West Ham climbs fifth as they defeated Leeds United 2 – 0. David Moyes’ side climbed to fifth – two points behind Chelsea, who beat Everton 2-0 earlier on Monday – and have a game in hand on their London rivals. West Ham maintained their unlikely push for a place in next season’s Champions League with a deserved Premier League victory over Leeds United at London Stadium.

Jesse Lingard sparked West Ham into life when his menacing run into the penalty area drew a foul from Luke Ayling. Lingard, on loan from Manchester United, converted the rebound after his spot-kick was saved by Illan Meslier.

Leeds had found the net twice in a blistering opening spell, but Tyler Roberts’ finish was ruled out for a marginal offside against Helder Costa, and Raphinha ran the ball out of play before crossing to Patrick Bamford.

But the visitors were two goals down before half-time when the unmarked Craig Dawson headed in Aaron Cresswell’s corner.

Marcelo Bielsa’s Leeds went close to a response five minutes after the restart when Raphinha’s sensational overhead attempt was tipped over by Lukasz Fabianski, while Bamford blazed over from Raphinha’s cut-back and Dawson cleared off the line as Leeds chased a late lifeline.

Pablo Fornals struck the crossbar with a dipping second-half shot, but the Hammers ultimately held firm at the back to see out the three points.

Mai Mujuru spotted with First Lady Auxillia Mnangagwa: Let’s embrace each other, avoid hate. The two went down memory lane and shared ideas on various subjects where the former Vice President indicated that she was now 66 years old and no longer had political ambitions.

Women countrywide should embrace each other and avoid hate which will not take them anywhere, First Lady Auxillia Mnangagwa has said. She was speaking after a meeting with former Vice President Dr Joice Mujuru at Zimbabwe House yesterday in the spirit of International Women’s Day.

She said she was now concentrating on farming and family. The meeting came after the First Lady recently visited former President Canaan Banana’s widow, Janet, and national hero Dr Dumiso Dabengwa’s widow, Zodwa, as well as veteran freedom fighters in Bulawayo.

She visited Mrs Banana to thank her for the good work she did during her tenure as First Lady and proceeded to console Mrs Dabengwa following her husband’s demise.

The First Lady also visited war veterans, Cdes David Mongwa “Sharpshoot” Moyo, Aaron Ndlovu and Jane Ngwenya. In an interview with journalists after yesterday’s meeting, Mrs Mujuru expressed gratitude to the First Lady for remembering her and praised the mother of the nation’s empowerment programmes which she described as beneficial mostly to women.

“I feel honoured and elevated to a level I did not expect. The First Lady phoned me requesting that she wanted to come over to see me. I give respect to the President and hence I also respect the First Lady. Therefore, I said it was befitting that I visit her instead.

“What made me happy is that we spoke about women’s issues considering that we are in the women’s month and did not discuss about positions or politics. The First Lady is apolitical so we discussed family issues, health and the way we live. Amai sought to catch up with me on my family and the farming business that I am involved in. I extended an invitation to Amai to come and see for herself at the farm,” she said.

Dr Mujuru passed condolences to the President over the deaths that have occurred in Government due to Covid-19. “We now all accept that Covid-19 is a destroyer. Covid-19 is not good at all, that is why you now see us with masks which were previously for doctors and nurses.

“I want to thank you Amai for sparing time for me and the thought that you needed to see me. This is pure love from you, God bless you,” she said. Amai Mnangagwa reinforced the need for genuine love and concentrating on unity and development.

“I felt very happy because when I called Mai Mujuru, I told her that I needed to pay her a visit to see how she is and where she is staying? She said she respected my office and therefore it was befitting that she comes here. She expressed no reservations and promised to come that is why you see her here today,” said the First Lady.

“The issues we discussed were about what she is doing, where are her grandchildren, how about the children? Did you plough this season? Where are you staying now that you have gone quiet? I told her that I went to Bulawayo where I met Mrs Banana, Mrs Ngwenya and war veterans. After that I looked for her to catch up. Women, we are all the same and we should love one another without leaving anyone behind. I wish to make a plea and educate the whole country that hatred does not take us anywhere as women. Do not hate anyone until death.

“Politics comes and goes. Our problems as women are the same. What only differs is the time of occurrence. The problems I have today, Mai Mujuru might have gone through them a long time ago. She can actually give me advice on how to overcome the challenges. All women should unite. Do not hate anyone even at church. You should not have a permanent enemy even in politics. Do not be weighed down by hate and jealousy. Today we even shared ideas even on the philanthropic works I do.”

Amai Mujuru praised the First Lady for her empowerment projects and said she was willing to lend a hand. “Family should remain as family and Amai you are working hard in uniting families. I am happy with what you are doing.

“I will support you and you can send me anywhere Amai when it comes to issues involving women empowerment and family unity. As a nation, let us embrace the projects and programmes that the First Lady is initiating. We want to see these empowerment projects she is starting for women growing into bigger businesses,” she said.

Information Minister: Follow COVID-19 regulations or else. Speaking after being vaccinated against the virus at Wilkins Hospital in Harare yesterday, Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said the easing of Covid-19 lockdown measures should not be mistaken for a total victory against the global pandemic as it continued to be a threat.

The government will not hesitate to re-introduce tough Covid-19 control measures if non-compliance with regulations becomes rife and risks a spike in new infections. Complacency has been creeping in, with people disregarding Covid-19 mitigatory protocols after President Mnangagwa announced new measures allowing people to have more social contact as part of the delicate process to return to normal life.

Despite spirited campaigns by authorities to discourage irresponsible behaviour, people continue flouting recommended measures leading to thousands of arrests. Health experts are warning, and have been advising authorities that a third wave is likely if people stop adhering to protocol.

