Kasukuwere in Trouble for selling land to Prophet Walter Magaya and political bigwigs.

President Robert Mugabe yesterday took Local Government, Public Works and National Housing Minister Saviour Kasukuwere to task for reportedly selling land earmarked for youths housing to Prophet Walter Magaya and political bigwigs.

Prophet Magaya leads the Prophetic Healing and Deliverance Ministries that has pledged to build 20 000 housing units in Harare and Mutare.

This comes a few weeks after the President availed 1 000 hectares of land for residential development to youths in Harare as part of efforts to fulfil Government’s economic blueprint, Zim-Asset, which targets provision of 300 000 housing units by 2018.

The land is in Shawasha B, Norton and Harare South.

Youths — as exposed by our sister paper The Sunday Mail — have reportedly been muscled out of the project with most of the land going to Prophet Magaya and shelf companies belonging to political bigwigs, among them Minister Kasukuwere’s cronies.

President Mugabe, who a few days ago at the National Youth Assembly meeting in Harare slammed corrupt allocation of residential land, yesterday took Minister Kasukuwere to task over the shenanigans.

“Ko nyaya yevakomana yemastands iri kufamba sei?” the President asked before the start of the Politburo meeting.

“Ndakanzwa kuti mastands makatengesa, makatengesera ananaMagaya.”

Minister Kasukuwere responded: “No shefu. Vakanga vashaya zvekunyora. There is nothing like that. I am the responsible Minister and hakuna zvakadaro zvakaitika.”

Not convinced, President Mugabe retorted: “No, No, ndiri kunzwa kuti land yakatengeserwa ananaMagaya. Makatengesa, makatengesa!”

The land where alleged corruption has erupted is at Chishawasha B farm where youths were allocated 300ha of the 2 848,77ha that lies along Arcturus Road.

The offer, according to sources, had been withdrawn under unclear circumstances amid reports that some bigwigs were using shelf companies to mask their allocations.

As at July 26, according to documents from the Local Government Ministry’s State Land Management section, Chishawasha B had been allocated as follows: Udcorp 1 000ha; National Housing Fund 378ha; Harare youths 300ha; Homelink 200ha; Twinbag Investments, N-Frays Infrastructure, Farmtel Investments (Terrence Mukupe), Nettfields Investments (Pvt) Ltd and Mahlaba (Pvt) Ltd (100ha each); Elephant Trust (linked to a Cabinet minister) 70ha; and Zimshelter, Washtrom, Denrock Investments (Kudzai Chipanga) and Casewood (Tongai Kasukuwere) (50ha each).

It is understood that some of these firms are linked to Betty Kaseke, Sarah Mahoka, Innocent Hamandishe and Shadreck Mashayamombe.

Farmtel, Denrock, Casewood and Kaseke reportedly signed memoranda of agreements with the Local Government Ministry to develop the land on July 29.

Around that same time, Prophet Walter Magaya’s Planet Africa is said to have signed a memorandum of agreement with the ministry for 300ha.

Documents indicate Planet Africa paid a deposit of US$100 000 on August 10.

On August 17, Minister Kasukuwere withdrew all offer letters except for Planet Africa.

It is alleged that Planet Africa was subsequently offered land reserved for youths, with some quarters speaking of an “improper relationship” between the Minister and the Prophet.

Officials from Prophet Magaya’s Prophetic Healing and Deliverance Ministries have maintained that their transactions were above board.

The officials confirmed to The Sunday Mail that they had received 300 hectares in Chishawasha B adding that “we have paid deposit for that.”

On the other hand, Minister Kasukuwere dismissed allegations of impropriety, saying the priority list for Chishawasha B had youths, women, the Urban Development Corporation and Homelink.

He confirmed that some allocations were done wrongly and he “had to cancel everything.”

He claimed PHD was yet to get land and that the church was in discussions with Udcorp to that end.

One of the firms whose offer letter was withdrawn has written to Minister Kasukuwere’s ministry threatening legal action.

Part of the generic withdrawal letters read: “This ministry regrets to advise you that the offer of (number of hectares) of land at Chishawasha B Farm is being withdrawn with immediate effect due to other pressing needs for land in this area.

“Consequent to this decision to withdraw the land offer, the memorandum of understanding which had been signed between yourselves and the ministry has been deemed cancelled.”

Investigations show that the Chishawasha B saga started on September 4, 2015 when Harare East legislator Cde Terrence Mukupe approached the Local Government Ministry seeking approval for urban development on 710,226ha of Chishawasha B.

The property fell under the jurisdiction of the Lands and Rural Resettlement Ministry and on October 21, 2015 Minister Kasukuwere asked for its transference to his brief.

Around March this year, Lands Minister Dr Douglas Mombeshora formally handed over the farm to Local Government.

Soon after that, Minister Kasukuwere issued offer letters to Mahoka, Mashayamombe and Choto, at which point Mukupe threatened to expose what he felt was corrupt allocation of the land.

The three offer letters were withdrawn, and in April Minister Kasukuwere issued 13 new ones, only to withdraw all but Prophet Magaya’s Planet Africa three days later.

Simon Khaya-Moyo battling hypertension

Minister of Policy Coordination and Promotion of Socio-Economic Ventures in the President’s Office Simon Khaya-Moyo is reportedly battling hypertension-related illnesses  in South Africa.

Khaya-Moyo, the ruling party’s secretary for information and publicity, has not been reporting for duty for the past three months and has also been conspicuous by his absence at many government and ZANU-PF functions.

According to the Financial  Gazette, Khaya-Moyo has been unable to attend the last four Politburo meetings, resulting in Ignatius Chombo, the party’s secretary for administration, assuming some of his responsibilities, including making important public announcements.

