What do you do after you get HIV from your partner? There is a constant struggle in a relationship about whether one who should reveal their status to their partner or not. There are moral and legal questions on how one partner can intentionally infect the other with the virus.

HIV infection is still a sensitive topic in today’s society as well as relationships. In the case of one contracting a S.e.xually Transmitted Disease (STD), HIV included, one may be wondering what to do to next together with your partner and if there are any legal repercussions involved. Should be it be a criminal offence or a private matter to be dealt with in the civil courts

Recently, singer Tytan Nkomo revealed on a Youtube video that his ex-wife, socialite Olinda Chapel is HIV positive and that she deceived him about the nature of her status during the course of their marriage.

Tytan says he only discovered her positive status later and was so devastated that he had to take HIV prevention medication and is still testing regularly fearing for his health.

But do people know what to do after getting HIV from their partners? Here are some legal questions and answers that may help you.

Am I Required to Disclose that I Have HIV to My S.e.xual Partner?

Legally no, one has the discretion not to disclose their HIV status to their partner but ethically it is the right thing to do and failure to do so may result in a lawsuit and in some instances criminal charges.

What is the Penalty for Not Disclosing HIV Status to a S.e.xual Partner?

Worst case scenario there is no penalty unless it has been made a legal issue then lawsuits and criminal charges in some instances may results.

Can I Sue My Partner for Failing to Disclose His/Her HIV Status?

While it is possible to sue your partner for exposing you to HIV it can be challenging as the onus rests on you the plaintiff to prove your case to the courts and most of that will have to depend on the cooperation of the defendant where their HIV status is concerned.

Can My Partner Be Held Liable For Negligence?

Yes. Regardless of your state, if your partner knew he or she was infected with HIV and failed to inform you, the person may be sued for negligence. To prevail in a negligence case, you would need to prove the following:

Your partner knew he/she had HIV;
Your partner had a duty to inform you or duty to prevent the transmission of his/her STD;
This duty was breached; and,
As a result of the breach of duty, you contracted HIV.
In negligence cases, the plaintiff only needs to demonstrate that a reasonable person in the defendant’s position would have told his/her partner that he/she had an HIV before having sex.

Further, negligence does not require that the defendant had ill intent. In that regard, a defendant who used protection (ex: a condom) can still be found negligent and liable for compensatory damages to the plaintiff.

The S.e.xual Offenses Act of 2006 criminalizes infection of spouses with HIV or any other life-threatening s.e.xually transmitted disease. And the penalty is imprisonment for a term not less than 15 years in jail. The law also provides for life imprisonment for the guilty spouse.

Can I Sue Someone(My Partner) for Disclosing My HIV Status Without My Consent?

Scenario

My wife of 15 years has infected me with the HIV/AIDS virus. She confessed to me recently that she had an affair with a married man who passed on last month. She spilt the beans after I tested positive last week following my routine tests every six months. I am now devastated as we are strict Christians with three children below 13 years. I am annoyed with her and contemplating taking legal action against her. Is this possible?

Answer: Yes, it is possible for you to take legal action against the acts of your wife. Firstly, if you were married in Church, your wife’s self-confessed extra-marital affair amounts to adultery. Secondly, knowingly infecting you with HIV is criminal.

If you were exposed to HIV/AIDS and/or potentially contracted it, then you should check with your local state laws to see if your state prosecutes those who intentionally infect others with HIV. For the safety of others in your community, it’s important to find and stop any individuals who knowingly and purposefully expose or infect others against their will.

Woman beds sick hubby doctor. In a very disturbing development, a Harare woman is alleged to have had an illicit s.e.xual affair with her husband’s doctor at a time when he was in poor health. The nasty alleged infidelity details came to light at the Harare Civil Court where Nigel Kadziya had been hauled by his estranged wife, Believe Jokonya, for allegedly abusing her.