Minister Mutsvangwa said Government was following science as well as the submissions of experts. “The inter-ministerial taskforce on Covid-19 works very closely with experts or advisors who advise us on what is happening on the ground. These are people who advise the Government before any review or relaxation is made.

“The reviews are done according to advice coming from those experts who are researching daily. So when there is a bit of relaxation, we do not need to be complacent. We need to continue adhering to those protocols,” she said.

Minister Mutsvangwa emphasised that Zimbabwe had not won the fight against the global pandemic and there was need to continue following the laid down protocols. She said President Mnangagwa had emphasised that priority would be given to lives with the economy coming later, thus if need arose, restrictions would be tightened to save lives.

“We know that the President reviewed the lockdown measures and there was a bit of relaxation. The President is looking at saving lives and when you are saving lives there is another side where there is the economy that needs to be saved.

“Vaccination does not mean you are immune, therefore you should not be moving around without a mask and not adhering to protocols, all what it means is that it weakens the virus when it gets to you.”

Zimbabwe yesterday joined the rest of the world in commemorating International Women’s Day and Minister Mutsvangwa said accepting the vaccine was her way of remembering the day for women.

She encouraged other women to get vaccinated and help the country achieve herd immunity which would boost the country’s quest to win the war against the pandemic. “We should not be complacent. To the women of Zimbabwe, let us come together let us be vaccinated. We need to have that herd immunity so that our economies go back to normal.”

An expert in the Ministry of Health and Child Care who is part of the advisory team, Dr Raiva Simbi said generally people had been following protocols, but urged more vigilance and improved hygiene.

Dr Simbi said they would always base their recommendations on facts on the ground and would urge leaders to tighten restrictions if cases started rising. “We have not won the fight against Covid-19 and a few people are becoming complacent, but the majority are still complying with the regulations which is encouraging.

“If cases start rising, we will recommend tightening of some restrictions to save lives so at this point we urge people to adhere to regulations and these include social distancing, masking up and just general hygiene,” he said

He urged people to be vaccinated which he said was an effective way to control such viruses since time immemorial.

Update: Court stops executor in Ginimbi estate row. Popularly known as Ginimbi in social circles, Kadungure died in a horrific car accident last year. The executor of Genius Kadungure’s estate has been stopped from administering the estate of the late socialite and businessman, pending finalisation of the dispute.

The court ruling comes after the late Ginimbi’s sisters; Juliet and Nelia, and his father Anderson Kadungure, approached the High Court suing lawyer Ms Patricia Darangwa.

They wanted an order stopping any administration of an unsigned will presented by Ms Darangwa on November 25 pending a High Court review on why the Master of High Court appointed her as the executrix.

The family is challenging the legitimacy of the document. Justice Sylvia Chirawu-Mugomba granted the application by the Kadungure family, finding that Ms Darangwa jumped the gun in authorising the release of a Lamborghini in the absence of a proper liquidation and distribution account.

“In my view the applicants cannot be faulted for holding the view that irreparable harm may result from the conduct of first respondent,” she said. “Their apprehension in the face of the first respondent’s admitted conduct is valid.”

According to the Kadungure family, Ginimbi’s estate has liabilities. The court also noted that Ginimbi’s estate spans three countries, Zimbabwe, South Africa and Botswana, which have different laws and processes in relation to the administration of estates of deceased foreigners.

“That in itself may entail an external conflict of laws,” said Justice Chirawu-Mugomba, tilting the balance of convenience in favour of the Kadungure family who are the beneficiaries. The judge further ruled that even if the court found that on the return date that the disputed document should be taken as a will, the Kadungures’ rights should be protected.

The Kadungures outlined the basis upon which they believed the document was fake and should be nullified while Ms Darangwa explained the circumstances surrounding the preparation and presentation of the document. But Justice Chirawu-Mugomba ruled that the acceptance of any document that did not meet the requirements was not “a walk in the park”.

“In my view there are prima facie red flags in the document itself, processes and manner leading to the acceptance of the document as a will . . . that may result in court sitting on review making a finding in favour of the applicants,” she said. The Kadungures had reasonably arguable prima facie case on review, said the judge.

Justice Chirawu-Mugomba said the question on review should revolve around the circumstances leading to the writing of the document and whether or not a proper inquiry was conducted of the document itself.

She said the whole basis was to arrive at the truth and rule out fraud. The judge added that if the court find in favour of the Kadungures on the return date, then the estate would be wound up on the basis of intestate succession.

If not, the document would continue satisfying as Ginimbi’s, said the judge. In their urgent application, Juliet said the family was entitled to protect its interests in Ginimbi’s estate and would not rest until the alleged irregularity was finalised.

NAMA 2021 Awards: From Busi Ncube to Poptain. The event, which will be beamed live on ZBC, will also be streamed on Zimpapers Television Network (ZTN) and the NAMA social media page, on March 27. The 2021 National Art Merit Awards will this year be held virtually under the Covid-19 pandemic regulations and will run under the theme “Our Legacy, Our Pride”.

The awards will honouring 40 arts legends and celebrate Zimbabwe’s 40th anniversary, as well as the 35 years of the National Arts Council (NAC)’s existence. Organisers of the show yesterday released a trailer of some of the performers for this year’s edition, which was warmly received by music fans.

Just like the Grammy’s, BET and MTV awards shows, it is essential to know who is performing and hosting such an event, but some local show organisers prefer to leave that as a surprise. Such a move affects the production, creativity and support, not only from fans, but the corporate world as well, who end up doubting the seriousness of the ceremony.

The NAMAs are equivalents to the Oscars, the prestigious American show which cover music, dance, theatre, and everyone now is expecting fireworks, with NAC raising the bar from last year’s edition where it brought South African-based Zimbabwean actor Leroy Gopal as the host of the show.

