Report: Couple dupes business partner

Report: Couple dupes business partner. Elvis Chigazira and his wife Tafadzwa Chibare are alleged to have duped their fellow church member Pervia Chigwida of US$11700 in deal to import cement from a neighbouring country. A couple stands accused of duping their church member of more than US$11 000.

Chigwida and her brother Talent Lungu posted the couple’s wedding photograph on social media and UFI church group appealing for anyone who may have knowledge of where they could be found.

The two were further alleged to have changed their contact numbers and have been ignoring Chigwida’s calls. Chibare confirmed to H-Metro her differences with Chigwida over money saying the latter has been their business partner, who is now blackmailing them and their company.

“Pervia and her brother Talent are blackmailing us on social media and misinforming people about the correct facts,” said Chibare. “Pervia has been our business partner and is now based in Botswana.

“She is posting falsehoods on social media that we are not answering calls and nowhere to be found in her effort to blackmail my husband and I. “We are not in hiding or not answering calls as alleged.

“Pervia was aware of our deal to import cement from a neighbouring country and the agent of that country failed to supply our full order. “We lodged a police report against the agent and docket was opened at Chirundu Border Post and Pervia is aware of that.

“We have both been duped by the agent who failed to supply all our orders not what Chigwida wants people to believe. “Pervia’s money is US$5000 not US$11700 she posted on social media.

“Her reason to tarnish our image is best known to her and her brother and we have no option other than taking a legal action against them.

“Our lawyer is now working on the matter and we will be guided accordingly,” said Chibare. Contacted for comment Lungu said he had been receiving several calls from individuals and some claiming to be journalists over his post.

“I am no longer comfortable to answer questions because I have been receiving calls from several people among them claiming to be journalists,” said Lungu.

“I have decided not to respond to any of the questions pertaining to the matter posted on social media until I meet each one of the people concerned and claiming to be journalists,” said Lungu.

Lungu posted a message appealing to anyone who may have information about the couple’s whereabouts. Chigwida could not be reached for comment. However, her message on social media also appeals for information that may lead to location of the couple.

Killer Zimbo man dies in UK prison 2 weeks before release. A Zimbabwean man who was jailed 15 years in 2005 for killing his former wife died in prison in the United Kingdom (UK) just two weeks before his release.

The deceased, Godfrey Muzhuzha (50), who was jailed for killing his former wife Judith Muzhuzha, died from an unknown ailment when he had served a 15-year jail term in Hemel Hempsted. His relatives have set up a GoFundMe appeal to repatriate his body back to Zimbabwe

A post on the page reads: Hi there my name is Jane Mutukwa I am trying to help repatriate the remains of my late nephew Godfrey Muzhuzha who sadly suddenly passed away on 3 May 2021 just before his release from prison.

His immediate family members are in Zimbabwe and are unable to raise the funds required to repatriate his body back home.

We are aiming to send the body in the next few weeks preferably 12 June 2021. Your support towards contributing to this good will be highly appreciated, Thank You in advance and may God richly bless you.

Mutukwa is an aunt to the late Muzhuzha. The court was told in 2005 that Muzhuzha stabbed his former wife nine times in from of their kids who were seven and 11 years old back then.

Muzhuzha killed his ex-wife Judith, who was 31 at the time after finding photos of her with a boyfriend. He was arrested the following day and claimed he had killed her accidentally after she had attacked him.

Farmers’ wives design way to frustrate s.e.x vendors. Reports suggest that a lot of farmers have in the past lost thousands of their hard-earned United States dollars to s.e.x workers who who usually work with male criminals.

Hookers in Macheke, Murehwa, are complaining that tobacco farmers’ wives this time around accompanied their husbands to the auction floors a situation that robbed them of an opportunity to make money.

Hookers who spoke to NewZimbabwe said the move by farmers’ wives dealt them a heavy blow since they used to rely on tobacco farmers for revenue. One s.e.x worker, who only identified herself as Mucha, said:

We used to rely on tobacco farmers during this period, but now their wives are now accompanying them to the auction floors and they are no longer accessible.

So, for us to approach tobacco farmers soliciting for beer or s.e.x is now impossible. The farmers also come to bars that are operating illegally with their wives and as a result, the couples don’t spend much time in the town compared to previous years when they would stay for over a week.

S.e.x is work and if we do nothing, our children will die from hunger and be unable to attend school. We are getting old, and s.e.x work will not take us far. We need to prepare for retirement, so we appeal to authorities if we can be assisted with income-generating projects and retire from this trade.

According to Mucha, the female s.e.x workers’ sources of income had also been worsened by the Covid-19 pandemic, which has seen most people finding it hard to survive. She added that the decline in demand resulted in them lowering their fees to as little as $1 per session.

Mucha also bemoaned the fact that most beer outlets remain closed while police are chasing or abusing them as fine, if they resort to beer outlets operating illegally.

A look into the background of judges who effected Luke Malaba’s ouster. Their background could be one of the reasons why President Emmerson Mnangagwa and his allies were uncomfortable with the bench. The panel ruled that Malaba’s tenure as Chief Justice ended when he turned 70 on 15 May and the judgment was a direct jab at President Mnangagwa’s bid to extend Malaba’s tenure.

This article looks into the background of three High Court Judges, justices Happias Zhou, Jester Helena Charewa, and Edith Kuda Mushore who ruled in favour of Chief Justice Luke Malaba’s ouster.

