, unable to get shoes on his feet (circulation problems linked to heart conditions) and struggling to stand by himself or walk, sleeping in his seat at the Japan/Africa summit in Kenya and an awful image of him on the podium.

Followed by a very public collapse in the SADC summit and his hurried departure at 22.00 hrs for Harare where he did not get off the plane which then loaded a medical team and fuel and set off for Singapore.

Then the sudden diversion to Lusaka and another departure to Singapore with an unplanned turn over the Indian Ocean to Dubai can only mean a health crisis.

In recent months he has clearly not been fully in charge of national affairs. He is a frail, shrunken old man with obvious health problems. Flying him around the world in an aircraft is certainly not ideal treatment of care – more like a deliberate attempt to kill him.

I remain convinced that he cannot come back from this. This is the end of the Mugabe era and the start of a new era under new leadership for Zimbabwe the only questions are how and when.

Convicted man gulps poison in court attacks magistrate with bottle _ he was afraid to go to jail

A 51 year old Beatrice man caused a stir at Chitungwiza magistrates’ court after he drank a poisonous liquid upon conviction for cell phone theft.

Cuthbert Shoko was convicted for stealing his niece’s phone by magistrate Francis Mapfumo.

The magistrate was about to deliver his sentence when Shoko suddenly took a small bottle with a poisonous substance from his pocket and gulped the contents before court orderlies reached for him.

Shoko was out of custody during his trial.

He then took the bottle and hit the magistrate on face with it before he was apprehended by prison authorities who then rushed him to Chitungwiza hospital.

Mapfumo was forced to adjourn court business.

According to the state, Shoko was an employee at Tavistock Estates in Beatrice.

He stole a cell phone from his wife’s sister Yeukai Mutefani (25)

Allegations against him arose on April 15 this year.

His niece was having a drink with her boyfriend Chester Mupfimbwa and Edmore Chandanangirira at Hippo Drum Bottle Store.

The three then went to Beatrice motel where Mutefani had a disagreement with her boyfriend.’

She then gave her cell phone to Chandanangirira for safe keeping after striking her boyfriend with a bottle on the face and arm.

Chandanangirira then took the phone to his place and the following day Shoko went to Chandanangirira’s place where he resided together with Mutefani’s boyfriend to help him nurse his injuries.

He then took Mutefani’s phone from Chandanangirira, saying he was going to deliver it but never did.

He was arrested after he failed to account for the cell phone.

POLICE have claimed that the country was under threat of terror attacks, hence, a decision to ban demonstrations and political rallies to ensure terrorists do not take advantage of the volatile situation to create anarchy.

After banning demonstrations in Harare last week, police now say they fear a full-scale war could break out in the country due to messages circulating on social media and could not allow political rallies in other urban centres in light of the threats.

Tendai-Biti“Serious threats have been received from various pressure groups through social media inciting people to declare a full war in Zimbabwe starting on September 2, to destroy all police properties, to destroy all roadblocks with fire, to blow up allgovernment vehicles and buildings, attack all members of the prison services and release all prisoners in jail, seize Zimbabwe Revenue Authority by force, shut down all major shops until government changes, prevent all airlines from landing and taking off, allow bus operators to operate at their risk and to blow up all Zupco buses and ambulances,” the police wrote in a letter banning the People’s Democratic Party (PDP)’s first anniversary rally.

PDP had notified the police of its intention to hold a rally to mark its first anniversary, but the police said they could not allow it, as they were stretched in trying to prevent full-scale war and terror.

We do not take these threats lightly and we have remained on high alert since September 1, a situation that has strained our resource utilisation,” officer commanding Bulawayo West district police, Chief Superintendent Mthokozisi Manzini Moyo, wrote to the party in a letter yesterday.

“We advise that your intended event be delayed up to such a time when security threats levels reduce to normal. In this regard, I invoke the provisions of section 26(9) of the Public Order and Security Act Chapter 11:17.”

He said information reaching his office indicated that the opposition party’s planned event might be compromised.

PDP’s anniversary rally was scheduled for White City in Bulawayo on Sunday, but has become the latest casualty of the prohibitions.

The police claimed the ban follows reports of terrorism threats circulated on social media platforms.

PDP Bulawayo provincial spokesperson, Edwin Ndlovu, described the ban as ridiculous.

“It is very ridiculous for the police to act in the manner they have acted. Ours is just an anniversary celebration, which has nothing to do with the said allegations,” he said.