Last year’s opening song was a remix of “Ngaibake” featuring Alick Macheso, Freeman, Ammara Brown and TiGonzi, which had the whole auditorium on its feet. What surprises are in store this year? Well, a few of the performers for the night have just been announced.

Poptain

According to the trailer, the list of performers includes Zimdancehall sensation Poptain, Nutty O, Anita Jaxson, Busi Ncube, ExQ, DJ Tamuka and Tammy Moyo.

In an interview, NAMA executive producer, Napoelon Nyanhi, affectionately known as “Napstar” in the showbiz industry, said despite the Covid-19 pandemic that has affected the entertainment industry, the show will go on as planned and it will be held virtually.

“It is a total 100 percent no attendance, everything is virtual. NAMA is about positioning our artistes to be taken seriously in Africa and the world. We are, therefore, striving to keep on raising the bar of the ceremony so that it adds value to the profile of winning and performing artistes.

“This year we have a different format, but we will still raise the bar. Lockdown or no lockdown, we will conquer.” Nyanhi said the show will be two-and-half hours long.

Busi Ncube

“Rehearsals are taking place and we are trying to make sure everything is on point and in place, no glitches whatsoever. The show will be 2 hours 30 minutes sharp. What makes us different is our commitment to professionalism and ground-breaking creativity.

“So many corporates have started to take us seriously by coming on board because they have seen the diligence in our approach.”

The people’s lawyer Advocate Mpofu responds to Prof Madhuku. Advocate Thabani Mpofu has responded to a statement by Professor Lovemore Madhuku which had suggested that President Emmerson Mnangagwa was not obliged under the current constitution to announce former Vice President Kembo Mohadi’s resignation within 24 hours. Below is Advocate Mpofu’s response.

THIS is a quick response to the “detailed” and “scholarly” opinion given by Professor Lovemore Madhuku on the legal position pertaining to the applicability of s96(2) of the Constitution of Zimbabwe to former Vice President Kembo Mohadi’s resignation.
I will try to set out the law in as clear a manner as I can. I will in this regard proceed on the assumption that this “response” will be consumed by lay people. For that reason, I have decided to go soft on “the technical”. It is not lost on me that modern constitutions are made for lay people, explaining why it is a constitutional imperative for the text of the constitution to be translated into vernacular languages.

Approach to constitutional interpretation

2. This matter is all about constitutional interpretation. There are so many principles that bear on the matter, some of which have been relied upon by Prof Madhuku. I do not intend to deal with all such principles. I will confine myself to those that concern this response. I will render the principles in my own words and give them my own form given my target audience. For that reason, I will call them processes. They are as follows:

2.1 The first step in constitutional interpretation requires one to consider the text of the constitution. It is the text that constitutes the constitution and not some indeterminate spiritual principle. If the text is clear on the subject matter, subject to what I will say below, effect must be given to it.

2.1.1 I must immediately indicate that Professor Madhuku’s approach is steeped in the English approach to constitutional interpretation. The British have no written constitution, that’s why they have “inner eyes” and obscure principles understood only by elites.

2.2 The second step is to consider all the provisions of the constitution that bear on a particular matter. The idea is that a particular provision, speaking to an issue must be understood in the context of the entire constitution. These provisions combine to create, the so called “spirit of the constitution”. The spirit of the constitution is something that can be understood by someone reading the constitution in ChiTonga and is not a preserve for lawyers. If all the provisions considered say one thing, that is the end of the matter. You don’t ask, “What has the inner eye seen?”

2.3 The third applies under circumstances where there is no clear provision bearing on the matter. If there is a power to be exercised or an obligation to be discharged, the question must be asked whether the exercise of that power or the discharge of the obligation or otherwise the enjoyment of a right is to be implied-see section 342 of the Constitution. This only happens if the constitution is silent on the matter. On the authority of section 342 however, there must be some constitutional conferment on the basis upon which an implied power is found to exist.

2.3.1 The need for implication lies in the fact that a constitution cannot cater for all conceivable legal eventualities. For that reason, it must be “a living organism” and those dealing with it must treat it in a manner that “eschews the austerity of tabulated legalisms”

2.4 These three principles explain Prof Madhuku’s reference to express and implied provisions, incorrectly called by him, terms. (Express and implied terms are found in contract law, interpretation deals with provisions)

2.5 Another principle of importance is that the duties imposed by the constitution on politicians must be clear. Put differently, politicians do not need to have “an inner legal eye”. The constitution must speak to them in clear terms. The framers of the constitution knew that there would be politicians like Hon… (supply the name, I don’t want to risk an arrest). The following are the reasons for that position:

2.5.1 Grave consequences attend upon a failure by politicians to obey the constitution. Any constitutional obligation that might lead to consequences being visited upon politicians must be clear. It must be clear to the politician reading the constitution in the “Buhera dialect of Shona”

2.5.2 A constitution is a political document. That being the case, on questions of governmental power, it must speak in clear terms to the citizens against whom or for whose benefit political power is exercised.

2.6 This evidently, and as you have already noted, is not the approach taken by Professor Madhuku. Professor Madhuku takes the constitution to be an elite document which can only be understood by 3,000 people in this country. Ngeke!

The constitutional position on the subject

3 Our constitution has two types of provisions governing the subject matter, and once again I speak in lay terms. The first are the provisions contained in the “substantive part” of the constitution. The second, are the provisions contained in the schedule, which are transitional in nature.

3.1 The purpose of transitional provisions is broadly speaking the following:

3.1.1 To retain the legality of that which was substantively legal under the old order.

3.1.2 To retain the legality of constitutional officials who had lawful authority under the old order and which must be carried into the new.

3.1.3 To fill in gaps that would inevitably exist between what used to be and that which now is.

3.1.4 To transition to the new in as smooth a manner as is possible.

3.2 In that regard, the constitution recognises that for the first ten years reckoned from 2013, an executive structure with unelected Vice Presidents will be in place. This is dealt with in the sixth schedule and is a continuation of the old.

