ED’s administration closely monitoring Chamisa and Hichilema’s relations. Nelson Chamisa has been friends with Hichilema when the latter was also in the opposition before defeating Edgar Lungu in last year’s election.

The NewsHawks have reported that President Emmerson Mnangagwa’s administration is closely monitoring Nelson Chamisa, the leader of opposition Citizens Coalition for Change and Zambia’s president Hakainde Hichilema’s relations

Following his victory, there were fears that the wave of change might spread across the region, a development that could prove costly to conservatives and former revolutionary parties in the region which include ZANU PF and ANC in South Africa.

The NewsHawks reports that President Mnangagwa is one of those worried sick and scared stiff of a potential major geo-political and electoral shift in the country amid reports that Chamisa held meetings with Hichilema twice inside five months.

This comes as veteran Kenyan opposition leader Raila Odinga, who is also close to Chamisa, is believed to have high chances of winning elections scheduled for 9 August.

The NewsHawks was told that Mnangagwa became very attentive since Hichilema’s invitation to Zimbabwe’s opposition leaders, to his inauguration. An intelligence source told the NewsHawks:

Since HH (Hichilema) came to power, the intelligence has been working hard to establish the nature of their relations and whether it involves financial support. Their worry is on various fronts: diplomatic, political and geopolitical.

Diplomatically, the issue is whether this won’t damage relations between Zambia and Zimbabwe; politically if HH supports Chamisa and his CCC, and in geopolitical terms how this will influence relations between the two countries and power relations in the region.

Bluntly put, Mnangagwa is worried that HH may fund Chamisa and influence the outcome of the 2023 elections, mainly the presidential poll.

When Chamisa flaunted his close relations with Hichilema, saying he had called him after his victory, Mnangagwa came out to claim that he was a friend to the Zambian leader and his wife, in fact, a relative.

Passion Java announces divorce with wife Lilly. Passion Java who leads the Kingdom Embassy posted on his official Facebook page Wednesday afternoon and promised to give more details on Thursday.

United States-based flamboyant preacher, Prophet Passion Java and his wife Lily have decided to go their separate ways after a year living separately, Java claimed.

He said: Ndineurombo kukuzivisai kuti divorce yangu namai mwana has been approved, takasiyana Gore richitanga Saka ndakugara mu Zimbabwe, Tomorrow around @5pm zim time ndichakupai video yakakwana!!!” (I am sorry to let you know that my divorce with Lily Java has been approved, we separated at the beginning of 2020.

I now reside in Zimbabwe. I will give you more detail tomorrow around 5 pm.) Java got married to Ethiopian-born Lily Tsegaye in Jamaica in 2016. This comes barely a week after Lily posted on Instagram confessing her undying love for Passion. She said:

Some believe this could be a publicity stance. One Hon Rodwell Tendai Nyika, responded to the comment suggesting that Java was an attention seeker. Nyika said:

The velocity at which you seek attention provokes intense vomiting.If surely beyond your usual histrionics you are now divorced who really do you think would really get disturbed. Our conscience deserves better things like making sure that your political godfather Mnangagwa relinquishes power while Zimbabwe is still on death bed. After all, you proved for long to be childishly childish not to be anyone’s father !!

Another commentator, Martin Chipoka, said: WRITING IN SHONA JAVA KNEW THAT LILY WOULDN’T UNDERSTAND. THIS IS A PUBLIC STUNT TO DRIVE PEOPLE AWAY FROM FOCUSING ON YESTERDAY’S POST. BE WARY

This comes when prominent journalist, Hopewell Chin’ono has castigated the flamboyant preacher whom he calls “a fake prophet” saying they should focus on real-life issues including the fight against corruption which he says is responsible for the economic downturn in the country.

Tendai Biti challenger speaks: The struggle for youth emancipation is won now. Precious Musarurwa, who is also an actress, said now is the time to push forward a generational mandate, which is taking up responsibility by all young minds.

Musarurwa, the Secretary-General for the Labour Economists And African Democrats (LEAD) and an aspiring Member of Parliament for Harare East Constituency has said “the struggle for youth emancipation is won now.”

She said the ruling ZANU PF and the other parties that have been in existence for over a decade had failed the citizenry and the youths in particular hence the need to entrust the youths’ future in youths.

Musarurwa will be battling it out with former Finance Minister Tendai Biti who now represents the Citizens Coalition for Change after he was recalled from Parliament by MDC-T.