The court case which saw both parties trading accusations turned ugly after the adultery allegations emerged. Kadziya left the court shell-shocked when he exposed his wife’s bed-hopping shenanigans with his doctor. More shockingly, the illicit s.e.xual affair allegedly happened when Kadziya was ill. However, he did not reveal before the courts what he was sick with at the time the affair started.

‘She has lied your worship, Believe was having an affair with my doctor when I was sick. She left the house on December 21, 2019 and in the 29th. Jokonya hired someone to remove our solar panel which was on the roof. She collected the rest of the property that was in the house and sold it. I was left with a television set.

Speaking before magistrate Glady’s Moyo, Jokonya stated that she had abandoned their marriage because she was being unfairly treated. ‘When I applied for maintenance, he assaulted me, insulted me and chased me out of the house saying we cannot live together.

Most of the time I would sleep outside with the children. I don’t have anywhere to stay. Our children are not even going to school because he cannot afford to pay their school fees. Kadziya threw stones at the house and damaged our property. He came home with a girlfriend and slept with her.

The presiding magistrate granted the protection order in the complainant’s favour and sternly advised both parties to share their property fairly under the law.

Unathi is finally back on radio and fans are loving it

Unathi Nkayi made her return to radio on Monday following a three-year hiatus. Mamela neh, I haven’t done this for three years, I’m going to call number wrong station’s number or name…get over it,” says Nkayi just a few minutes into her brand new show “Midday Joy” with Unathi on Kaya FM. Her day kicked off with chauffeur service from her home, courtesy of Kaya FM.

Dressed in MaXhosa by Laduma, the clearly surprised Nkayi is heard saying “What do I deserve this honour?” as she greets the gentleman and slides into the Maserati. I can’t believe this day is finally here…I’ve been picked up by my Kaya FM in a Maserati,” she says in between laughs.

As she’s driven to work for her first instalment of “Midday Joy”, Nkayi received a warm reception by seasoned broadcasters Thabiso Sikwane and David O’Sullivan. In a video posted on the station social media platforms, Nkayi is seen crying during the conversation with the duo as they continue to welcome her.

In response, she said:” It’s been a wonderful journey this past month, getting ready. I was in the Caribbean last week and bumping into so many South Africans and Afropolitan…saying ‘please don’t miss your flight, we really need to hear you on Monday”.

The clearly emotional Nkayi, added: ‘It’s been overwhelming to say the least and absolutely beautiful. I feel safe and it’s rare…it’s a rare feeling.

“It’s wonderful to know that I’m walking into a group of people who believe in excellence, live excellence, exudes excellence and are welcoming me with open arms. I said to Greg (Maluka) and Neil (Johnson) that all I want to do is make all of you proud and that’s all I want to do.

Veteran actress Rami Chuene and Mzansi’s all-time favourite starlet Natasha Thahane have bagged a new acting gig in a new BET telenovela. Entertainment commentator Phil Mphela revealed the exciting news on twitter today.

According to Phil, the telenovela is produced by Clive Morris production, who are the brains behind the show, Red Cake on SABC 2. The telenovela is called Isono – The Sin and it co-stars TK Sebothoma, Bohang Moeko, Didintle Khunou and Zolisa Xaluva.

Rami recently left Mzansi Magic’s hit soapie The Queen Mzansi and hinted that she was back in front of the camera. Although she did not divulge more details about her new character we are assuming it’s this one. Social media congratulated them on their new acting gigs.

Ginimbi embarrassed at the Nama Awards. Flamboyant businessman and socialite, Genius “Ginimbi” Kadungure endured a torrid time after he was barred by security from entering the National Arts Merit Awards (Nama)’s VVIP section on Saturday only to be rescued by the National Arts Council of Zimbabwe (NACZ) director Nicholas Moyo.

Ginimbi, who had endured a tough month that saw him being arrested twice for tax evasion and losing his mother recently, may have needed a time out to relax at the glamorous awards ceremony, but that was not without frustration.