3.3 The provisions governing unelected Vice Presidents, are however, set out in both the substantive part of the constitution as well as in the transitional provisions. It is important for purposes of illuminating the subject matter that the provisions set out in the schedule be identified, isolated and their effect spoken to:

3.3.1 Paragraph 14(1) which provides that in the first ten years reckoned from 2013, there wont be any running mates.

3.3.2 Paragraph 14(2) which provides that a person elected in the two elections (2013 and 2018) must nominate not more than two Vice Presidents who must hold office at his pleasure.

3.3.3 Paragraph 14.3 which provides the manner of the exercise by the Vice President of the role of Acting President.

3.3.4 Paragraphs 14.4 and 14.6 which provides for succession in the event of death of the President.

3.4 What must be noted is that the sixth schedule restricts itself to formal issues. There is nothing that speaks for instance to the values that must govern a VP. There is nothing that speaks to VP’s obligations, or even terms of service. To say that a VP is only governed by the sixth schedule to the exclusion of the substantive body of the constitution is to claim without a basis, that both a VP and his/her president do not in the first ten years have any form of constitutional restraint placed upon them.

3.5 The substantive portion of the constitution also has provisions that pertain to Vice Presidents. It is easy to see which provisions apply to an elected VP, which provisions apply to an unelected VP and which provisions apply to both. This with respect and in my view, is where Prof Madhuku has not done justice to the subject matter. The need for the provisions to be considered in that manner assumes ascending importance when one has regard to the limitation(s) of the sixth schedule as already set out above.

3.6 I will quicky go through the relevant provisions:

3.6.1 Sections 91, 92 and 93 deal with qualifications for election to the office of VP. This will obviously take effect after the first ten years.

3.6.2 Section 94 which deals with assumption of office upon the taking of the oath of office before the Chief Justice or the next available senior judge. I believe Mohadi took this oath of office and that it was important that he does so before executing any constitutional function. This provision applies to both elected and unelected VPs (If I am wrong on this one I enjoy the Chief Justice’s company).

3.6.3 Section 96(2) deals with resignation. This is the only provision that deals with the resignation of a VP. The sixth schedule is silent on the matter. There is nothing that limits the applicability of this provision to an elected VP. To hold otherwise would leave the constitution, for no good reason, without a provision which regulates the resignation of a VP. That is both dangerous and unnecessary.

3.6.3.1 I must point out that Robert Gabriel Mugabe, correctly resigned in terms of section 96(1). It would be absurd to say a president can resign in terms of section 96(1) but a VP cannot resign in terms of section 96(2). In fact, if Professor Madhuku is correct, then Mugabe did not resign and ED’s assumption of office and everything that has followed such assumption is tainted with illegality. Varasiki, benefit from the wisdom of the Shona, “Chenjera kufarira n’anga neinobata mai”

3.6.4 Section 97 deals with the “impeachment” of a VP. There is no similar or equivalent provision in the schedule. This provision applies to both elected and unelected VPs given that both can be impeached. To hold otherwise would leave us with a constitution which does not allow for the “impeachment” of a VP during the first ten years. That’s simply absurd.

3.6.5 Section 99 deals with the functions of a VP. There is no doubt again that this relates to both an elected and unelected VP given that both exercise functions. Indeed, the sixth schedule does not deal with this issue. It would be infantile to argue that this provision does not apply to an unelected VP. Elected or unelected, a VP must discharge a constitutional function.

3.6.6 Section 100 deals with the exercise of functions by an Acting President as well as the mechanics that attend upon the issue. To the extent that there is a competing provision in the sixth schedule, it is that provision that takes effect by reason of paragraph 2 of the sixth schedule. Put differently, s100 only governs elected VPs.

3.6.7 The same goes for s101 which deals with succession in the event of death.

3.6.8 Section 102 deals with the remuneration of Vice Presidents. Although the sixth schedule says nothing about the matter, it is clear that a VP must be remunerated. This provision accordingly governs both elected and unelected VPs.

3.6.9 Section 103 provides that a serving or former VP must not hold any other paid employ either during the period of their service or after the expiry of such service, if they are still receiving a state pension. It goes without saying that this pertains to both elected and unelected VPs.

3.6.10 Section 106 is a Code of Conduct for both VPs and Ministers. There is no similar Code in the schedule. Any executive official must submit themselves to the wholesome restraint of the constitution. This pertains to both elected and unelected officials.

3.6.11 Section 107 deals with the accountability of VPs to the President. It is puerile to argue that it is only elected VPs who are accountable to the President and that those that serve at his pleasure are not so accountable. This provision also deals with the obligation cast upon VPs to attend Parliament. That obligation is upon both elected and unelected VPs.

3.7 It is therefore clear upon a consideration of the substantive text of the constitution that there are provisions that (i) pertain to both elected and unelected VPs and (ii) those that only pertain to elected VPs. The dispute has to be on how section 96(2) is to be characterised. To that issue, I turn.

The relevant transitional structure

4 With these provisions having been identified, it is important that we consider first, whether the constitution helps us answer the question regarding the status of s96(2). Put differently, the question has to be whether s96 has commenced its operation.

4.1 I believe, with respect, that Professor Madhuku has on this aspect chosen to rely on esoteric quackery and sophistry, ignoring in the process the relevant constitutional provisions. In particular, Professor Madhuku argues on implied powers and the whole lot whilst ignoring a specific provision that governs the matter. He has committed a cardinal sin of interpretation. You can’t “play football without a football”. Professor Madhuku has interpreted the constitution whilst ignoring the most relevant constitutional provision governing the subject matter. As indicated, ours is not like the British system where the constitution is unwritten.