Musarurwa bemoaned the level of polarisation in the country saying it was hindering unity amongst youths who instead should be united by the fact that they are all fighting for a better future. She added:

I observe and learn from how the regime has managed to keep the opposition in a vulnerable position, which we witnessed during the GNU that had ZANU PF with an upper hand over the MDCT; let alone the support many Zimbabweans gave approving the beginning of the second republic. 2018, then marked the rebirth of what they term, ‘The New Republic’.

The civil unrest that followed the 2018 elections due to ignorance by political parties resulted in the loss of lives and a vandalized city in particular Harare CBD and a Monthlante Commission that never yielded the much-expected results left many wondering if justice can be delivered against the perpetrators of political violence of 1 August 2018 shootings.

There is anger amongst Zimbabweans, disunity and mistrust as can be attested on social media i.e Twitter and Facebook platforms. But we are forgetting one thing, that we can face each other in opposition because each one believes they can serve better. It is this democratic environment we wish the government to create for us.

As young people we must realize the time is now to choose inclusivity in all democracy initiatives, economic developments, depolarization programs and in our devolutionary approaches as we change our grassroot survival trajectory as LEAD. We need to work together to take this responsibility and action for our communities, our constituencies and wards.

Musarurwa added that her party, LEAD, has consulted with the general populace before coming up with farreaching and sustainable development solutions that are premised on solving issues bedevilling the nation. She spoke narrowing down to her constituency:

I’m talking about localisation, ‘do-it-ourselves’ solutions to sustainability range from civic energy communities to sustainable housing projects and eco-villages; community currency, fresh food and modern market spaces.

She said one of the best ways of addressing current issues is standing firm against corruption, “together, with the same kind of energy.” Added Musarurwa: When I spoke with war veterans on 21 July 2016, regarding their standing on the then economic, social and political discourse, it was a timely conjecture.

I felt and knew I had to speak with them. The developments that followed will be coming out in parts during this campaign. Musarurwa said her party that is led by women, advocates for an all-inclusive approach towards a peaceful and reconciled nation.

#BBMzansi: Acacia eliminated

Following last week’s shock eviction of two housemates, this week’s Big Brother Mzansi saw Thando ‘Acacia’ Mati eliminated from the competition, much to the relief of the remaining Housemates.

Speaking to host Lawrence Maleka after her eviction, Acacia said she was sad but excited to see her daughter again. “It’s been very hard to shut out that part of my life.”

About her time in the House and her image as more of a boys’ girl, she said: “I tried to steer clear from the ladies and be more with the gents, and I guess that was also just a problem.” Regarding her several rivalries and tensions in the house, Acacia said: “I am generally a [confrontational person]. Addressing things gives me peace.”

The 30-year-old model from Soweto also addressed her flirtatious vibes with fellow Housemate B.U., and particularly the realisation that she wasn’t the only lady in the House he was hitting it off with. Acacia explained, “I was really mad about it, but I felt better once I addressed it, because I’m that girl.”

Also, up for eviction this week were Mphowabadimo, Nale, Zino, Themba, and newcomers Vyno and Nthabii. Both Acacia and Mphowabadimo were up for eviction for the second week in a row, with Head of House Sis Tamara saying that the evicted Acacia had “forgotten why she [was] on the show”.

Deputy Head of House this week was Yoli. This week’s eviction brings the remaining number of Housemates to 16. This follows a dramatic week where tension started showing between Housemates, from potential romances gone wrong to some Housemates giving each other the silent treatment.

But not everything was drama, a genuine romance bloomed in the house, Vyno and former Head of House Terry coming out as a couple, the first official lovers on the show.

With another week down, we’re getting closer to the R2-million grand prize for the Big Brother Mzansi season 3 winner. Viewers can also win R20,000 in prizes each week.

President Mnangagwa: We can’t grow our economy on the basis of a Foreign Currency. Zimbabwean President Emmerson Mnangagwa has said the Southern African country cannot grow its economy on the basis of a foreign currency which it does not have control over.

He made the remarks on Saturday while addressing dozens of ZANU PF supporters at a rally held in Epworth to launch the party’s campaign for the March 26 by-elections. Mnangagwa said:

We know that there is no country that prospers without their own currency. We are on that path. We are supporting our own currency which will help to grow our economy. We cannot grow our economy on the basis of a currency which we have no control upon. So that’s where we are going.

His remarks come as government workers including teachers are demanding the restoration of their 2018 salaries that were United States Dollar-denominated.

Some teachers have refused to report for duty since the resumption of schools on the 7th of this month saying they are incapacitated. They are demanding US$540 which they were being paid in 2018.