Pindula News previously posted some background on Justice Happias Zhou. Charewa and Mushore’s Curriculum vitaes that were seen by The NewsHawks indicate Justice Charewa:

  • Was also a senior army official where she served for 10 years (1985 and 1995).
  • Chief legal officer at the Zimbabwe Defence Forces where she was head of the Department of Research, Legal Drafting and Training (1990 and 1995).
  • Joined the military as a captain in 1985, having served as a professional assistant at Higham, Lewis and Lock (now Henning Lock Donagher and Winter Legal Practitioners) in Mutare.
  • Left the military, went into private practice as a partner at Mucharehwa and Partners during which she was also a lecturer in Civil Practice and Procedure at the University of Zimbabwe’s Faculty of Law.
  • Joined the African Court on Human and People’s Rights in Arusha, Tanzania, as a senior legal officer in 2008 before becoming a special assistant to the president and later deputy registrar.
  • Appointed a High Court judge in September 2015.
  • Holds a Bachelor of Law (Honours) degree from the University of Zimbabwe (UZ), a Bachelor of Law degree from the UZ and a Master of Science in International Relations, also from the UZ.
  • Undertook several courses with institutions such as the Commonwealth Judicial Education Institute, African Court on Human and People’s Rights, PricewaterhouseCoopers and the International Organisation for Migration, among others.

Justice Mushore:

  • Was a long-time advocate based at the Advocates Chambers in Harare.
  • Legal adviser (Africa) of the International Organisation of Consumer Unions at The Hague in the Netherlands (1993 to 1999).
  • Parliamentary research assistant at the House of Commons (1987 and 1989).
  • She had previously served as the corporate legal adviser for Old Mutual.

Ngezi defeat FC Platinum to go top of group. Substitute Bruno Mutigo scored a quick-fire brace to inspire Ngezi Platinum to a come-from-behind 2-1 win after FC Platinum had scored through Silas Songani in the 38th minute.

Ngezi Platinum extended their winning streak in the Chibuku Super Cup after beating FC Platinum 2-1 at Mandava Stadium this Thursday.

As Ngezi pressured, in search of an equaliser in the second half, FC Platinum defender Gift Bello lost his cool and was red-carded for remonstration. Ngezi took advantage of their numerical edge and found a formula to beat their opponents.

The Mhondoro team now is on top of Group 4 log table with nine points, after winning all their three games, while FC Platinum are second on six.

They, however, lost their talisman, Denver Mukamba who sustained an injury and its magnitude could not be determined. He has been instrumental to Ngezi Platinum’s performance since the commencement of the Chibuku Super Cup tourney.

ZESA issues power supply update following sudden blackouts

ZESA issues power supply update following sudden blackouts. Local power utility, the Zimbabwe Electricity Supply Authority (ZESA) has issued a statement on power supply in the country saying the blackouts experienced countrywide recently were caused by a technical fault at Hwange. POWER SUPPLY UPDATE – DEPRESSED POWER SUPPLY DUE TO TECHNICAL FAULT AT HWANGE

ZESA Holdings would like to advise its valued customers countrywide that there is limited power supply in the national electricity grid due to technical faults at Hwange at 1141 hrs yesterday. The depressed power supply situation has also been compounded by the unavailability of normal import levels due to the loss of interconnection to Eskom of South Africa.

The interconnection to South Africa has since been restored and recovery of service to optimum levels at Hwange is currently underway. Customers are advised to use the available power very sparingly and updates will be availed as the situation improves.

The inconvenience caused is sincerely regretted.

Update on Luke Malaba’s contempt of court case

Update on Luke Malaba’s contempt of court case. This was after the recusal of one of the judges. The hearing later resumed with 2 judges as Justice Chinamhora recused himself. Justice Chinamhora confirmed that he had a meeting with the Justice Service Commission (JSC) Secretary Walter Chikwana. The JSC is party to the hearing.

The Court hearing the contempt of court charges against former Chief Justice Luke Malaba sat at 2 pm Thursday to consider if a two-judge bench can proceed.

Lawyers for Luke Malaba and Justice Minister Ziyambi Ziyambi have requested permission to appeal against the composition of the bench as a two-judge bench. Advocate Thabani Mpofu opposed the request and castigated the respondents for ostensibly trying to get a favourable judge. Justices Tsanga and Chirawu-Mugomba have dismissed the application for leave to appeal against the composition of the bench saying there are no prospects of success. The hearing then proceeded.

Advocate Thabani Mpofu then addressed the court arguing why Malaba should be committed to prison. Mpofu told the court that Malaba complied with the order issued by Justice Zhou for some 10 days before he made a decision to violate it.

Mpofu also urged the court to take judicial notice of the swearing-in of 6 Supreme Court judges today (Thursday) presided over by the Acting Chief Justice Gwaunza because the former Malaba was complying with Zhou order. He also observed that Justice Zhou’s order was being abided by but as and when the Malaba wishes to.

On Malaba’s contempt of court, Mpofu submitted that the former CJ had passed many judgements which were abided by. There is nothing stopping him from abiding by a decision of the High Court. Advocate Uriri, representing Malaba, denied that Malaba was in contempt of court insisting that the use of the word it is declared does not make an order a declaratory one.

Advocate Magwaliba, representing the minister of justice, submitted that the Zhou judgment did not require anyone to do anything and or to stop doing something and therefore contempt proceedings cannot be used in these circumstances.

The lawyers for the minister of justice asked for the application to be dismissed with costs prompting Justice Tsanga to question: Does the issue of costs not discourage citizens from challenging matters in court?