He has also missed important national events such as the Heroes and Defence Forces days, amid reports that he is spending much of his time in a South African hospital, although he often flies back home.

“Speculation is rife that Khaya-Moyo could have succumbed to the energy-supping hard politics playing out in ZANU-PF.

His political fortunes took a knock in 2014 after he was accused of being part of a faction led by Joice Mujuru, who was President Robert Mugabe’s deputy back then’ the publication said.

Presidential spokesman, George Charamba said  he would not publicly discuss someone’s health issues.

“I am not competent to talk about someone’s personal health issue,” said Charamba.

However, an unnamed  family source said: “He spent about three weeks in a South African hospital last month and came back at the end of the month. He flew back to South Africa last week as his condition deteriorated. As of now, I am not sure if he is back in the country. He is battling hypertension”.

Zimbabwe denies opposition supporters food aid : Rights group

President Robert Mugabe’s ZANU-PF party has prevented opposition supporters receiving emergency food aid in Zimbabwe, a rights body said Wednesday, as the country reels under severe shortages.

A drought across southern Africa has pitched Zimbabwe further into economic crisis, with public anger over lack of food helping to fuel a series of recent protests against veteran leader Mugabe, 92.

“Ruling party members were the major perpetrators in violations linked to distribution of food,” Zimbabwe Human Rights Commission (ZHRC) chairman Elasto Mugwadi told a news conference in Harare.

ZANU-PF youths “openly told those affiliated to the opposition (they) would never get food aid,” Mugwadi said, adding the problem affected several rural areas across the country.

“Investigating officers were informed (that) youths from the ruling party who are not even part of the distribution committees are involved in the distribution of food aid.”

Mugwadi gave no exact figures but said that “huge numbers of people” were affected.

The ZHRC was established under the 2013 constitution.

Zimbabwe’s main opposition Movement for Democratic Change (MDC) party has often accused the government of channelling food supplies to Mugabe supporters.

“Officials (must) desist from using political affiliations as yardsticks and guarantee impartiality in any food aid,” Mugwadi said.

Earlier this year, Harare appealed for $1.5 billion of foreign donations to help prevent hunger, saying 4.5 million people — half of the rural population — faced starvation.

Zimbabwe, Malawi and Mozambique have all issued drought alerts this year, as thousands of cattle die, reservoirs dry up and harvests fail due to drought caused in part by the El Nino weather phenomenon.

Mugabe has vowed to crack down on the protests that have demanded his resignation.

ZANU-PF party spokesmen were not immediately available to comment on the ZHRC findings.

A Gweru gold panner appeared before Gweru Magistrate Primrose Elizabeth Magomora facing two charges of domestic violence.

Linda Sibanda (26), dragged Edias Nyawo (25), of Mkoba 4 to court where he faces two counts of domestic violence after he allegedly struck her with a half brick on the head and a wooden log several times on the head, face and hands over an alleged issue of taking ARVs without his knowledge.

Nyawo pleaded not guilty. The Court heard that on January 11, 2016 complainant received a phone call on her mobile which the accused suspected to be from her (Sibanda) boyfriend. An argument erupted leading to the two fighting. Accused allegedly struck complainant with a half brick on the head and later took a wooden log which he used to strike the complainant several times on the head, face and hands.

Nyawo refuted the allegations arguing that he was not at home on that day as he was in Shangani, gold panning but later agreed to count two saying he said he struck Sibanda to restrain himself from her for she was pulling his penis.

He said this was after he caught Sibanda taking ARV pills and asked her why she was hiding that from him to which she allegedly bragged and said that didn’t matter because she had already transmitted the virus to him. There was commotion until they started fighting, he said.

When Sibanda took to the witness stand she told the court that the argument had arose from a telephone call. Nyawo suspected that Sibanda was dating someone else. After the dispute they went beer drinking where they met the supposed boyfriend and Nyawo could not take it.

Nyawo allegedly assaulted her when they got back home from the beer drink. The matter was remanded to Octobert 16 but Nyawo defaulted leading to the Magistrate issuing a warrant of arrest. Chipo Matshe prosecuted.

Desperate Zimbabweans Looking for ‘Jobs’ in War Torn Sudan

Several Zimbabweans on Tuesday stormed the embassy of South Sudan in Harare’s Belgravia suburb following some hoax social media messages indicating that there are jobs being offered in that nation.

The job seekers told Studio 7 that they were disappointed and angry after incurring travelling costs for non-existent jobs as some of them travelled from as far as Zimbabwe’s second largest city, Bulawayo, about 400 kilometers away.

In May, Zimbabwean nurses besieged the same embassy after false messages were circulated that the embassy was recruiting some medical practitioners.

The Minister of Health and Child Care, David Parirenyatwa, had indicated that Zimbabwe would engage other countries to absorb the more than 3,000 trained nurses that have been bonded but failing to secure employment due to a government job freeze.

Samson Chitema, who travelled from Kwekwe, Midlands province, said despite the war ravaging in South Sudan, he had travelled for the job interview out of desperation.

Another job seeker, Miriam Mugodhi, whose face mirrored disappointment and pain, concurred adding that she had been elated after reading the job adverts as they required the qualifications she held.

Mugodhi said poverty and hardships facing her family had driven her to seek the jobs in South Sudan.

The unemployed woman said she borrowed the money she used to travel from Bulawayo.

Peter Museve, who alleged that he is a holder of a master’s degree, told Studio 7 that the war in South Sudan had not deterred him as he is desperate to secure a job anywhere.