Reacting to Mnangagwa’s speech, Robson Chere of the Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ) said the president is clearly “carefree and indifferent on the plight of teachers.” Added Chere:

We will resist any attempts by any means necessary, even by the highest office, from stopping us to demand a living wage. We will continue mobilizing teachers get the USD so that teachers can actively participate in this economy.

Progressive Teachers’ Union of Zimbabwe (PTUZ) Secretary-General, Raymond Majongwe echoed Chere’s remarks adding that while the government was choosing not to pay teachers in U.S. dollars, the government is charging in U.S. for every service it is providing.

Zimbabwe was using a multi-currency regime from 2009 until 2019 when the Zimbabwe dollar was reintroduced and declared the sole legal tender, for some time. The local currency has steadily lost value, effectively reducing workers’ wages.

Prosper Chitambara, a senior researcher and economist at the Labor and Economic Development Research Institute of Zimbabwe says high inflation is the reason why teachers are not interested in the local currency.

Drama and chaos as Chimutsamapfihwa clashes with husband’s new wife. According to Shona tradition, Chimutsamapfihwa is a woman’s younger sister or niece who is offered to her husband upon her death.

A Mutare woman who was offered to a widower as his “chimutsamapfihwa” is now fighting with her uncle-come-husband’s new wife.

The contention between the two women came to light at Mutare Civil Courts last week on Thursday when the chimutsamapfihwa, Elizabeth Makate, applied for a protection order against Mercy Kamangaise, accusing her of taking away her husband.

Makate told the court that she went to replace her late aunt five years after her death, only to discover that the man (name not revealed in court) had remarried.

Makate and Kamangaise appeared before Mutare magistrate, Xavier Chipato. Makate pleaded with the court to bar Kamangaise from meeting with her husband. She said:

This woman is very persistent. She visits my husband every morning before he leaves for work intending to prepare breakfast for him. She calls him unnecessarily and visits him even at midnight.

I feel she is harassing my husband because I have never seen him entertaining her.
Whenever I ask him about their relationship, he tells me that she is an ex-girlfriend he had after my aunt’s death.

I want her barred from communicating with him. He is my husband and mine alone. When she was asked why her husband had not applied for the protection order if he was against Kamangaise’s actions, Makate had no answer.

In her defence, Kamangaise said she got married a year after the death of Makate’s aunt. She said she and her husband have already built a rural home in Odzi, where she lives.

Kamangaise insisted that she was not aware that her husband had been offered a chimutsamapfihwa, saying had she known that, she wouldn’t have married him. She said:

Since my husband and his late wife had children, we agreed that I would not live at the Dangamvura house as it belongs to their children. We built a rural home and I live there. When I come to the city, I stay in Hobhouse where he rents me a house.

Kamangaise claimed that when the Makate family learnt that their rich son-in-law had married a new wife, they decided to offer him Makate. She added: This is causing chaos because Elizabeth does not want to share the husband, yet I was married for five years to this man before she came into his life.

She came to our rural home and destroyed my property. She removed some of my personal stuff from the bedroom, but I never complained. In fact, I respect her as a co-wife. She should continue staying at her aunt’s house.

She should just accept me as a senior wife as I was married before her. The magistrate granted a binding over protection order to the two women.

Chipato ordered Kamangaise and Makate not to disturb each other’s peace. He, however, did not bar Kamangaise from visiting, calling and talking to her husband.

19-year-old student impregnants 28-year-old married home teacher. According to the disturbed man, identified as Richard Nana Sam, his teenage son has also admitted to impregnating his teacher.

A Ghanaian man is in a state of dilemma after a 28-year-old home teacher he employed to teach his 19-year-old twins (male and female) said she is pregnant for the male one.

He added that the female teacher disclosed the development to him in a bid to seek his permission to get married to his son who is still in school.

He took to the Ghanaian Facebook page Tell It All to narrate his ordeal and sought advice on how to handle the quagmire. “Hello family, please I need your advise because it’s difficult to handle this issue.

“I have 19yrs old twins (a boy & a girl), I wanted a home teacher for them because I don’t want a male teacher who might make advances on my daughter so I opted for a female teacher who is 28yrs.

“This teacher is very good and very nice to my children. She’s made my children addicted to books, now my children’s academic performance is very very good. Infact I’m very happy to have her as my children’s home teacher. My children can now speak English and French frequently.