4.2 Paragraph 3(1) of the sixth schedule sets out provisions which came into operation on the publication day being the 22nd of May 2013. These are the provisions that immediately became law when the constitution was assented to and published. Not all provisions of the constitution became law upon the publication of the constitution.

4.3 Paragraph 3(2) provides as follows:

Except as otherwise provided in this Schedule, the rest of this Constitution comes into operation on the day on which the President elected in the first elections assumes office.

4.4 You will need to recall the distinction that I drew earlier between the two types of provisions constituting our constitution, the substantive text and the transitional provisions. This provision says and means that the rest of the constitution (substantive text) came into effect in August 2013. What is only excepted are those provisions set out in the schedule which will come into effect after the expiry of the ten years constitutionally provided for.

4.5 The schedule sets out those provisions, which will come into effect after ten years, either directly or indirectly. The fact that there are three dates on which provisions of the constitution will come into effect needs to be emphasized.

4.6 In those instances where the schedule clearly states that it has precedence, it takes effect-see paragraph 2 of Part 1 of the sixth schedule. See for instance paragraph 14.1 which provides, “Notwithstanding section 92….” In clear terms, the schedule provides that whatever the substantive text says, in that instance, it takes effect. This is an instance where the schedule directly deals with the matter as envisaged by paragraph 3(2) cited above.

4.7 The schedule does also deal indirectly with the matter where it establishes “a system” based on an unelected Vice President. What this means, is that the provisions in the substantive text that deal with an elected Vice President are automatically excluded. I have already set out those instances above. Everything else applies.

4.8 Indisputably, the question of resignation is not dealt with either directly or indirectly. That being the case and consistent with paragraph 3(2), the substantive text has now taken effect. Section 96(2) is the “rest of the constitution” in the words of paragraph 3(2) cited above. It is alive.

“The inner legal eye”

5 Unable to deal with the transitional provision which is clear to the naked eye, Prof Madhuku has now created what he calls an “inner legal eye”. He is supposed to have this eye and everyone else who disagrees with him doesn’t have it. With respect to a man of great learning, a naked eye can see the applicable provision that has been missed by his “inner legal eye”.

5.1 This resolves the express and implied provisions debate. You cannot imply the absence of a duty under circumstances where the duty is expressly provided for. The effect is that Professor Madhuku’s efforts have nothing to do with interpretation but are an act first of de-creation, in that he destroys an extant provision, and second, of creation, in that he creates using a dubious inner legal eye.

Only to an elected VP

6 Professor Madhuku’s inner legal eye sees him conclude that the obligation to notify only pertains to an elected VP. He reasons that the fact of the election obliges the existence of such a duty. He relies on no constitutional provision for this breath-taking view. There are so many problems with this conclusion and I only highlight two:

6.1 First, it plainly does not make sense. The VP is a high ranking constitutional official who assumes the powerful position of the President on occasions. The nation must obviously be advised of his resignation within a period of 24 hours of its occurence? Why should that be tied to an elected president? Does a VP, in the first ten years of the constitution exercise lesser powers than those of an elected VP?

6.2 Constitutional construction in a constitutional democracy is all about placing obligations and restrictions on the executive. This is how, executive power is kept in check. This approach is taken at all times and for all purposes unless the placing of such obligations or restrictions is unduly burdensome or onerous. What is unduly burdensome about notifying the country that a VP has resigned? Quite frankly its such a shame that I have to make this point against Professor Madhuku.

What I accept

7 In the interests of fairness, it is important that I set out what I consider to be the correct legal position(s) as expounded by the Professor. I am content, as a general position to say that I accept the correctness of most of the principles that he places reliance upon. It is their relevance to this matter that I query, particularly given the disconnect between those principles and the clear and operative legal provisions at play. I do not accept however, that there is an inner legal eye that must see things that are not and ignore those that are.

7.1 For the avoidance of doubt, I accept as sound in law, the following propositions:

7.1.1 That constitutional interpretation is a matter of dealing with express and implied provisions subject to the rider that express provisions must at all times and without prejudice, take effect.

7.1.2 That even if a power, duty or right is not expressed, it can by proper interpretation be implied but only in terms of section 342 of the Constitution. Put differently, there must always be a substantive provision on the basis upon which the implication takes place.

7.1.3 That there are provisions in the constitution that indisputably speak only to elected Vice Presidents.

Conclusion

8 My conclusion is that Professor Madhuku’s views are at best specious. My point of departure is that he seeks to imply under circumstances there is an express provision. In doing so, Professor Madhuku ignores a relevant provision which in the very least, he was obliged to have explained away. I also come to the conclusion that the application of section 96(2) to an unelected Vice President, is not inconsistent with the constitutional design and, just like other similar provisions bearing on the issue, has now taken full effect.

In the result, I come to the conclusion that President Mnangagwa violated the constitution in not informing the country that former Vice President Mohadi had resigned.

ZESA speaks on power outages. The Zimbabwe Electricity Transmission and Distribution Company (ZETDC) would like to apologise to its valued customers in Harare Region for the power outage due to underground cable faults on the feeders supplying them.

The Zimbabwe Electricity Transmission and Distribution Company (ZETDC), a ZESA subsidiary has apologised for power outages in some parts of Harare. We present below the power utility’s statement.

Areas affected are:-New Ardbennie industrial bound by Simon Mazorodzc road, Willowvale road. Harare Drive, Mangwende East road, and Orme road. ZETDC engineers and technicians are working to rectify the fault and restoration of service is expected by the end of the day on Tuesday 9th March 2021.

The inconvenience caused is sincerely regretted.

Report: ZANU PF Bigwig threatens police over the arrest of council officials. The three officials, Sheri Nyakudya Town Secretary, Letwin Watambwa housing and community services officer together with Simbarashe Kambare housing clerk.

It is alleged that Nhamburo who reportedly owns several stands in Mazowe, demanded the trio’s release saying their arrest will have an adverse impact on the image of the party.