Mr Addington Chinake, representing Justice Gwaunza (Acting CJ) noted that she is just a passenger in this matter. He further submitted that Malaba, the Acting CJ and the JSC were not in willful violation of the order as they had sought an opinion on the subject which opinion they were following.

In response, Advocate Mpofu submitted that Malaba never pleaded that he took advice, he is a lawyer and a judicial officer. He got advice long after he had received the advice.

Mpofu further submitted that if Malaba wishes to go back to work, he can approach the court for an order to be allowed to do that pending appeal. The court adjourned. The ruling is pending and expected next week.

Unsure Malaba skips swearing in of Supreme Court Judges

Unsure Malaba skips swearing in of Supreme Court Judges. Three High Court judges recently rejected President Emmerson Mnangagwa’s extension of Malaba’s term of office but the state appealed the ruling at the Supreme Court. The outcome is pending and Malaba has been reporting for work since the appeal.

Alex Magaisa, a law lecturer at Kent University in the United Kingdom, has said the actions of Chief Justice Luke Malaba show that he is unsure of the outcome of his contempt of court case.

Speaking on the development, Magaisa, a former Chief of Staff in the office of the late former Prime Minister, Morgan Tsvangirai said:

Malaba was The case against former CJ Malaba for contempt is in court. He claims he’s lawfully in office. But he skipped the swearing in of ConCourt judges last week. Today he skipped the swearing in of Supreme Court judges. The man is unsure. You can’t have your cake & eat it.

Why would a man who is confident of the legality of his position act in ways that are inconsistent with his claims? If he were on sure legal footing he would be asserting his position & claiming effective occupation. But no, he’s prevaricating. He knows he’s on slippery ground.

Even if he stays after all this the man and his reputation are damaged goods. His moral authority is eroded. He is supposed to be the person telling politicians to respect the law; judging their conduct. That his conduct is the subject of litigation is a huge embarrassment.

Tomorrow a challenge over the appointment of Supreme Court judges is also being heard in court. But in another show of judicial contempt President Mnangagwa went ahead & unilaterally appointed the judges knowing very well that there’s a legal challenge that he’s opposing.

He could have waited for the conclusion of the legal challenge. After all, he is opposing it. But before the court even hears the matter, he just went ahead & appointed anyway, with the pious @JSCZim acquiescing as usual. No effort to advise against the odious conduct.

But the biggest Pandora’s box awaits after one judge recused himself from the contempt case citing the fact that the @JSCZim Secretary had met with him. What might the Secretary, himself an active litigant in this mess, have been doing meeting a judge? Why? On whose behalf?

Some of Malaba’s colleagues in the legal fraternity have been urging the learned judge to voluntarily step down to preserve the dignity of the judiciary. It seems Malaba is determined or is being compelled to continue fighting.

In an interview, Cde Matemadanda said the rumours circulating before the official announcement were misplaced. “There was a lot of hype, saying Matemadanda has been demoted, has been fired from the Politburo. That was only gossiping.

Outgoing Zanu PF national Political Commissar, Cde Victor Matemadanda who was appointed as ambassador designate to Mozambique commended President Mnangagwa for re-assigning him to a diplomatic mission and is optimistic of delivering up to expectations.

“Why it could not be announced at that time is because of the protocol involved in the appointment of ambassadors. When one is about to be appointed or has been selected to be appointed, there is what is known as the Agrimo, a letter requesting one to be appointed an ambassador to a country, to give a country chance to accept or to refuse.

“Between that time and the time of appointment announcement, one is not even allowed to visit the country, let alone talk about it. This is why I was quiet. As to whether the appointment of ambassador from a Deputy Minister of Defence and War Veterans Affairs is demotion or not, that is none of my business.

I have confidence in my President and I know he assigns me where he thinks I can serve most. For me it is not about the position or seniority but it is about fulfilling that which I would have been I assigned to do. I can assure you, I will deliver as to expectations.”

Suspected robber disowns links with Musa Taj Abdul. Carrington Marasha is being jointly charged with Musa Taj Abdul, Liberty Mupamhanga, Prince Makodza, Godfrey Mupamhanga, Charles Lundu, Rudolf Kamhanga, Innocent Jairos and Tapiwa Mangoma. The State alleges that Marasha bolted out of a Beitbridge house where his other accomplices were arrested and disappeared.

Musa Taj Abdul, on charges of unlawful possession of firearms and ammunition told the court that he came to know of his alleged accomplices when he was arrested.

During cross examination with his lawyer Marasha told the court that he had never been in Beitbridge in his entire life. He said at the time his alleged accomplices were arrested he was not feeling well and was receiving treatment at a clinic in Bindura.

The State however produced a document from the undisclosed clinic which allegedly proves that they never treated Marasha.

When the trial commenced State witness Detective Sergeant Ronald Musekiwa told the court that the firearms and ammunition found in their possession were taken to CID Ballistics for testing. “The firearms matched some scenes in the laboratory, meaning that proved they were used in committing various crimes,” he said.

The nine, through their lawyers, are denying the allegations. The court heard that on August 24 last year, detectives from CID Drugs and Narcotics Beitbridge received information that the suspects, who were on the police wanted list, were at House Number 1184 Mashakada, in Dulivhadzimu suburb of Beitbridge.

It is alleged the detectives mobilised other police call signs, Support Unit and Canine section, and they surrounded the house before notifying the gang of their presence. The nine bolted out of their room and started running in different directions.

Police gave chase and subsequently arrested them and took them back to their room where searches were done, leading to the recovery of a 9×19 mm Vector Z88 pistol serial numbers obliterated, 11x9x19mm live cartridges and 20×12 bore live cartridges on a webbing belt.