The VVIP section is where dignitaries, among them guest of honour Youth, Sport, Arts and Recreation minister Kirsty Coventry and Moyo were seated as they followed proceedings of the country’s premier awards ceremony at the Harare International Conference Centre.

Dressed in a pair of jeans, Ginimbi arrived in the company of two men and a lady, but as they were about to walk into the VVIP section, they were denied entry by the security amid claims that the area was fully occupied.

The bullish Ginimbi and his crew resisted the security orders and had to endure about 20 minutes of waiting at the section’s entrance only to gain access amid reports of Moyo’s intervention.

Malaysia-based arts promoter Taona “TeeMak” Chipunza was also similarly embarrassed but unlike Ginimbi, he complied without much drama and sat in the VIP section.

Meanwhile, true to their promise, the new organisers of the Nama awards, Jacaranda Culture and Media Corporation (JCMC) staged an exceptional show full of glitz and glamour.

JCMC signed a five-year deal with the arts mother body to organise the Namas and they did not disappoint on their first assignment.

As a way of endorsement, arts observers have validated the event which they described as well organised unlike previous editions and even the selection of the winners did not raise much questions as has been the case of late.

Alpha Media Holdings the publishers of NewsDay, Zimbabwe Independent, Southern Eye and The Standard shone at the awards as NewsDay correspondent Tafadzwa Kachiko emerged winner in the Outstanding Journalist of the Year (Print) category.

On the music side, rapper T-Gonzi and Ishan of the Kure fame emerged as the biggest winners of the night, scooping two gongs apiece as Outstanding Male Musician of the Year and Outstanding Newcomer of the Year respectively.

The duo was again back on the podium for another gong for their duet, Kure which was voted Outstanding Song of the Year ahead of Ngaibake by Alick Macheso and Freeman, Mugarden by Winky D and Gemma Griffiths and Mweya Ndisesekedze by Mambo Dhuterere.

The dancehall “president” Winky D proved again to be the people’s favourite as he was voted for the People’s Choice gong. As a value addition to just a gong and a certificate in recent years, the awards winners will this year smile all the way to the bank with $10 000 after corporate support was secured.

The 19th edition of the awards, held under the theme, Taking It Back To The People, was hosted by South Africa-based Zimbabwean actor, television personality and voice artist Leroy Gopal along with actress Mbo Mahocs.

The awards were open, for the first time, to paying members of the public. A star-studded line-up that included sungura maestro Macheso, dancehall singer Freeman, Jah Prayzah, Vabati VaJehovha, Fusion 5 Mangwiro and Prudence Katomeni-Mbofana entertained the audience.

In her pre-recorded speech, Coventry saluted the creatives for their dedication to the growth of the sector.

“I am extremely proud that the sector, the creative culture industry is adding 6,96% to our Gross Domestic Product as a country and that is just the beginning,” she said. In an interview with NewsDay Life & Style on the sidelines of the event, JCMC founder Steve Zhao said their vision for Nama awards was for it to catch up with world standards.

“For the journey of Nama this is the new beginning, let’s take off from this start. Zimbabwe arts and culture have a very active life and the country has the potential that just need to be supported,” he said.

The second episode of Somizi and Mohale‘s reality show has revealed more extravagant details behind the preparation for their luxurious white wedding, which took place last month. Since the premiere of Somizi & Mohale: The Union on Showmax last Monday, fans have been on a journey to see their faves walk down the aisle at their wedding.

During their preparations, Somizi and Mohale sipped champagne at a hotel in Sandton, Gauteng, while viewing wedding rings worth up to R2.9-million.

The couple also reached out to President Cyril Ramaphosa to invite him to their wedding. We would really love for the president to arrive or be present at the wedding, not for us but to send the message to the entire continent and the world that it does not take anything away from having a president who treats and sees everyone for who they are.