A member of ZANU PF’s Central Committee, John Nhambura is alleged to have threatened Mvurwi police over the arrest of three Mvurwi town council officials who are facing fraud charges.

Bulawayo24 reports that Nhamburo sent a high-powered delegation to the Mvurwi police station on Friday with the mandate to influence the release of the trio. Speaking to Bulawayo24, an anonymous junior police officer said:

Nhamburo first called our bosses saying he wanted the release of council officials chief among them Sheri Nyakudya as her arrest will put the image of party in disrepute.
Hours latter the delegation arrived on the station fuming and demanding the release of the trio but fortunately, our bosses stood their ground and dragged the trio to court.

ZANU PF’s Mazowe District Coordinating Committee (DCC) leadership confirmed receipt of the report adding that they had already warned Nhamburo against issuing any threat to the police as that will tarnish the image of the party. The trio was allegedly swindling Mvurwi residents of their money. The three council officials are appearing at Guruve magistrates courts this Monday for bail ruling.

Gunshots fired as Mthwakazi Republic Party attempted to evict Kembo Mohadi’s son-in-law. Gunshots were fired, Monday, at Tabas Induna Farm in Ntabazinduna as members of the Mthwakazi Republic Party (MRP) attempted to forcibly evict one Floyd Ambrose, who is refusing to vacate the farm owned by the Davies and Parsons family despite a High Court order compelling him to do so.

Apparently, Ambrose is former Vice-President Kembo Mohadi’s son-in-law and has invaded the farm owned by his ex-employer Brian Davies. Luckily no one was injured in the incident, where the MRP party was enlisted by Brian Davies and his wife, Carol to help them evict Ambrose.

The Davies’ were popular Ntabazinduna farmers whose surprise eviction in 2019 by Ambrose attracted the ire of former chief, Nhlanhlayamnagwe Felix Ndiweni. Ambrose was given an offer letter by the Umguza District Council’s lands committee in 2019.

Tabas Induna Farm was purchased in 1953 by Carol’s grandfather, Jack Parsons and the farm was at one time the largest pig producer in Zimbabwe and is behind the Colcom brand.

The late Chief Khayisa Ndiweni (Nhlanhlayamangwe’s father) even granted the Davies family the authority to build a lodge on top of the Ntabazinduna Hill in 1992, a famous historical site that is revered by the Ndebele people.Mohadi drama

The Davies have a court order which stated that Ambrose, who moved in two weeks ago, must vacate their farm by March 6, 2021. Instead, Ambrose refused to leave, but removed the Davies, property, dumped it outside the farm lodge and moved his own stuff in.

When MRP party members arrived at the farm, they tried to seek an audience with Ambrose, to inquire why he was defying a court order to leave the farm, but he ran away with two of his security men and one was armed.

To gain entrance into the farm, MRP members broke down the gate and chased the trio down a thicket within the farm. As the MRP members were still pursuing him, two gunshots, presumed to be warning shots, were fired from the thicket.

This did not deter the MRP party members who continued pursuing them while others started carrying Davies property back into the lodge. “We are willing to wait here all day and night for Ambrose,” said MRP Leader, Mqondisi Moyo in an interview with CITE.

“As MRP we have come here to make sure sanity prevails and that Davies is given back his place. We were touched because Davies agreed with our chiefs to modify this place into a tourist attraction that preserves Ndebele, culture and values. We will not allow anyone to destroy Ndebele cultural values. Zanu PF tried to destroy them for the past 30 years, but as MRP we are saying “enough is enough.”

Moyo said MRP was justified to carry out this act because they regarded themselves a revolutionary party, the same way Zanu and ZAPU fought against the Ian Smith regime over land imbalances.

“Since 1999 to 2000, Zanu PF embarked on a chaotic, fast track land reform programme and since then has been willy nilly invading other peoples properties. They do so without agreement, but base acts, saying they are the ruling Zanu PF yet Zimbabwe’s constitution and the Traditional Leaders Act reads that wherever there is land, people who are involved in the land distribution are only traditional leaders – chiefs, kraalheads and village headmen,” he said.

The MRP leader queried why the Zanu PF government was politicising land when chiefs were the custodians.

“Look at Matabeleland, the area which falls under Umguza constituency, there are now so many outsiders who were illegally settled. As MRP we are the custodians of Mthwakazi land and we want land to be taken back to rightful people,” he said.

Two years ago, Chief Ndiweni claimed there was corruption in how the Umguza land committee apportioned land to Ambrose. The chief held an Imbizo, as part of the Save Ntabazinduna Mountain campaign, stressing his fight was not about the white farmer, but was motivated by greed of individuals within Zanu PF who wanted to destroy the legacy of the mountain.

Chief Ndiweni also at that time, called on the United States government to immediately increase and tighten sanctions and travel restrictions they applied against President Emmerson Mnangagwa’s administration.

“We were here two years ago after Chief Ndiweni and Ntabazinduna locals asked us to defend this place. See how beautiful this place is,” said the MRP leader who noted the former chief had engaged them again in December when he heard Ambrose was contemplating moving in.

“Ambrose came back threatening Davies that he was Zanu PF and was untouchable. To make matters worse, Davies has more than three high court rulings, which are to his favour as the owner of the place so Ambrose must abide by the court rulings.”

“In trading, there are three kinds of brokers; A Book, B Book and hybrid. A broker can literally trade against you so that you lose your money and my idea is to create a broker that gives access to the market to retail traders and not trade the trades in-house.

“I am a Pan-Africanist by heart, and as African people, our financial freedom and independence comes from trading in the markets,” he said.

Tsopotsa has business interests in education, IT and finance. He said adopting the use of AfricaCoin has advantages like straight forward transactions, minimising the time and expense involved in making asset transfers and more confidential transactions.