They were recovered in a black satchel stashed in a washing basket. In March last year, Mashwede Holdings in Harare lost over US$100 000, R42 000 and $14 000 worth of fuel coupons to five workers and the nine alleged robbers.

Job Sikhala’s colleagues exonerated of violating lockdown rules charges. Zengeza West constituency legislator Job Sikhala’s three colleagues were Wednesday exonerated of violating lockdown regulations when they appeared before Harare Magistrate Barbara Mateko. The magistrate quashed charges of breaching national lockdown regulations pressed against them last year. The three namely Terrence Manjengwa, Blessed Changara and Barnabas Gura, who all reside in Harare were arrested on 3 September 2020 outside Harare Magistrates Court while following proceedings for Hon. Sikhala, who had been arrested and detained on charges of inciting public violence by urging people to participate during the 31 July 2020 protests.

The trio was charged with unnecessary movement during the national lockdown as defined in section 4(1)(a) of the Public Health (COVID-19 Prevention, Containment and Treatment) (National Lockdown) Order Statutory Instrument 77/2020.

Prosecutors claimed that Manjengwa aged 26 years, Gura aged 32 years and Changara aged 22 years unlawfully and unnecessarily moved from their places of residence during the national lockdown imposed by government in a bid to contain the spread of coronavirus by gathering at Harare Magistrates Court without exemption letters.
But on Wednesday 2 June 2021, Magistrate Mateko upheld the trio’s application for exception and quashed the charge of violating national lockdown regulations.

Magistrate Mateko’s decision came after Manjengwa, Gura and Changara’s lawyer Kossam Ncube of Zimbabwe Lawyers for Human Rights had objected to the charge of unnecessary movement during the national lockdown on the basis that it does not exist at law under the cited section.

Ncube had also argued that proceeding to trial with the charges as framed would amount to a violation of section 70(1)(b) of the Constitution as it abrogates the right to a fair trial and hence the trio must not plead to a nullity.

While Manjengwa, Gura and Changara have been set free on charges of contravening national lockdown regulations, their application excepting to charges of possession of offensive weapons at a public gathering as defined in section 43(1)(a) of the Criminal Law (Codification and Reform) Act was dismissed by Magistrate Mateko, who ordered the State to amend the charge of possession of weapons as prosecutors had cited a wrong section. In their application for exception, Manjengwa, Gura and Changara had argued that the purported offence cited in the State papers is not established under the particular sub-section cited by prosecutors, hence no cause of action arises.

The trio had also argued that the failure by the State to cite the correct provision is so glaring that it cannot be condoned or be said to be inconsequential and to seek to commence a prosecution on non-existent charges is a grave anomaly and irregularity which will unduly prejudice and embarrass the accused persons. Manjengwa, Gura and Changara return to court on 25 June 2021, where their trial on charges of possession of offensive weapons is scheduled to commence.

Health Minister VP Chiwenga: Health services delivery improving. The past two years has seen Zimbabwe giving greater focus on the fight against the pandemic, a situation which some felt would hinder the country’s quest to revamp the health services to match best international practices.

The Government’s Covid-19 response is not compromising Zimbabwe’s quest to improve the country’s general health services, Vice President and Minister of Health and Child Care Dr Constantino Chiwenga has said.

VP Chiwenga, however, said Zimbabwe was not negating its vision of transforming the health services and outlined some major strides by Zimbabwe.

“We maintained above 86 percent childhood coverage in 2020 and currently we are carrying out integrated and targeted catch up campaigns for under-performing districts. Zimbabwe is currently on a milestone rollout of the Typhoid Conjugate Vaccine (TCV) and the programme has already earned huge praise from United Nations agencies.

According to the World Health Organisation (WHO), Zimbabwe is only the third country in the world to make TCV part of its routine immunisation programme. “The HIV programme has achieved — the 90-90-90 targets. The delivery of TB, malaria and other essential health services during the Covid-19 response has also been maintained,” said VP Chiwenga.

Zimbabwe has so far defied the odds with a thorough and effective response to the Covid-19 pandemic, faring exceptionally well in comparison to other developing countries.

The country’s ability to respond to the pandemic has received international rave reviews with the World Health Organisation and China all commending the Government’s efforts.

“Our response has been a combination of health promotion and prevention measures based on raising awareness and community mobilisation. The whole of Government and society’s approach helped the country to reduce transmission and Covid-19 associated morbidities and mortalities,” said VP Chiwenga.

He said Government was partnering with local universities and the private sector on innovations and strengthening of local production of personal protective equipment (PPEs), medicines and medical equipment.

“The Government has put in place frameworks that are guiding these engagements. “The Government is encouraging donors and development partners to strengthen local production capacities for sustainability,” he said.

“We have managed to incorporate gender-based violence and children violence into the Nurses Training School curriculum so that our staff are able to manage these cases as they present them to our institutions.

“Zimbabwe appreciates WHO and the key leadership role it plays in the fight against the Covid-19 pandemic. We are strongly committed as a nation, to ensuring equitable access to vaccines to all residents of Zimbabwe,” said VP Chiwenga.

Acting Mashonaland Central provincial medical director Dr Rudo Mari-Masanganise confirmed that her province continued offering other healthcare services despite the Covid-19 situation.

This was also corroborated by several district medical officers in separate interviews.  “Covid-19 was a new virus and most people were talking about it, but at no point did we stop offering other services.