Another Zimbabwean, James Mukomva, who also visited the South Sudan Embassy in search of a job, said he no longer has any hope that the Robert Mugabe-led government would create any jobs.

Zanu PF promised to create 2.2 million jobs during the 2013 elections. However, no jobs have been created and companies continue to shut down in the country.

The high unemployment rate, which some economic analysts have pegged between 85 and 91 percent, has also contributed to the protests bedeviling the country as social movements such as #Tajamuka-Sesijikile, #This Flag, unemployed graduates and many others are demanding jobs.

James Maridadi convicted after he refused to pay a parking ticket worth $1

MDC-T Member of Parliament for Mabvuku-Tafara constituency James Maridadi was yesterday convicted and sentenced to pay $50 fine or spend 20 days in jail for allegedly grabbing a parking ticket book worth $2,50 from a National Railways of Zimbabwe (NRZ) salesman.

In passing sentence, Chitungwiza magistrate Mr Takunda Mtetwa wholly suspended 30 days for five years on condition the legislator does not commit any offence involving dishonesty.

Maridadi, it was proved, refused to pay $1 in parking fees at the Harare Station parcels office on October 9 last year, after which he grabbed the ticket book from the salesman and drove off in his red Ford Ranger truck.

Maridadi (48) was charged with unauthorised borrowing or use of property when he appeared before Harare magistrate Mr Takunda Mtetwa.

james MudadiProsecuting, Mrs Stylon Marufu proved that on October 9, Mr Zivanai Muzokomba (38), who is employed by (NRZ) as a ticket salesman, was manning the NRZ parcels parking zone and was receipting parking fees.

The court heard that Maridadi parked his vehicle at the NRZ-controlled car park and Mr Muzokomba waited for Maridadi’s return when he asked the legislator to pay the parking fees, but Maridadi became furious and demanded to see the ticket book which the salesman was using.

Mr Muzokomba, the court heard, showed Maridadi the ticket book, but the legislator grabbed the book and drove away along Kenneth Kaunda Avenue.

Mrs Marufu proved that Muzokomba managed to note down Maridadi’s vehicle registration number and reported the case at Harare Central Police Station.

A Central Vehicle Registry check revealed that the legislator owned the vehicle. This led to Maridadi’s arrest, leading to the recovery of the ticket book


Business Mogul Frank Buyanga ‘appeals’ to Mugabe for help

FLAMBOYANT property magnate, Frank Buyanga, has written to President Robert Mugabe requesting him to push officials to act on his appeal for intervention in a property deal that has gone sour.

Confidential documents exclusively obtained by this newspaper indicated that Buyanga has been fighting to get authorities’ support in the transaction, which resulted in him losing a mansion that was recently auctioned for US$535 000.

His decision to approach President Mugabe came after he entered the transaction with a Harare couple, which ended in a wrangle over payment.
The matter was subsequently referred for arbitration.

Buyanga claims that the couple “alleged before the arbitrator” that they had paid him in full, yet he never received the money.He claims that the couple had also failed to produce proof of payment.

frank-buyanga“The last time I fervently convened with you was at the 18th annual African Union conference in Addis Ababa, 2012, wherein I informed you that I had been placed on international warrant of arrest. But I did not fully communicate my issues with you as you were about to enter a session,” Buyanga said in the letter to President Mugabe.

“I have since returned to Zimbabwe and operating several businesses thanks to polices advocated under your administration. I have not only served the First Family but been an advocate for human development and employment creation in Zimbabwe.

“As a result of my affiliation with ZAOGA, I was invited and attended your daughter’s wedding and rendered a cash gift more significant than any of the amounts read out for Cabinet Ministers,” said Buyanga.

Buyanga highlighted his family’s contribution in the liberation struggle , which he believes warrants the President’s attention.

“My father’s family was a victim of the liberation struggle. His family was tortured by the Rhodesian Special Forces when he left the country en route to Russia during the liberation struggle. He was officially in exile from Ian Smith government for several years, hence one of the reasons I was born in the United Kingdom,” Buyanga said.

State media reported last month that Buyanga had sued the Zimbabwe Republic Police (ZRP) and a retired judge who presided over the arbitration, in his bid to have the award that resulted in the auction set aside.

He said police did not act after he requested them to look into the matter, according to several documents seen by this newspaper.Instead, he alleged, the ZRP had acted swiftly to detain him where complaints had been raised against him.

In the letter to President Mugabe dated August 1, 2016, Buyanga praised him for his track record in building a good investment climate.He then turned to his family’s sacrifice during the liberation war, saying they had played a significant role.

The young entrepreneur, who is known for his love for fast and expensive cars, informed the President that he paid one of the biggest gifts on his daughter’s wedding day last year.He said he has been working with the Office of the President and Cabinet, offering advice on how to deal with the economic crisis, while his investments, which include a portfolio of over 100 properties, had created jobs.

He said he had been working flat out in the fight against sanctions imposed on government officials by the European Union (EU).The EU has, however, relaxed most of the measures.This paper can report that in February last year, Buyanga was making frantic efforts to rope in an Israel-based advocate to advise several authorities slapped with the EU sanctions.He says he has also been at the forefront of drumming up support for foreign direct investment.

Buyanga says he is a deacon in ZAOGA.Buyanga indicates that in spite of his personal sacrifices for the country, he has continued to face injustice from a number of State agencies.

“I am a victim of crime and have no one to go to, including (the) National Prosecution Authority, hence my approach to you as the final ray of hope,” said Buyanga, who was named among Africa’s top 10 millionaires under the age of 40 last year.