“Beloved, after 8months of teaching my children, the teacher oneday came to inform me that she is 3months pregnant for my son of which my son also accepted the pregnancy is really his. She says she in love with my son so I should allow them to marry.

“Family please I need your advise because I’m going nuts now. I can’t think far,” Richard Nana Sam wrote. His post has triggered mixed reactions as some members of the Facebook page accused the home teacher of abusing the teenager and advised that he takes care of the pregnant woman and allow the son to continue with his schooling.

While some people are opposed to the pregnant teacher marrying the young man, others disagree, wondering what the advice would be if the teacher was a male and impregnated the female of the twins.

“My father had the same problem but our parents stayed together. “I have been to churches, prophets and even to a men’s clinic but nothing has worked.”

He said some women have noticed he has a problem and they get into a relationship to milk him. “There’s nothing more hurtful than to see that you can’t satisfy a woman. I don’t feel like a man,” he said.

His sister said they were surprised when his marriages failed. “He had beautiful weddings and we celebrated, but three years down the line the marriages fell apart.”

“When I sat down with him and asked him why all his women left him, he started crying.

“He told me he can’t satisfy a woman and this makes them leave.” The man is appealing for help to grow his 4-5 so he can satisfy women.

ZEC accused of moving 170k voters from their original constituencies

ZEC accused of moving 170k voters from their original constituencies. The move is seen as being deliberately aimed at affecting the outcome of the elections. Activists, Team Pachedu, an opposition political activism online group, expressed concern over the development, saying ZEC was illegally changing electoral boundaries without notifying voters as stipulated by the law.

The Zimbabwe Electoral Commission (ZEC) has been accused of moving 170 000 voters from their original constituencies and wards ahead of the March 26 by-elections. Critics say the move could disenfranchise many voters.

Team Pachedu said a total of 170 867 addresses that were in the 2018 voters roll have been edited by ZEC between 2018 and 2022, with Glen View South having the highest number of edited addresses (19 758), followed by Mangwe, Lupane East, Zaka East, Luveve, Kuwadzana and Chiredzi North. Said Team Pachedu:

Zec has also moved many people from Glen View South constituency to Harare South constituency. The mass movement of voters across constituencies and wards when addresses have not changed implies that Zec is illegally changing electoral boundaries.

One typical illegal movement involves hundreds of voters from Zvimba East to Glen View South (Chirangano Car Park Tent).

For multiple voters in Chitungwiza South constituency, Zec has changed their former 2018 wards, yet their residential addresses have not changed at all. Who did Zec inform before making these sweeping changes in wards as required by the law?

After the 2018 elections, Zec created new polling stations and some of them are 6301HRE2807 C, Glen Norah (728 voters), 6301HRE3103 C, Glenview South (671 voters), 6301HRE3202 C, Glen View South (669 voters) and 5801KWE1402 C, Kwekwe Central (669) without informing anyone as required by the law.

ZEC chief elections officer, Utoile Silaigwana, said citizens or organisations affected by the changes should approach ZEC district offices. He said:

Can we see the claims because we haven’t received any complaints to date? You are very aware that the voter registration exercise is still underway, and so we can only have the correct information when it has been completed.

On its official Twitter handle, Zec said polling stations are allocated according to proof of residence provided by the voter. The commission added that a voter has an option to transfer his/her registration to an area of preference provided they submit the requisite documents.

Zimbabwe Election Support Network (ZESN) board chairperson, Andrew Makoni, said the trends were worrying as it could disenfranchise voters. Makoni added:

Yes, it disfranchises voters as many will fail to vote because their wards have changed. Only Zec can provide the reasons why some voters may have been moved from one constituency to the other, and in this case from Glen View to Harare South as alleged.

Makoni also echoed ZEC’s remarks that it is possible for a voter to change his ward or constituency adding that they have to be the ones approaching ZEC seeking a transfer.

Election Resource Centre (ERC) programmes manager Solomon Bobosibunu said they were analysing the voters’ roll to establish if reports are accurate adding that ZEC cannot move registered voters without their consent.

ZEC has in the past been accused of being biased towards the ruling ZANU PF, allegations the commission refutes.

RBZ Governor John Mangudya defends withdrawal limits. This comes after criticism from stakeholders including a former finance minister, Tendai Biti, who said Mangudya was using the withdrawal limit to block access to the Zimbabwean dollar as a means to control inflation.

Reserve Bank of Zimbabwe governor John Mangudya defended bank withdrawal limits announced on Monday last week, saying the new levels were above average formal sector salaries.