Vendors back, flood Harare CBD. Vendors are in violation of city by-laws as they are operating illegally without licenses and at undesignated points.

Vendors have flooded pavements in the central business district (CBD) selling school uniforms and other goods on the streets following the relaxation of lockdown regulations.

Harare City spokesperson Michael Chideme has warned the vendors, saying the council would take action. “Those vendors have to be dealt with by-laws so that they are removed.

“They should go and sell at the respective sites.” In an interview with some vendors along Robert Mugabe Road and Leopold Takawira Street, they said they were struggling to put food on the table. “We have been at home for a long time so we didn’t know how things were outside. “So this is just our first time in town since lockdown began; we were starved since we had no other sources of income”

Another vendor, Laiser Gamundana, said: “Lockdown has been difficult; we are happy that the doors have been opened and we are now able to hustle and feed our families. “We were seated at home; people did not have money,” she said.

They say they just feel this is an attack on them because people can see how happy they are.

She maintains that if they were really broke, they wouldn’t be launching House of Kgwedi, a shop for muti-infused beauty products created by her wife who is a sangoma.

I know there is Covid-19 and people are going through a hectic time financially but God has been good to my wife and I. Even without a full-time job I have been able to provide for my family and even buy a car in cash for my wife.”

Popular socialite Mkoma Masimba forced into thigh vending in Australia. A man who rose to the top of the limelight on social media feels Australian authorities have let him down after failing to offer him proper accommodation for a year.

Homeless socialite Mukoma Masimba, popularly known as Legend of Facebook, says he has been reportedly forced into “commercial” prostitution in Australia.

He has since lodged a written complaint with the authorities. Masimba, who last year left his home and decided to stay on the streets of Melbourne, has raised suspicions that he might be facing mental health challenges.

He is taking lessons under contract on how to satisfy clients. In some explicit videos he is being taught how to treat male and female clients. He lamented neglect by the authorities and called for intervention. Some sections have described him as losing sanity, but he insists that he is of sound mind.

In an interview, he discussed his status and dilemma. “I have been staying in the streets for a year and the authorities here have not helped me to get a proper place to stay. “And now I have resorted to commercial thigh vending to make ends meet. “I am on my way to satisfy a client, it’s not by choice or optional, but circumstances beyond my control have forced me to do this.

“I have no other way of making money since some drug addicts are stealing my medication. “The authorities here ill-treated me and I have since made a complaint, which I believe should be heard back home.

“Remember last year I went into the streets before the outbreak of Covid-19. “Many people believed that I was bewitched by Sekuru Banda, which was not true and I was called someone with mental illness, but I was tested for all that,” he said.

Added Masimba: “I am okay, but the authorities here exposed my HIV status and no one wants to be associated with me now. “I was forced to reveal my status after some drug addicts here were stealing my pills and I had to confess so that they could not continue stealing, but I put the blame on the authorities here.

“And now I have shifted focus so that I can manage to survive from thigh vending. “I am angry with the Australian government, they have violated my privacy and now most homeless people in Melbourne now know I am HIV positive because I have been homeless for one year.

“The same Australian government imposed sanctions on Zimbabwe. “I remember writing BhukureBenzi when I was always showing the same Australia also abuses Australians. “I am appealing to the authorities back home to take note of my issue. “Australia imposed sanctions on my country and they should remove them, our President is a listening man.”

Mapula Khune’s Mum Details What Happened The Night she died

The SABC reported that the 17-year-old suspect in Mapula Khune’s murder was released yesterday by the National Prosecuting Authority (NPA), due to insufficient evidence. The teenager appeared at the Ventersdorp Children’s Court on Monday morning.

“What transpired today is that after going through the docket, the NPA realised that there is no sufficient evidence for us to institute a prosecution. So the docket has been send back to the police for further investigations. The suspect will be led free,” said a North West NPA spokesperson Henry Mamothane as quoted by SABC.

Mapula Khune is Kaizer Chiefs goalkeeper, Itumeleng Khune’s younger sister. She lost her life due to a fatal fire at her grandparents home in Tshing, Extension 2, North West. Her body was discovered on Thursday morning and she was burnt beyond recognition. The 17-year-old boy was arrested in connection to the murder of the goalie’s sister on Friday afternoon.

This comes after the 17-year-old boy was charged on Friday afternoon, 5 March 2021, in Ventersdorp, following the alleged murder of Khune. Police initially investigated an inquest, but after obtaining more information, the inquest was changed to murder.

“Since Friday, additional cases of assault with the intent to do grievous bodily harm (GBH) have been reported as community street patrollers and family members have allegedly been assaulting alleged perpetrators for the murder of Khune,” reads a police statement.

The national broadcaster also revealed that the police still need to explain why the boy was linked as a suspect in the murder. However Daily Sun is reporting that a young boy had visited Mapula the night before the fire and wanted her to assist him with his school work. This was revealed by Mapula’s mother, Florah Khune, who told the publication, “He wanted her to help him with his homework. I directed him to where Mapula was. Her cousin came later and helped the boy as Mapula told him she had a vision.“

The cousin then revealed to the family that the 27-year-old saw her own death before it initially happened. She told her cousin that she had a vision about ambulances, fire trucks and the police.

Florah also added that when she was informed by her neighbours that her house was on fire she was in disbelief. This caused her to turn the ambulances away however in a jaw dropping moment, she saw with her own eyes that the backroom Mapula lived in was on fire. “My husband and I screamed hoping that our daughter was not inside.

Govt to reamend law after the Chiredzi Evictions scandal. Instead of using the contentious Statutory Instrument 50 of 2021 which ordered the villagers to vacate their ancestral land for Dendairy, the government will use a “refashioned statutory instrument”.