“We actually improved our services in various aspects and there was a lot of infrastructure development to boost the health sector,” said Dr Precious Madziwa of Mazowe.

President Mnangagwa: Heritage corridor opens. Local authorities need to consider renaming local buildings, roads and special monuments to reflect the country’s independence and sovereignty to market brand Zimbabwe, President Mnangagwa said.

Officially opening the Second Edition of the Bulawayo Cultural Arts Festival (BAF) yesterday, President Mnangagwa, who had earlier toured some of the city’s standout historical and heritage sites, said the cultural industry has vast economic potential.

“Under the Second Republic, my Government made a bold and deliberate decision to correctly portray and promote our rich history and cultural heritage. To this, there is no going back.

“Local authorities must continue renaming. We still have buildings and roads with names that are not local, if you go to America or anywhere else, you don’t find Shona or Ndebele names but you still have foreign names here. Please wake up!” said the President.

Before officially opening the festival held under the theme “Enhancing Local Government Participation in Cultural Governance”, the President toured Inxwala Grounds, the late Father Zimbabwe Joshua Nkomo statue, the National Museum, St Mary’s Cathedral Basilica among other key historic sites in the country’s cultural capital.

“Although, the Bulawayo Arts Festival is being held here in this city, it carries national stature and importance. More so, as there remains the pending national celebrations of our Independence Day commemorations here in Bulawayo.

“The festival affords us yet another opportunity to celebrate and promote our rich heritage, culture and arts with specific focus on the Urban Cultural Heritage. It further augments my Government’s quest to ensure that cultural professionals, practitioners, artists and our citizens create, produce, disseminate and enjoy a broad range of cultural goods, services and activities,” President Mnangagwa said.

The President called upon the creative sector to seize opportunities that have come with the democratisation of the country’s broadcasting industry that has brought about new players. He said the country should preserve its heritage as it was a source of national pride and inspiration, not only to the present generation but also to those to come.

“The City of Bulawayo remains the country’s epicentre of creative arts. It is indeed a hot pot of various cultures and convergence of histories which confirms Zimbabwe as a unitary state.

“This morning, I was pleased with the Heritage Corridor; beginning with my visit to the Inxwala Grounds which was opportune, following the successful agriculture season and bountiful harvest. The sojourn to the site retraces King Lobengula’s footprints to the sacred shrine where the harvest celebrations and other important ceremonies in the Ndebele culture were conducted.

“Lest we forget, the Hanging Tree stands as a reminder to present and future generations of the brutality and savagery of the white settler regime towards our forefathers. This national monument must inspire all of us and the youth in particular to consistently defend our independence, territorial integrity and dignity as a nation.

“The reincarnation of colonialism and imperialism in whatever form, must never be allowed a foothold, in our country.”On the statue and Memorial Museum of the late National Hero, uMdala Wethu and Founding Father, Dr Joshua Mahabuko Nyongolo Nkomo, Chibwechitedza, President Mnangagwa said it “evokes sentiments of the importance of unflinching patriotism and loyalty as well as peace and unity to the achievement of sustainable development”.

“The National History Museum and the Saint Mary’s Cathedral Basilica Parish, among other sites demonstrate the wealth and diversity of our culture and heritage. These must be cherished, protected and safeguarded for generations to come.”

With the Covid-19 pandemic having stymied the country’s economic growth potential in the tourism sector, the President said culture remains a cornerstone of the country’s economic revival plans towards Vision 2030 to become an upper middle class economy.

“The Bulawayo Arts Festival initiative is commended for its inclusion of a broad array of stakeholders and participants to this festival. This has served to showcase creative talent from beyond the boundaries of Bulawayo Metropolitan Province, itself a reflection that we are a diverse and united people, under one flag, one national anthem and a unitary state.

“Bulawayo has further demonstrated that it is a sanctuary of different cultures and traditions through exhibiting these hybrid cultural product portfolios.

“Going forward, the development of the creative and cultural industries as well as domestic tourism remains a collective responsibility for us all, Government, stakeholders and the private sector.”

Under President Mnangagwa, the Second Republic has made it its mission to correctly portray and promote the country’s rich history and cultural heritage.

“Culture is an important pillar for sustainable socio-economic development. Under the National Development Strategy-1, my Government recognises the power of culture in transforming societies, fostering strong family values, a sense of identity and belonging for all people. “Creative cultural industries are thus an essential component for building national cohesion, inclusive economic growth and the reduction of inequalities towards the achievement of Vision 2030. It is therefore imperative that Bulawayo Province and other communities throughout the country tap into the potential of the culture, art and heritage sector to derive economic value.

“This must see communities taking advantage of linkages with other economic sectors and value chains to generate increased production and consumption of our locally produced goods and services. The creative cultural industries must be perceived and executed as an economic sector, in its own right, which contributes to the Provincial and National GDP,” he said.

The Bulawayo City Council has been running an online campaign to celebrate Bulawayo Day through the hashtag “I love Bulawayo.”

Last year, the BAF was held virtually due to Covid-19. The event was viewed online in at least 45 countries and the ultimate goal this year is to reach all corners of the globe and showcase local art and culture.

Jacob Mudenda to brief President on Pan-African Parliament row. The elections in Midrand, South Africa were suspended until October to allow consultations, especially with the African Union, which has clearly stated that it wants these sort of top posts to rotate between the regions.

The dispute last week over whether the presidency of the Pan-African Parliament (PAP) pitting delegates from North and Southern Africa against those from East, West and Central Africa should help the Southern African nominee, Chief Fortune Charumbira of Zimbabwe, land the top post of the continental body.