Several documents seen by this paper this week revealed that the arbitral action invoked bitter memories for the businessman.In one of the letters, he tells a government official that when he was placed on the Interpol’s wanted list, “high-ranking civil servants serving in the high echelons (applied pressure) for warrants of arrest to be instigated against me”.

He said in the case that led to the Interpol action, he had used foreign capital to purchase over 100 properties in Zimbabwe through the banking system.He said in 2008, he was stung by mosquitoes in remand prison over alleged vehicle fraud, only to be proved innocent.

Documents seen by this paper revealed that on June 27, he also wrote to the police saying he had lost confidence in their ability to protect him.He said as a result of his “perceived” wealth, he had suffered setbacks due to countless investigations against him.He said no government agency had found incriminating evidence against him. The letter said his decision to write to authorities had been caused by his disappointment with police during the case of the failed property transaction.

“It is the above sequence of events that have led to my continued loss of confidence in the ZRP,” he said.

“It is startling that when a complaint is made against me, it is dealt with the uttermost serious of attention and officers speedily visit homes and offices to make arrests. You may recall that at one stage, I was listed on Interpol as a wanted person. The allegations stemmed from one of my property establishments that own a few 100 properties which were purchased by foreign capital directly imported into Zimbabwe through the traditional banking system.

However, due to pressure from (people) serving in the high echelons, arrest warrants were instigated against me and my subjects due to… my refusal to compromise to their self seeking demands. This led to loss of profit and rentals spanning a period of over half a decade. This loss is totally unrecoverable together with the fact that my name was defamed beyond calculable quantum. The bottom line really is the police’s refusal to act, neglect and failure to bring to account the accused and loss of my assets,” he said.

In a display of his flamboyance, Buyanga told the Click programme on Africa Magic in 2012 that he had lost count of the fast and expensive cars that he owns.

“I don’t know how many cars I have, of course I don’t. How am I supposed to know? It’s not like I wake up in the morning and start counting how many cars I have everywhere,” he said.
Last year, Buyanga was listed among Africa’s top 10 millionaires under the age of 40.

At that time, his personal fortune was estimated at about US$20 million.

Human rights groups slammed the World Bank for belittling Zimbabwe human rights

Human rights groups slammed the World Bank on Thursday over an internal report on Zimbabwe that suggested it would be a sign of “political development” for the country if its poor human rights record did not get any worse

In the leaked July 27 document, seen by Reuters and reported by some African media, the Washington-based bank laid out a potential plan for clearing $1.88 billion (1.41 billion pounds) of Zimbabwe’s arrears with the region’s big three multilateral lenders – the IMF, World Bank and African Development Bank (AfDB).

The report identified progress on Zimbabwe’s human rights record as a needed benchmark to justify re-engagement with the southern African country and bring it back into the international financial fold.

The bank believed Zimbabwe was committed to “major change”, with 92-year-old Robert Mugabe – Zimbabwe’s only leader since independence from Britain in 1980 – recognising the need for outside help to resuscitate a moribund economy, the report said.

But as a proposed indicator of “political development” away from “coercion” in the country, it said in a bullet point: “Number of alleged human rights violations level off or decline from 2014 average and/or no unwarranted arrest of key opposition leaders.”

Rights groups took exception to such a benchmark in a country where security forces are accused of routine abuses, ranging from harassment of opposition supporters and activists to beatings and forced disappearances.

“Reading this literally turned my stomach,” Todd Moss, the chief operating officer of the Center for Global Development, a Washington-based think-tank, wrote in a blog that also accused the World Bank of being too ready to believe the government’s rhetoric on reform.

“For the World Bank to move ahead with funding Zimbabwe based on this naive and deeply flawed analysis would be a colossal mistake,” he added.

The report also noted that – with the exception of disputed and bloody elections in 2008 – Zimbabwe’s politics were largely non-violent, due in large part to “strong coping mechanisms and a rigid security apparatus”.

“It is shocking to hear that the World Bank is considering a bailout package for Zimbabwe at a time when the human rights situation in the country is deteriorating as police use excessive force to crush numerous peaceful protests,” added Dewa Mavhinga, senior Africa researcher for Human Rights Watch in Johannesburg, adding that the bank risked “unwittingly funding abuse in Zimbabwe.”

In a statement issued in Washington, the World Bank distanced itself from the report.

“The Zimbabwe Turnaround Elibility Assessment Note that was leaked to some outlets is an unofficial draft document that has not been approved by the Bank,” the World Bank said.

The institution said it would only resume direct lending to Zimbabwe when the arrears were cleared. It said it was committed to helping Zimbabwe achieve its long-term development goals and cared “deeply about the well-being of the people of Zimbabwe.”

The report comes about a month after the World Bank approved new safeguards for people and the environment in its financing that have come under criticism from non-profit groups for creating “loopholes” with vague language and reliance on borrower country laws and standards.

One of Africa’s brightest prospects when it won independence, Zimbabwe’s economy has collapsed since 2000 after the expropriation of thousands of white-owned farms and disastrous hyperinflation.

Clearing the arrears is a pre-requisite for restructuring its $8.3 billion of foreign debt, or attracting investment to upgrade its creaking infrastructure and kick-start the economy.

The document said Harare would repay its $120 million of arrears to the IMF using its Special Drawing Rights (SDRs) at the Fund.

The outstanding amounts owed to the World Bank and AfDB – $1.156 billion and $601 million respectively – would be cleared via a mixture of short-term loans arranged by the Cairo-based Afreximbank and Lazard, a large U.S. investment bank, and the AfDB’s ‘Transitional Support Facility’.

It did not provide further details.