Veteran Afrikaans singer Lance James dies

Veteran Afrikaans country singer Lance James has died at the age of 81, his long-term agent Lydia Winchester confirmed to TshisaLIVE on Monday afternoon.

Winchester said James was surrounded by close friends and family in his last moments.

“Lance, my friend, died this morning in a Johannesburg hospital,” she said.

She said the star had struggled with health issues and heart problems and was admitted to hospital several weeks ago. He later fell and broke his hip.

The musician, known to his fans as Big Daddy, was famous for his hits Dankie, Hoe Groot is U and Don’t Let The Old Man In.

Minister of defence Oppah Muchinguri descends on Mashonaland West. The All-powerful ZANU PF National Chairman Oppah Muchinguri will be landing in Mashonaland West this weekend amidst allegations that she is rallying ZANU PF supporters to buy into her faction.

A message sent by then Zimbabwe Liberation War Collaborators Mash West Chairman S. Madembo said, “The Mash West Provincial Executive will on the 7th of March 2020 host our Patron cde O.C.Z Muchinguri -Kashiri at a meeting to be held at Cooksey hall in Chinhoyi.”

Oppah will be accompanied by Pupurai Togarepi who was recently fired from the politburo for indiscipline and failing to follow party ideology and stance regarding corruption.

“Accompanying her is a delegation including The National Chairman Cde P Togarepi.” Madembo added. The meeting will also be attended Resident Minister for Mash West Province, Mary Mliswa-Chikoka, Zanu PF Mash West Province Chairman Ziyambi Ziyambi and the War Veterans MashWest Provincial Chairman C. Muoni.

There has been reports that Muchinguri is behind a new faction that seeks the ouster of Vice President Constantino Chiwenga to be replaced by the National Chairman.

It is not yet clear if the alleged faction has the blessing of President Emmerson Mnangagwa with some analyst saying he is playing both factions so that he remains powerful and safeguard his post.

Kadewere scored after just three minutes in their 3-0 win over Chateauroux in the French Ligue 2. “It’s always nice to be back on the field of play and scoring makes it more fun. Le Havre and Warriors striker Tino Kadewere says he is happy to score on his return from injury after missing out in the last four games.

“Sometimes injuries can affect the form that you have been in but if you work hard you will get your results. “My aim is to keep on banging goals as many as l can and maybe win the golden boot. “I just have to work harder and go back to where I am supposed to be,” he said.

Nine hours of torture for busted drug dealer

Nine hours of torture for a busted drug dealer. A 24-year-old man is nursing injuries he sustained after he was reportedly bashed and detained for more than eight hours in a botched drugs deal. …stripped naked, tied overnight

Tapiwa Mashingaidze was given a thorough hiding by the alleged drugs seller Tendai ‘Tenso’ Walani.

The incident occurred on Friday evening when Tapiwa was bashed after confiscating a mobile phone belonging to Tenso for allegedly selling him coarse salt instead of a drug called Crystal Methamphetamine. The case has since been reported as an assault charge under RRB 4334769 at Katanga Police Base and he was referred to Norton Hospital for medical examination.

Efforts to get a comment from Tenso were fruitless. “Tenso sold me coarse salt instead of crystal meth and I went for recovery. “I took his mobile phone before they followed and attacked me.

“They took me to their house where they tied me whilst I was naked. “Vakandirova rough, with an electric cable from 11 pm and forced me to sleep outside at the veranda of their house,” narrated Tapiwa.

Tapiwa said, he bought the fake drug for US$5. “I was apprehended at Katanga shopping centre by Tenso who was in the company of his friends. “They tied and beat me whilst I was naked, they even urinated on me, vachindisvipira.

“I wanted to recover my money since he had sold me fake drugs,” added Tapiwa. The matter came to light around 8am on Saturday when Tapiwa’s brother Takudzwa went to the house and found him tied whilst on the veranda.