Speaker of National Assembly, Advocate Jacob Mudenda said yesterday that he would soon brief President Mnangagwa about developments around the suspension of the PAP elections and remained hopeful that Chief Charumbira would be elected.

He commended the Zimbabwean delegation for joining with their colleagues in the Southern and Northern African caucuses in pushing for the rotation of the presidency, which has always been held by countries from Western, Eastern and Central Africa.

Adv Mudenda said this in the National Assembly yesterday while responding to Mashonaland East Proportional Representative legislator, Cde Tatenda Mavetera (Zanu PF), who commended the Zimbabwean delegation in South Africa.

He said the Northern African region did not field a candidate, which should have left Chief Charumbira as the only candidate if the principle of rotation of regions was followed. The Northern region did not want to put a candidate. That left the Southern region with only one candidate of Chief Charumbira who should have gone unopposed. I will brief the President who has been a strong supporter of PAP and assure him that all is not lost.

“We will get there. From my assessment you will see some major transformation (of PAP) in terms of rules of procedure and its impact and role as an organ of the AU,” said Adv Mudenda.

PAP legislators who have spoken to by The Herald said the suspension of the election has galvanised Southern and Northern African regions to assert their rights by pushing for Chief Charumbira to land the continental body’s presidency.

Chief Charumbira is the acting president of PAP after taking the post early this year. His bid to contest the election suffered a temporary setback this week after chaos ensued in the PAP as legislators from Africa’s regions were deeply divided on the procedure to adopt for the polls.

At the centre of the fracas is a proposition by Southern and Northern African region calling for the post to be rotated through the regions to allow each region a fair chance.

In an interview from South Africa, Chirumhanzu South legislator Cde Barbara Rwodzi said the Southern African caucus for PAP remained optimistic that they will assume the presidency in line with the principle of rotation.

“Firstly, we are happy that the elections have been suspended. Obviously this will enable the African Union to come and address the sticking issue of presidency on a rotational basis which has not been adhered to for too long.

“We are therefore optimistic that the principle of rotation will prevail because it is in compliance with the rules,” said Cde Rwodzi.

Namibian opposition leader, Mr McHenry Venaani told The Herald from Midrand that the position taken by Southern and North Africa calling for rotation of regions nominating the presidency was vindicated when the AU wrote a letter confirming that position before the continental body suspended the elections.

“Firstly the Southern African region rejected an illegality that has been perpetuated for more than 15 years. There is a famous saying that ‘when an injustice becomes the law, resistance becomes a duty’. We have since been vindicated by a letter from the AU that the principle of rotation must apply,” said Mr Venaani.

A former PAP vice president representing Western African caucus, Senator Bala Ibn Na’Allah from Nigeria weighed in saying the PAP was bound by principles of the AU.

“Yes I agree that PAP is bound by AU and in this case the principle of rotation must apply. We do not need to ratify the Malabo Protocol for us to comply with this principle of rotation.

“People need to put interests of institutions and the continent ahead of their personal interests if are to build strong institutions in Africa,” said Mr Na’Alla in an interview with The Herald.

The Malabo Protocol on the PAP calls for a regional rotation for the presidency, but the East, West and Central African caucuses said it did not yet apply fewer than 28 countries had ratified it.

The AU’s legal opinion read out at the meeting said the post should rotate by region but the majority rejected this as only an advisory opinion although it was argued that AU opinions amount to a directive.

Some of the candidates contesting include Haidara Cisse from Mali and Albino Aboung from Southern Sudan.

SACU speaks on catch and release action. Speaking at a recent anti-corruption conference held in Harare, Mr Mpofu said the release of suspects on bail does not amount to “catch and release”. This followed an attack on the investigators for alleged “catch and release” of corruption suspects.

The head of the Special Anti-Corruption Unit (SACU) Mr Tabani Mpofu said the phrase “catch and release” was coined by some elements trying to discredit President Mnangagwa’s anti-graft fight, and suspects who deserve bail are freed by the courts in terms of the law.

Judicial officers are the ones who make bail rulings and they do so in terms of the law, said Mr Mpofu. “Insinuating that those who catch are the ones who release is mischievous. The phrase was coined by people who want to discredit the President’s noble anti-graft fight.

“According to the Constitution, every person is innocent until proven guilty. Bail is a right to all those who qualify. Blasting the Government or investigators over release of suspects on bail is wrong and unfair.

“We may oppose bail as the State, but the Judiciary, which is an independent arm of the State, reviews our arguments and come up with a decision. “The court may agree or disagree and that is how the criminal justice system operates,” said Mr Mpofu.

Mr Mpofu clarified SACU’s role in the fight against corruption saying only the Zimbabwe Anti-Corruption Commission (ZACC) and the police have arresting powers. The clarification followed an attack by some people that SACU was acting unconstitutionally. Some even contested SACU’s powers in court, without success.

“As SACU, we are a body established by the President when he got concerned that nothing much was being done in terms of prosecution of corruption cases.

“The problem comes from people who don’t understand how prosecutors operate. When we do our prosecution, we fall directly under the Prosecutor-General, under whose authority we are prosecuting.

“We are not two teams competing with each other. The PG in terms of the Constitution, may direct the Commissioner-General to investigate certain cases. We are not unique in our interaction with the police. We work under the supervision of the PG.

“There are only two entities with the powers to arrest, that is the ZRP and the ZACC,” said Mr Mpofu.