Tungamirai Madzokere (41), who was then councillor for Glen View Ward 32; Yvonne Musarurwa (29), the party’s youth deputy secretary; and Last Maengahama (40), a member of the party’s national executive, were found guilty of murder with actual intent.

Their alleged accomplice, Phineas Nhatarikwa, was convicted of a lesser charge of being an accessory after the fact to public violence and released on bail.

Mutedza was brutally stoned to death at Glen View 3 Shopping Centre in May 2011. Addressing the court in aggravation, prosecutor Mr Edmore Nyazamba said the law now allows imposition of the death penalty on convicts of murder in aggravating circumstances.

This follows the recent amendment of the criminal law statute that deals with a crime of murder. “In view of the amendment of the law, it is important for the court to determine whether the offence was committed in aggravating circumstances,” said Mr Nyazamba.

He said murdering a policeman on duty was on its own an aggravation.

“The deceased sustained several injuries from stone beating. They trampled on him and he suffered excruciating pain.”

Mr Nyazamba said the court should protect the interests of peace by removing the trio from society. “This can only be achieved if the court passes the death sentence according to the law,” said Mr Nyazamba.

The submission drew angry cat calls from the gallery that was packed with MDC-T top officials and supporters.

Lead defence counsel Ms Beatrice Mtetwa urged the court to consider the circumstances under which the trio was convicted. She blamed the death of Mutedza on the police brutality whenever they deal with opposition party members and members of the public.

“It is actually the police that created the commotion that took place and led to the death of their compatriot,” said Ms Mtetwa.

The lawyer urged the court to take the opportunity of this case to condemn police brutality.

“The highest possible sentence sought would not be justified but clearly fuel the perception of selective application of the law when dealing with certain political players,” she said.

After hearing submissions from both the defence and State counsel, Justice Bhunu Chinembiri — sitting with assessors Messrs Patrick Musengezi and Alexander Mhandu — said he would need sufficient time to consider sentence.

He postponed the sentencing to a later date.

Earlier on, the court was briefly turned into a mini rally when the convicts emerged in the dock. Led by Musarurwa, the quartet broke into sloganeering. The party supporters who had come to give their solidarity responded with cheers.

Slowing economy in Zimbabwe points to more anti-government anger

Zimbabwe’s economy is flatlining while the budget deficit is ballooning, the finance minister said on Thursday, pointing to a worsening of financial difficulties that are already stoking rare protests against 92-year-old President Robert Mugabe.

Frustrated at widespread cash shortages, unemployment above 80 percent and delays in payment of public sector salaries, Zimbabweans have turned to social media to organise anti-government demonstrations that have sometimes turned violent.

In his mid-year budget speech, Finance Minister Patrick Chinamasa cut his growth forecast for this year to just 1.2 percent from 1.4 percent.

He also admitted the budget deficit was on track to top $1 billion this year – more than six times the initial projection – as tax and mineral revenues dropped and public sector spending snowballed.

In the grip of its worst drought in a generation and with 4 million people facing food shortages, the southern African nation is also running out of cash, forcing the central bank to impose limits on imports and withdrawals from banks.

“The fiscal position remained under pressure during the first half of the year due to underperfoming revenues and high expenditures,” Chinamasa said, pledging to get tough on state spending.

It is imperative Mr. Speaker, Sir, that we urgently address the wage bill, a major contributor to the growing fiscal deficit that is threatening financial sector and economic stability.”

Between January and June, Zimbabwe spent 96.8 percent of its revenue on government employee salaries, Chinamasa said, although he added that Mugabe’s cabinet had agreed to slash the wage bill by $118 million by the end of this year.

Such cuts – alongside other economic reforms – are part of demands by international lenders before resuming any financial support to Harare.

Western powers have imposed sanctions on Mugabe’s government over allegations of vote rigging and human rights abuses, which he rejects, while lenders such as the International Monetary Fund have frozen financial aid since Zimbabwe defaulted in 1999.

Chinamasa said a government plan to repay $1.8 billion in foreign arrears was still “work in progress.”

“Chinamasa has just shown how terrible the economic situation is but does not do anything about it. There is nothing in the budget that can stop people from going onto the streets,” said University of Zimbabwe professor Tony Hawkins.

Traffic cops ‘force’ Mbembesi couple to wed by roadside

A Mbembesi couple had to exchange wedding vows at a roadblock after traffic cops had detained them and demanding $120.

Bekithemba Ndlovu and Nomagugu Zulu were detained with their 40 wedding party and six cars.

What caused the trouble was a family commuter bus which they had used from Bulawayo.

Police said it had diverted from its normal route and had to pay a fine.

“The police at a roadblock by the Mbembesi turnoff stopped the commuter omnibus carrying the bridal team “They said it had diverted from its normal route. We tried reasoning with them but they said we were pirating.

As if that was not enough, it got worse. Another officer said the T-35 truck that carried relatives was overloaded” Ndlovu told B-Metro.

Ndlovu said police went on to demand $120 for the convoy and a further $105 for overloading.

However, they did not have money.

That forced the couple to exchange vows by the roadside.

Police reportedly fled the scene as people were baying for their blood.

#Tajamuka leader approaches High Court seeking bail following the arrest on public violence.

Political activist and spokesperson of the radical #Tajamuka/Sesijikile pressure group — Promise Mkwananzi — has approached the High Court seeking bail following his arrest on inciting public violence.

Mkwananzi was denied bail when he first appeared at the Harare Magistrates’ Courts after he was nabbed by police following bloody clashes between protesters and the law enforcement agents.

Magistrate Tendai Mahwe denied him bail arguing that he would interfere and intimidate witnesses if he was set free.