Florence Taruvinga, the president of the Zimbabwe Congress of Trade Unions (ZCTU) said the increase was insignificant. She said: The nominal increase, while welcome, is not adequate as the percentage increase is below the annual inflation rate, which implies that in real terms there was no increase.

Exports and remittances have increased quite markedly over the period, 2020 to 2021 for instance, exports rose from US$3.7 billion in 2020 to US$6.2 billion in 2021, while remittances rose from US$1 billion in 2020 to US$1.4 billion in 2021.

Mangudya set new mobile banking limits per transaction of ZW$25 000 and ZW$10 000 for person-to-business and person-to-person transactions, respectively. Previously, the limits were ZW$20 000 and ZW$5 000, respectively.

The maximum limit for individual-to-business transactions was set at ZW$100 000 per week while the person-to-person transfer limit was set at ZW$70 000 per week.

Speaking at an event organised by the Zimbabwe Economic Society to review the MPS, Mangudya said in arriving at the limits, the bank was informed by average salaries. He said:

We were of the view, and we are still convinced, that the figures which are there are quite high. If you look at the average salaries in Zimbabwe, they aren’t all that high.

How many people are earning more than ZW$50 000 or ZW$60 000 in the general economy? They are not as many as you think they are. So, we looked at the general salaries in the market.

He said ZW$100 000 is equated to US$417, using a parallel market rate of US$1:$240. A salary of ZW$50 000 or ZW$60 000 translates to US$208 or US$250, respectively.

Mangudya added that RBZ will be monitoring the numbers and adjusting the limits accordingly. He said the limits were also meant to limit foreign currency parallel market activities.

While the new limits were based on average salaries in the formal sector, about 60% of Zimbabwe’s economy is now in the informal sector, which is rarely considered in government planning.

Opposition parties remember late ex-Prime Minister Morgan Tsvangirai. Opposition MDC-T led by Senator Douglas Mwonzora has announced that it will this afternoon host an annual lecture in remembrance of former Prime Minister, the late Morgan Tsvangirai who succumbed to cancer on the 14th of February in 2018.

Tsvangirai was a founding member of the Movement for Democratic Change (MDC), a party he led from 1999 when it was formed until 2018 when he died. In a statement, the party said:

President Morgan Tsvangirai passed away on 14 February 2018. Honouring his memory, we will host the annual Morgan Tsvangirai Memorial Lecture at MRT House tomorrow (Monday). We shall forever preserve his legacy.

Morgan Tsvangirai’s political career began with his election as the Secretary-General of the national trade unions umbrella body. During this period, the movement criticised the government’s failure to improve the lives of the workers and this placed Tsvangirai in the political limelight.

Tsvangirai had earlier on joined active politics in 1987 and 1989 after leading a series of strikes against the ZANU-PF government’s tax increases when he was the Zimbabwe Congress of Trade Unions Secretary-General.

Another opposition party, Citizens Coalition for Change (CCC), which morphed from MDC Alliance early this year, described Tsvangirai as a champion of democracy.

Headmaster fired over Grade 7 exam scandal. Benjamin Muridzo was sacked from his job at Masuka Christian Junior and High School in Whitecliff. The pupil is now failing to get a Form One place.

A privste school headmaster has been dismissed after allowing a Grade 7 pupil to sit for an examination using another pupil’s birth certificate.

Muridzo told H-Metro he has been replaced and referred questions to the school administrator. “I am no longer eligible to comment on that issue because I have since left the school,” said Muridzo.

“Get hold of the school administrator for more information,” he said. School owner, identified only as Masuka, confirmed the matter but was furious with H-Metro for seeking comment from the new headmistress.

“I do not entertain the media, go and write whatever you want, “ said Masuka. “Why did you disclose that matter to the headmistress first? “After all, this is after hours, we are closed so you better leave our place.”

The pupil’s parent, Mai Murisa, narrated her ordeal. “I asked the school to help me get my child’s results but they said they cannot help me,” she said.

“I wanted to secure a place at other schools but the discrepancy on the results slip is making it difficult. “I need help from the Ministry of Education.” The pupil got 25 units.

Serial rapist sentenced to 18 years jail. Allan Makoni (22), of Witchwood Farm, appeared before Chinhoyi magistrate, Ignatius Mugova, charged with two counts of r@pe.

A Chinhoyi man, who r@ped a juvenile twice, has been jailed for 18 years. He was found guilty.

Six years of his sentence were suspended on condition of good behaviour. Makoni will serve an effective 12 years behind bars.