“All these accusations do not hold water and are ridiculous, to say the least. We are appealing against this unilateralism. For the avoidance of doubt, our celebrations are going ahead, whichever way, come Sunday. Zimbabwe is not a police State and we frown at this behaviour by the police.”

PDP said its legal team was preparing a court challenge to the ban, which comes a few days after police in Harare prohibited protest marches in the central business district until September 16 under Statutory Instrument 101a. The provision is currently being challenged at the High Court, with PDP leader, Tendai Biti representing the applicants.

The Zimbabwe Republic Police (ZRP) has alleged that the country is on the brink of a civil war being plotted by social media activists.

The claim emerged in a statement used to ban an application by the opposition People’s Democratic Party (PDP) to hold its anniversary in Bulawayo on 11 September.

Bulawayo police threw out the application, insisting there was a serious threat to national security and thus police could not entertain political gatherings.

We can’t reform ourselves out of power : Jonathan Moyo

Higher and Tertiary Education minister Jonathan Moyo has declared that the ruling Zanu PF government will not consider the electoral reforms that opposition parties are clamouring for as that would be tantamount to “reforming ourselves out of power”.

Moyo told journalists here on Friday last week that the mooted move by the opposition parties to hold nationwide demonstrations to push for electoral reforms will be a waste of time as government has “had enough of attempts to institutionalise and entrench unreasonability”.

A grouping of 18 opposition parties under the banner of the National Electoral Reform Agenda (Nera) recently united to push President Robert Mugabe’s government to implement electoral reforms.

The parties, however, had their mega demos against the non-implementation of the reforms that had been planned for last Friday in Bulawayo and Harare banned.

But Moyo said even if opposition parties continue boycotting elections in protest — the ruling party will not move an inch because “their demands are totally unacceptable”.

“They (opposition parties) have been quiet for three years and now all of a sudden they want electoral reforms and give themselves a funny name, a parastatal name, like Nera,” Moyo said.

“Let us be clear, for a long time since 1999, the opposition had said the most important reform that must happen in the country is a new Constitution.

“…they were saying no Constitution, no elections, For a long time. We got that in 2013 and it was a negotiated Constitution among the political parties within the context of the Global Political Agreement (GPA),” Moyo said.

“The Electoral Act as it is right now is a product of GPA parties. Then they said no we must start talking about electoral reforms. It is totally unacceptable and we should not be in doubt about that because the fundamental laws of the land have changed.

“There is no law, conduct or practice or custom that supersedes the law or that is above the Constitution.”

Moyo said latest demands by opposition parties is an act of cowardice as the move is meant to disadvantage the ruling party and favour their opponents, something he said will not happen.

“Those people who made the laws they must be the ones who know what the provisions of section 2 of our Constitution say.

“Now they are coming out in their full colours as electoral cowards, they are now literally saying put in place electoral reforms that will ensure that you lose and we win and we are saying no,” he told journalists.

Moyo added: “That will never happen anyway in a modern constitutional democracy that a political party that is coming to government on the back of a new negotiated Constitution, on the back of a new negotiated Electoral Act to then come up with reforms intended to reform itself out of power.

“The reforms they are talking about are a clear code to say, come up with laws that will ensure that you are out.

“That will not happen. That will not happen because it is inherently unreasonable.”

The Tsholotsho North legislator said if the opposition parties were serious about electoral reforms they were supposed to put them in their electoral manifesto ahead of the 2018 watershed elections.

“We have heard enough of attempts to institutionalise and entrench unreasonability. We cannot continue doing that. If they want those reforms over and above what has been done they must put them in their manifesto.

“They must say we are contesting elections, we want these reforms implemented so that when we win we will reform ourselves out of power.

“Let them do that, that is what is done in a civilised world . . . let every party contest election on the basis of its reform agenda, let every party carry its own cross.”

The former Information minister also rubbished allegations from different quarters that he intended to destroy Zanu PF from within.

Opposition parties are demanding, among other things, the implementation of electoral reforms and also the announcement of a clear road-map to the next election by the Zimbabwe Electoral Commission — a road-map complete with processes and time-frames.

State Procurement Board seeks arrest of former boss for evading tax and drawing unauthorised allowances.

The State Procurement Board (SPB) has reported its former boss, Charles Kuwaza, to the police for allegedly evading tax and drawing unauthorised allowances.