Mkwananzi, who is jointly charged with Bruce Usvisvo, is facing charges of inciting public violence using the group #Tajamuka, which reportedly led to the torching of State vehicles during demonstrations last month.

Through his lawyer, Tonderai Bhatasara, Mkwananzi, said that on the day that the vehicles were torched, he was attending a workshop at Sapes Trust in Belgravia, Harare.

He said that the workshop started at 8am and ended at 1pm.

“After lunch, appellant (Mkwananzi) stayed behind and continued with informal discussions with other participants, including . . . Ibbo Mandaza, a renowned academic,” the court heard.

He told the court that he left the venue at 15:30hrs and walked home, while in the company of Makomborero Haruzivishe.

Mkwananzi said he never set his foot in town on the day because he knew that the demonstration was organised by MDC youths under the #MyZimbabwe banner.

He said he is not a member of the MDC or of any political party.

“The police searched his mobile phone without his consent or a warrant and infringed his Constitutional right to privacy,” the court heard.

Usvisvo, a self-confessed vendor, said he is not involved in politics.

He said he was only picked up by the police from his home without being advised of the charges that he was facing.

Usvisvo said on the day in question, commotion broke out when he was in Choppies Supermarket, where he wanted to buy some few items. He said people started throwing stones into the shop, resulting in him bolting out of the shop with the items that he had already paid for.

Usvisvo further said that he lost some of his items as he was escaping from the commotion.

Mkwananzi and Usvisvo argued that Mahwe misdirected himself by denying them bail when he failed to consider the circumstances surrounding the case.

They said the State never substantiated its claims that they will intimidate the security forces.

“ . . . there were no cognisable indications that appellants’ release to bail could endanger the administration of justice. Bail should not have been denied and the decision to contrary effect must be set aside”.

Government taking legal advice from second year law students

So, Statutory Instrument 101A has been given short-shrift by Mrs Justice Chigumba, and sanity has been restored. One Tendai Biti and and the aptly named Dzimbabwe Chimbga have likely never had a clearer case to argue, so much so that one is reminded of the old song:

Manhungetunge, manhungetungewo,

haiwa manhungetunge, manhungetungewo. 

… so old in fact that I forget how the rest of it goes. Though I suspect it keeps repeating that same line, which is what you do when you have picked something up and you cannot believe your good fortune

But the question must be asked: on what planet did it ever appear that they would get away with such pity, blatant an attempt at usurping constitutional democracy through the avenue of a mischievously epigrammatic Statutory Instrument?

Why would a government that is punctilious in its power hoarding enterprise, meticulous in the art of legalistic survival (see how elections are always held despite the result being determined outside those elections – they only bother so as to give their kleptocracy a veneer of legality) come up with such blatant an own goal?

Well, the answer is suspiciously obvious.

A couple of years ago, Messers Moyo, Kasukuwere and Zhuwawo took up book bags and traipsed off to law school. They of course likely did not get the 14 or 15 points you need at A’ Level to get admitted into the UZ Faculty of Law, no, why bother with qualifications when all you need is a telephone call?

Were it not for the fact that they know that the Law Society will never accept their registration as lawyers unless they can evidence the full four years of study, I would bet they would have done a Grace Marufu and just phoned the degrees office to confirm when their graduation ceremonies would be held, and simply go get their certificates.

And since the day their studies started, we have seen how these gentlemen have taken pains to demonstrate that they are learned (pronounced ler-nerd). Zhuwao will not let a good sentence pass by without adorning it with the kind of verbal ventriloquism that will have you scrambling for a thesaurus, even if that means he ultimately (which is often) ends up saying nothing.

This is how he communicates his ministerial brief, in his empowerment strategy for example: “we need platforms for the creation of creators” through, among others,      ‘“Inclusion of the Diaspora, the Disabled and those in conflict with the law” as well as “     affirmative self-representation for active participation and career guidance (mentorship, incubation, acceleration).”

And who can forget that famous week when they were taught this Latin gem: ‘modus vivendi’ at law school and Comrade Muzukuru Zhuwawo spent the entire week declaring that he had no ‘modus vivendi’ with Major Wadyajena, absolutely no modus videndi with Mutsvangwa, promoting one person on Tweeter to ask where all that animus injuraindi was coming from, and it degenerated from there.

Well, perhaps it’s high time we pointed out that we too have no modus vivendi (whatever that means to him) with him, his Sekuru, the wife and their whole lot.

Add to that the Professor! He that thinks he is the repository of all the intelligence that God deemed enough for Zimbabwe. He pontificates his understanding of the law for all to see, parsing simple concepts into convoluted diatribes that he then sells as legal knowledge.

Take for example the day when his boss, Ebagum the First, came back from his Captain Lazarus rescue of Robert Ebagum the Second from another ‘drugs, drink and groping’ arrest in Dubai and proceeded to warn judges to ‘be careful’.

A clear assault on judicial independence, one that anyone could see from a mile. And rightly so. You cannot have an independent judiciary when the President ‘warns’ judges to rule in his favour and his supporters claim, in front of him, to take the law into his own hands. But did the Professor of Intelligence see it? No way.

The president is entitled to his opinion because we have a doctrine of separation of powers, Professor Listen-to-me-for-I-am-Intelligent claimed. Sounded like the words of a fundi that knows what he is on about, and many of his followers on Tweeter must have felt that they couldn’t very well challenge that wisdom. Because according to this doctrine of separation of powers, that the government is made up of there branches (the executive, the legislature and the judiciary) which acts as a checks and balance on each other.