Prosecutor, Nyasha Sibesha, told the court that some time in August 2019, the 11-year-old juvenile was sleeping in a hut, with her younger brother, when Makoni entered their room.

He then r@ped her and promised her a drink should she not reveal the matter. On the second count, on September 14, 2019, Makoni r@ped her again. Makoni gave her three sweets.

Teen injured in hit-and-run incident

Teen injured in a hit-and-run incident. The motorist, who was driving a Toyota Wish, then sped off after hitting the boy, aged 17, and police are looking for him. A teenager was on Tuesday injured in a hit-and-run incident in Chitungwiza after he had confronted the motorist for parking his vehicle in their maize field.

Police said the victim approached the motorist and asked him why he had parked his vehicle in their maize field and an argument arose. He was then hit by the speeding car with the victim sustaining serious injuries.

A report was then made to the police. National police spokesperson, Assistant Commissioner Paul Nyathi, confirmed the incident.

“The ZRP is investigating a hit-and-run in which a victim, aged 17, was hit by a motorist who was driving a Toyota Wish after he confronted the motorist for parking the vehicle in his maize field in Chitungwiza on January 8, 2022.

“The victim sustained some serious injuries and was referred to Chitungwiza Hospital for medical attention,” he said.

Meanwhile, ZRP confirmed the arrest of a legal practitioner, Burukai Muchadzireva (42), in connection with a case of fraud, which occurred between December 12 and 20 last year, in Chinhoyi.

“The complainant reported that the suspect fraudulently withdrew $102 439,20 from the complainant’s sister account after he was given the ATM card to settle legal fees amounting to $41 059,23,” Ass Comm Nyathi said.

“The police is also investigating a robbery case in which a 33-year-old Norton man was robbed of a Mercedes Benz C200 vehicle, A20 Samsung cellphone and US$180 cash, at the 35 km peg along the Harare-Bulawayo Rd.

“The complainant offered a lift to three men and a woman at Dzivarasekwa turn-off, Harare. Along the way, the suspects produced two unidentified pistols and threatened to kill the complainant while demanding cash.

They stole the complainant’s valuables and cut the seat belts of the vehicle before tying him to a tree in a bushy area at Hunyani Bridge. “They then drove off in the complainant’s vehicle towards Harare.”

Pastor drags Justice Minister Ziyambi and AG Machaya to court. Chivhu-based cleric Abinel Mukaro is challenging Statutory Instrument 221 of 2020, which he says was unconstitutional as it infringes on his right to equal benefits from the law as well as his right to access courts.

Mukaro has dragged Justice minister Ziyambi Ziyambi and Attorney-General Prince Machaya to the High Court over “unreasonable” court fees, which he said impeded people from accessing justice.

In his founding affidavit, Mukaro said his wife died on September 12, 2021 after being severely assaulted by members of the Zimbabwe Republic Police (ZRP) stationed in Chivhu, and gave notice of intention to sue the police and proceeded to issue summons.

He said he was instructed to be ready to pay the Registrar of the Court 1% of the amount that he was claiming, which amounted to $10 266 for service of the summons.

“I cannot afford these fees due to my precarious financial position, but I believe I am entitled to have my case heard by the court and I do not believe or qualify to be represented as a pauper nor would I want to,” Mukaro said.

“I am advised that Ziyambi, in terms of section 57 of the High Court Act, fixes fees that are payable to the Registrar for issuing of process.

“The High Court (Fees) (Civil Cases) Regulations, 1992 published in the High Court (Fees) (Civil Cases) (Amendment) Rules, 2020 (No 11) entitles the Registrar to charge an extra 1% for issuing summons where the claim sounds in money.

This is in addition to the fees payable under item 1, which is $1 000. I believe that there is no basis or rationale, for charging the extra 1% as I am advised that the duties of the Registrar are the same in respect to actions whether sounding in money or not.

“I am advised that section 56(1) of the Constitution of Zimbabwe provides that ‘All persons are equal before the law and have the right to equal protection and benefit of the law’. I believe requiring me to pay 1% of the amount that I am claiming in a wrongful death action infringes and deprives me of my right to equal benefit of the law.” He said SI 211 of 2020 was, therefore, unconstitutional.

“I am humbly praying that the registrars entitlement to be paid 1% of a claim sounding in money be declared unconstitutional and that item 2 of item two of the High Court (Fees) (Civil Cases) Regulations 1999 published in the High Court (Fees) (Civil Cases) Amendment rules 2020 Statutory Instrument 211 of 2020 (No 11) be set aside,” Mukaro said. Ziyambi and Machaya are yet to respond to the application.