RBZ: Forex auctions revive industry. Displaying the rapid recovery and growth of Zimbabwe’s industrial sector, raw material requirements absorbed 44 percent of hard currency allotted on the Reserve Bank of Zimbabwe’s foreign currency system during the first three months of the year, latest numbers show.

That huge block of cash is largely the result of the move away from expensive imports of finished products towards local manufacturing where all operational costs except some raw materials are paid locally.

Of the total US$424,8 million was allotted across both the main and SMEs platforms, the bulk was taken up by raw materials showing the role of the system in meeting industry’s basic needs.

According to latest Treasury data, there was a significant upturn in allotments for the quarter, compared to the three-months period ended December 30, 2020, which would only be expected given that the fourth quarter is typified by company closures for the extended holidays.

“During the first quarter of 2021, a total of 12 auctions were conducted on both the main and SMEs, with a total US$424,8 million being allotted, at an average exchange rate of 83,47 percent, compared to US$359,6 million allotted in the previous quarter, at an average rate of 81,6 percent,” reported Treasury in its latest Quarterly Bulletin.

With regards to the other allotments, machinery and equipment absorbed 17 percent, consumables 9 percent, retail and distribution and energy absorbed eight percent, respectively and other priority lists absorbed 14 percent.

The foreign currency auction system has brought about pricing stability, and both the fiscal and monetary authorities have maintained a tight leash on money supply growth.

Over the first quarter, there was an increase in money supply due to maturing savings bonds, but the overall impact on money supply in the economy was negligible as stability continued to prevail.

“On average, reserve money increased by 115 percent to $21,69 billion, compared to the 2020 first quarter level of $10,11 billion.

“The increase in reserve money was largely driven by the increase in banking sector’s deposits at RBZ and banks’ RTGS liquidity attributable to maturity of savings bonds held by banking institutions,” said Treasury.

The Zimbabwe dollar this week traded largely unchanged against the United States dollar at $84,76 from $83,72 in the previous week.

The authorities anticipate increased efficiency in the distribution and use of foreign currency accessed from the central bank’s auction system after last week’s promulgation of Statutory Instrument 127 of 2021 that targets arbitrage that has been affecting the system.

Luke Malaba crisis update: Drama at contempt hearing. Justice Webster Chinamhora recused himself from the three-judge panel in the morning after lawyers representing Zimbabwe Human Rights NGO Forum executive director Musa Kika, who is the applicant in the matter, asked for his recusal following revelations that he met with JSC secretary Walter Chikwana ahead of the hearing of the case.

There was drama yesterday after one of the three judges designated to hear an application seeking the arrest of Chief Justice Luke Malaba recused himself after confirming that he had met with the head of the Judicial Service Commission (JSC) secretariat, but government sought to reverse his decision.

Critics say the meeting was meant to pressure the judges to make a ruling in favour of Chief Justice Malaba which would seriously compromise their independence. Justice Chinamhora then recused himself, confirming that he had, indeed, met with Chikwana.

The remaining two judges, Justices Amy Tsanga and Sylvia Chirawu-Mugomba then consulted the JSC, which ruled that they could proceed and hear the matter as a two-judge panel.

The case against Chief Justice Malaba came after his term of office as Chief Justice ended a fortnight ago, with the High Court ruling that he ceased to be the country’s top judicial officer on May 15 when he turned 70 and that a recent constitutional amendment allowing the President to extend his term did not apply to him.

Last week, Chief Justice Malaba returned to office under the belief that the High Court ruling had been suspended by an appeal filed by Justice minister Ziyambi Ziyambi and Attorney-General Prince Machaya.

However, Kika, who challenged the extension of Chief Justice Malaba’s term in the initial case, argued that an appeal against the declarator suspends the operation of the judgment and has asked the High Court to find Chief Justice Malaba in contempt and jail him for six months.

The matter was adjourned to the afternoon, but before it could be heard, Chief Justice Malaba’s lawyer Advocate Lewis Uriri, together with Ziyambi’s lawyer Thembinkosi Magwaliba, and JSC lawyer Addington Chinake immediately made an application for leave of appeal against Justice Chinamhora’s recusal.

Uriri represented President Emmerson Mnangagwa when opposition MDC Alliance leader Nelson Chamisa challenged the Zanu-PF leader’s victory in the July 30, 2018 presidential election. Chief Justice Malaba presided over the case and ruled in Mnangagwa’s favour.

The lawyers argued that a decision had already been made by the appointing authority to the effect that a three-judge panel should hear the matter.

“The proceedings of the chambers are not part of the hearing. They are just incidental proceedings which do not have an effect because they are not substantial proceedings. The appeal had prospects of success,” Uriri said.

Magwaliba also argued that the recusal of Chinamhora would affect the rights of his client, Ziyambi, as a litigant if the judge does not return to the bench to constitute a three-judge panel, which would form a quorum before the matter was heard.

However, Kika’s lawyer Thabani Mpofu argued that there was no prejudice to Chief Justice Malaba, Ziyambi or the JSC if the matter was heard by two judges given that ordinarily, such matters could be heard by a single judge.

“This is a piecemeal appeal. Piecemeal appeals ought to be dismissed by the court. One member of the High Court is properly constituted. There is no merit in the application. Its prospects for success are zero. This is a properly constituted court. This application is vexatious and meant to waste time,” he said.

“There is a tendency of forum shopping and I urge the court to frown on that. Regrettably, it gives the impression that the Executive is protecting the first respondent (Chief Justice Malaba).”