A doctrine is a set of beliefs or teaching, a creed of principle that is widely accepted or at least supportable by evidence. It is a theory, one for which there can be different opinions. There is such a doctrine yes.

Except that the Professor missed one thing: in Zimbabwe the separation of powers is not just a doctrine. It’s the constitutional arrangement. As in, that is the law. Of course, had the professor waited until the last few lectures of this year’s course at Law School, he would know this, as the distinction has not been taught yet. And that distinction is crucial.

His boss might have his opinions about judges, but because of his position in our society, he cannot and should not go about expressing those opinions. He holds the coercive arm of the state. ‘Warning’ judges when you are an old retiree in Singapore is one thing, doing that when you are the President is an impeachable crime, if only we had a parliament.

As the learned Judge put it, “Judicial authority is enshrined in Section 162 and 164 of the Constitution. Courts are independent and must act without fear, favour or prejudice. It is essential to the rule of law that courts operate without interference in a democratic society.”

But, how did we get here?

It is because the government takes legal advice from second year law students that we have some of this rubbish floating around. When I was a second year law student, I thought I knew the law, but 22 years letter, I am in awe of the law. You need to be tempered with reality after graduating before going about using tutorial talking points to run a country.

Kasukuwere spends his time at UZ researching how best to fire elected public officials and keeps wasting our money in this endevaour, because Administrative Law is offered in Third or Fourth Year, and so he has not yet mastered that you cannot have unfettered discretion to fire elected people without due process.

And now that the court has rubbished their pithy attempt to emasculate the constitution, what do the students do? Professor I-am-Intelligent has come up with another gem: those who want to engage in demonstrations ought to pay a security deposit in case they destroy property! I wonder where he learnt that one!

There cannot be any question of people paying to enjoy democratic rights. Human rights accrue to us as Zimbabweans without a property qualification. Odd that the people who claim to have liberated us from a Rhodesia that placed a property qualification to the right to vote now want us to pay for the right to march along Selous Avenue. Odd that a government minister thinks there is nothing sad about asking an impoverished people that their right to express themselves must be paid for first before it is exercised.

Sounds so foolish that it cannot possibly happen? Well, two weeks ago I would have thought that no-one in their right minds would think it possible to take away constitutional rights by the avenue of a Statutory Instrument. A few years back I would have believed that a mother holding a placard at Africa Unity Square was less dangerous that a Minister’s son caught trying to leave the country with $6m in cash, but it is Linda Masarira who languishes in jail while Chinamasa’s son is free.

Why is all this important? Because they will likely not stop. Because this setback through Mrs Justice Chigumba will not make them stop. We have already seen how Professor I-think-for-you-all is arguing that the judgement means we must pay for the right to demonstrate. Now, the law students advising our government are advising Grace Marufu’s Supa-the-in-law to make it an offence to receive a Whatsapp message.

The Computer Crime and Cybercrime Bill, which will soon be law, says that anyone who “(c) receives computer data and is not authorized to receive that computer data, commits an offence and is liable, upon conviction, to a fine not exceeding [amount not fixed] or to imprisonment for a term not exceeding [period not yet fixed], or to both.”

So, anyone thinking of sending me pictures of Robert Ebagum the Second groping women in Dubai, let me tell you now: carry on; I am authorised to receive such images. By the constitution of Zimbabwe!

The thing that Zanu PF has always done is to make laws that legalise the evil they do. From the 1980s, each time the Supreme Court found anything to be unconstitutional, they passed an amendment overruling the Court. That is why the old constitution was amended into meaninglessness. It looks like they are starting again.

And this time, they have lawyers in their midst. Even if those lawyers are still in school.

We should be more angry. Not because some old-men are going to school, but because we are a country run by people that are yet to understand the laws they use to rule our country and who lack the humility to curb their arrogance but are experimenting on our rights.

Jah Prayzah sucked into Mnangagwa storm

Musician Jah Prayzah, born Mukudzei Mukombe, has been sucked into Zanu PF’s deadly fights to succeed President Robert Mugabe with music fans and critics saying his latest album Mudhara Vachauya was produced to prop-up embattled Vice President Emmerson Mnangagwa in his battle to succeed the 92-year-old leader.

Lyrics from the lanky musician’s latest offering praise an ultimate father figure — of the Lion totem — who is expected to change economic fortunes of the underprivileged in society.

Zimbabwe’s economy has virtually collapsed due to the high unemployment rate, power shortages, massive company closures and a serious cash crisis that has sparked a wave of anti-Mugabe protests across the country.

This has resulted in social commentators linking Jah Prayzah’s song to Mnangagwa, who is of the Shumba totem and is seen as heir-apparent to the throne following the axing of former vice president Joice Mujuru.

The Midlands godfather, who is believed to have strong military links, is alleged to be leading a faction known as Team Lacoste that is angling to succeed Mugabe but has had spanners thrown into his path to State House by another Zanu PF faction headed by young Turks going by the moniker Generation 40 (G40).

However, Jah Prayzah who ironically is the brand ambassador of the Zimbabwe National Army — whose boss General Constantino Chiwenga is believed to be backing Mnangagwa’s presidential ambitions — dismissed suggestions that the song was pregnant with undertones of succession politics in Zanu PF.

There is nothing political about that song. It is clear that it is a love song in which a husband is telling his wife that she should shun other men who ask her out when he is away by telling them that “mudhara vachauya,”  Jah Prayzah told the Daily News when contacted for comment.

The Tsviriyo hit-maker said those who are drawing political links to his song should wait until he produces a video.

“The video that has political connotations was not produced by me. Mine is on its way and it will answer all the questions being raised. I am not a politician and will never be one in my life so I don’t sing for them (politicians). I sing to entertain my fans,” he insisted.