Report: Zimbabwean deportees not tested for COVID-19. This was revealed at the Zimbabwe–South Africa cross-border migration management stakeholders meeting held at Musina in South Africa last week.

South African officials have revealed that not all illegal immigrants, particularly Zimbabweans deported from the neighbouring country, are tested for COVID-19 before being sent back home amid concerns by human rights activists that some may have been infected by the virus while detained at Lindela holding camp in that country.

The meeting was attended by International Organisation for Migration (IOM) officials and various government departments and ministries from both countries.

“The South Africa authorities informed the Zimbabwean delegation that not all deportees are being tested for COVID-19 due to resource constraints. They are only testing suspected cases of COVID-19. Concurrently, the Zimbabwean authorities reported that a significant proportion of deported migrants were testing positive for COVID-19 upon presentation at a quarantine facility,” an IOM report read.

Stakeholders raised concern on the disparity between the two countries in terms of the validity of COVID-19 PCR test certificates, with South Africa requiring 72 hours, while Zimbabwe is at 48 hours.

“The Zimbabwean Ministry of Health authorities noted that the issue was a policy position which could not be decided at the meeting. They did note, however, that countries in the Sadc region needed to synchronise requirements in the region,” the IOM report added.

A Zimbabwean human rights activist based in South Africa, Nobuhle Ajiti, yesterday expressed concern that some of the inmates may have been exposed to COVID-19 at Lindela deportation centre.

“I was doing a follow-up on people who were directly affected by xenophobia. So I went as far as following those who were detained for non-documentation at Lindela, where some nationals are forced to do self-deportation. If you are Zimbabwean, you pay your own bus ticket to go home. Some are saying others die, they get sick until they die in centres because they are not tested when entering the holding camp,” she said.

Last month, the South African Department of Home Affairs deported 672 irregular migrants to Zimbabwe through the Beitbridge Border Post. Foreign Affairs and International Trade ministry spokesperson Livit Mugejo said government was aware of the plight of Zimbabweans at the Lindela deportation centre.

“In the case of Zimbabweans at Lindela holding camp, there is constant engagement between our mission and the South African Home Affairs ministry,” he said.

“As part of our effort to make sure that our people are treated within the confines of law, we make weekly visits to the deportation centre for the purpose of identifying and assisting our people. It is the Zimbabwean embassy in South Africa’s duty to make sure that all Zimbabweans are provided with necessary assistance.”

Mugejo said nearly 2 000 Zimbabweans, among them 527 deportees, were repatriated from South Africa under the assisted repatriation model.

“It was a pandemic intervention to help our people to come back home. What necessitated the repatriation were the hardships that our nationals were facing following the proclamation of the national state of disaster and the lockdown measures that were implemented,” he said.

Mugejo added that government was working closely with South Africa and IOM to facilitate safe repatriation of Zimbabweans from Lindela as the law does not allow deportees to stay beyond 120 days in detention camps.

He would not comment on the claims that some people died while detained at the holding centre.

Teachers blast National Joint Negotiation Council. TEACHERS unions yesterday accused the National Joint Negotiation Council (NJNC) of betraying their cause by consenting to a government pay deal which includes a 20% increment and a US$100 cash allowance to be converted from the local currency salary component.

Last Friday, civil servants representatives under the auspices of the NJNC met with government and assented to the new pay deal.

National Joint Negotiation Council (NJNC) statement: But teachers unions, that have been demanding that government must pay them the pre-October 2018 salary of US$540, accused the NJNC of sabotaging them.

Amalgamated Rural Teachers Union of Zimbabwe president Obert Masaraure said his members had not consented to the new salary offer.

“It seems that the NJNC was not representing the cause of teachers who are incapacitated. We do not recognise the NJNC, and are not going back to work until teachers are fully capacitated. The NJNC has betrayed the teachers’ cause,” he said.

Zimbabwe Teachers Association secretary general Goodwill Taderera said: “The NJNC consented to the government offer and we are their member. Teachers, however, will not be willing to return to work despite our representatives (NJNC) having consented to the offer. We will meet and decide whether it is prudent that our members should return for duty. Consenting verbally is one thing and reporting for duty is another. We will see if teachers will report for work on Monday (today).”

Progressive Teachers Union of Zimbabwe president said teachers were still incapacitated and had not agreed to the new salary offer.