Tamy Moyo on cloud nine after scooping NAMA Award. The 22-year-old faced stiff competition from Janet Manyowa and Ammara Brown who were vying for the same gong. Singing sensation Thamsanqa “Tamy,” Moyo says she was on cloud nine after winning the Outstanding Female Musician awards at the National Arts Merit Awards ceremony held at HICC.

In an interview with H-Metro, Tamy said she was excited after being nominated for the NAMAs. “I feel so excited to have won the award. “I am now feeling more encouraged to keep on working hard. “It is good to see that people have been acknowledging the work that I am doing,” she said.

Asked how she felt about winning in the category that her mentors were in, Tamy said:  “It is an honour and I was pleasantly surprised to be the winner. “Those two are incredible human beings and I really admire their work. “I feel so inspired to have been among them,” Tamy told H-Metro.

Tamy said that she did not expect the award for Outstanding Female Musician as she was up against the people that she looks up to in the music industry. Asked what she would say to encourage those that are in the music industry Tamy said the trick is staying true to yourself.

“It is very simple, one has to remain true to themselves and their music. “Keep doing your best, recognition or no recognition your time to will eventually come,” she said.  Tamy said that the secret behind her success was the Grace of God. “It is all about believing in God and believing that He sat aside a time for you to prosper.  “I am not the first to do it neither am I the last one to do it,” she said.

Tamy added: “With my mother as my manager there is that eagerness to work hard. “It is nice having her as my manager because she can be so tough is she needs to. “She is a hard worker and she pushes me towards greatness as she picks up after me to help me move forward.”

Alick Macheso salutes NAMA. Alick Macheso’s handlers reckon their camp still has plenty to offer after their chief dancer Selamane “Majuice” Mpochi walked to the winner’s podium at the National Arts Merit Awards held at HICC over the weekend.

Majuice won the Outstanding Male Dancer gong at the awards ceremony where he shrugged off still stiff competition from two dancers Tawanda Tanaka Fireyi from My Journey To The International Scene and Tichaona Chikara in Hero’s +. Majuice was all smiles as he saluted his boss Macheso for his contribution.

“I would like to thank my boss for giving me this exposure and I wouldn’t want to disappoint him. “I know there are many people who can easily replace me at Orchestra Mberiwkwazvo but I would like to remain dedicated to him and do my work diligently.

“It’s a task that I have taken upon myself and I will do my best to ensure that we keep the brand going onwards,” he said. Similar sentiments were echoed by Orchestra Mberikwazvo publicist Tich Makahamadze who accompanied Majuice to the awards ceremony before their show in Chegutu on the same night.

“This victory means a lot to us as a band and this is the first time a sungura outfit has won this gong which used to be a preserve of the elites. “The win means that sungura still has plenty to offer and we will continue doing our best,” he said.

Being one of the senior people in the band, Makahamadze urged Majuice to remain level-headed. “I know that that boy is happy but it is our duty as management to ensure that the man remains focused on his work.

“We will not let him get carried away as the victory means a lot for his career. “In fact, this victory means that he needs to continue working hard,” he added.  Meanwhile, Macheso who was clad in a 4 May designer suit had a good day in office when he thrilled fans during the opening stages of the awards ceremony.

He performed their duet Ngaibake along with Freeman and contemporary dancers and left fans in awe. To say their performance was polished would be an understatement. Maybe, magical is the right word to sum it all on a night when Zimbabwe showered him with love.

Aaron Chiundura Moyo imitates Passion Java’s tongues. Chiundura gave the individuals different roles in the play and among them was a pastor who spoke in tongues, imitating that of Java. The play which was performed featured a pastor in the drama play using Java’s popular saying “tokutsotsonya, tokutubuda, mahumba mahumba” among other phrases.

Novelist, playwright and actor, Aaron Chiundura Moyo, imitated Passion Java’s controversial tongues in his play staged at the National Arts Merit Awards ceremony.

The role thrilled fans as people screamed and laughed to the act. The whole play’s theme was about a pastor who had impregnated one of the church members.