Loosely translated, the title of Jah Prayzah’s song means “the old man in coming”, although the word “mudhara” is street lingo used to refer to a generally superior and powerful person.

But in this case, some fans believe that the title and the lyrics that say “mudhara wacho ishumba inoruma” (the superior and powerful man is a lion that bites) is the artist’s way of telling the nation that Mnangagwa will soon upstage G40 rivals to replace Mugabe.

The musician’s fans have gone on to mischievously produce a video in which Mnangagwa is seen with his wife Auxillia immaculately dressed and inspecting a military guard of honour — presidential style.

There has always been a connection between music and politics, particularly political expression in song since time immemorial.

But while music influences political movements, it is not often clear to the musician how or to what extent general audiences relate to their songs on the political level

Banks to match cash deposits for fuel imports

The interim measure, which some bankers said would go a long way in encouraging deposits, is meant to ensure uninterrupted availability of edible crude oil and fuel in the country.

“In recognition of the need to ensure availability of fuel in Zimbabwe, which is critical and strategic to the economy, authorised dealers are hereby advised, with immediate effect, to process fuel payment transactions for cash depositing companies by matching as an interim measure, cash deposits with cross border transfers on a ratio of 1:1,” RBZ director (Exchange Control) Mr Morris Mpofu said in a note to banks.

In the same vein, authorised dealers are advised to apply the matching principle for manufacturers of cooking oil. Payments for importation of crude edible oil shall be matched by cash deposits by the manufacturing companies at the ratio of 1:1. To ensure compliance with the requirement for payments, the central bank said banks will be required to declare cash deposits made by fuel and crude edible oil importers.

The RBZ added that to ensure consistency in reporting, fuel and edible companies will also be required to declare all cash deposits with the Reserve Bank’s exchange control department.

The banks, however, will still be required to avail foreign currency to non-cash depositing fuel and cooking oil manufacturing companies in terms of existing Foreign Priority Guidelines that seek to promote efficient utilisation of foreign currency.

To promote efficient utilisation of foreign exchange and to re-orient import demand towards productive uses, the Reserve Bank and the Business Council, represented by the Confederation of Zimbabwe Industries, the Zimbabwe National Chamber of Commerce and the Bankers Association of Zimbabwe came up with foreign exchange priority list to guide banks in the distribution of foreign currency.

Some of the companies that fall under the priority one category include exporters who import raw materials or machinery to aide them to produce and generate more exports, non-exporting importers of raw materials and machinery for local production (value addition) that directly substitute import of essential finished goods and importers of critical and strategic goods such as basic food stuffs and fuel.

President Robert Mugabe yesterday said he was fast running out of patience with MDC-T leader, Morgan Tsvangirai and other opposition parties and pressure groups protesting against his government, threatening to deal with them decisively.Addressing his party’s central committee, Mugabe said Tsvangirai and his supporters were playing a “very dangerous game” and his government would not fold its arms while violence scaled up across the country in the name of electoral reform protests.

Mugabe said MDC-T and the other opposition parties under the National Electoral Reform Agenda (Nera) should be sternly cautioned of grave consequences, warning them they will not win the war.

“Let the opposition parties and all those angling for chaos and mayhem, and violent demonstrations be warned that our patience has run out,” he boomed.

“Government will take very strong measures against any political party, organisation or individuals that perpetuate violent demonstrations.

“Anybody breaking the law will be punished accordingly. The MDC and its supporters are playing a very dangerous game.

“We also understand that they are planning to terrorise the rural areas in the mistaken belief that they can intimidate and harass our supporters, let them be warned they cannot win the war.”

“We don’t want those who will cry, saying there is no more democracy when we go for them. Democracy does not mean destroying people’s property, beating people and looting. We are there to defend true democracy, which is peace and non-violence,” he said.

“And if they take actions that are painful, they have only themselves to blame. Most of them have never been in a prison cell, where food will be thrown to them and ordered to eat facing their own waste.”

The country has been rocked by demonstrations in the past few months, with pressure groups such as Tajamuka/Sesijikile and #ThisFlag mobilising through social media to successfully stage a complete shutdown of the country.

Nera also joined in the act, but their protest was violently crushed by the police.

But Mugabe yesterday attacked Nera, accusing opposition political parties of trying to make the country ungovernable in order to invite foreign intervention.

He said the opposition was afraid of losing the 2018 polls, which he said would be held under the same conditions Nera was fighting against.

Mugabe further accused Nera of inviting Western countries to reinforce sanctions against the country and using protests to derail his efforts to resuscitate the economy.

“The demonstrations we have witnessed in the last few weeks were not by accident of history, but were purposefully choreographed and launched in the mistaken belief that time was ripe for a popular uprising against government and Zanu PF,” he said.

“Zanu PF remains alive to, and does not need to be reminded about the continuing everyday economic challenges facing all our people today. What is happening around us with these concocted demonstrations is distracting us from progressing on with our concerted efforts aimed at improving the performance of our national economy and the welfare of the people.”

Mugabe also warned opposition parties against using social media to force regime change, saying political support should not be by force.

Mugabe lashed out at the Zimbabwe Human Rights Commission for “peddling falsehoods” that Zanu PF was embarking on partisan distribution of food.

“We are committed that all the people in drought-stricken areas receive food,” he said.

“The information, which some stupid people and stupid spokesperson of Zimbabwe Human Rights Commission; that food is being distributed in a partisan manner is actually false.”

“They just want to make headlines internationally. They don’t have shame. It is because of the little money they are getting as non-governmental organisations.”