“Even if teachers are willing to report for work, they are still incapacitated. The government must offer teachers a rescue package to afford them to report for work. We are still collecting members’ views on the issue,” he said.

Said Zimbabwe National Union of School Heads president Munyaradzi Majoni: “We are actually on an online meeting today (yesterday) to map the way forward for school heads.” Last week, government responded by suspending all educators that did not report for duty when schools opened last week.

Primary and Secondary Education ministry spokesperson Taungana Ndoro told State media at the weekend that investigations into the conduct of truant teachers had commenced.

“In a couple of days after investigations and disciplinary hearings, we will know the exact number of suspended teachers,” Zhou was quoted saying.

Meanwhile, in a statement yesterday, the Zimbabwe Nurses Association (Zina) said nurses were also considering taking a position if government continues to unlawfully suspend teachers that have declared incapacitation.

“We implore government to immediately revoke the unlawful suspensions issued to teachers, and invite not only to teachers but the civil service at large to the negotiating table to find a lasting solution,” the Zina statement read.

“Should it become clear that the government intends to proceed with the unlawful position, nurses in Zimbabwe will have to consider their position as we cannot watch our colleagues being punished for grievances we all share.”

Update: ZEC dismisses allegations of moving 170k voters. In a previous article published by Pindula News, Team Pachedu, an opposition political activism online group, said a total of 170 867 addresses that were in the 2018 voters roll have been edited by ZEC between 2018 and 2022.

The Zimbabwe Electoral Commission (ZEC) has dismissed reports saying the commission moved about 170 000 voters on the voters roll from their original constituency and wards in an endeavour to manipulate the outcome of elections.  In response, ZEC said:

The Zimbabwe Electoral Commission would like to dismiss allegations of rigging purportedly exposed by an analysis of a national voters’ roll requested by a political party as pure malice bent on diminishing the public’s confidence on the voters’ roll and the country’s electoral processes. The so-called analyses being posted on social media platforms are clearly targeted at confusing the electorate and tarnishing the image of the Commission.

The Commission wishes to make it clear that any voters’ roll that is requested in terms ofsection21(3) of the Electoral Act (Chapter 2:13) is a valid document as at the date of issue and is subject to subsequent addition of any new registrants or removal of voters because of death or disqualification.

Please note that voter registration and the maintenance of the voters’ roll is a continuous process in terms of section 17A of the Electoral Act Thus, the removal of deceased voters, duplicates and other malcontents is a continuous exercise necessary for the update of the voters roll in an effort to keep it accurate, complete and current.

The state of the voters roll is always very fluid save for cases where rt is deemed dosed for purposes of an election in terms of sections 26A and 121A of the Electoral Act, as the case may be, and in this instance, for wards and constituencies being contested on the 26 March 2022 by-elections whose voters’ rolls have already been closed and compiled.

The public should also know that the Commission has come across a few cases of several different people using the same national identity cards and sometimes, the same physical addresses to register as voters. Investigations have revealed that there are some people who engage in the illegal practice of giving their identity documents to relatives for use.

In some cases, the identity documents are stolen and used without the owner’s knowledge. The Commission’s Automated Fingerprint Identification System (AFIS) does not pock such anomalies since the fingerprints of the registrants are different because they are indeed different people sharing the same identity cards. However, when the Commission identifies such irregularities, it removes the entries from the voters’ roll and puts them on an exclusion list pending regularisation of the identities by the Civil Registry.

Regarding allegations of too many transfers, the public is hereby informed that the Electoral Law permits any voter who has become resident in another constituency or ward to transfer their registration to that constituency or ward upon production of their proof of identity and requisite residence documents. It is incumbent upon registered voters resident in that constituency or ward to object to the new registration if they feel that that is not the case. ZEC has no authority to deny a voter his or her right to transfer.

The Commission would like to state that the allocation of polling stations to registrants is purely determined by their proofs of residence presented to voter registration officers. Voter registration officers are not duty-bound to go and physically check whether

the details on the affidavits and other proofs of residence presented to them by prospective registrants are correct or not. It behoves on all eligible voters and other stakeholders to act in good faith in relation to all electoral processes and the public is reminded that an affidavit is a sworn statement and If one presents fake information on affidavits used as proof of residence, they commit an offence of perjury.

ZEC is not secretly changing boundaries as alleged by the so-called analysts and no boundary delimitation has started. Delimitation is a public exercise involving stakeholder consultations and it shall only commence after the conclusion of the national population census. The allegations are therefore unfounded and meant only to tarnish the image of the Commission and to mislead stakeholders.