In her ruling, Justice Tsanga in concurrence with Justice Chirawu-Mugomba dismissed the appeal saying it had no prospects of success. She said they had consulted the appointing authority, JSC, which gave them the go-ahead to hear the matter as a two-judge panel.

“The process of approaching a judge in the chambers can’t be divorced from the hearing of the application for leave to appeal to the Supreme Court. The recusal of the judge (Chinamhora) from the panel is part of the proceedings. We have come to the decision that the application for leave of appeal to the Supreme Court is dismissed because it has no prospects of success and it is hereby dismissed,” Justice Tsanga said.

During the court proceedings before the two-judge panel, Kika’s lawyer Mpofu argued that Chief Justice Malaba was in contempt of court because the order which was granted by High Court judges, Justices Happias Zhou, Edith Mushore and Jester Helena Charehwa, three weeks ago, was a declarator which could not be suspended by the noting of an appeal by Ziyambi and Machaya.

“The declarator barred the first respondent (Chief Justice Malaba) to exercise the duties of a Chief Justice as he had ceased to be one when he turned 70 years. He complied with the order for the first 10 days, but what he has done after the 10 days is in contempt of court,” Mpofu submitted.

He said Ziyambi’s appeal filed on May 27 did not solve the matter. “If the minister’s appeal had solved anything, he couldn’t have filed an appeal. I submit that by seeking shelter under the minister’s appeal, he was in contempt
of court,” Mpofu added.

In his submissions, Uriri said Chief Justice Malaba did not commit any offence as the declaratur had been suspended by the noting of appeal by Ziyambi.

“He noted his own appeal because the full judgment was only availed on May 27 with all the reasons. That’s why he had to file his own appeal after seeing the reasons. The declarator is not a declarator because it can only be a declarator if it’s pure,” he said.

Justice Tsanga then quizzed him in relation to his assertion that the declarator was impure. “Sorry, I don’t like to use this example, but I want clarity. Are you saying cocaine is not cocaine unless it’s pure?” she asked. Chinake argued that the declarator had not taken away the right of Chief Justice Malaba to be heard.

“He has an absolute right to be heard through an appeal and an appeal suspends the declarator order. So, the first respondent (Malaba) didn’t commit any contempt of court crime,” Chinake said.

The proceedings dragged on up to 5:45pm when the two judges then reserved judgment to next week. Meanwhile, Deputy Chief Justice Elizabeth Gwaunza yesterday swore in six former High Court judges as Supreme Court judges.

The six are Justices George Chiweshe, Alpheus Chitakunye, Samuel Kudya, Felistas Chatukuta, Joseph Musakwa and Hlekani Mwayera.

Justice ministry secretary Virginia Mabhiza said among other duties, the newly sworn-in judges would play a pivotal role in assisting the justice system in the country to clear outstanding cases at the Supreme Court.

“This is a very important event in the Judiciary calendar and this is a constitutional requirement. The newly-appointed judges will help in clearing cases at the Supreme Court and make sure that cases are heard on time,” she said.

Ambulance crash leaves 5 dead. The two-tonne truck was travelling towards Harare from Kariba and the accident happened near Bufallo Downs. Police spokesperson Assistant Commissioner Paul Nyathi confirmed the accident, adding that the victims included a nurse, two patients, an ambulance driver and a relative accompanying one of the patients.

A Karoi District Hospital ambulance driver, nurse and two patients died on the spot while another passenger died later after an ambulance they were travelling in collided with a truck along the Harare-Chirundu Highway on Wednesday.

The deceased are Laurence Lundu (39) the driver, Marjury Matutu, a nurse, and the two patients Patricia Murisa (18) a pregnant woman and Tichaona Matashu (47).

The patients were being transported to Chinhoyi Hospital for treatment. Nyathi said the fifth victim, who was unidentified died while being transported to Harare for treatment.

“The ambulance encroached onto the lane of an on-coming truck, which tried to avoid a head-on collision by moving to the right, but the twotonne truck was hit by the ambulance,” Nyathi said. He said the driver of the truck, Ryan Murembe from Harare fled from the scene after the accident, while two passengers in his truck sustained injuries and are receiving treatment at Karoi Hospital.

MDC A Defectee Lillian Timveos appointed PetroTrade board member. Timveos, who served as Midlands senator under the MDC Alliance before she was recalled by the Douglas Mwonzora-led MDC-T, will now sit on the PetroTrade board chaired by lawyer Tino Chinyoka and deputised by Zanele Dube.

Former MDC Alliance deputy treasurer Lillian Timveos was yesterday appointed board member for PetroTrade a few months after she defected to the ruling Zanu-PF party.

Other PetroTrade board members are Simba Mhuriro, Gladys Mumhure, Ferida Matambo, Getrude Marabada and Godfrey Ncube.

The MDC Alliance said Timveos’ appointment did not come as a surprise to them as every defector from the opposition to Zanu-PF was rewarded shortly after their exit.

Former MDC-T vice-president Obert Gutu was also recently appointed to the National Peace and Reconciliation Commission after he ditched opposition politics. “Zanu-PF abuses State resources and it is not surprising that they will appoint people like Timveous as a reward for joining them,” said MDC Alliance deputy party spokesperson Clifford Hlatywayo.

“State institutions and bodies must be independent and board appointments must not be seen as the extension of the failed party. There is no independence of institutions in the country.”

But Timveos told NewsDay: “These are sour grapes, the MDC Alliance is finished. It is a confused bunch and who follows such a party that has let Zimbabweans down? Their in-house fights have spiralled out of control and they have rendered the opposition useless.”