The Zanu PF-led government has doubled down on its plans to push Chilonga villagers in Chiredzi out of their communal land holdings to pay the way for a lucerne production project by Dendairy, a company based in Kwekwe. This was revealed by George Charamba, the Deputy Chief Secretary-Presidential Communications in the Office of the President via Twitter posts on Monday. He wrote:

Lucerne growing is a small part of the development plan of the affected area. The plan is far-flung and involves irrigation of over 200 000 hectares under thousands of centre pivots, all for crop, fruit and beef production.

Those wishing to diss (dismiss) the project do so by presenting it as a one-item affair, which it isn’t. They also predicate it on the coming in of an outsider as a fodder grower forgetting the bulk of the plan is State-involved and funded or the development of community and country!

Anyway, there will be complete communication from the government, both by a comprehensive statement and a refashioned statutory instrument. However, MDC Alliance vice-president Tendai Biti yesterday told NewsDay that the government cannot amend an SI but the correct thing is to repeal it. Biti said:

There is nothing like a refashioned statutory instrument. They simply have to repeal SI 50 of 2021, which took away land ownership rights of the Chilonga people. They cannot amend a statutory instrument. SI 50 of 2021 was promulgated by Government on 26 February 2021. It read:

Communal Land (Excision of Land) (Notice, 2021): His Excellency, the President, in terms of section 6(1)(b) of the Communal Land Act [Chapter 20:04], hereby makes the following notice:— 1. This notice may be cited as the Communal Land (Excision of Land) Notice, 2021. 2. The area of land described hereunder in terms of the schedule shall cease to be part of the Chiredzi Communal Land.

Drama as family refuses to bury murdered relative. The family believes that their relative, Mthandazo Moyo (52) who was a teacher at Simana Primary School, was killed by Thobelani Bhebhe after a misunderstanding over a woman about two weeks ago.

A family from Silobela, Midlands Province is refusing to bury a slain relative, demanding a 30-herd of cattle from the family of a man accused of having murdered him. The Moyo family demanded that the Bhebhe family part with 30 beasts plus US$3 000 dollars.

However, the Bhebhe family managed to release five cattle but the Moyos refused to accept them and dumped the body at the Bhebhe homestead demanding full payment. But following Silobela legislator Mthokozisi Manoki-Mpofu and Chief Malisa’s intervention, the family softened their stance and buried their relatives on Sunday. MP Manoki-Mpofu said:

It is true that the Moyo family had dumped the body at the Bhebhe homestead as they demanded that they be paid 30 cattle and money. I had to intervene together with Chief Malisa as the body was now at an advanced stage of decomposition.

Fortunately, they understood and burial was conducted and we are now negotiating to see how Bhebhe can now pay the remaining beasts and the remaining money. Manoki-Mpofu further revealed that the Moyo family have reduced the number of cattle from 30 to 15 plus money on top. He said he was working with Chief Malisa on how the Bhebhe family can come up with a payment plan to settle the outstanding debt.

20 people miss death by a whisker after stolen petrol explodes. Twenty people escaped death by a whisker when a house in Bulawayo’s Mpopoma suburb caught fire following a petrol explosion around 9 AM Sunday morning.

One of the victims, Lenxious Sibanda (27) of New Lobengula, reportedly stole 20 litres of petrol belonging to his parents who are based in Botswana and intended to sell it on the black market. Lenxious then took the stolen fuel to Mpopoma where he hid it at a friend’s family house.

His sister, Leterevy Sibanda revealed that the petrol was meant to be used by their parents to fuel their car for a trip to their rural home in Nyamandlovu during the Easter holiday. She said:

He took the fuel without permission from our parents and the intention was to sell it on the black market. We were shocked when his friends came to inform us that he had been rushed to hospital after he was burnt in a petrol explosion at a house in Mpopoma.

The owner of the house, Margret Mangwiro told the Chronicle that she suspects Lenxious could have been smoking in the room. She said:

It seems Lenxious was smoking a cigarette in the room, which had a container of fuel resulting in the explosion that nearly cost our lives. There were 20 people in the house including my grandchildren who had visited us for the weekend.

Mangwiro said her neighbours swiftly reacted and helped to douse the inferno and her grandson, George Mangwiro and his friend Wellington Mukonza rescued Lenxious who was trapped in the house. Said Mangwiro:

It was a terrible sight as my neighbours joined us in putting out the fire using sand and water. My grandson and his friend took the risk and got inside the room where the fire had started to rescue Lenxious who was trapped inside.

Lenxious sustained life-threatening burns and was rushed to Mpilo Central Hospital where he is admitted. The explosion shattered window panes and the fire burnt blankets, a mattress and a headboard. Property worth $10 000 was lost in the inferno.

Good news for ED as former VP Mai Mujuru quits politics. Former Vice President Joice Mujuru on Monday said she no longer has any political ambitions and is now focusing on raising her family and her farming business.

What made me happy is that we spoke about women’s issues considering that we are in women’s month and did not discuss positions or politics. Mujuru (66), was speaking to journalists soon after meeting the First Lady Auxillia Mnangagwa at Zimbabwe House in Harare. She said:

The First Lady is apolitical so we discussed family issues, health and the way we live. Amai sought to catch up with me on my family and the farming business that I am involved in. I extended an invitation to Amai to come and see for herself at the farm

Mujuru, better known as Mai Mujuru, was the Vice President for nearly 10 years until her expulsion from Zanu PF in 2015. She was accused of, among other things, attempting to illegally remove the then President Robert Mugabe from power, witchcraft, corruption, colluding with the party’s enemies and sowing divisions in the ruling party.

Mai Mujuru’s Gamatox faction, which included Didymus Mutasa and Rugare Gumbo, who were also expelled from the ruling party, went on to form their own party, Zimbabwe People First. Mugabe appointed the current president, Emmerson Mnangagwa as Mai Mujuru’s replacement.