The SPB board led by former ambassador, Buzawani Mothobi, has also alerted the Office of the President and Cabinet (OPC) which is now supervising procurement following a series of reports of corruption over the years.

Kuwaza reportedly omitted paying salary and allowance taxes on hundreds of thousands of dollars he earned since dollarisation in 2009 even though the rest of the SPB employees complied.

The former SPB head is alleged to have argued that he would not pay tax since his contract was with the OPC but the Zimbabwe Revenue Authority (ZIMRA) went on to garnish the board after issuing numerous letters of demand.

Police’s Criminal Investigations Department (CID) Serious Fraud section is said to have opened a docket against Kuwaza, but it could not be established immediately what further action it had taken.

Kuwaza was relieved of his post at SPB, which recommended that he must negotiate his exit package with the OPC.

Mothobi said SPB was working on Kuwaza’s exit.

“We are in the process of finalising on the exit of Mr Kuwaza and all those issues are being taken into account. One does not want to pre-empt some of the things that need to be done and not to be done by just rushing to make statements on those issues,” Mothobi told the government-controlled media

Blow for Mugabe as court strikes down police ban on protests

Zimbabwe’s High Court struck down on Wednesday a two-week ban on public protests issued by the police, a ruling hailed as a brave stand by the courts in the face of threats to the judiciary from President Robert Mugabe.

Judge Priscilla Chigumba, who was deciding a case brought by political activists, said the official police notice issued last week after some of the worst public violence in two decades was invalid, and therefore suspended.

Mugabe’s opponents have become emboldened in the last two months by rising public anger over economic hardships including severe cash shortages, high unemployment and delays in payment of public workers.

Lawyer Tendai Biti, a former finance minister who represented the four activists, said the police commander who issued the notice had no authority and had violated the constitution.

After the ruling, Biti told reporters Chigumba had issued “a brave judgement that asserts the independence of the courts.”

Controversial legislator Joseph Chinotimba is in the eye of a storm after he allegedly threatened to have teachers who had attended an opposition party rally transferred from his Buhera South constituency.

While Chinotimba dismissed the allegations that are contained in a report compiled by Zimbabwe Peace Project (ZPP) for the month of July, he insisted that he would not allow any teacher to attend a rally during school hours, whether they are MDC or Zanu PF.

According to the ZPP report “two school teachers, Christopher Jera from Muzokomba High School and one Munemo from Muzokomba Primary School were on July 22 threatened with transfers after attending an MDC rally at Mushongwi Business Centre in Buhera South”.

“It is reported that after the rally, Chinotimba summoned Kambira and Chirau, the headmasters of the schools, and ordered them to immediately transfer the teachers in clear violation of the teacher’s constitutional rights and freedoms of assembly. The teachers are reportedly living in fear due to the threats and suspicion that transfers could be effected anytime,” read the report.

However, Chinotimba said the allegations are a “100 percent lie”.

“I don’t have the power to transfer a teacher. But if a teacher abandons his post to go to a rally whether it’s a Zanu PF or MDC rally, handidi teacher anoenda kurally nguva dzebasa. Ndinoti pasi navo (I will not allow a teacher to attend a rally during schooling time).”

Chinotimba said he has often been labelled uneducated and would do everything in his power to give the children in his constituency the education he never had.

He added that he does not see Zimbabweans, particularly children, through political affiliation lenses.

“In fact, umwe teacher uyu muZanu PF (One of the teachers is a Zanu PF supporter) but you don’t give an excuse that you are sick and then go and attend a rally,” said Chinotimba.

In the report, ZPP also singled out a school in Buhera South that risks being prejudiced of development material due to political interference.

“The headmaster of Muzokomba Primary School (Buhera South) a Mashonganyika and his staff were verbally threatened with unspecified action by Chipo Chin’ono (Zanu PF) on July 4, after hosting some white missionaries from America,” ZPP said.

“It is reported that the missionaries had visited the school to offer financial assistance towards the construction of teachers’ accommodation. Chin’ono allegedly approached the headmaster accusing him of bringing American spies camouflaged as church pastors,” read the report.

“He further accused the school staff of being MDC party activists and promised tough action against them in the run-up to the 2018 (elections). The threats have the potential to deny the school staff the chance to freely associate with a political party and agencies of their choice.”

The Jestina Mukoko-led civic organisation said police brutality, denial of freedom to demonstrate, discrimination and denial of food aid were the other major highlights for the month of July