The impregnated lady was a married woman and her husband gets the shock of his life after finding out the father of the newly born baby. It was during the labour time that the pastor was busy speaking in tongues in expectation of safe delivery from the woman whom he had impregnated.

Even after the husband learns about the truth, the pastor continued with his tongues’. At this time, the crowd was overjoyed by the act.

Drama, as man fails to pay thigh vendor, gets dragged n@ked in the streets – Video. Pedestrians were treated to a free drama in Arcadia Shopping centre as a thigh vendor embarrassed and dragged n@ked a client after they had an altercation overpayment of a quick s.e.x session they had.

In this case, a thigh vendor had to deal with the necessary measures that she saw fit after her client failed to honour their agreement. In a video circulating on social media, a thigh vendor is reported to have taken a cellphone of her client after the client failed to pay for the short time s.e.x session they had.

The thigh vendor said the client was offering short money the one which they had not agreed on. So she retaliated by dragging the man n@ked in the streets as people looked on. Watch the video below

Nkunzi’s rival Khathaza set to return to Uzalo

For the past few days, actor Sibonile Ngubane has been hinting that he might return to Uzalo.

This follows his abrupt departure late last year from the SABC1 popular soapie, in which he played the character of Khathaza, a psychotic serial killer who was after Nkunzi (Masoja Msiza).

In response to fans asking for the return of Khathaza, Sibonile took to Instagram and shared a video that revealed “ghost” is coming back.

“The ghost you’ve all been begging for will be on your screens. Nyweee Nyweee ‘Sibonile Ngubane is fired from Uzalo’ my foot,” he wrote.

In the video, the actor can be seen with on-screen enemy Masoja Msiza, who exclaims “Asikaqedi!” when telling fans about the return of Khathaza. This can be loosely translated to: “We’re not done”. Sibonile is set to appear on the 6th season of the show.

Speaking to Daily Sun, the soapie’s public relations officer Nomfundo Zondi was not forthcoming about whether the character will make a return to the show or not.

“I cannot confirm or deny whether he will be making a return to the show,” she said.

Even though it was not immediately established whether or not he met one of the suspected cases, he was seen shaking hands with the faithful and even kissed a baby.

He also greeted the visiting bishops even as the deadly Covid-19 continued to spread to other parts of Europe. “I wish, again, to express my closeness to those who are ill with coronavirus and to health-care workers who are caring for them,” he said. By Thursday, February 27, the disease had claimed 2,812 lives while 33,198 patients having recovered from the 82,526 reported cases worldwide. In Italy alone, at least 14 people have died from the initial 528 cases reported while 42 patients were said to have recovered. At least an additional 35 cases in the European nation remained critical.

In the wake of a front-page story published at the weekend in which musician Lady Zamar (Yamikani Janet Banda) claims her ex-boyfriend and fellow musician Sjava (Jabulani Hadebe) raped her, controversial musician and poet Ntsiki Mazwai has come out in support of Banda and vowed to block anyone who protects Sjava.

According to the report, the alleged incident took place in 2017 and Banda opened an official case against Hadebe late last year. This after she revealed to the public (prior to opening the case) that Hadebe had also allegedly physically and s-e-xually abused her during their relationship. Banda found herself trending alongside Sjava on social media on Sunday as many took to their preferred platform to share their views.

In the midst of it all, Mazwai declared: ” I’m blocking anyone who protects Sjava… I’m sorry I have no objectivity when it comes to rape. I stand by the victim. ALWAYS. Because when it happened to me it’s the ONLY thing I needed.

This was in reference to her own past experiences in which she alleges convicted rapist Brickz (Sipho Ndlovu) also raped her at a time when they were said to have been dating. She even compared Sjava to Brickz in a separate tweet.


Mazwai is not the only celebrity who came out in support of Zamar. She was joined by The Queen actress Zenande Mfenyana.
